Bank Statement HELOC Rules on One Income After a Divorce

Bank Statement HELOC Rules on One Income After a Divorce

The Quick Read: A divorced borrower is underwritten alone, so the file is reviewed on that person’s own deposits, credit, debt-to-income ratio, title and valuation, with no spouse income added. Bank statements only change how income is proven. Everything else is still reviewed, and the ex-spouse stays on the first mortgage until it is refinanced or paid off.

  • Deposits over a 12 to 24 month window replace tax returns as proof of income, and business accounts get an expense factor.
  • Support you receive counts only if documented and likely to continue. Support you pay counts as debt.
  • Investment-property lines through Lendmire’s wholesale network cap at 70% CLTV, with a 700 minimum credit score.
  • A line does not remove your ex from the first mortgage. Only a refinance, payoff or written release does that.
  • Lendmire’s HELOC availability covers 16 full-service states, narrower than its DSCR footprint.

What a bank statement HELOC is

A bank statement HELOC is a revolving second-lien line for self-employed homeowners. It reads deposits instead of tax returns. HousingWire’s non-QM guide describes these products as reviewing actual deposits over a 12 to 24 month window, with an expense factor applied to business accounts based on business type, employee count and operating structure.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Why it exists: deductions shrink taxable income. A business owner with healthy cash flow can show thin returns. Deposits show the cash that actually moved.

The catch is simple. Statements change the income proof. They do not change underwriting. Credit, debt-to-income, combined loan-to-value, title and valuation all still apply.

Key Terms Defined

CLTV: Combined loan-to-value, meaning all liens on the property divided by its value.

DTI: Debt-to-income ratio, meaning monthly debt obligations divided by qualifying monthly income.

Expense factor: A percentage of business deposits treated as operating cost and removed before income is counted.

Draw period: The stretch when you can borrow from the line, usually interest-only.

Vesting: The legal form in which title is held, such as an individual or a revocable living trust.

How does underwriting treat one income after a divorce?

Underwriting treats you as a single borrower with no household income to add. Your ex’s earnings are not a cushion, and your deposits have to carry the file by themselves. Here is how it runs.

1. You are evaluated alone. If you qualify on your own, a creditor generally cannot require your ex-spouse to sign the credit instrument, per the signature rule in 12 CFR Part 1002.

2. Deposits are collected. Expect 12 to 24 months of personal or business statements, labeled by month.

3. The deposit average is built. Eligible deposits are totaled and averaged across the lookback window. Business accounts take the expense factor. Underwriters look for consistency and may ask about large or irregular deposits.

4. Divorce items are layered in. Support received and support paid are treated differently, covered below.

5. Everything else is reviewed. Credit, DTI, CLTV, title and valuation.

On the network’s HELOC programs, DTI tops out at 50%. It drops to 45% for credit profiles from 600 to 679, and a ratio above 45% needs at least a 680 score. The line is qualified on the interest-only payment calculated on the maximum draw. That matters on one income, because the test assumes you borrow the full amount.

How lenders read your deposits when you are newly single

Clean, consistent deposits carry the file. A divorce tends to muddy them. Joint accounts get split, transfers move between your own accounts, and personal and business money sometimes mixes.

Deposit type Usually counts Usually questioned
Customer or client payments Yes Only if irregular
Transfers between your own accounts No Often flagged
Settlement or property-division funds No Yes
Support received Only if documented Needs a decree
Large one-time deposits Depends Yes, expect a letter

Cleanup steps that help:

  • Label each month’s statements and add an average-deposit worksheet.
  • Annotate any non-business transfer.
  • Separate business deposits from personal accounts before the statement window starts.
  • If a non-standard expense factor is claimed, include a CPA letter.

Deposits that dropped after separation can lower the qualifying figure. Do not assume the earlier months will rescue the average.

Support paid and support received

Support you receive counts only when it is documented and likely to continue. Support you pay is a debt obligation. Treat them as two separate lines and never net one against the other.

On the income side, CFPB Regulation B § 1002.6 says a creditor must count alimony, child support or separate maintenance to the extent it is likely to be consistently made. A creditor can evaluate each component for reliability but cannot automatically discount or exclude it. A creditor may also weigh the amount and probable continuance of income. Disclosure runs the other way too: a creditor cannot ask whether income is support unless it first says that income need not be revealed.

On the debt side, a court-ordered support obligation belongs in the DTI. That is underwriting practice, not a quoted rule, and each lender applies it its own way.

Here is the double-counting trap. Do not deposit support into the business account and let it inflate the average, then also claim it as support income. Count it once, with the decree behind it.

A one-income worked example (ratios only)

Say a borrower’s qualifying income from deposits puts their existing debts at a 38% DTI before the divorce is final. The decree then adds a support obligation. Debts rise and the ratio moves up. If the new ratio lands in the mid-40s, a borrower with a 680 or better score is still inside the 50% ceiling. A borrower at 650 is not, because that profile caps at 45%.

Same file, same deposits. A different credit tier changes the answer. This is why a broker shops the scenario across programs instead of assuming one outcome. Everything here is subject to lender guidelines and full file review.

What are the network’s HELOC limits?

Limits depend on occupancy, and only the occupancy you are actually borrowing against applies. Lendmire brokers these files through select wholesale partners. It is not the lender.

Occupancy Credit floor Ceiling Max line
Primary residence 600 90% CLTV, only at 720+ $500,000 at 90% CLTV; $750,000 at 75% CLTV, 700+ (720 on the longer-runway program)
Second home 640 90% CLTV, only at 720+ $500,000
Investment property 700 70% CLTV $500,000

For a primary residence, the 90% tier is limited to lines up to $500,000. A 700 profile reaches 85% on lines up to $500,000. A line above $500,000 is primary-residence only, needs a 700 or better score (720 on the longer-runway structure), caps at 75% CLTV and requires a full appraisal.

