How to Clear a Solar Lien Before Your First VA Cash-Out

How to Clear a Solar Lien Before Your First VA Cash-Out

The Quick Read: A solar lien is usually not a dealbreaker, but it has to be identified and cleared before the new VA loan can close. The new loan must sit in first-lien position, so the solar debt gets paid off from proceeds, subordinated, or released. Identify the instrument first, then pick the clearing path, then confirm the release is actually recorded.

What a Solar Lien Is, and What It Isn’t

Most “solar liens” are not mortgages. The federal consumer-finance regulator says lenders commonly file UCC liens on the panels themselves. Technically that lien is not on the property, but it can cloud title. In some jurisdictions it is treated as reaching the whole property. When that happens, it has to be released or subordinated to the new mortgage.

Here’s the catch. “Just paperwork” is the wrong read. A filing the title company flags will stop a file until it is dealt with.

Key Terms Defined

  • UCC-1: A public filing that tells the world a lender has a claim on equipment, such as solar panels.
  • Fixture filing: A UCC filing recorded in county land records, so it shows up on a county title search.
  • UCC-3 termination: The filing that ends a UCC-1 after the debt is paid.
  • Subordination: The solar lender agrees to rank behind the new mortgage, at its own discretion.
  • First-lien position: The new loan ranks ahead of every other claim on the home.
  • PACE: A solar or energy assessment collected through the property tax bill.

Which Situation Are You In?

The answer depends on how the system is owned and financed. Across the wholesale programs Lendmire places VA files with, the first question on any solar file is the instrument type.

Situation What is recorded Usual clearing path
Owned outright Nothing None needed
Financed, equipment filing only State-level UCC-1 Payoff plus UCC-3
Financed, fixture filing County-recorded filing Payoff plus UCC-3, or subordination
Recorded deed of trust Lien in land records Payoff and recorded release
PACE Tax-bill assessment Payoff; generally a stopper
Lease or PPA Owner’s UCC-1 Buyout or written consent

A UCC filing tied to a solar lease or power purchase agreement (PPA) signals that the panels belong to someone other than the homeowner.

Why the Filing Matters for a VA Cash-Out

A VA-guaranteed loan must be secured by a first lien. VA program notice 26-16-18 cites the statute, 38 U.S.C. § 3703(d)(3)(A), and says lenders are responsible for securing first-lien position. How solar UCC filings get handled is lender and title-company practice applied to that first-lien requirement, not a stand-alone VA rule.

The cash-out side helps. A VA cash-out refinances any loan type into VA and can reach 100% of the appraised value, including the financed funding fee, subject to lender guidelines and full file review. That means the solar payoff can come out of proceeds. It also carries a net tangible benefit test and the same seasoning as the VA streamline refinance: the later of 210 days from the first payment and the sixth payment.

If the solar lender will not subordinate and will not be paid off, the VA loan cannot close. Plain and simple.

One more point on eligibility. VA’s cash-out page says the loan is for a home you will live in. Rentals fall outside it. A VA streamline refinance cannot pay off other liens, so it is not the tool here.

How to Find Out What’s Filed

Start with two searches, because they can disagree. Order a title search, which catches recorded deeds of trust and fixture filings. Then run a UCC search at the state level. A state-level UCC-1 may not appear in a county title search, so a clean county report does not prove there is no solar filing.

Then pull the solar contract. You want the lender’s name, the account number, whether the system is owned, financed or leased, and any clause that lets you request a UCC release for a refinance. The CFPB-cited research says that release is often at the solar lender’s discretion.

Five Ways to Clear It

Path How it works Watch for
Payoff from proceeds Title pays the solar lender at closing Reduces net cash
Payoff from own funds You pay before applying Cash needed up front
Lease or PPA buyout Owner sells you the system Provider’s paperwork
Subordination or consent Solar lender ranks behind new loan Lender’s discretion
Written demand Forces a late UCC-3 Takes follow-up

Payoff from proceeds is the cleanest path on most cash-out files. The U.S. Treasury’s consumer guide notes that these liens can affect the home, and that the lender may require repayment or the buyer to take over the solar loan. In a refinance there is no buyer, so a lease cannot simply be transferred. The realistic options are consent, buyout or subordination.

