Is an FHA Cash-Out Refinance Legitimate and Who Is Eligible?

Is an FHA Cash-Out Refinance Legitimate and Who Is Eligible?

The Quick Read: Yes. It is a long-standing federal program, insured by FHA and made by approved lenders. You qualify if you own and live in the home as your primary residence, have owned it and lived there for 12 months, have paid your mortgage on time, and keep at least 20% equity after closing. Credit and income must also pass FHA underwriting.

Why “Legitimate” Is a Fair Question

Legitimate is the right word to ask about. Mailers and ads use fuzzy phrases like “untapped equity” and “government money.” Some of them have nothing to do with a real loan.

An illustration, not a Loan Estimate, an approval, a quote, or a commitment to lend. The rate shown is the weekly Freddie Mac thirty-year conventional benchmark, used as a market reference; an FHA cash-out is priced by the lender at lock, and this is not an FHA cash-out refinance quote. HUD’s cap limits the base loan; the upfront premium is financed on top of the capped base loan; the monthly premium for the first year follows the snapshot’s schedule. Cash available means the base loan the cap permits less the balances retired, before closing costs, which this calculator leaves out. The line figure applies the line program’s combined loan-to-value ceiling to the same value and balance. Taxes and insurance are estimates you can edit. Licensed in sixteen states for consumer mortgages.

The real product is plain. You replace your current mortgage with a new, larger one. The difference, after paying off the old loan and the costs, comes to you as cash. FHA does not lend you that cash. A private lender makes the loan, and FHA insures it, which protects the lender if the loan defaults. You still repay every dollar.

If you want the program overview, the FHA cash-out refinance program page covers it. The rest of this piece explains how to tell real from fake, then who qualifies.

Is It Actually a Government Program?

It is. HUD’s own refinance guidance has long listed cash-out refinances as one of the types FHA insures, alongside streamline and no-cash-out refinances. Today’s rules sit in HUD’s FHA Single Family Housing Policy Handbook 4000.1, which records the 80% cap on cash-out loans.

HUD also tightened the program on purpose. In its mortgagee letter lowering the cash-out cap, HUD cut the maximum from 85% to 80% of value. It said the change would strengthen the equity position of these loans and reduce losses if a borrower defaults. The same letter notes cash-out endorsements rose more than 250% in five fiscal years.

That is a regulator tuning a program, not a program in trouble. HUD’s press release on the change says cash-out made up 64% of FHA refinances.

Real Loan vs. Scam: What to Look For

A real FHA cash-out refinance looks like any mortgage. A scam looks like an offer.

Real FHA cash-out loan Red flag
Lender is licensed and verifiable Won’t give a license number
Appraisal, credit check, income review “No documents, guaranteed”
Loan Estimate shows the costs Upfront fee before any disclosure
You repay a mortgage “Free government money”
Clear loan terms in writing Pressure to sign today

“FACOP” and similar labels are marketing names, not an official program name. FHA’s real refinance types are streamline, no-cash-out and cash-out. A pitch built around a made-up name deserves extra scrutiny.

Verify before you hand over documents:

1. Ask for the company’s and loan officer’s license numbers. Look both up in the national licensing registry.

2. Get a Loan Estimate in writing and read the loan type, the amount and the costs.

3. Confirm the loan is described as an FHA loan, with a mortgage insurance premium line.

4. Never pay anyone upfront for “processing” before you have a disclosure.

5. Walk away from anyone who promises approval before reviewing your file.

Across the wholesale programs Lendmire places FHA files with, no approval comes before a full review of credit, income, the home and the appraisal. That is true of every legitimate lender, so a promise of certainty is the warning sign.

Who Is Eligible?

Eligibility comes down to five tests. Every program figure here is subject to lender guidelines and full file review, and nothing is a commitment to lend.

Test What it means
Occupancy The home is your principal residence
12 months You owned it and lived in it for the 12 months before the FHA case number
Payment history Mortgage payments made on time over those months
Equity New loan is 80% of appraised value or less
Underwriting Credit, income and debts pass FHA review

Occupancy. FHA cash-out is for the home you live in. A second home or rental property does not qualify. Occupancy decides how much leverage a property can reach, and rentals fall outside this program.

The 12-month clock. Your lender assigns an FHA case number early in the process, and the clock counts back from that date. HUD’s handbook has the lender review employment records or utility bills as proof you lived there. If you moved in last spring, you wait.

Payment history. The lender looks at your mortgage payments over the prior 12 months, or since the loan began if that is shorter. Late payments are a problem. HUD has also required manual review of cash-out files showing current or recent delinquency. After forbearance, HUD’s guidance for borrowers coming out of forbearance required a completed plan and 12 straight on-time payments for a cash-out. That was a pandemic-era letter, so your loan officer confirms what applies now.

Credit and ratios. The wholesale programs Lendmire places FHA loans with start at a 580 decision score. Debt-to-income ratios start at a base pair of 31/43 (housing costs and total debts as a share of income). Documented compensating factors, such as reserves or a strong payment record, can stretch that to 40/50 at the top tier. The automated underwriting finding governs most files.

The 80% cap. FHA cash-out reaches 80% of the appraised value. That is lower than the rate-and-term refinance, which reaches 97.75% on a principal residence you have occupied for the previous 12 months. You trade cash for equity.

