Bank Statement HELOC vs Bank Statement Cash-Out Refinance Before Probate Ends

Bank Statement HELOC vs Bank Statement Cash-Out Refinance Before Probate Ends

The Quick Read: Neither product normally closes while probate is open, because the estate still owns the house and a lien needs someone with recorded title and authority to sign it. Bank statement income only decides how much a self-employed borrower can qualify for. It does not fix a title problem. Once the deed records, the choice comes down to loan size, how the property is vested, and whether the borrower wants a second lien or a new first lien.

  • A will names who should inherit. Court letters give authority to act. A recorded deed moves title.
  • A bank statement HELOC suits a smaller, flexible need on a property held by an individual or a revocable trust.
  • A cash-out refinance suits a larger lump sum, a single new first lien, or a property that will sit in an LLC.
  • Both use bank deposits to document self-employed income, and both still need enough equity.

The Honest Answer on Who Each Option Is For

The HELOC is for the heir who keeps the existing first mortgage in place, wants a revolving line, and needs a modest amount. The cash-out refinance is for the heir who needs a bigger lump sum, wants one lien instead of two, or plans to hold the rental in an entity. It also works as a way to fund a sibling buyout under a written agreement.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Side-by-Side

The HELOC column reflects the parameters Lendmire’s wholesale network applies to its standalone equity line, which can sit in first or second lien position. The cash-out column shows published industry norms for bank statement cash-out refinances, which vary by lender. Every figure is subject to lender guidelines and full file review.

Factor Bank Statement HELOC Bank Statement Cash-Out
Review basis Borrower credit, deposits, DTI Same method, new first lien
Lien position First or second lien; an existing first mortgage can stay in place Replaces the first mortgage
Property types 1-4 unit, PUD, townhome, condo Varies by lender
Entity vesting Individual or revocable trust only LLC possible in some programs
Funds Draw structure over time One lump sum at closing
Reserves Set by the lender per file Often several months of PITIA

What Open Probate Does to Both Products

Open probate blocks both loans for the same reason. The person signing must own the property or hold clear authority over it, and the title company must be willing to insure the new lien. Bank statement underwriting changes how income is counted. It has no effect on who owns the house.

The California Judicial Council’s Letters form (DE-150) shows how this works. It separates full authority from limited authority. A representative with limited authority cannot sell real property or borrow against it by encumbrance without court supervision. The Contra Costa Superior Court probate forms packet repeats that language and adds that a representative cannot take possession of property without a specific court order. California is one example only. Other states use different forms and names, but the idea of scoped authority carries across.

Letters alone do not guarantee the power to place a lien. The scope of authority printed on them matters.

Key Terms Defined

Letters: The court document that appoints a personal representative and shows what that person may do for the estate.

Recorded deed: The filed instrument, such as an executor’s deed or court order, that moves title to the heir.

CLTV: Combined loan-to-value, which adds every lien on the property and divides by its value.

Bank statement income: A self-employed method that averages deposits over a lookback window and applies an expense factor, instead of relying on tax-return income.

How Bank Statement Underwriting Treats a Self-Employed Heir

Bank statement files take deposits from complete, consecutive statements and remove non-income credits such as transfers. An expense factor is usually applied to business-account deposits, adjusted for ownership share. The result is a monthly income figure that feeds a debt-to-income test.

Inheritance adds one wrinkle. Estate distributions or inherited cash that land in a business account can look like revenue. Keep inherited funds in a separate personal account, and be ready to explain any large deposit.

For the HELOC through Lendmire’s network, DTI tops out at 50%. It drops to 45% for credit profiles from 600 to 679, and a ratio above 45% requires at least a 680 score. These DTI tiers sit on top of the credit minimum for the occupancy in question, which is 600 on primary residences, 640 on second homes and 700 on investment properties. The line is qualified on the interest-only payment calculated at the maximum draw, which is a stricter test than the payment on what the borrower actually draws.

When the Bank Statement HELOC Is the Better Fit

The HELOC fits an heir who already has a first mortgage worth keeping, needs a moderate amount, and holds title personally or in a revocable living trust. Leverage depends on how the property is used, so occupancy matters:

  • Investment property: the ceiling is 70% CLTV, with a 700 minimum credit score and a maximum line of $500,000.
  • Primary residence: the ceiling reaches 90% CLTV, but only with a credit profile of 720 or better. Other tiers sit lower.
  • Second home: the ceiling also reaches 90% CLTV, again only at 720 or better.

