Best FHA Cash-Out Refinance Program After Meeting FHA Ownership and Occupancy Seasoning

Best FHA Cash-Out Refinance Program After Meeting FHA Ownership and Occupancy Seasoning

The Quick Read: Once the 12-month ownership and occupancy clock is satisfied, FHA cash-out is often a strong fit for a borrower whose credit or debt ratios suit FHA better than conventional. The cap is 80% of the appraised value, and it covers the whole new loan, not just the cash. The clock runs to the date the FHA case number is assigned. Meeting it opens the door; it does not approve the file.

The best program for your situation depends on credit, equity, existing loan type, and what the cash is for. This article walks through the mechanics in order: what the clock measures, how the file is underwritten, where the rule bends, and how the decision usually plays out.

An illustration, not a Loan Estimate, an approval, a quote, or a commitment to lend. The rate shown is the weekly Freddie Mac thirty-year conventional benchmark, used as a market reference; an FHA cash-out is priced by the lender at lock, and this is not an FHA cash-out refinance quote. HUD’s cap limits the base loan; the upfront premium is financed on top of the capped base loan; the monthly premium for the first year follows the snapshot’s schedule. Cash available means the base loan the cap permits less the balances retired, before closing costs, which this calculator leaves out. The line figure applies the line program’s combined loan-to-value ceiling to the same value and balance. Taxes and insurance are estimates you can edit. Licensed in sixteen states for consumer mortgages.

Key Terms Defined

Seasoning: The minimum period a borrower must own, live in, or have paid on a home before a given loan program allows cash out.

Ownership and occupancy: At least one borrower has owned the home and lived in it as a principal residence for the full 12 months.

Case number date: The date FHA assigns the case number to the loan. The 12-month clock is measured back from this date, not from application or closing.

Adjusted Value: FHA’s appraisal-based value, the figure the 80% cap is applied to.

UFMIP and annual MIP: The upfront and annual FHA mortgage insurance premiums. The upfront premium is 1.75% of the base loan and is usually financed.

CLTV: Combined loan-to-value, which counts every lien on the home against its value.

What Does the Seasoning Clock Actually Measure?

It measures two things at once: ownership and occupancy. At least one borrower must have owned the home and lived in it as a principal residence for the 12 months before the case number is assigned. Across the wholesale programs Lendmire places FHA files with, that is the test on a standard cash-out.

Three points trip people up:

  • The anchor is the case number date. Applying in month twelve does not help if the case number was assigned in month eleven.
  • Ownership alone is not enough. A home that was rented out for part of the year does not count for those months.
  • Only one borrower needs to meet it. A spouse who moved in later does not break the file if the other borrower has the full 12 months.

A second home or rental does not fit this program; occupancy decides the leverage, and this lane is built for the home you live in.

How Is an FHA Cash-Out Underwritten, Step by Step?

The deal works through five checks, and each one can stop it on its own. Lendmire’s FHA cash-out refinance program page covers the program summary; the mechanics below are what the lender actually reviews.

1. Seasoning check. The lender confirms the 12-month ownership and occupancy history against the case number date. Documents like the prior settlement statement, utility bills, and ID addresses support it.

2. Payment history. The existing mortgage is reviewed for late payments. On a cash-out, the review window is strict, and a single late payment can stop the file even with plenty of equity. Newer mortgages with short histories face their own test. Lenders can set overlays above HUD’s minimums, so two lenders can give different answers on the same borrower.

3. Appraisal and Adjusted Value. A true cash-out needs a full FHA appraisal. The 80% cap applies to that value. HUD Mortgagee Letter 2019-11 lowered the cap to 80% from the earlier 85%, effective by case number date, and applies it to both LTV and CLTV.

4. Credit and ratios. Underwriting runs through the automated finding or manually. The base pair is 31/43 (housing / total) with no compensating factors. Documented compensating factors can reach 40/50 at the top tier. The network’s wholesale programs start at a 580 decision score for maximum financing. Subject to lender guidelines and full file review.

5. Mortgage insurance and closing. The upfront premium is 1.75% of the base loan and is typically financed. The annual premium runs between 0.15% and 0.75% of the balance, depending on term, loan amount, and LTV. On a thirty-year loan above ninety percent LTV, the annual premium lasts the term; at or below ninety percent it ends after eleven years. A cash-out is above the ninety line only rarely, since the cap is 80%.

What Does the 80% Cap Really Mean for the Cash?

The 80% limit covers the entire new loan. Payoff of the old mortgage, financed costs, the financed upfront premium, and the cash to you all sit inside it. It is not a cap on the cash alone, and it is not 80% of your equity.

Picture a home appraised at 100 units of value. The new loan can reach 80 units. Subtract the old balance, the financed premium, and the costs, and what remains is the cash. Borrowers with a large existing balance get little cash even with real equity.

HUD’s announcement said the change was meant to strengthen the equity position behind cash-out loans. The older 85% figure still circulates on websites. It is outdated.

Closing costs usually come out of the proceeds. That is why cash to close can be zero while total costs are not. The CFPB describes a cash-out refinance as replacing your mortgage with a larger one and taking the difference in cash, and notes you often must pay closing costs.

Worked Timelines: When Does the Clock Start and Stop?

