Is a Broker FHA Cash-Out Different for a First-Time Equity Borrower?

Is a Broker FHA Cash-Out Different for a First-Time Equity Borrower?

The Quick Read: No. The FHA cash-out rules are the same whether a broker arranges the loan or you apply straight to a lender. They are also the same whether or not it is your first time taking equity out. What changes is which lenders can look at your file and who you talk to along the way. The program itself does not bend, subject to lender guidelines and full file review.

An illustration, not a Loan Estimate, an approval, a quote, or a commitment to lend. The rate shown is the weekly Freddie Mac thirty-year conventional benchmark, used as a market reference; an FHA cash-out is priced by the lender at lock, and this is not an FHA cash-out refinance quote. HUD’s cap limits the base loan; the upfront premium is financed on top of the capped base loan; the monthly premium for the first year follows the snapshot’s schedule. Cash available means the base loan the cap permits less the balances retired, before closing costs, which this calculator leaves out. The line figure applies the line program’s combined loan-to-value ceiling to the same value and balance. Taxes and insurance are estimates you can edit. What Does “First-Time Equity Borrower” Actually Mean?

A first-time equity borrower is a homeowner who has never pulled cash out of their home before. Maybe you bought with an FHA loan, or a conventional one. Now you want money for repairs, debt, or another goal.

Nothing in the FHA rulebook treats that as a special category. HUD’s cash-out requirements are not written around first-time status. They are written around the loan and the property.

Here is what a cash-out refinance does. It replaces your current mortgage with a new, larger one. The new loan pays off the old balance, and you keep the difference as cash. You do not add a second loan on top. The old one goes away.

That replacement is the part first-timers often miss. You are not borrowing against your equity while keeping your current loan. You are starting over with a new loan, a new term, and new costs.

What Stays the Same With a Broker or a Direct Lender?

Everything that defines the loan stays the same. The government sets the program rules. A broker cannot loosen them, and a lender cannot skip them.

Factor Same either way? Who sets it
Maximum leverage Yes FHA program rules
Home must be your residence Yes FHA program rules
Ownership and occupancy history Yes FHA program rules
Appraisal sets the value Yes Licensed appraiser
Mortgage insurance structure Yes FHA program rules
Which lender’s added rules apply No The lender
Who you talk to day to day No Your channel

Across the wholesale programs Lendmire places FHA files with, the FHA cash-out reaches 80% loan-to-value (LTV, the loan as a share of the home’s value). That applies to a home you have owned and occupied for 12 months before the case number is assigned. HUD cut the cap from 85 to 80 percent of adjusted value in Mortgagee Letter 2019-11, citing risk to the FHA Insurance Fund. Some older lender pages still show 85%. They are stale.

Think of 80% as a ceiling, not a promise. Credit, income, the appraisal, and your payment history still decide the outcome.

What Can Differ When a Broker Is Involved?

A broker changes the channel, not the loan. That is the honest answer, and it is a smaller one than some brokers will tell you.

A mortgage broker does not lend money. Per the CFPB’s explanation of lenders versus brokers, a broker helps you find lenders or loan products and is paid a loan-specific fee. Some institutions act as both, so ask whether a broker is involved.

Here is where the channel can matter.

Lender choice. One lender applies one set of added rules. A broker works with several wholesale lenders. If your file fits one lender’s rules and not another’s, a broker can point it to the right one.

Overlays. An overlay is a rule a lender adds on top of HUD’s minimums. One lender may want a higher credit score. Another may not. HUD’s rules are the floor. Overlays are where the real differences hide.

File packaging. A first-time file is easier to place when the documents are organized and the story is clear. A broker’s job includes that.

Communication. You deal with one person while the deal works between you, the appraiser, and the lender.

Now the limits. A broker does not guarantee a lower cost. The only real test is to compare Loan Estimates side by side.

Wholesale lenders Lendmire works with set their own guidelines. Those decide the final answer on any file.

Who Is Who in a Broker Deal?

Four roles show up, and they are easy to confuse.

Role What they do
Broker Matches your file to lenders, collects documents
Lender Underwrites, funds, and owns the loan at closing
Appraiser Sets the home’s value
Servicer Collects your payments after closing

The lender makes the credit decision, not the broker. After closing, your payments may go to a servicer, which can be a different company from the lender. That is common with any mortgage, broker or not.

A broker is paid by the borrower or by the lender, depending on how the loan is structured. Either way, the compensation is disclosed on your Loan Estimate and Closing Disclosure. Compare those documents line by line before you commit.

What Does the Lender Check on a First Cash-Out?

Four things carry most of the weight.

Ownership and occupancy. At least one borrower must have owned the home and lived in it as a principal residence for the 12 months before the case number is assigned. The lender confirms this with documents like employment records or utility bills. FHA is for homes you live in. Rentals and vacation homes do not qualify for FHA cash-out.

Payment history. The lender looks at your prior 12 months of mortgage payments. A late payment in that window is a problem on a cash-out. Exact tests vary by lender, so ask yours how it reads the window.

Credit and ratios. The wholesale programs Lendmire places FHA loans with start at a 580 decision score. Ratios start at a base of 31/43, meaning housing costs at 31% of income and total debts at 43%. Documented compensating factors can reach 40/50 at the top tier. The automated underwriting finding governs most files.

The appraisal. The 80% cap applies to the appraised value after adjustments. So the appraisal drives your maximum loan. A low appraisal means a smaller loan or less cash.

Lenders also review income, the new payment, and closing costs. These are program norms, subject to lender guidelines and full file review.

How Much Equity Stays in the Home?

At least 20%. That is what the 80% cap means. The CFPB’s guide to using home equity notes that lenders typically require you to keep some equity in the home, and that a cash-out refinance creates a new mortgage.

