Best Bank Statement HELOC Program During and After a Divorce

Best Bank Statement HELOC Program During and After a Divorce

The Quick Read: The program that fits depends on the occupancy of the property, your credit profile, how title is held, and whether the divorce is pending or final. It does not depend on a single product label. Lendmire is a mortgage broker that places these files with select wholesale lenders, so the match is made to your scenario rather than to one lender’s menu.

  • A decree changes who owns the equity. It does not remove anyone from a lender’s contract.
  • On an investment property, the network ceiling is 70% combined loan-to-value (CLTV), with a 700 minimum credit profile and a $500,000 maximum line.
  • Primary residences reach higher leverage, but only at stronger credit tiers.
  • A rental held in an LLC cannot take a HELOC at all. That file needs a DSCR cash-out or a vesting change.
  • Clean, separated deposit history matters more than anything else on a self-employed file.

What a Bank Statement HELOC Actually Is

A bank statement HELOC is a home equity line where the lender reads your deposits instead of your tax returns to measure income. Self-employed borrowers use it because write-offs shrink the income on a return.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

The lender pulls a set of personal or business statements. It strips out deposits that are not income, such as transfers, loan proceeds, gifts and refunds. It then averages what remains over the months reviewed. Some programs apply an expense factor to business deposits. Each lender sets its own method, and no federal formula dictates it.

The line itself is a standalone first-lien or second-lien product. Across the wholesale network, most lines draw interest-only first and then fully amortize. Line size runs from $25,000 to $750,000, with a Michigan floor of $10,000. Availability runs through Lendmire’s 16 full-service states (AL, CA, CO, FL, GA, IN, MI, MT, NM, NC, OH, PA, TN, TX, VA, WA). That is narrower than the 41-market DSCR footprint. Every figure here is subject to lender guidelines and full file review, and none is a commitment to lend.

What Divorce Changes, and What It Does Not

The core point is simple. A divorce moves ownership and responsibility between spouses. It does not rewrite the lender’s contract. DivorceNet explains that a judge can order a spouse to refinance or sell, but cannot force a lender to release a borrower. A Justia attorney answer adds that a quitclaim deed does not touch the mortgage. Both parties stay liable until the loan is refinanced or modified.

That matters for any HELOC you open. A new line needs the applicant on title. If your ex is still on the deed, expect a signature requirement. If a joint line is already open, a freeze stops new draws, but the balance and the payments stay. Experian notes that a lender must notify you in writing after it freezes or reduces a line. It also notes that divorce-related credit damage can itself trigger a freeze.

This article focuses on how to pick the program.

What “Best” Means in a Divorce

The best program for your situation is the one that fits five things at once. No lender is best in the abstract, and a broker that shops several wholesale lenders can test each point.

Criterion Why it matters in a divorce What to confirm
Occupancy Investment lines cap far lower than primary lines Which CLTV tier applies to your property
Title and vesting The applicant must hold title as an individual or revocable trust Whether the ex is still on the deed
Single-earner qualification Two incomes became one How the file reads your deposits alone
Credit scoring Score keys to the primary wage earner Whether joint debts are still reporting
Draw structure Longer interest-only runway changes cash flow Which draw and repayment terms apply

Skip any program that cannot answer the title and vesting question in writing.

How Bank Statement Income Reads for One Earner

Underwriting treats the retaining spouse alone. Old household income no longer counts. Only the deposit history in your own accounts counts.

The mechanics run in order:

1. The lender collects personal or business statements for the review period. 2. It removes non-income deposits: transfers between accounts, loan proceeds, gifts, refunds. 3. If business statements are used, it applies the program’s expense factor or a third-party profit-and-loss statement. 4. It averages the remaining deposits over the months reviewed, and adjusts for your ownership share in the business. 5. It tests the result against obligations. Network programs set a 50% maximum debt-to-income ratio, or 45% for credit profiles from 600 to 679. A ratio above 45% requires a 680 minimum. The test uses the interest-only payment calculated on the maximum draw.

Court-ordered support you pay and any joint debt not yet closed or refinanced can count against that ratio. Whether support you receive counts as income depends on the lender and on the documentation behind it.

Statement hygiene during a split

Divorce muddies deposits. A few habits keep the file clean:

  • Move your income to individual accounts early. A joint account still holding your ex’s money distorts the averages.
  • Keep business and personal funds apart.
  • Document every large transfer from your ex or from asset division. Unexplained lumps get excluded or questioned.
  • Keep joint payments current. Late marks on a joint line hurt your score during the review.

Network Parameters by Occupancy

Occupancy decides the ceiling, and the ceilings differ sharply. These are typical ranges from select wholesale-network guidelines.

Investment property. The ceiling is 70% CLTV at a 700 minimum credit profile, up to $500,000. These lines run a 5-year interest-only draw followed by a 25-year fully amortizing repayment.

Primary residence. The tiers step down with credit:

  • 720+ reaches 90% CLTV up to $500,000.
  • 700+ reaches 85% CLTV up to $500,000.
  • 680+ and 660+ also reach 85% up to $500,000.
  • 640+ reaches 80% up to $500,000.
  • 620+ reaches 70% up to $400,000.
  • 600+ reaches 60% up to $400,000.

