How to Get Your First Bank Statement HELOC After a Quitclaim

How to Get Your First Bank Statement HELOC After a Quitclaim

The Quick Read: A bank statement line of credit becomes available after a quitclaim once the deed is recorded, title sits with you or your revocable trust, and the lender’s seasoning policy is satisfied, with deposits supporting income and combined leverage staying within program limits. A quitclaim moves ownership only. It does not move the debt, and it does not reset your credit or your equity. Everything below is subject to lender guidelines and full file review.

  • Recording is what counts. A signed deed that was never recorded generally does not count as a transfer.
  • Vesting decides the file. On our network, an individual or a revocable living trust can hold title. An LLC cannot.
  • Seasoning is lender policy. Some lenders count from your original purchase. Others restart the clock at the new recording date.
  • Deposits are screened, not trusted blindly. Transfers and loan proceeds come out before income is counted.
  • Investment lines are capped. Across our wholesale network, an investment-property line tops out at 70% CLTV and $500,000.

Key Terms Defined

Quitclaim deed: a document that hands over whatever ownership interest the signer holds, with no promise of clean title.

Recorded deed: a deed filed in the county land records. Lenders read ownership from the recorded chain, not from a signed copy in a drawer.

Seasoning: the waiting period a lender wants between an ownership event and a new loan.

Vesting: the exact name or entity that holds legal title.

CLTV (combined loan-to-value): your first mortgage plus the new line, divided by the property’s value.

Bank statement qualification: a method where the lender reads business deposits over a set window in place of tax-return income.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

What Does a Quitclaim Actually Change?

A quitclaim changes who owns the property. It does not change who owes the mortgage. UpCounsel’s explainer on due-on-sale exceptions makes the same point: the deed conveys an interest and leaves the loan where it was.

Question After the quitclaim
Who owns it? The person named on the recorded deed
Who owes the first mortgage? Whoever signed the note, unchanged
Who can borrow against it? Only someone who holds title
Is title guaranteed clean? No, liens stay attached

That last row trips up new borrowers. A lender still runs a title search, and anything hiding in the chain becomes your problem.

Does the Deed Restart a Waiting Period?

Sometimes. No law sets a waiting period after a quitclaim, so the answer is lender policy, and our network splits into two camps.

“Look-through” lenders count seasoning from your original purchase. They treat the quitclaim as a paperwork event, especially when you moved title into a revocable trust or added a spouse. “Restart” lenders count from the date the new deed was recorded. They treat the transfer as a fresh ownership event.

Three details apply either way:

1. The clock runs from recording, not from signing and not from closing.

2. Which camp a lender sits in is not always obvious from its marketing, so ask before you apply.

3. A strong credit profile does not shorten a restart clock.

That is why the sequence matters. If you plan to deed the property and borrow against it, ask the lender which camp it is in before you record anything.

How Does Bank Statement Qualification Work Step by Step?

Bank statement qualification documents income through deposits instead of traditional personal-income documentation. The loan still is reviewed on documented income under the applicable program, subject to lender guidelines. Credit, equity, debts and the property all get tested. It is not a shortcut around underwriting.

1. Confirm the recorded deed and vesting. Pull the recorded deed and a current title report. Make sure the name on the application matches the name on title.

2. Read the whole chain of title. Spouse additions, partial-interest deeds and entity deeds all show up. A title company may need to add an endorsement.

3. Gather the deposit history. Lenders typically ask for a 12 to 24 month window of business statements. The exact window is the lender’s call.

4. Expect the deposits to be cleaned. Transfers between your own accounts, refunds and loan proceeds come out. The lender then applies an expense factor to what remains, and that factor varies by lender.

5. Prove reserves separately. Asset statements generally show reserves, apart from the deposit history.

6. Test debts. Debt-to-income runs at a 50% maximum on our network, or 45% for scores from 600 to 679. The lender reviews the debt ratio using the interest-only payment calculated on the maximum draw.

7. Test equity. Your first mortgage stays in place. Its balance counts toward CLTV and its payment counts in your debt ratio.

8. Test the property. A lender usually adds its own title policy or endorsement on the new line.

A tip on deposit hygiene: keep personal and business money apart for the statement window. Commingled accounts force the lender to sort out which deposits are income. The more it has to guess, the less income it counts.

What Does a Line Look Like on an Investment Property?

On an investment property, the line caps at 70% CLTV and $500,000, and it needs a 700 minimum credit score. These come from the select wholesale partners Lendmire works with, and they are guidance, not a promise. Primary-residence and second-home lines run on different tiers, so the occupancy on your file matters.

Here is how the structure works on a standalone line in first or second lien position:

  • The draw runs 5 years interest-only, then a 25-year fully amortizing repayment period.
  • At least 75% of the line is drawn at closing.
  • Pricing floats through both periods and does not convert to fixed.
  • Lines at or below $500,000 ordinarily run an automated valuation. A full appraisal is available on request.
  • A borrower can hold up to three lines, and owning more than 15 financed properties makes the file ineligible.
  • Manufactured homes, log homes, co-ops, condotels, and commercial, mixed-use or agricultural properties are not eligible.

