Can You Get a Bank Statement HELOC With a Final Decree and Old Title?

Can You Get a Bank Statement HELOC With a Final Decree and Old Title?

The Quick Read: Usually yes, once the recorded deed shows you as the owner. A final divorce decree proves the marriage ended, but it does not always change who owns the property in the county records, and the lender liens whoever the records name. Title decides the file. Your bank statements only prove you can repay.

  • Title and income are separate tests. Deposits prove repayment ability. The title search proves who can pledge the property.
  • A decree is not automatically a deed. You often need a recorded deed, or a decree your title company accepts as a transfer.
  • Vesting has limits. On this kind of line, title must sit with an individual or a revocable living trust, not an LLC.
  • Investment property has its own ceiling. On an investment property, the network ceiling is 70% combined loan-to-value, with a 700 minimum credit score.
  • The old mortgage and any joint line need a plan. The decree does not bind the lender on either one.

“Final decree” here means a divorce decree. It does not mean a bankruptcy or probate decree, which are different animals.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Does a Final Decree Clear You With the Lender?

No. The decree is an agreement between you and your ex-spouse, ordered by a court. The lender was never a party to it. So the lender looks at three separate layers, and the decree only touches one of them.

Layer What it answers What the decree does
Title (the deed) Who owns it Describes the split; may not update records
The note (the loan) Who owes the lender Nothing; the lender is not bound
The lien Who can pledge the property Nothing until title is clean

A title company, Vanguard Title, explains that a divorce judgment may name who gets the home but does not automatically update county land records. Without a properly prepared, signed, and recorded deed, the public record can still show both ex-spouses as owners.

That is the whole problem in one sentence. You may be the owner in the court’s eyes and a co-owner in the county’s eyes. A new equity line is a new lien, and the lender wants a clear owner to sign it.

What Does Old Title Mean for Your Loan?

Old title means the recorded deed still reflects an earlier ownership picture. It might show both spouses, the ex alone, or a prior owner. The fix depends on which one you have. Here is how the common situations usually play out.

Situation Can you borrow now? Usual cure
Deed still shows both names Usually not Record a deed, or get the decree accepted
Quitclaim signed, not recorded Usually not Record the deed
Ex still on title after decree Usually not Deed from ex, or accepted decree
Deed already in your name alone Yes, on title Clear any lien the decree created
Property held by an LLC Not on this line Vesting change, or a DSCR loan

Every row ends the same way. Title gets cleaned up first, then the income side moves forward. Whether a decree alone can carry the transfer varies by state and by title company. Some accept it when no mortgage remains. Others insist on a deed.

How Does a Title Company Test the Decree?

Title companies run a checklist. One Texas title agent, Texas National Title, describes the tests it applies:

  • The decree must be final and non-appealable.
  • It must have been signed, and the required time between signing and closing varies by title company and by file.
  • It must grant the property to one spouse and divest the other of all interest.
  • It must include the legal description. A street address alone is not enough, because records are indexed by legal description.

That is one Texas company’s practice, not a national rule. Still, a second title company, Vanguard Title, also addresses decree requirements. It adds that an incomplete decree may require a warranty deed. It also says a decree that creates a lien in favor of an ex-spouse must be satisfied before closing.

Most parties prefer signing and recording a short deed over recording the entire decree. A title company can often prepare that deed at closing. The decree usually contains financial details you would rather not put in the public record.

Federal law does not set one rule for this. It is state law and title-underwriter practice. So the title commitment, not any article, tells you what your file needs.

How Does Bank Statement Income Work After a Divorce?

The income side works like it does for any self-employed borrower. The file is reviewed on documented income under the applicable program, subject to lender guidelines. It is alternative documentation, not a pass on documentation.

Here is how it generally runs across the lenders Lendmire places files with:

  • The lender reviews a run of months of actual business or personal deposits.
  • For business accounts, it applies an expense factor, since not every deposit is profit.
  • Transfers between your own accounts come out.
  • One-time deposits come out too.
  • The review period and the expense factor vary by lender.

