How a Founder Disputes a Low Appraisal on a Super Jumbo Bank Statement Loan

How a Founder Disputes a Low Appraisal on a Super Jumbo Bank Statement Loan

The Quick Read: The route is a written reconsideration request, sent through the lender to the appraiser, that lists documented factual errors and closed comparable sales; the appraiser alone decides whether the value moves, so the request must rest on proof rather than opinion.

  • The income test and the value test are separate. A low appraisal never changes the bank statement income calculation.
  • A lower value shrinks the loan or raises the cash needed, because every leverage ceiling applies to the lower of price or value.
  • Facts come first: square footage, room count, lot size and missed improvements.
  • On files above $4,000,000, leverage is reviewed case by case before submission, so ask the broker early how a lower value would be handled.
  • Prevention beats dispute. Comps and improvement records sent before the appraiser visits do more than a rebuttal sent after.

What a Low Appraisal Does on This Kind of Loan

A low appraisal cuts the value that the loan-to-value ceiling is applied to. Through select wholesale programs, subject to full underwriting, leverage steps down as loan size rises. On a primary residence purchase, the ceiling is 90% through $1,000,000, then 85%, 80%, 75%, and case-by-case review above $4,000,000.

Here is how that plays out. A founder contracts to buy a primary residence at $2,200,000. In that size band, the purchase ceiling is 80%. If the appraisal lands 5% under contract, the 80% applies to the lower figure. The loan shrinks by about 5%, and the founder covers the difference in cash or renegotiates the price.

A lower value also moves the loan amount. That can place the file in a different size band with its own ceiling, its own credit tier and its own reserve requirement. Reserves run 3 months to $500,000, 6 months to $1,500,000 and 9 months above that, subject to program guidelines.

Income and Value Are Separate Tests

Bank statement deposits qualify the borrower. The appraisal values the collateral. These never cross.

Across the wholesale network, income is built from 12 or 24 months of deposits after an expense ratio. Transfers from the founder’s own business into a personal account count in full. None of that moves when the appraisal comes in low. What moves is leverage, loan amount and cash to close.

Some founders assume a bank statement loan skips the appraisal. It does not.

Step One: Get the Report and Audit It

The borrower is entitled to a copy of the appraisal. The federal consumer-finance regulator’s Reg B rule at 12 CFR 1002.14 requires the creditor to deliver appraisals on a first-lien dwelling application, either promptly on completion or three business days before consummation, whichever is earlier. Whether that applies cleanly to an LLC or entity borrower is a question for counsel.

Read the report for facts first. A factual error is the cleanest reason to ask for a re-look.

What to check Why it matters Proof to send
Living area Drives price-per-foot comparisons Plans, prior survey, permit file
Bed and bath count Changes comp selection Listing history, permits
Lot size Large on estates Survey, county parcel record
Finished basement or addition Often missed Permits, contractor invoices
Comp selection Dated or distant sales skew value Closed sales nearer the subject
Adjustments Where most challenges succeed or fail Paired-sale support

Valid Grounds Versus Disappointment

The interagency guidance on reconsiderations of value frames a deficient valuation as one with discrimination, errors or omissions, or unreasonable or unsupported methods, assumptions or data, as ABA Banking Journal quotes it. A number you simply dislike is not on that list.

Valid ground Not a ground
Wrong square footage or room count The value is below what you paid
Closed sales the appraiser missed Listings with high asking prices
Unadjusted distressed sale in the comps A neighbor’s claimed sale price
Documented improvements left out The value you need for the loan
Evidence of bias Frustration with the process

Most challenges fail when the comps support the number. If the appraiser’s comps and condition rating are consistent, only more similar closed sales can move it.

Building the Evidence Packet

The packet should read like a short brief, not a complaint. Keep it in this order:

1. Cover note: the property address, the report date, and a one-sentence statement of what you are asking the appraiser to reassess.

2. Factual corrections: each error stated once, with the document that proves it.

3. Comparable sales: closed sales only, each tied to a specific unadjusted difference in the original report.

4. A closing line that asks for reassessment without naming a target value.

Never state a desired value or range. That reads as pressure and tends to sink the request.

Thin comps are the real problem on a super jumbo. Estates and custom homes rarely have exact matches. The argument is usually about adjustments, so show why a comp’s adjustment for view, lot or finish is too small or too large. Super jumbo valuation also goes better with an appraiser who has luxury or custom-home experience, which is worth asking the broker about before the order goes in.

