The Quick Read: You can do it, but Texas treats the loan as a constitutionally regulated home equity loan, so you have to satisfy two rule books at once. VA allows cash-out up to 100% of the appraised value. On a Texas homestead, the state’s 80% ceiling controls. The lower limit wins, and your lender needs to be set up to write the loan. Exact terms depend on the lender’s guidelines, property type, leverage, and a full review of the borrower’s file.
What Is a VA Cash-Out Refinance?
A VA cash-out refinance replaces your current mortgage with a new VA-backed loan, and you can take cash from your equity. VA describes it as a loan that swaps your current one for new terms. It can also move a non-VA loan into a VA-backed loan.
Texas VA cash-out estimate
Seeded with an example value, a typical balance, and a round cash request at the first-use fee; change any field.
Editable benchmark: 7.32% as of October 22, 2026 · Freddie Mac 30-year average via FRED®. A conventional market reference, not a VA cash-out refinance quote.
Illustrative starting assumptions: a $285,000 home value, a $157,000 current balance, the Texas homestead cap with the first-use funding fee financed, a thirty-year term at the current Freddie Mac benchmark, and property taxes and insurance estimated at typical rates for Texas. Every field is editable.
Illustrative estimate only — not a Loan Estimate, approval, quote, or commitment to lend. The rate field carries the weekly Freddie Mac thirty-year conventional benchmark, a market reference and not a VA cash-out refinance quote; a VA loan is priced by the lender at lock. The total loan, funding fee included, is capped at the program leverage on the reasonable value; the fee follows the tier chosen. The cash available is what the cap allows less the balances paid off and the fee, before closing costs, which are not included. The HELOC line is the line program’s combined loan-to-value ceiling applied to the same value and balance. Taxes and insurance are editable estimates. The debt-to-income figure is a guideline; residual income decides a VA file. Licensed in sixteen states for consumer mortgages. On a Texas homestead the state constitution caps a cash-out refinance at eighty percent of value, fee included, and adds a waiting period, a prescribed closing location, and a fee cap; the calculator applies the Texas cap.
Three things must be true. You qualify for a Certificate of Eligibility (COE). You meet VA’s and the lender’s standards for credit and income. You will live in the home you are refinancing.
That last point matters. This is an owner-occupant program. If the Texas property is not your home, VA cash-out does not apply, because occupancy decides the loan.
Across the wholesale programs Lendmire places VA files with, the envelope looks like this: no mortgage insurance, no VA loan limit with full entitlement, and a 580 decision-score floor. VA itself sets no minimum credit score. That floor is a lender standard, and some lenders set a higher one. Every figure here is subject to lender guidelines and full file review.
Why Does Texas Change the Rules?
Texas protects the homestead from forced sale. Under Article XVI, Section 50 of the Texas Constitution, a lien on a homestead is valid only if it secures a kind of debt the section permits. A refinance that puts extra money in your hands falls under the section’s home equity provision, known as §50(a)(6).
So Texas is not banning VA cash-out. It regulates it. Your VA loan simply also has to meet the home equity rules.
The biggest consequence is the equity cap. The Texas Real Estate Research Center at Texas A&M explains that the new loan plus all other debt secured by the home cannot exceed 80% of fair market value. You keep at least 20% equity.
Here is the gap in plain terms:
| Rule set | Maximum loan against value |
|---|---|
| VA cash-out (national) | Up to 100% of appraised value |
| Texas homestead equity loan | 80% of fair market value |
| Your actual ceiling | The lower one: 80% |
Many borrowers hear “VA goes to 100%” and expect that number in Texas. It does not apply to a homestead cash-out.
How Is the Loan Underwritten, Step by Step?
A cash-out gets full underwriting. It is not a streamline. Here is the sequence.
1. Confirm eligibility and get your COE. The lender can pull it, or you can request it through VA. The COE from VA decides your eligibility, and VA’s service rules govern it.
2. Document income, credit and occupancy. VA says you need satisfactory credit and enough income to cover the expected monthly obligations. Residual income is the controlling test. That is the money left each month after taxes, debts and housing costs, measured against a VA table. The 41% debt-to-income figure is a guideline, not a cap. A higher ratio needs residual income well above the table.
3. Get classified. VA’s system sorts every refinance into Type 1 or Type 2. Per the VA cash-out refinance quick reference, Type 1 means the new loan is at or below 100% of the payoff of the loan being refinanced. Anything larger is Type 2, which puts cash in your hands. Taking equity cash in Texas puts you in Type 2.
