Banks That Offer a Bank Statement HELOC After a Quitclaim Deed

Banks That Offer a Bank Statement HELOC After a Quitclaim Deed

The Quick Read: No national list of lenders answers this question, because the answer depends on program type, not bank name. Lenders that document income from deposits will generally consider a recently deeded property once the deed is recorded, the vesting is acceptable, and the lender’s own seasoning policy is satisfied, all subject to lender guidelines.

  • A quitclaim moves title only. The old mortgage and the borrower’s liability stay in place.
  • The deed must be recorded, and the person on title must be the person applying.
  • No law sets a waiting period after a deed. Seasoning is each lender’s policy, so get it in writing before recording.
  • Bank statements change how income is documented. Credit, equity, debt ratios, and property rules still apply.
  • Large retail lenders are not the usual home for this product. A broker that shops several wholesale lenders can match the file to a program.

Lendmire is a mortgage broker, not a lender. It places these files with select wholesale lenders in its network. Everything below describes how those programs look at a recent deed, so you can screen any lender yourself.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

What Does a Quitclaim Deed Actually Change?

A quitclaim changes who holds title. It does not change who owes the debt.

The deed passes whatever interest the signer holds, with no warranty. A legal explainer on due-on-sale exceptions makes the point plainly: the deed does not transfer or eliminate the mortgage. The note and the deed are separate documents, so the original borrower can stay liable after signing away title. Release takes a lender release, an assumption, or a refinance.

For a HELOC lender, the split shows up in four items, each with its own effect:

Item Effect of the quitclaim
Title Moves to the grantee once recorded
Existing first mortgage Stays; the signer usually stays liable
New HELOC lien Must come from the owner(s) now on title
Owner’s title policy May not automatically cover a new owner

An unrecorded deed does not count. Lenders read recorded vesting, so a signed but unrecorded deed leaves you where you started.

Why “Which Banks Offer This” Is the Wrong Question

Most large retail lenders do not offer bank statement HELOCs at all. Documenting income from deposits is a non-QM practice, and it is not a standard feature of depository-institution equity lines. Adding a recent deed narrows the field further.

1. Whether they document self-employed income from deposits.

2. Whether they count seasoning from the original purchase or from the deed’s recording date.

3. Whether they accept the title holder as shown, or require a vesting change first.

4. Whether the property type, credit profile, and line size fit their matrix.

Rental-property lines have a smaller lender pool in general, with stricter terms than lines on a primary home. That is why the match matters more than the name.

How Is Bank Statement Income Read After a Deed?

Income is read from deposits, not tax returns, and the deed does not change that.

Self-employed borrowers often show low taxable income because of legitimate deductions. A bank statement program looks at deposits over a set period instead. The lender then reduces business deposits by an expense factor, so qualifying income lands below total deposits. Supporting documents commonly include proof of self-employment, a profit-and-loss statement, a mortgage statement, an insurance declaration, and a tax bill.

Two points trip people up after a deed:

  • Whose deposits count. The income belongs to the applicant on title and on the note. A spouse who was added to title but not the loan does not lend their deposits to the file.
  • Commingled or transferred funds. Transfers between accounts and one-time deposits often get excluded. A statement window that straddles the deed date does not matter by itself, but messy transfers around that date draw questions.

This is qualification on documented income under the applicable program, subject to lender guidelines. It is not “no documentation,” and the file still gets a full review.

Does the Deed Restart a Waiting Period?

Sometimes. No federal rule imposes a waiting period after a quitclaim, so any clock comes from the lender.

Two lender styles show up:

  • Look-through lenders count from the original purchase and treat the deed as a title matter.
  • Restart lenders count from the recording date and may ask the borrower to wait.

The difference can decide the whole outcome. Ask for the lender’s position in writing before you record, not after. If you are weighing several lenders, a broker can ask each one the same question.

What Does the Old Mortgage Lender Think of the Deed?