What It Looks Like in Practice

Run the picture in percentages. Say your home appraises at a certain value and your current mortgage is about 55% of it. The 80% cap leaves roughly 25 points of value as potential cash, before the costs.

The new loan also carries FHA’s upfront mortgage insurance premium, 1.75% of the base loan amount. Most borrowers finance it, which makes the new balance a bit bigger. Closing costs, and any liens that must be paid off, come out of the proceeds. So the cash you receive is smaller than the headroom suggests.

If your balance already sits near 75% of value, the room is thin. The same is true if a low appraisal knocks the value down. The appraised value against the 80% line decides how much cash exists.

Two other points help. A home owned free and clear can still be cashed out, since no existing mortgage is required. And you do not need a current FHA loan. The program covers a refinance of any mortgage type, including conventional.

Exceptions and Edge Cases

  • Inherited home. HUD’s archived guidance allowed cash-out on an inherited property if you occupy it as your primary residence and the inheritance is documented. Lendmire’s piece Can an Heir Who Inherited the Home Get an FHA Cash-Out Refinance? goes through the occupancy details.
  • Former rental. If you moved back into a home you rented out, expect the 12-month occupancy clock to matter.
  • Cosigners. A non-occupant co-borrower cannot be added to rescue weak credit on a cash-out. Per HUD’s guidance on co-borrowers, anyone on the note must live in the home.
  • Streamline. An FHA streamline refinance cannot pull equity out. It allows only a small incidental amount of cash.
  • Property type. One to four units are generally allowed if you live in one of them. Manufactured homes carry extra conditions, and 3-4 unit properties have extra tests. Your loan officer confirms current handbook rules.
  • County loan limits apply to FHA loans and change every year, so your county’s limit caps the loan amount.

Key Terms Defined

Cash-out refinance: A new mortgage larger than the one you owe, with the difference paid to you.

LTV (loan-to-value): The loan amount divided by the home’s appraised value.

Case number: The FHA ID your lender requests for your loan. It starts the 12-month clock.

Seasoning: The waiting period you must meet before a loan is eligible. Here, that is 12 months of ownership and occupancy.

Mortgage insurance premium: FHA’s insurance charge. It has an upfront piece and an annual piece paid monthly.

Debt-to-income ratio: Your monthly debts as a share of monthly gross income.

Legitimate Is Not the Same as a Good Idea

Think of two questions. Is it real? Yes. Is it right for you? That depends.

The cost side is mechanical. You pay the upfront premium. The annual premium runs between 0.15% and 0.75% of the balance, depending on term, loan amount and LTV. On a thirty-year loan above 90% LTV it lasts for the whole term. At or below 90% it ends after 11 years. Your balance rises, and so does your monthly obligation. Loan Estimate figures, not guesses, tell you the true cost. Terms vary by lender guidelines, property type, leverage, credit profile, and full file review.

How people spend the money matters too. A CFPB report on cash-out borrowers found that paying off other bills or debts was the most common reason. More than half of surveyed borrowers chose it each year from 2014 to 2019. Home repairs ranked second. The same report found credit scores jumped at first, then slowly slipped, though they generally stayed above pre-refinance levels.

Here is the catch. Rolling credit card debt into your mortgage turns unsecured debt into debt secured by the house. The CFPB’s research on debt paydown after cash-out cautions that missed payments can then put your home at risk. Missing a card payment does not do that.

This one’s a genuine tradeoff. Cash-out can make sense for a repair that adds value, or a debt swap you will not repeat. It rarely makes sense if the cards will fill up again. Compare it against keeping your current loan, or against other options. Lendmire’s explainer on cash-out refinance in plain English lays out the basic definition and the alternatives.

Common Mistakes

  • Assuming 85%. Older web pages still say FHA cash-out goes to 85%. The cap is 80% now.
  • Counting on a cosigner. Your helper must occupy the home, or they cannot be on the note.
  • Using it for a rental. This program is for your principal residence.
  • Ignoring late payments. One recent late payment can change the underwriting path.
  • Skipping the Loan Estimate. Read the loan type, the premium and the amount before you sign anything.

Frequently Asked Questions

Is an FHA cash-out refinance a scam?

No. It is a real HUD/FHA program, and a private lender makes the loan. Scams copy the vocabulary. They often ask for upfront fees, promise approval regardless of your circumstances, or call it free money. A genuine lender is licensed, provides a Loan Estimate, and underwrites your credit, income and appraisal.

Do I need an existing FHA loan to qualify?

No. You can refinance a conventional mortgage, an FHA loan, or a home owned free and clear. What matters is that you own and live in the home, meet the 12-month rule, and the new loan stays within 80% of the appraised value.

Can I use it on a rental or second home?

No. FHA cash-out is for your principal residence. Occupancy decides how much leverage a property can reach, so rentals and second homes fall outside this program.

Can a cosigner help me qualify?

Only if the cosigner lives in the home with you. HUD does not allow a non-occupant co-borrower to be added to meet credit guidelines on a cash-out refinance.

How much equity do I have to leave in the home?

At least 20% of the appraised value, because the cap is 80% loan-to-value. A lower appraisal shrinks the cash available, so the appraisal matters as much as your balance.