Dates matter more than most borrowers expect. Three common cases:

Situation What counts Result
Lived in home 11 months at case number Short of 12 months Not eligible yet
Two co-borrowers, one moved in later Earlier occupant has 12 months Clock is met
Home rented out, then moved in Occupancy starts at move-in Count from move-in

The month-eleven applier is the most common failure. Waiting a few weeks costs nothing; an early case number can mean starting over with a new appraisal and case.

Where Does the General Rule Break?

Six named edge cases come up regularly.

Inherited property. The catch: if the borrower rents the home after inheriting, occupancy as a principal residence for 12 months is still needed before cash-out.

Homes owned under 12 months. Not eligible for standard FHA cash-out. The borrower may look at other programs or wait.

Paid-off homes. Taking equity from a home with no mortgage is still treated as cash-out. Subject to lender guidelines.

Hawaiian Home Lands (Section 247). The 80% reduction does not apply to mortgages insured under section 247 of the National Housing Act. A narrow case, but a real one.

Existing FHA borrowers. The FHA Streamline refinances an existing FHA loan with no appraisal, a limited credit review, and a net tangible benefit. It allows only a small amount of cash back. The 12-month occupancy test belongs to true cash-out, not the Streamline.

State rules. Some states add their own homestead or waiting rules for taking equity out of a home. Check yours before planning dates.

Proving Occupancy: What Lenders Look For

Strong evidence is dated and tied to the property address. Weak evidence is a statement from the borrower.

  • Prior settlement statement showing the purchase date
  • Utility bills, bank statements, and insurance in the borrower’s name at the address
  • Tax returns, driver’s license, and voter registration showing the same address
  • Pay stubs or W-2s mailed to the property

Gaps get questions. A borrower who traveled for work or stayed elsewhere for months should expect the lender to ask where they lived and why.

Which Program Fits Which Situation?

The right program depends on equity, credit, existing loan, and the amount of cash needed. Lendmire is a mortgage broker that shops multiple wholesale lenders and matches the scenario to the program; it does not lend.

Situation Program to compare Why
Clock met, credit near FHA floor FHA cash-out Fits FHA credit tiers better
Existing FHA loan, no cash needed FHA Streamline No appraisal, limited credit review
Strong credit, high equity Conventional cash-out Mortgage insurance may be avoidable
Veteran or service member VA cash-out Separate program, separate rules
Clock not met Wait or other options Standard rule needs 12 months

Tie-breaker order for most files: credit profile first, then equity cushion, then the cost of mortgage insurance over the life of the loan, then whether VA applies. The CFPB cautions borrowers to weigh the cost of the new loan carefully, especially against the loan they hold now.

One trap deserves a mention. Doing FHA cash-out now and refinancing to conventional later means two sets of closing costs. If your credit is about to improve or your equity is about to rise, waiting may beat paying twice. It is a genuine toss-up on some files.

What Should You Do at Each Stage?

Clock not met. Do not request a case number early. Keep the occupancy paper trail and make every mortgage payment on time. Use the time to clean up credit.

Clock just met. Confirm the date your case number would be assigned and compare it to your move-in date. Gather the occupancy documents before the file goes in.

Clock met, late payment on record. The late payment may matter more than the clock. Ask how the lender reads it. Overlays differ, and a broker can check programs against that history.

What Does It Mean for Your Budget and Credit?

A cash-out generally raises the payment, because the new loan is bigger and carries the financed premium plus annual insurance. Closing costs apply in full, since it is a new first mortgage. Loan Estimate and Closing Disclosure rules apply.

The CFPB’s research on cash-out borrowers’ credit scores found an initial sharp improvement, followed by a gradual worsening. Borrowers often use the money to pay down credit card and auto debt, which explains the initial lift.

Tax treatment can depend on your situation; borrowers should speak with a qualified tax professional before relying on any deduction or credit.

For borrowers weighing the same question under conventional rules, Lendmire’s piece Best Cash-Out Refinance Program After Meeting the Twelve-Month Ownership Seasoning Rule covers the comparison.

Common Misconceptions

  • “FHA cash-out goes to 85%.” That limit is outdated. The maximum is 80%.
  • “80% means I can take 80% of my equity.” No. Payoff, costs, and premium come out of the 80% first.
  • “The clock runs from closing.” It runs to case number assignment.
  • “Equity alone qualifies me.” Occupancy history, payment history, and credit all decide it.
  • “Zero cash to close means no costs.” Costs were netted from proceeds.
  • “Rentals qualify.” Standard FHA cash-out is for a principal residence only.

Frequently Asked Questions

Does meeting the 12-month clock guarantee an FHA cash-out approval?

No. The clock only makes you eligible to apply. Credit, ratios, payment history, appraised value, and any lender overlays still decide the file, subject to lender guidelines and full file review.

Which date does the 12 months count back from?

The FHA case number assignment date. Not the application date and not the closing date. Plan the case number around your move-in anniversary.

What if I inherited the home?

The 12-month ownership rule is waived for inheritance. If you rent the home after inheriting, you still need 12 months of occupancy as your principal residence before cash-out is available.

Is an FHA Streamline the same as a cash-out?

No. The Streamline requires an existing FHA loan, skips the appraisal, and allows only small cash back. The 12-month occupancy test belongs to true cash-out.

Can a late payment block me even after the clock is met?

Yes. Payment history on the existing mortgage is reviewed separately, and one late payment in the review window can stop a cash-out. Lenders may also add stricter overlays than HUD’s minimums.