That is a separate question from the HELOC, and it is worth settling first.

Federal law makes due-on-sale clauses enforceable and lists specific transfers where a lender may not enforce them. The statute, 12 U.S.C. § 1701j-3, sets those exceptions in subsection (d). The protections apply to residential property with fewer than five dwelling units. The national-bank rule at 12 CFR § 34.5 adds that outside the listed exceptions, due-on-sale clauses are enforceable.

Commonly cited protected transfers include a transfer to a spouse or children, a transfer under a divorce decree, and a transfer into a borrower’s own living trust where the borrower stays a beneficiary. The statute text controls, so read it or have an attorney read it.

Two cautions:

  • A deed to an unrelated person can fall inside the clause. The name “quitclaim” creates no exception.
  • Protection from acceleration is not approval by a new HELOC lender. The old lender being unable to call the loan says nothing about a new lender’s title or seasoning rules.

Because the clause is enforceable outside those exceptions, do not plan around the old lender overlooking the transfer.

Deed Scenarios Compared

How the deed reads depends on direction. Here is how common versions usually look to a HELOC lender:

Deed direction Usual title read Typical next step
Spouse added Individuals on title; usually workable Both owners sign the lien
Divorce transfer Individual on title; documents matter Provide decree and recorded deed
Into own revocable trust Often acceptable vesting Confirm trust is eligible
Into an LLC Not eligible vesting for this line Re-vest, or use a DSCR cash-out
Out of an LLC to an individual Becomes eligible once recorded Ask about seasoning
Gift to family member Eligible vesting; seasoning varies Get the policy in writing

Some investors stack two deeds, such as a spousal deed followed by a move into an LLC. That creates two recording dates and two possible seasoning questions. Plan the sequence before signing anything.

Where Do Lendmire’s Network Programs Fit?

Across the wholesale lenders Lendmire works with, a standalone HELOC can sit in first or second lien position. Eligible vesting is the individual borrower or an inter vivos revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title on these lines. That is the sharpest structural difference from a DSCR loan, and a property already deeded to an LLC needs a vesting change or a DSCR cash-out instead.

Ceilings are tiered by occupancy and credit. Here is how they read, subject to lender guidelines and full file review:

Occupancy Top CLTV Credit pairing Max line
Primary residence 90% 720 or better $500,000
Primary residence (larger line) 75% 700+ (720 on the longer-runway program) $750,000
Second home 90% 720 or better $500,000
Investment property 70% 700 or better $500,000

The 90% figure exists only at a 720 credit profile, and it never applies to an investment property. On an investment property the network ceiling is 70% CLTV, with a 700 minimum credit score. A line above $500,000 is primary-residence only and requires a full appraisal.

  • Lines run $25,000 to $750,000, with DTI generally capped around 50%, and 45% for credit profiles from 600 to 679.
  • Draw structures on primary residences and second homes include a 3-year interest-only draw with a 17-year repayment, or a 5-year draw with a 25-year repayment. Investment lines use the 5-year draw and 25-year repayment structure only.
  • Eligible types include single-family, 2-4 units, PUD, townhome, and condominium. Manufactured homes, co-ops, condotels, log homes, and mixed-use are not eligible.
  • A borrower is limited to three lines and cannot own more than 15 financed properties.
  • This HELOC platform operates in 16 full-service states, which is narrower than the 41-market DSCR footprint.

Occupancy is the first thing to settle, since a quoted ceiling means nothing without it. Lendmire’s piece Best Bank Statement HELOC Program After a Quitclaim Deed covers how to pick among structures.

Deed First, Line First, or Neither?

Order matters here, and the wrong sequence can be costly.

If the property is a rental or a second home and you are self-employed, a line opened before the deed keeps the existing first mortgage intact. But the deed afterward may violate the line’s own documents, so the lender must allow the later transfer. Deeding first can restart a seasoning clock. Neither order is universally right.