Divorce adds a cleanup step. Support payments, buyout payments, and money moving between joint and individual accounts all show up in the deposit history. The lender strips out account-to-account transfers. A joint account that fed your business for years may need explaining.

Be careful about which deposits you lean on. If you choose to rely on support income, expect to document it separately, subject to lender guidelines. Many self-employed borrowers qualify on business deposits alone and leave support out of the file.

Lines also carry a debt-to-income test. The ceiling is 50%, and it drops to 45% for credit profiles from 600 to 679. That test is run on the interest-only payment calculated on the maximum draw, not on what you plan to borrow.

What Does the Line Look Like on a Rental?

Occupancy sets everything. The ceilings differ sharply, so check the right row before you plan.

Occupancy Max combined LTV Credit and size
Primary residence Up to 90% 720+ credit; 90% applies on lines to $500,000
Second home Up to 90% 720+ credit; lines to $500,000
Investment property 70% 700 minimum; lines to $500,000

Lower credit tiers on primary and second homes carry lower ceilings. A primary residence can run a larger line, up to $750,000, but only at a lower ceiling and with stronger credit. That does not apply to a rental. On an investment property, 70% is the top, with no tier above it. And the investment cap on the line itself is $500,000 total.

Other mechanics matter for rentals. Investment lines run a 5-year interest-only draw followed by a 25-year repayment. At least 75% of the line is drawn at closing. Lines at or below $500,000 ordinarily run an automated valuation instead of a full appraisal, though a borrower can request one.

Market surveys of lenders report higher combined ceilings for equity lines in general. Those are market-wide figures, not what this network offers on an investment property. The network figure for an investment property is 70%.

Availability is narrower than DSCR. Lendmire arranges these equity lines in 16 states, while its DSCR investor programs reach 41 markets, including Washington, D.C. Every figure here is subject to lender guidelines and a full file review.

What About the Old Mortgage and a Joint Line?

Cleaning title does not clean up the existing debt. Treat the two as separate projects.

A quitclaim deed moves ownership only. The original borrowers stay on the note until someone refinances, assumes, or pays it off. The CFPB reports that homeowners complain servicers refuse to release the original borrower, even where decrees require it. Servicers also reportedly pressure some homeowners to refinance rather than assume.

If you were awarded the home but never signed the loan, there is a path. Servicing rules on successors in interest treat a confirmed successor as a borrower, and NCLC notes that divorce transfers are included. Assumption still does not release the original borrower unless the investor agrees.

Why does this matter to a new line? The existing first mortgage, and its payoff or subordination status, will appear on the title report. A standalone line can sit in first or second lien position, but the lender will see everything already recorded.

A joint HELOC is its own trap. It stays a joint debt, and your ex can keep drawing unless the line is frozen or closed. Contain the old line before you apply for a new one.

When Is a DSCR Loan the Better Tool?

Sometimes the equity line is the wrong product. Two situations push investors elsewhere.

The first is an LLC. These lines require title held by an individual or an inter vivos revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title. A rental already deeded to an LLC needs a vesting change, or a different loan.

The second is size and structure. A DSCR cash-out refinance can pull equity from an LLC-titled rental, subject to lender program eligibility. It qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. Cash-out on a standard rental generally tops out around 75% LTV, and about six months of seasoning is the common expectation. Most programs want a score around 660, and 700 or better unlocks the strongest tiers. Our complete DSCR loans guide walks through the mechanics.

One caution. DSCR compares rent to the full monthly obligation, which covers principal, interest, taxes, insurance, and any association dues. Clearing 1.00 does not mean positive cash flow. Repairs, vacancy, management, and utilities sit outside the calculation.

Worked Example: A Rental Awarded in the Decree

Picture a self-employed contractor. The decree awards her a duplex she and her ex bought as a rental. The decree is final and includes the legal description. But the recorded deed still shows both names, and a joint equity line is open from years ago.