4. Pass the net tangible benefit test. VA wants proof the loan serves your financial interest. The same guide says the system auto-determines this and requires at least one qualifying benefit. VA’s own lender training lists eight tests in its regulation. Meeting the loan-to-value limit does not replace this test.
5. Receive the cash-out disclosures. VA requires lenders to provide and upload cash-out compliance disclosures. You also certify that you received the net tangible benefit information at application and again at closing.
6. Seasoning and recoupment, if you are refinancing a VA loan. Across the programs Lendmire works with, VA-to-VA refinances carry seasoning of the later of 210 days from the first payment and the 6th payment. VA also tests how long the fees take to pay back through your lower payment. On a Type 1 VA-to-VA loan, recoupment must fall within 36 months. A non-VA loan converting into VA has no recoupment test.
7. Appraise the home. The appraisal sets the value. In Texas it drives how much cash you can reach, because the 80% test uses fair market value.
8. Work through the Texas home equity steps. Texas imposes a mandatory waiting period, fee limits, a right to cancel after signing, and restrictions on where the loan can close. Your title company or lender will lay out each one. Expect the Texas steps to add time compared with a VA cash-out in another state. Spouses commonly sign too, since Texas homestead law involves each owner and each owner’s spouse.
How Much Cash Can You Actually Reach?
Three inputs decide it: the appraised value, what you still owe, and the costs that are financed. Take 80% of the appraised value. Subtract existing liens and financed costs. What is left is your ceiling.
Picture a homeowner with a paid-down mortgage and a home appraised well above what they owe. In most of the country, VA would let them borrow up to the full value. In Texas, they stop at 80%, and the financed funding fee counts toward that total. Run it on your own numbers with a loan officer before you pay for an appraisal. The percentage tells you most of what you need.
The VA funding fee is reviewable. On a cash-out refinance it is 2.15% on first use and 3.3% on later use. Veterans who receive compensation for a service-connected disability, and the other exempt groups, do not pay it. VA also warns that closing costs can add up to thousands of dollars, so weigh them against what you gain.
Where Does the General Rule Break?
VA’s 100% versus Texas’ 80%. Covered above. The lower limit wins on a homestead.
Back-to-back cash-outs. Texas allows only one §50(a)(6) loan secured by your home at a time. Texas also limits how often you can take another. Ask your lender about the waiting rules on your file.
Refinancing an existing Texas equity loan. Texas treats refinances that add no new money differently from ones that do. If you are rolling an existing equity loan into a new one, ask the lender how your file is handled.
Non-VA loan into VA. A VA cash-out can refinance any loan type into VA. That is useful if you hold a conventional or FHA loan and want VA terms.
Entitlement. If you used VA benefits before, your remaining entitlement may affect how much you can borrow. With remaining entitlement, a down payment may be required. Speak with a loan officer on your specific numbers.
Disability exemption. The funding fee waiver depends on your compensation status. It does not apply to every veteran.
Not every lender writes this loan. Texas home equity rules add steps that some lenders skip. That is the practical hurdle for many borrowers. Confirm that your lender actually closes VA cash-outs on Texas homesteads before you order an appraisal.

What Does the Decision Look Like in Practice?
Start with your goal. Debt payoff, repairs, and moving a non-VA loan into VA each fit this loan differently. VA can also guarantee an alteration and repair loan structured as a cash-out refinance on a home you own and occupy.
Then check the tradeoffs:
- A bigger balance and a financed funding fee change your monthly budget.
- The net tangible benefit test exists to justify that change.
- Texas rules add steps and require a lender experienced with them.
- The 80% cap may reach less cash than you expected.
Not sure the numbers work? That is common. A loan officer can compare keeping your current loan against a cash-out and show the equity each reaches.

Frequently Asked Questions
Does Texas ban VA cash-out refinances?
No. Texas regulates them as home equity loans under §50(a)(6). The loan has to satisfy both VA’s rules and the Texas constitution, which is why a lender experienced with both matters.
Can I borrow 100% of my home’s value in Texas?
Not on a homestead cash-out. VA allows up to 100% of value nationally, but Texas caps the new loan plus other debts at 80% of fair market value. You keep at least 20% equity.
Does VA set a minimum credit score?
No. VA sets none. Lenders add their own standards. Across the wholesale programs Lendmire places VA loans with, the floor is a 580 decision score, though some lenders set it higher.
Is a VA cash-out the same as a streamline refinance?
No. The streamline, called an IRRRL, refinances an existing VA loan with no new COE and no cash to you. A cash-out needs a COE, full underwriting, an appraisal and the net tangible benefit test.
Can I use it on a rental or investment property?
No. VA requires you to live in the home, so occupancy decides eligibility.