A rough decision frame:

  • Deed first makes sense when the new vesting is the one you want long term and the lender looks through to the original purchase.
  • Line first makes sense when you want the equity before any title change and the lender permits a later transfer.
  • Neither makes sense when the title change would put the property in an LLC. In that case a DSCR cash-out refinance may be the cleaner path.

When a DSCR Cash-Out Is the Better Tool

If the deed already put the property in an LLC, the HELOC door is closed. DSCR financing works differently. It qualifies primarily on property-level rental income covering the payment, subject to lender guidelines, and the lender reviews the property’s coverage ratio rather than personal income.

On the network, cash-out refinances on standard rentals generally top out around 75% LTV, with about six months of seasoning a common expectation. Coverage of 1.00 is where select programs start, and stronger ratios open better leverage. Clearing 1.00 is not the same as positive cash flow, because repairs, vacancy, and management sit outside the calculation. The trade-off: a DSCR cash-out replaces the first mortgage, while a HELOC leaves it alone.

Many investors use both on different properties. The complete DSCR loans guide covers the investment-property side in full.

Why Do These Files Get Declined?

1. The deed is signed but not recorded.

2. The title holder does not match the applicant, or an owner will not sign.

3. The vesting is an LLC or an irrevocable or land trust.

4. The lender’s seasoning policy has not been met.

5. Credit, equity, or DTI falls outside the matrix, regardless of the deed.

Fallbacks depend on the cause. A vesting problem points to a re-deed or a DSCR cash-out. A seasoning problem points to waiting or to a look-through lender. A credit or equity problem needs a different fix.

Key Terms Defined

Quitclaim deed: A deed that passes whatever interest the signer holds, with no warranty of clear title.

Recorded deed: A deed filed with the county, which is what makes the title change visible to lenders.

Vesting: The legal form in which title is held, such as an individual or a revocable trust.

Seasoning: The time a lender wants to pass after a purchase or title change before it will lend.

CLTV: Combined loan-to-value, which adds all liens against the property and divides by its value.

Bank statement qualification: Documenting self-employed income from deposits rather than tax returns.

A Practical Checklist

Before recording:

  • Ask the first-mortgage servicer about transfer consent.
  • Ask the title insurer whether the owner’s policy survives the deed.
  • Get each lender’s seasoning policy in writing.

After recording:

  • Pull the recorded deed and a current title report.
  • Collect statements, a profit-and-loss statement, and property documents.
  • Confirm every titled owner will sign.

The facts above are general information, not legal or tax advice. A real estate attorney or CPA can speak to your own title and transfer questions.

Frequently Asked Questions

Can a quitclaim deed hurt my chances of a bank statement HELOC?

It can if it creates a vesting or seasoning problem. A deed to an LLC makes the property ineligible for this line. A recent deed to an individual or revocable trust is workable with lenders that count from the original purchase. Restart lenders may ask you to wait, so get the policy in writing before you record.

Does a quitclaim remove me from the first mortgage?

No. The deed moves title only. The note stays with the original borrower unless the lender releases it, the loan is assumed, or it is refinanced. A new HELOC lender will still count the existing first mortgage in your combined leverage.

Is there a legal waiting period after a quitclaim before I can borrow?

No federal rule sets one. Any waiting period is lender policy, and it varies. Some lenders look back to your original purchase date, and others count from the recording date.

Can I use an LLC-owned rental for a bank statement HELOC?

Not on this network. LLCs, corporations, and partnerships cannot hold title on these lines, so a property already in an LLC needs a vesting change or a DSCR cash-out. Lenders may differ, so confirm before you deed.

What is the highest leverage on an investment property line?

On an investment property the network ceiling is 70% CLTV, with a 700 minimum credit score and a maximum line of $500,000. Higher figures apply only to primary residences and second homes at stronger credit tiers. Each file is reviewed individually and is not a commitment to lend.