Structure: the line sits in first or second lien position. Primary and second-home files offer a 3-year interest-only draw with 17-year repayment, or a 5-year draw with 25-year repayment. Investment lines use the 5-year draw and 25-year repayment only. At least 75% of the line is drawn at closing, and pricing floats rather than converting to fixed. Lines at or below $500,000 usually use an automated valuation, though a higher CLTV may require a secondary one.

Divorce gates that sit outside income

Income is only one gate. Four others can stop a file even when the deposits are strong.

Signatures. If you qualify alone, your ex generally does not sign the note. For secured credit, though, a creditor may require signatures on instruments needed to reach the collateral, as NAFCU’s Regulation B explainer lays out. The spouse may be asked to sign only the mortgage, not the note. In community property states, a spouse’s signature can be required if you rely on that spouse’s separate income.

Court orders. A pending case, or state automatic orders, can restrict new liens. Check with a family-law attorney before applying.

Title. A quitclaim changes title, not the debt. Your ex remains obligated on the first mortgage until a refinance, payoff or assumption with a written release. The decree binds you and your ex. It does not bind the lender.

Existing joint line. Under Regulation B, a creditor may require reapplication on an open-end account after a marital-status change when the credit leaned on the spouse’s income. Practitioners generally contain or close a joint line before opening a new one.

Situation Who stays liable
Joint first mortgage, quitclaim signed Both, until refinance or release
Joint HELOC, decree assigns it to you Both, until paid off or modified
Your own line, ex never signed You alone
Transfer to spouse under a decree Due-on-sale protected, but both remain obligated

Sequencing: before, during and after

Stage What is possible Main risk
Before filing Clean deposits, split accounts, check credit Joint debt stays joint
During the case Gather documents Court orders may block new liens
After the decree Apply on your own income Title and old-loan liability still open

After the decree, work this checklist in order:

1. Record the deed and confirm vesting. 2. Get payoff statements on every joint debt. 3. Close or refinance joint lines. 4. Assemble 12 to 24 months of labeled statements. 5. Apply alone.

Where the general rule breaks

Pending divorce. With no decree there is no support order to document. You qualify on your own income only.

LLC-held rentals. This is the sharpest edge for investors. The network’s HELOC programs require title held by an individual or an inter vivos revocable living trust. LLCs, corporations, partnerships and irrevocable, blind or land trusts cannot hold title. A rental already deeded to an LLC needs a vesting change, or it belongs in a different product.

Rent does not qualify the file. A bank statement HELOC counts your deposits, DTI and credit. A rental’s income does not carry it by itself.

Property types. Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use and agricultural zoning are not eligible. Non-warrantable condos are.

Past credit events. A bankruptcy needs 4 years of seasoning from discharge or dismissal. Foreclosure history splits by program on primary and second homes: one seasons a foreclosure in 7 years and a deed-in-lieu or short sale in 4, while the other declines the history entirely.

Exposure. A borrower is limited to three lines, and anyone with more than 15 financed properties is not eligible.

Is a HELOC the right tool?

Sometimes a different structure fits better. The decision turns on whether the decree requires releasing your ex from the first note, and whether your own income is strong enough.

Tool Fits when Wrong tool when
Bank statement HELOC Own deposits are strong, first mortgage can stay Decree requires releasing your ex
First-lien refinance Ex must come off the note Existing first loan is worth keeping
DSCR cash-out refinance Property rent is strong, own income is weak Property is your primary residence

For rentals, a property-level path may fit better. Lendmire’s complete DSCR loans guide explains how rental coverage is measured. On DSCR files, cash-out refinances top out around 75% LTV across most of the network, and 1.00 coverage is where select programs start. These specifics are subject to lender guidelines and a full review of property, leverage, and credit.

Stress-test the one-income budget

A HELOC is variable. Pricing floats through both the draw and repayment periods. The qualifying test assumes a full draw on interest-only terms, but real life on one income is tighter. Test three things before you sign:

  • What happens when the draw ends and repayment begins to amortize.
  • Whether a thin cushion survives a freeze or a drop in business deposits.
  • Whether you need the whole line, since at least 75% is drawn at closing.

Never size the line to the maximum just because the file allows it.

Frequently Asked Questions

Can I get a bank statement HELOC while the divorce is pending?

Often yes, if you qualify alone, but a pending case may carry court or state restrictions on new liens. Without a decree there is no support order to document, so only your own income counts. Talk to a family-law attorney first.

Does a HELOC take my ex off the mortgage?

No. A HELOC leaves the first mortgage untouched. Only a refinance, a payoff, or an assumption with a written release removes your ex from that loan.

Does the decree remove me from a joint line?

No. A decree binds you and your ex-spouse, not the lender’s contract. Both of you remain liable until the line is paid off, refinanced or modified.

Can I count alimony or child support?

Yes, if it is documented and likely to continue. A creditor cannot automatically exclude it, and you cannot be forced to disclose it. Support you pay is treated as debt in the DTI.

What if I do not qualify alone?

Look at a first-lien refinance, or for a rental, a property-level DSCR cash-out refinance. Lendmire works with a network of wholesale lenders and matches the scenario to the program. Qualification is subject to lender guidelines and full file review. This is not a commitment to lend.

If you are considering a home equity line and want to see how the numbers work, Lendmire can help you compare HELOC options based on the property, the equity available, credit profile, combined leverage, and your goals. Call 828-256-2183 or request a quote.