The 90% figure exists only at a 720-or-better profile. A Texas primary residence is a homestead and caps at 80% CLTV, so the higher tiers never apply there.

Second home. The ceiling reaches 90% CLTV at 720+, with a 640 minimum and a $500,000 maximum line.

Primary and second-home lines offer two draw structures. One is a 3-year interest-only draw with a 17-year repayment. The other is a 5-year draw with a 25-year repayment. Tennessee shortens both. At least 75% of the line is drawn at closing. Pricing floats and never converts to fixed. Some lines above $500,000 are available on primary residences only, at 75% CLTV, with a 700 minimum credit profile (720 on the 5-year draw structure) and a full appraisal.

Lines at or below $500,000 ordinarily run an automated valuation. A full appraisal is required above that, and you can request one in any case. Combined LTV counts every lien together. The cash needed to buy out your ex and the new line must both fit under the ceiling.

Where the General Rule Breaks

A joint HELOC is already open. The decree does not free you. Your options are to freeze it, pay it off and close it, or refinance it into one name. A borrower-requested freeze is separate from a lender-initiated one. Federal rules limit when a lender may freeze or reduce a line on its own after it is opened. A freeze never pays anything down.

The rental sits in an LLC. HELOC title must be held by an individual borrower or a revocable living trust. LLCs, corporations, partnerships and irrevocable, blind or land trusts cannot hold title. This is the sharpest difference from a DSCR loan. A property already deeded to an LLC needs a vesting change or a DSCR cash-out refinance instead.

The property type is not eligible. Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use and agricultural-zoned properties are not offered. Single-family, 2-4 units, PUDs, townhomes and condominiums, including non-warrantable, are eligible. The 2-4 unit tier carries a 640 minimum on the longer-draw structure.

Credit is thin or damaged. A bankruptcy needs 4 years of seasoning from discharge or dismissal. A foreclosure history can split the file: one structure seasons a foreclosure at 7 years and a short sale at 4, while another declines the history entirely.

The transfer carries a due-on-sale risk. Federal law protects some transfers between spouses from due-on-sale enforcement, but those protections are generally framed around residential property. Rentals need extra caution. This one belongs in front of your attorney, not in a guess.

When a HELOC Is the Wrong Tool

A HELOC does not release your ex from the first mortgage. A cash-out refinance replaces the old note, which is the cleaner way to take someone off the loan. Bankrate lists a HELOC as a way to pay an ex’s equity share when cash-out refinance room is short. Both routes have a place.

For a rental, a DSCR cash-out refinance often fits better. It qualifies primarily on property-level rental income covering the payment, subject to lender guidelines, so a one-earner household’s personal income is not the main test. Cash-out on a standard rental tops out around 75% LTV across most of the network, with about 6 months of seasoning as the common expectation. A short-term rental is capped at 70% on cash-out. Clearing the coverage ratio does not equal positive cash flow, since repairs, vacancy and management sit outside it. The complete DSCR loans guide walks through that comparison.

Situation Usually points to
Keep a low first lien, need cash, own as an individual Bank statement HELOC
Need your ex off the existing note Cash-out refinance
Rental held in an LLC DSCR cash-out
Self-employed, personal income understated Bank statement documentation, on either path

Key Terms Defined

Bank statement HELOC: a home equity line that reads deposits in your statements to measure income instead of tax returns.

CLTV (combined loan-to-value): all liens on the property added together, divided by its value.

Draw period: the stretch when you can borrow against the line, usually interest-only.

Vesting: how title is held, such as an individual or a revocable living trust.

Quitclaim deed: a document that moves ownership but leaves the mortgage obligation untouched.

Joint obligor: a person who signed the loan and remains liable to the lender.

What to Prepare

Gather these before the file goes in:

  • Divorce documents: the decree or settlement agreement, and any court order permitting the lien.
  • Property documents: the current mortgage statement, insurance, and the recorded quitclaim deed.
  • Income documents: personal or business statements for the review period and a profit-and-loss statement if the program asks for one.
  • Credit items: a list of every joint line and who signed each. Credit reports must be no more than 90 days old at closing, and the score keys to the primary wage earner.

A buyout is a tax-adjacent event. Tax treatment varies, so consult a qualified professional before relying on any deduction.

Frequently Asked Questions

Can I get a bank statement HELOC while the divorce is still pending?

Sometimes. It depends on title, state rules, and any court order. A lender will usually want spousal consent or an order that allows the new lien, and an attorney should confirm what your court requires.

Does the divorce decree remove my ex from an existing HELOC?

No. The lender’s contract stays as written. The line must be paid off, closed, or refinanced into one name before the other signer is released.

Can support income count toward qualifying?

Possibly. Support you pay can count against your ratio. Support you receive may count if it is documented and the lender accepts it. Some borrowers choose not to rely on it.

Can I use this on a rental property?

Yes, on an individually held or trust-held rental. The investment ceiling is 70% CLTV at a 700 minimum credit profile, with a $500,000 maximum line. A rental held in an LLC is not eligible for a HELOC.

What if the HELOC is blocked?

Move to the alternative that fits the property. A cash-out refinance can release an ex from the note. A DSCR cash-out fits an LLC-held rental.