Here is how a sensible file moves:

1. She pulls a title search. It confirms both names and shows the joint line. 2. She asks the title company whether the decree alone will carry the transfer. The answer is no. They want a deed. 3. Her ex signs a deed, and it gets recorded. Because the decree gave the duplex to her, there is no lien to clear. 4. She freezes the joint line and arranges payoff or closure. 5. She assembles her deposit history. She separates business deposits from transfers between her own accounts, and from deposits tied to the buyout. 6. She applies on an investment property. The ceiling is 70% combined LTV, with a 700 minimum credit score and a line no larger than $500,000.

If her score is under 700, the investment line is off the table. A DSCR cash-out is the next option, depending on credit and seasoning. The calculator on this page gives an illustrative estimate, not a quote.

What Is the Step-by-Step Sequence?

1. Order a title search and commitment. Read Schedule C for any divorce-related requirement.

2. Ask the title company to test your decree. Finality, grant language, and legal description are the usual checks.

3. Cure the gap. Record a deed, or confirm the decree is accepted. Satisfy any lien the decree created.

4. Confirm vesting. Individual or revocable living trust only.

5. Deal with the existing debt. Freeze or close a joint line. Understand the first mortgage’s status.

6. Gather documents. You need the decree, the recorded deed or title instructions, a mortgage statement, an insurance page, deposit statements, and support documentation if you plan to use it.

7. Choose the product. An equity line, or a DSCR cash-out if title or size does not fit.

Each step depends on the one before it. Skipping ahead is how files stall.

Key Terms Defined

Decree: the court’s final order that ends the marriage and divides assets and debts.

Title and vesting: title is legal ownership shown in county records. Vesting is the exact way ownership is held, such as individual or trust.

Quitclaim deed: a deed that transfers whatever interest the signer has. It moves ownership but does not touch the loan.

Lien: a recorded claim on a property that secures a debt, such as a mortgage or equity line.

Bank statement income: documented deposits used in place of tax-return income to show repayment ability.

Combined loan-to-value (CLTV): all loans against the property, divided by its value.

What Mistakes Stall These Files?

  • Treating the decree as the deed. It may not change the record.
  • Ignoring the joint line. Your ex can keep drawing, and the debt stays shared.
  • Mixing accounts. Deposits that run through joint accounts get stripped or questioned.
  • Assuming a quitclaim ended the mortgage. It did not.
  • Applying on an LLC-held rental. The vesting rule blocks it.
  • Leaning on an old title policy. A lender requires its own lender’s policy against defects.

Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

One more honest limit. State law, community-property rules, and your decree’s exact wording are beyond a broker’s call. A family-law attorney and your title company have the last word on those.

Frequently Asked Questions

Does the decree remove my ex from the HELOC?

No. The lender is not bound by the decree, so a joint line stays a joint debt until it is paid off, closed, or refinanced. Until then your ex can usually keep drawing unless the line is frozen. Handle that before applying for a new line.

Can I borrow if my ex is still on the deed?

Usually not. The new lien needs every owner of record to sign, or title must first be cleaned up. A recorded deed, or a decree your title company accepts as a transfer, is the common fix. Ask the title company what it will accept.

Does a quitclaim change who owes the lender?

It does not. A quitclaim moves ownership only, so the original borrowers stay on the note until a refinance, assumption, or payoff. If you hold the house but not the loan, you may need to refinance to be fully clear.

Can support payments count as income on a bank statement file?

They may, if you choose to rely on them and can document them, subject to lender guidelines. Many self-employed borrowers qualify on business deposits alone. Either way, transfers between your own accounts get removed before the deposits are averaged.

How long should I wait after the decree?

There is no single national waiting period. Title companies commonly want the decree final and signed well before closing, though that standard varies by file and lender. The real clock is how long it takes to record a deed and settle the old debt.