Defunct solar company? The lien generally outlives the company, so the filing still has to be cleared. Talk to your title officer early.

PACE is the hard one. Because it is collected on the tax bill, it typically takes priority over a mortgage. VA Circular 26-16-18 once allowed PACE under conditions, but its current status is unclear. Treat PACE as a stopper and confirm with your loan officer.

What the Appraisal Does With the Panels

VA appoints the appraiser. Under VA’s Lenders Handbook, Chapter 12, leased solar equipment, including panels under a PPA, is left out of value because leased items are not suitable loan security. The appraiser identifies the leased items in the report. Owned systems are valued at the appraiser’s judgment.

Paying off the solar debt does not change what the home is worth. It reduces your net cash.

A Backward-Planned Checklist

1. Start early. Request a written payoff from the solar lender before you apply. Solar companies can be slow, and title companies say provider paperwork should run alongside underwriting.

2. Identify the instrument. Order the title search and the state UCC search, then sort the result using the table above.

3. Pick the path. Payoff from proceeds, buyout, or a subordination request. Ask early whether the contract allows a release request.

4. Tell your loan officer. The solar payoff goes in the file so the net cash and the first-lien position are planned, not discovered.

5. Close and confirm. Title pays the solar lender from proceeds. A promise to file a release is not a cleared lien. Verify the UCC-3 or subordination actually records.

A Worked Example

Say a veteran with a financed solar system wants a first VA cash-out. The state search shows a UCC-1. The county title search shows nothing, which is exactly why both searches matter. The veteran gets a written payoff, the loan officer builds it into the file, and title pays it from proceeds.

The new loan can reach up to 100% of the appraised value including the financed funding fee. The solar payoff comes out of that, so net cash is lower by the payoff amount. The funding fee on a first-use cash-out is 2.15%, and 3.3% on later use, waived for exempt veterans. The Congressional Research Service reports the same schedule. Subject to lender guidelines and full file review, the net-cash goal either still works after the payoff or it doesn’t. Better to know before applying.

What If the Solar Company Is Slow or Disputing?

Keep the payoff request moving on a parallel track. If a release is late after payoff, send a written demand and follow up. If there is a real dispute over the contract itself, talk to a licensed attorney. A dispute should not be allowed to sit unaddressed, because an uncleared lien can stall the file. Ask the title company what they need in writing.

Documents to Gather

  • Solar contract and lender contact
  • Written payoff letter
  • Title search and state UCC search results
  • UCC-3 termination confirmation, once filed
  • Any subordination request and response
  • Lease or PPA agreement, if the system is not owned

What Decides the Outcome

Four things: the instrument type, whether it ranks ahead of the new loan, how cooperative the solar lender is, and whether the payoff still leaves the net cash you want. On top of that, your file must meet VA’s and the lender’s credit and income standards. Residual income is the controlling test. The 41% debt-to-income figure is a guideline, not a cap. The wholesale programs Lendmire works with start at a 580 decision score.

Frequently Asked Questions

Can a VA cash-out pay off my solar loan?

Yes, in most financed situations. A VA cash-out refinances any loan type into VA, so the payoff can come from proceeds, subject to lender guidelines. It reduces your net cash. It doesn’t reduce the home’s value.

Do solar panels hurt the VA appraisal?

Owned panels are valued at the appraiser’s judgment. Leased or PPA panels get no value under VA’s handbook, and the appraiser notes them in the report.

Will a clean title report mean there’s no solar filing?

Not necessarily. A state-level UCC-1 may not show on a county title search, so run both.

Can I use an IRRRL instead?

Not to clear other liens. An IRRRL cannot pay off other liens, and it refinances an existing VA loan. A cash-out can pay them off.

What if the solar lender won’t subordinate or release?

Then the lien has to be paid off. If it can be neither paid off nor subordinated, the VA loan cannot close, because VA requires first-lien position.

Tax treatment can depend on your situation; borrowers should speak with a qualified tax professional before relying on any deduction or credit.
