How Much Can You Borrow on a Bank Statement HELOC for a Divorce Buyout After the Decree?

How Much Can You Borrow on a Bank Statement HELOC for a Divorce Buyout After the Decree?

The Quick Read: It depends on four limits, and you can borrow only the smallest of them: the buyout figure in the decree, the property’s combined-leverage ceiling minus the existing first mortgage, the program’s maximum line size, and what the keeping spouse’s documented income and debts support. Bank statements change how your income is proven. They do not raise the leverage ceiling.

  • On an investment property, the network ceiling is 70% combined loan-to-value (CLTV), with a 700 minimum credit score and a $500,000 maximum line.
  • On a second home, the ceiling reaches 90% CLTV only at a 720-or-better credit profile, up to $500,000.
  • On a primary residence, 90% CLTV also requires 720 or better and applies to lines up to $500,000. A larger line, up to $750,000, is available on primary residences only and caps at 75% CLTV.
  • The decree sets what you owe your ex. The lender’s ceiling sets what you can borrow against the property.
  • A line leaves your ex on the original mortgage unless that loan is paid off, so check what the decree actually requires.

All figures are subject to lender guidelines and full file review, and none is a commitment to lend. Lendmire is a mortgage broker that places these lines through select wholesale lenders. Its home equity line programs cover only 16 full-service states, which is narrower than its 41-market DSCR footprint.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

How Is the Maximum Line Calculated?

The line is capped by a simple formula: the CLTV ceiling times the property value, minus the first-mortgage balance. The buyout is a separate number: appraised value minus all liens, times the departing spouse’s share. If the line formula produces a number at or above the buyout, the plan fits. If not, it doesn’t.

Here is a worked example using percentages of value, so you can swap in your own numbers. These are modeled assumptions, not market data.

  • The first mortgage equals 40% of the home’s value.
  • Equity is therefore 60% of value.
  • Your ex’s share is 50%, so the buyout is 30% of value.
  • A 70% CLTV ceiling allows total debt of 70% of value. Subtract the 40% first mortgage and the line can reach 30% of value.

That fits exactly, with zero cushion. A low appraisal, a first mortgage at 45% of value, or a ceiling under 70% means the buyout can’t be funded this way. If your settlement ties the price to an appraisal, run the same math before you sign, because a low lender valuation shrinks the line, and the price may shrink with it only if the settlement says so.

CLTV counts every lien plus the full line commitment, not just what you have drawn. That means the full line size is what the ceiling is tested against, however much of it you expect to use. On Lendmire’s network, at least 75% of the line is drawn at closing, so plan on carrying most of the balance from day one.

What Are the Network Limits by Occupancy?

Ceilings on this network depend on how the property is used, and they are not interchangeable. Use the row that matches the property you’re keeping.

Occupancy Max CLTV Credit Max line
Investment property 70% 700+ $500,000
Second home 90% (720+ only) 640 minimum $500,000
Primary residence 90% (720+ only) 600 minimum $500,000
Primary residence, larger line 75% 700+ (720 on the longer-runway structure) $750,000

Lower credit tiers on second homes and primary residences get lower ceilings. A second home at 660 tops out at 80% CLTV, for example.

Lenders in the wider market may advertise different limits on rental-property lines, and those figures do not apply here. On this network, an investment property tops out at 70% CLTV. That ceiling is fixed whatever the credit score or the size of the buyout.

Line terms matter too. Investment lines run a 5-year interest-only draw followed by a 25-year repayment period. Pricing floats during both periods and never converts to fixed. Qualifying debt-to-income is calculated on the interest-only payment at the maximum draw, with a 50% ceiling, so a large line can fail on the debt ratio even when the equity is there.

Lines at or below $500,000 ordinarily run an automated valuation with no traditional appraisal, though a higher CLTV may require a secondary valuation. A full appraisal is required on anything above $500,000, and you may request one in any case.

How Do Bank Statements Prove Your Income After a Divorce?

Bank statements let a self-employed or deposit-income spouse qualify on documented income under the applicable program, subject to lender guidelines. It is not a no-documents loan. The lender averages roughly a year of eligible deposits, removes anything that isn’t income, and applies an expense factor where business statements are used. Each lender sets its own window and its own factor, so any single percentage you see online is illustrative.

Divorce adds a cleaning problem. Your statements should show only your income after the split, so a few habits help:

  • Move your deposits into accounts that are solely yours before the statement window starts.
  • Expect transfers from your ex to be stripped out.
  • Expect support payments to be treated under the program’s own rules, not as business revenue.
  • Keep personal and business accounts apart, since the two are treated differently.

Credit matters separately. The network runs a single-bureau score model keyed to the primary wage earner, and the report can be no more than 90 days old at closing. A joint account in collections or a missed payment during the separation can pull a score below a tier cutoff, and the cutoff sets both the ceiling and eligibility.

Does the Property Type or Title Change the Answer?

Yes, and title is where rental owners get caught. The network’s lines require title held by the individual borrower or a revocable living trust. A property held in an LLC, corporation, partnership or land trust is not eligible. Moving a mortgaged rental into an LLC to get around this can also trigger the first lender’s due-on-sale clause, because the federal protection for transfers does not cover mortgaged property moved into an LLC. If your rental sits in an LLC, a DSCR cash-out refinance, subject to program terms, is usually the cleaner route.

