Bank Statement HELOC Rules by State and Where It Is Offered

Bank Statement HELOC Rules by State and Where It Is Offered

The Quick Read: Federal rules for a home equity line are the same in every state, so the real differences come from where a lender operates and a few state-specific overlays. Lendmire’s network offers the bank statement HELOC in 16 full-service states, a narrower footprint than the 41-market DSCR platform.

  • The 16 states are AL, CA, CO, FL, GA, IN, MI, MT, NM, NC, OH, PA, TN, TX, VA and WA.
  • On an investment property, the network ceiling is 70% CLTV, with a 700 minimum credit score and lines of $25,000 to $500,000.
  • Title must sit with an individual or a revocable living trust. An LLC cannot hold title.
  • Texas homestead rules bind primary residences only. A Texas rental is a non-homestead transaction.
  • Outside the 16 states, the practical answer is a DSCR cash-out refinance.

What Is a Bank Statement HELOC?

A bank statement HELOC is a standalone line of credit, in first or second lien position, that qualifies the borrower on deposit history instead of traditional personal-income documentation. It is still full underwriting. Credit, equity, debt-to-income and the property all get reviewed.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

It fits self-employed borrowers whose traditional personal-income documentation shows heavy write-offs. It does not fit anyone hoping to skip documentation. The income is documented differently, and the file is read just as closely.

The structure matches other lines. A draw period comes first, then a repayment period, and the CFPB explains that payments are often significantly higher once repayment begins. Seasonal earners should stress-test the amortizing payment against their weakest month, not their best one.

How Underwriting Treats the Statements, Step by Step

Underwriting runs in a fixed order, and most delays come from gaps in step one.

1. Collect statements. Consecutive months, every page, personal or business.

2. Strip non-income deposits. Transfers, refunds and loan proceeds come out.

3. Apply an expense factor. Business-account deposits carry a default 50% expense factor. A lower factor is possible with CPA documentation, at the lender’s discretion.

4. Compute qualifying income and DTI. DTI tops out at 50%, or 45% for credit profiles from 600 to 679. A ratio above 45% requires a 680 minimum. The line is qualified on the interest-only payment calculated on the maximum draw.

5. Run credit, CLTV, property and title checks. The score model is single-bureau, keyed to the primary wage earner, with a report no more than 90 days old at closing.

6. Valuation. Lines at or below $500,000 ordinarily run an automated valuation. A higher CLTV may require a secondary valuation, and a borrower may request a full appraisal in any case.

The line limit comes from a percentage of appraised value minus the existing mortgage balance. The CFPB’s HELOC booklet describes that calculation and the lender’s review of ability to repay.

Why Availability Differs by State

Three things drive the map: lender licensing, state law, and lender appetite. Federal rules do not change at a state line.

Licensing decides where a given lender can write the product at all. A state can be open for DSCR and closed for the HELOC.

State law shapes a small number of files, mostly in Texas. Lender appetite shapes the rest. Large retail lenders often stay out of rental collateral entirely, and borrowers who have shopped depository institutions for a rental line report that small banks and credit unions are the main source. BiggerPockets threads describe lines being cut or products discontinued. Availability depends on the lender in front of you, not only on the state.

Where the Network Offers It, and the State Wrinkles

State group What applies
AL, CA, CO, FL, GA, MI, MT, VA Standard network terms
IN, NC, PA, TN, WA Listed-for-sale property ineligible (a recent-listing restriction applies)
TX Same listing rule; 10-acre limit; $4,000 minimum later draw
NM, OH CLTV cap depends on credit profile
TN Shorter repayment on primary and second-home structures
MI Line floor of $10,000

Texas deserves its own note. A Texas primary residence is a homestead under constitutional rules, which cap combined liens at 80% of value, require a 12-day waiting period, allow one such loan at a time, and impose a 12-month spacing rule. A secondary legal guide summarizes the 80% cap and 12-day notice. Texas second homes and investment properties are non-homestead, so those limits do not attach to a rental.

What Leverage Looks Like by Occupancy

The ceiling depends on the occupancy being financed. Quoting one number for all three is where most reader confusion starts.

Occupancy Max CLTV Min credit Max line
Investment property 70% 700 $500,000
Second home 90% only at 720+ 640 $500,000
Primary residence 90% only at 720+ 600 $750,000

On an investment property, nothing sits above 70% CLTV and there is no tier above a $500,000 line. A line above $500,000 is primary-residence only. It requires a 700 credit profile or better (720 on the longer-runway structure), caps at 75% CLTV and requires a full appraisal. Every figure is subject to lender guidelines and full file review.