Submitting the Request Through the Lender

The appraiser’s client is the lender, not the borrower. Independence rules bar the borrower from pushing the appraiser directly, so substantive value discussion routes through the client.

The Federal Register notice of the interagency guidance defines a reconsideration of value as a request from the financial institution to the appraiser to reassess the report. The same notice states that supervisory guidance lacks the force and effect of law. A founder has no legal right to a changed value, only a process the lender may follow.

Agency-style norms, such as one request per report and a cap of five added comps, are a template at best. Non-agency lenders set their own limits. Ask the broker for the lender’s written reconsideration policy before you spend time on the packet.

When Two Appraisals Are in Play

No federal rule requires two appraisals because of loan size or documentation type. Lendmire’s page on the second appraisal rule makes the same point. A second report is lender policy, and it is more common on the largest files.

Where two values exist, the lower typically governs. A desktop or field review may stand in for a second full appraisal. The consequence is practical. Winning a reconsideration on one report may not lift the sizing value if the other report stays low. Ask how the file is reconciled before you put effort into either one. Lendmire’s piece How to Dispute a Low Appraisal on a Super Jumbo Bank Statement Loan covers the borrower’s side of that process in more detail.

Founder-Specific Wrinkles

Entity ownership. If an LLC holds title, confirm how the copy-of-appraisal rule applies.

Home office and mixed use. Appraisers value the dwelling as a residence. Business use of a room rarely adds value, and documenting it as a business asset can invite questions. Keep the packet about the house.

Custom improvements. Unusual work is where reports undercount. Permits and invoices carry more weight than photographs.

Acreage. Above the super-jumbo line, the programs carry overlays: no rural property and ten acres maximum, on a primary residence above $3,500,000 and on a second home or investment property above $3,000,000. Acreage comps are also hard to find.

Occupancy. A second home or investment property takes its own ladder, not the primary-residence figures. Use the correct occupancy when you test the new value against the ceiling.

If the Number Holds

Sometimes the report is right. The options after a denied request are few.

Option What it does Trade-off
Take a smaller loan Keeps the original price More cash at closing
Renegotiate price Matches price to value Seller must agree
Wait and reapply Lets the market or improvements catch up Appraisals expire; a new report is needed
Change lender or program Gets a new appraiser and new overlays Restarts the file

A second order is the lender’s call and needs a documented reason. Agency guidance on this point is contrast only, since non-agency super jumbo files are not bound by it.

Sequence From Report to Decision

1. Receive the report and read every page.

2. Verify the facts against your own records.

3. Decide whether you have an error, a missed improvement or only an opinion.

4. Assemble the packet in the order above.

5. Send it to the broker, who routes it to the lender.

6. Ask how the file is reconciled if two values exist.

7. Take the result and choose among the four options above.

Expiry is the quiet risk. A long dispute can age the report out, which forces a new one.

Common Mistakes

  • Calling or emailing the appraiser directly.
  • Citing listings instead of closed sales.
  • Sending forty comps when five good ones with adjustment arguments would do.
  • Stating the value you need.
  • Fighting a condition issue as if it were a value issue.

Key Terms Defined

Reconsideration of value (ROV): A request, routed through the lender, asking the appraiser to reassess a report based on errors or new information.

Appraiser’s client: The lender that orders the appraisal, which is why requests go through the lender.

Comparable sale (comp): A recently closed sale of a similar property used to support the value.

Adjustment: A dollar change an appraiser makes to a comp to account for a difference from the subject.

Lower-of-two rule: On files with two valuations, the lower value typically sets the loan size.

Frequently Asked Questions

Does a low appraisal affect my bank statement income calculation?

No. Income comes from 12 or 24 months of deposits after an expense ratio. The appraisal changes the value the leverage ceiling applies to, so it affects loan amount and cash to close, not qualifying income.

Can a founder pay for a second appraisal?

A second order is the lender’s decision and needs a legitimate, documented reason. A borrower-paid report may not be accepted as the sizing value. Ask the broker how the lender treats outside reports before paying for one.

Will the appraiser have to change the value?

No. The appraiser reassesses and decides. A change is more likely when the request shows verifiable errors or better-supported closed sales than when it offers opinion.

Is a second appraisal required on every super jumbo loan?

No. It is a lender or program choice, not a federal rule. Across the network, large files are the ones most likely to see a second report or a desktop or field review, and files above $4,000,000 are reviewed case by case.

Can I send the appraiser my own comps?

Send them through the lender, as closed sales tied to specific errors or adjustments in the report. Sending them directly runs against independence rules, and the appraiser’s response goes back through the lender.