Picture a home that appraises at a certain value. The new loan, including the financed upfront premium, cannot exceed 80% of that value. The old balance comes off the top first. What remains is your cash. A first-timer is often surprised by how much the old payoff, closing costs, and financed premium shrink that number.

Lendmire’s piece How CLTV Tiers Size an FHA Cash-Out for a First-Time Equity Borrower walks through that sizing in more detail.

What Does FHA Mortgage Insurance Do to the Loan?

It adds cost, and you pay it in two ways. Across the programs Lendmire places, FHA charges an upfront premium of 1.75% of the base loan, which is usually financed into the balance. It also charges an annual premium between 0.15% and 0.75% of the balance, depending on term, loan amount, and LTV.

Duration matters. On a thirty-year loan above 90% LTV, the annual premium lasts for the full term. At or below 90% LTV, it ends after eleven years. Since a cash-out tops out at 80%, that second case is the relevant one for most cash-out files.

This is a program fact, not a price. Your Loan Estimate shows what applies to you.

What Are the Exceptions?

A few situations bend the usual clock.

  • Inherited home. An heir does not need a minimum occupancy period before a cash-out. The catch is that the property was never treated as an investment after inheriting. If it was rented out, the heir must live in it for at least 12 months first.
  • Manufactured home. It must have been permanently installed on a site for more than 12 months before the case number.
  • Owned free and clear. HUD’s older reference material says a home with no mortgage may be refinanced as a cash-out. That guidance is archived, so confirm current handling with your lender.
  • Recent forbearance. Under Mortgagee Letter 2020-30, you must have completed the plan and made at least 12 consecutive payments afterward.
  • Past credit events. HUD’s waiting periods are two years from a Chapter 7 discharge and three years from a foreclosure. Those are HUD’s rules, not a promise from any broker.

County loan limits also apply to every FHA loan. They change every year, so check your county’s current limit with your lender.

What Happens After Closing Day?

You do not get the cash at the table. A cash-out refinance on your primary residence comes with a three-business-day right to cancel. The CFPB explains this right to rescind. Saturdays count. Sundays and legal holidays do not.

You can waive that window only for a bona fide personal financial emergency. It takes a dated, signed statement in your own words. Pre-printed forms do not count.

If you cancel, your old loan stays in place. Cash is typically released after the window passes.

Should You Use a Broker, a Bank, or Both?

It depends on your file. Here is a simple way to sort it.

Your situation Likely better start
Clean credit, strong bank relationship Ask your bank first, then compare
Credit near the lower end of FHA range Broker, for overlay matching
Unusual history (forbearance, inheritance) Broker, to find a fit
Want one quote only Bank or direct lender
Want several options to compare Broker, or both

Put the Loan Estimates side by side. The cheaper, cleaner offer wins, whoever sent it.

A bank you already use may offer matching terms with less friction. That is a real advantage, and a broker should not pretend otherwise.

What Are the Alternatives to an FHA Cash-Out?

Option Best when Trade-off
FHA cash-out Credit is modest, equity is solid Mortgage insurance, resets the loan
Conventional cash-out Stronger credit, more equity Tighter credit standards
Home equity loan You want to keep your first loan Second payment, second set of costs
HELOC You need cash in stages Flexible but adds a second lien
FHA rate-and-term You want no cash out Reaches 97.75% on a primary residence you have occupied for the previous twelve months

The FHA Streamline is a different product. It refinances an existing FHA loan with no appraisal and a limited credit review, and it requires a net tangible benefit. It does not pay out cash. Taking cash out ends your access to streamline options on that loan.

Using the Money Wisely

The CFPB’s cash-out report found the most common reason borrowers gave was paying off other debts, with home repairs second. It also warned that paying non-mortgage debt with mortgage debt can raise foreclosure risk. Credit scores rose at first, then drifted down.

Tax treatment can depend on your situation; borrowers should speak with a qualified tax professional before relying on any deduction or credit.

Honestly, this is the question first-timers should spend the most time on. The loan is the easy part. The use of the money is the decision.

Key Terms Defined

Cash-out refinance: a new, larger mortgage that pays off your old one and gives you the difference in cash.

LTV (loan-to-value): your loan amount as a percentage of your home’s appraised value.

Overlay: an extra rule a lender adds on top of the minimum program requirements.

Seasoning: the waiting period of ownership, occupancy, or on-time payments before you qualify.

Mortgage broker: an intermediary who matches your file to lenders but does not lend money.

Rescission: your right to cancel certain refinances during a limited window set by federal rules.

Frequently Asked Questions

Does a broker get me looser FHA rules?

No. HUD’s rules are the same for everyone. A broker can only help match your file to lenders whose requirements fit it. A lender may add its own overlays, and a broker can steer around the stricter ones.

Does being a first-time equity borrower make approval easier or harder?

Neither. Eligibility turns on ownership, occupancy, payment history, credit, income, and the appraisal. First-time status is not a category in those tests. Review the full list in Lendmire’s piece Cash-Out Refinance Requirements for a First-Time Equity Borrower.

Does a broker cost more than going to a bank?

It can go either way. A broker is paid by the lender or by the borrower, and that compensation is disclosed on your Loan Estimate. Compare the full terms from each source side by side to see which costs less for your situation.

Does 80% LTV mean I am approved for that amount?

No. It is the ceiling. Credit, income, the appraisal, and payment history still decide the amount. Approval is subject to lender guidelines and full file review, and nothing here is a commitment to lend.

Can I use FHA cash-out on a rental or vacation home?

No. FHA is for your principal residence, and occupancy decides the leverage.