Property type matters as well. Single-family homes, 2-4 unit properties, townhomes, PUDs and condos (including non-warrantable condos) are eligible. Manufactured homes, co-ops, condotels, log homes and commercial or mixed-use properties are not offered.

One BiggerPockets thread shows an investor told that a lender would do a HELOC on a primary home only. A broker shops several wholesale lenders, so the first no from one institution doesn’t end the search.

What Does the Decree Actually Require?

Read the decree before you shop. Some decrees fix a dollar figure, some require a refinance by a date, and some do both. The order of operations after the decree usually runs like this:

1. Confirm the buyout figure or formula, and whether it is tied to an appraisal.

2. Have your ex sign a deed (often a quitclaim deed) transferring their interest to you. A deed changes ownership only. It does not release your ex from the loan.

3. Size the line using the formula above, including your first-mortgage balance and any other liens.

4. Document your income and debts on your own.

5. Close, and let the title company pay off liens and distribute funds as the decree directs.

If the decree requires a refinance, a line may not satisfy it. A line sits beside the first mortgage and leaves your ex on that note. A cash-out refinance replaces the note. Keeping a low first mortgage is the main reason to choose a line over a refinance. Preserving that first mortgage is a financial decision, though, not a compliance one.

A joint line already on the property is a separate problem. If both spouses signed, both remain responsible until it is paid off or released, regardless of what the decree says. Your ex’s name stays on any open joint account until the lender removes it.

One more point on transfers. Nolo explains that federal law generally stops lenders from enforcing a due-on-sale clause when property moves between spouses under a divorce decree or settlement. FedLaws notes that this protection covers only residential property with fewer than five units. Some secondary sources also tie it to the protected spouse living in the home, which is a real question for a non-occupying rental owner. Ask your attorney.

What If the Buyout Is Bigger Than the Line?

When the buyout exceeds line capacity, you have a few options, and they combine:

  • Renegotiate the structure. Part cash now and the rest over time, or a different property split, can bring the number under the cap.
  • Add cash. Savings or a sale of another asset covers the gap between line capacity and the buyout.
  • Use a cash-out refinance instead. On a standard rental, DSCR cash-out refinances top out around 75% LTV across most of the network, with about 6 months of seasoning as the common expectation. That is a different product with different qualification, so read how it works in Lendmire’s complete DSCR loans guide.
  • Sell and divide the proceeds. This is not what you wanted, but sometimes the numbers leave no other workable answer. Final terms depend on lender guidelines, property type, leverage, and the borrower’s complete credit picture.

DSCR loans are designed for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage. A DSCR cash-out qualifies primarily on property-level rental income covering the payment, subject to lender guidelines, so your personal income matters less. Coverage of 1.00 is where many select programs start, and a separate select-lender path takes coverage below 1.00 with leverage and terms adjusted. A buyout cash-out enlarges the loan balance, so the coverage ratio falls compared with the old note.

Clearing 1.00 does not mean the rental produces positive cash flow. The calculation compares rent to the full monthly housing obligation only. Repairs, vacancy, management and utilities sit outside it.

Does a Federal Rule Make Bank Statements a Right?

No. The federal ability-to-repay rule, Regulation Z section 1026.43, excludes home equity lines from its coverage but includes a rule against structuring a loan as an open-end line just to evade it. Bank statements are a lender’s and program’s choice of income documentation, not an entitlement. Bank statement documentation exists on these lines because a program offers it.

Talk to your attorney about the decree, the deed and any due-on-sale question. Tax treatment can depend on how the funds are used and how the property is held; borrowers should keep clear records and speak with a qualified tax professional before relying on any deduction.

Key Terms Defined

CLTV (combined loan-to-value): Every loan secured by the property, plus the new line’s full commitment, divided by the property’s value.

Draw period: The stretch when you can borrow from the line and pay interest only, before the repayment period begins.

Release of liability: A lender’s written release removing a person from a loan. A divorce decree alone does not do this.

Bank statement documentation: Income proven by averaging eligible deposits over a period of months instead of using tax returns or pay stubs.

Quitclaim deed: A deed transferring one person’s ownership interest to another, with no promise about the title.

Frequently Asked Questions

Can a bank statement HELOC fund a spouse buyout at all?

Yes, when the property and borrower qualify and the decree allows it. The line pays the ex-spouse their share, and the lender sizes it on CLTV, credit and your documented income. On an investment property, the ceiling is 70% CLTV, with a 700 minimum credit score.

Does the line remove my ex from the mortgage?

No. The line is a separate loan, and your ex stays on the first mortgage unless that loan is paid off or the lender grants a release. If the decree requires removal, you may need a cash-out refinance instead.

Can I qualify on my own after the split?

Possibly, if your own documented income and credit support the line. The lender looks at your deposits, your debts and your score, with a debt-to-income maximum of 50% and 45% for scores from 600 to 679. A score under the tier cutoff lowers the ceiling.

What if my rental is held in an LLC?

These lines require title in your name or in a revocable living trust, so an LLC-held rental is not eligible. Moving title can trigger the first lender’s due-on-sale clause. A DSCR cash-out refinance is usually the better fit, subject to program eligibility.

Can I get pre-approved before the settlement is signed?

You can usually review the numbers before signing, which is smart, because the buyout figure and the line ceiling need to match. Final approval depends on the executed decree, the valuation and a full file review.