Market surveys describe a wider range. NerdWallet reports that investment-property HELOCs run stricter than primary-home lines on credit, LTV, reserves and DTI, with a market-wide maximum LTV of 80% at many lenders. That is a market statistic. The network figure for an investment property is 70% CLTV. Exact terms depend on lender and investor guidelines, credit profile, reserves, and property review.

Structures That Exist

The line can sit in first or second lien position. Primary residences and second homes can use a 3-year interest-only draw with a 17-year repayment, or a 5-year draw with a 25-year repayment. Tennessee shortens those to 3 and 12 years, and 5 and 10 years. Investment lines run the 5-year draw and 25-year repayment only.

At least 75% of the line is drawn at closing, and pricing floats through draw and repayment without converting to fixed. Later draws carry a $1,000 minimum, $4,000 in Texas. A borrower can hold up to three lines, with combined exposure capped at $2,000,000 on the higher-leverage structure and $750,000 on the longer-runway structure. More than 15 financed properties makes a borrower ineligible.

Where the General Rule Breaks

LLC vesting. This is the sharpest edge. LLCs, corporations, partnerships and irrevocable, blind or land trusts cannot hold title. A rental already deeded to an LLC needs a vesting change, or the better path is a DSCR cash-out refinance.

Property types. Single-family, 2-4 units, PUDs, townhomes and condos, including non-warrantable condos, are eligible. Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use and agriculturally zoned property are not offered. Two- to four-unit properties require a 640 minimum on the longer-runway structure.

Listing seasoning. In Indiana, North Carolina, Pennsylvania, Tennessee, Texas and Washington, a property that is currently listed for sale, or was listed within the past 60 days, is ineligible. Investors who relist after a failed sale hit this.

Derogatory credit. A bankruptcy needs 4 years from discharge or dismissal. On primary residences and second homes, one structure seasons a foreclosure at 7 years and a deed-in-lieu or short sale at 4, while the other declines that history outright. Investment files follow the 7-and-4 path.

The primary-residence tactic. Some investors take the line while the property is still their primary residence, then convert it to a rental. BiggerPockets discusses this approach and advises checking the stipulations first. Occupancy has to be stated honestly at application, and a later change in use is a conversation to have with the lender beforehand.

Key Terms Defined

CLTV: Combined loan-to-value, which adds every lien on the property and divides by its value.

Draw period: The stretch when the borrower can pull funds, usually interest-only.

Homestead: A primary residence that receives special legal protection, which in Texas limits how it can be borrowed against.

Vesting: The legal form in which title is held, such as an individual or a revocable trust.

Open-end credit: A revolving line the borrower can draw on repeatedly, unlike a closed-end loan funded once.

If Your State Is Not on the List

The answer is a different product, not a workaround. A DSCR cash-out refinance qualifies primarily on property-level rental income covering the payment, subject to lender guidelines, and it allows LLC vesting. It also reprices the whole balance, which matters for anyone holding a low-rate first mortgage. See Lendmire’s complete DSCR loans guide for how that structure compares.

DSCR is also not positive cash flow. Coverage compares rent to the full monthly obligation. Repairs, vacancy, management and capex sit outside the calculation.

Frequently Asked Questions

Is a bank statement HELOC offered in every state?

No. Lendmire’s network offers it in 16 full-service states: AL, CA, CO, FL, GA, IN, MI, MT, NM, NC, OH, PA, TN, TX, VA and WA.

Does Texas work differently?

Only for primary residences. A Texas homestead caps at 80% combined loan-to-value, with a 12-day waiting period, one such lien at a time and 12-month seasoning. Texas rentals and second homes are non-homestead.

Can an LLC hold the property?

No. Title must sit with an individual or a revocable living trust. A property already in an LLC needs a vesting change, or a DSCR cash-out refinance fits better.

What is the maximum leverage on a rental?

On an investment property, the ceiling is 70% CLTV with a 700 minimum score and a line up to $500,000, subject to lender guidelines. Higher figures apply only to primary residences and second homes.

Is it still full underwriting?

Yes. The borrower is reviewed on documented deposit income under the applicable program, subject to lender guidelines. Credit, equity, DTI and property still get reviewed.

Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.