HELOC placements also run through a narrower set of 16 full-service states than Lendmire’s 41-market DSCR footprint. Check availability before you plan around one.

Leverage is the number that surprises first-timers. At 70% CLTV, if your first mortgage is already near that level of value, there is little or no room left. The deed does not create equity, and a larger first mortgage balance eats into the line.

Which Deed Scenarios Cause Trouble?

The reason for the deed matters as much as the deed itself. Each scenario below points to a different next step.

Deed scenario Title result Usual next step
Into a revocable trust Often acceptable vesting Confirm the lender accepts it
Spouse added Both names on title Both usually sign and apply
Divorce, you keep it Title in your name only Debts must still qualify
Divorce, you signed it away You no longer hold title You cannot borrow against it
Into an LLC Entity holds title Re-vest, or use a DSCR cash-out
Out of an LLC to you You hold title again Ask about restart seasoning

The LLC Wall

This is the most common collision we see. Investors deed a rental into an LLC for liability reasons, then learn the home equity line won’t follow. Across our network, LLCs, corporations, partnerships and irrevocable, blind or land trusts cannot hold title on these lines.

You have two real options:

  • Deed it back out. This is the usual fix. It can restart seasoning at some lenders, and it gives up the entity’s liability separation.
  • Use a DSCR cash-out refinance. That loan is property-based, and entity-titled files can work subject to lender program eligibility. Cash-out on standard rentals tops out around 75% LTV, with about 6 months of seasoning as the common expectation. Our complete DSCR loans guide covers how it differs from a line of credit. The exact numbers vary by lender and program and follow a full review of property, leverage, and credit.

A property-based loan and a borrower-based line do different jobs. The line sits beside your first mortgage and underwrites you. The cash-out replaces the first mortgage and underwrites the rent.

The Due-On-Sale Trap

Your existing first mortgage almost certainly has a due-on-sale clause, meaning the lender can demand full payoff if you transfer the property. Federal law makes these clauses enforceable but protects certain transfers on a borrower’s own home. The implementing regulation, 12 CFR § 191.5, covers things like creating a subordinate lien (the HELOC itself) and moving the home into a trust where the borrower remains beneficiary and occupant.

Those protections are tied to owner-occupied homes. A rental moved into an LLC is not protected, as Navigate Law Group’s overview of the Garn-St Germain Act explains. A landlord moving a rental into a trust may also fall outside the occupancy condition. Lenders often don’t enforce the clause. Still, get written consent or advice from counsel before you record.

Existing Lines and Strong Rent Don’t Fix Title

Two more breaks in the general rule:

  • An existing line stays on you. A deed does not change who is on the note, and a lender that discovers a title change can freeze or reduce a line. Home equity lines carry those freeze rights generally. The federal consumer booklet on home equity lines is the plain-English baseline for how these lines work.
  • Rent coverage doesn’t offset a title problem. DSCR compares rent to the full monthly obligation (principal, interest, taxes, insurance, and any HOA dues). Clearing 1.00 does not mean the property cash flows, and it does not cure seasoning or vesting. Seasoning, title review, coverage and leverage are separate tests.

What Should You Do Before You Record the Deed?

Sequence can save you the seasoning question entirely. Here is the order we’d walk through with an investor.

1. Decide whether you want a borrower-based line or a property-based DSCR loan. The answer changes who should hold title.

2. Ask the lender whether it looks through or restarts after a transfer.

3. If you want a line and a liability shield, close the line first and record the entity deed later, after confirming with the lender and counsel.

4. If you are a BRRRR investor (buy, rehab, rent, refinance), consider holding off on the LLC until the rehab, rent and refinance stages are done.

5. Clean up the deposit history for the statement window.

6. Order a title report so no surprise liens appear mid-file.

Here is what usually triggers a denial after a transfer, and whether you can fix it:

Denial reason Fixable? What to do
LLC on title Yes Re-vest or use a DSCR cash-out
Seasoning not met Yes Wait, or try a look-through lender
CLTV too high Sometimes Pay down the first mortgage
Deposits screened low Sometimes Extend the window, clean accounts
Credit under 700 on an investment line Slowly Build credit, or use a DSCR path

Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

Frequently Asked Questions

Does “first” mean my first HELOC ever, or my first statement after closing?

Here it means your first line of credit ever. Once the line closes, you receive monthly statements that show draws, payments and balance. Those are a separate document and have nothing to do with qualification.

Can I apply the day after the deed is recorded?

You can apply, but eligibility depends on the lender’s seasoning policy. A look-through lender may count from your original purchase. A restart lender will count from the recording date and may ask you to wait.

Do I have to be on the deed?

Yes. A lender needs the borrower to hold title. Someone who quitclaimed away their interest cannot borrow against the property, and they usually stay liable on any existing joint mortgage.

Does a quitclaim to my revocable trust cause problems?

Usually not. A revocable living trust is an acceptable vesting on our network, provided you remain the beneficiary. Confirm the lender’s trust documents before recording.

Does bank statement qualification cost more or require less paperwork?

It changes the paperwork, not the scrutiny. You swap traditional personal-income documentation for deposit statements, but credit, equity, debts and the property are all still reviewed. Pricing varies by lender and file.