On an investment line the structure is a 5-year interest-only draw followed by a 25-year fully amortizing repayment. At least 75% of the line is drawn at closing. Lines of $500,000 or less ordinarily use an automated valuation instead of a traditional appraisal, though a higher CLTV can trigger a secondary valuation.

The HELOC also has hard limits that matter for inherited property:

  • Vesting: only an individual or a revocable living trust can hold title. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot.
  • Property types: manufactured homes, co-ops, condotels, log homes, commercial, mixed-use, and agricultural zoning are not eligible.
  • Availability: the line is offered only in Lendmire’s 16 full-service states, which is narrower than the 41-market DSCR footprint.
  • Lien position: the line can sit in first or second position.

Picture an heir who inherits a paid-off duplex, holds it in a revocable trust, and wants a modest cash reserve for repairs. The HELOC keeps things simple and flexible. If the heir later moves the duplex into an LLC, though, the line stops fitting.

When the Bank Statement Cash-Out Refinance Is the Better Fit

The cash-out is the stronger choice when the need is large, when the property will live in an LLC, or when a sibling buyout requires one lump sum. On a paid-off inherited home, the refinance is generally treated as cash-out. It creates one new first lien. A buyout of co-heirs can be paid from the proceeds if written releases or a buyout agreement are in place first.

Entity vesting is where the products split most sharply. Cash-out refinances can generally vest in an LLC, subject to lender program eligibility. If the heir wants the rental in an entity from day one, a cash-out at the point of vesting avoids a detour through personal title. A property already deeded to an LLC cannot take the HELOC at all without a vesting change.

Many investors in that spot compare a bank statement cash-out against a DSCR cash-out. The DSCR route qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. Across Lendmire’s wholesale network, DSCR cash-outs top out around 75% LTV on standard rentals, with about 6 months of seasoning as the common expectation. Most programs want a score near 660. Some start as low as 620, and 700 or better unlocks the strongest leverage tiers. Select programs start at a 1.00 DSCR, and a separate select-lender path takes coverage below 1.00 with leverage and terms adjusted. Reserves commonly run around 6 months of PITIA, though they vary by lender, leverage, loan size, and transaction type.

DSCR compares rent to PITIA only. Clearing 1.00 is not the same as positive cash flow, because repairs, vacancy, management, and capex sit outside the calculation. A cash-out refinance raises the loan balance, which lowers coverage, so a larger draw can push a file below its target ratio. For the full picture, see the complete DSCR loans guide.

DSCR programs through the network do not extend to manufactured homes, log homes, or barndominiums. Those property types are not offered.

Edge Cases That Change the Answer

Letters issued, probate still open. The scope of authority matters more than the existence of letters. A representative with limited authority cannot borrow against real property without court supervision. An estate-level or probate loan is a different product. It is typically short-term, privately funded, and may need court authorization.

Trust, transfer-on-death deed, or survivorship. Authority may exist earlier on these paths because the property may skip probate. A title insurer must still sign off.

Decedent held the property in an LLC. The LLC’s title does not change at death. The lender needs documented authority over the LLC, such as the operating agreement, any court letters covering the membership interest, and a signing resolution.

Multiple heirs. Lenders generally want written releases, quitclaims, or a buyout agreement before lending. Without them, neither product works.

Seasoning. Agency programs have an inheritance exception for the on-title period. DSCR and non-QM lenders set their own overlays, so the exception should not be assumed.

What an Heir Can Prepare During Probate

The file is ready sooner when the paperwork is gathered in advance. A typical checklist includes:

  • Death certificate and certified court letters
  • Will or heirship evidence and the existing deed
  • Payoff letters for any existing mortgage
  • Written releases or a buyout agreement if there are co-heirs
  • Complete, consecutive bank statements for every account used for income
  • A business narrative or proof of self-employment history, plus support for any non-default expense factor, such as a CPA letter

A Balanced Verdict

Probate status decides when either loan can start. Vesting decides which product can be used. Loan size and lien preference decide which one is the better value.

Choose the HELOC if the property will sit in an individual’s name or a revocable trust, the existing first mortgage is worth keeping, and the amount needed is modest. Choose the cash-out if the amount is large, an LLC will hold title, or a buyout needs a single lump sum. Neither choice rescues a file that lacks clean title.

Frequently Asked Questions

Can an executor borrow against an inherited rental while probate is open?

Normally not. Where the court has authorized the loan and the title company will insure it, a file may proceed. That is the exception, and the title company should be consulted first.

Does bank statement income fix a title problem?

No. Bank statement underwriting replaces tax-return income documentation. A self-employed heir with a clean title path and strong deposits can qualify, while an heir with perfect deposits and an open estate cannot.

Can an LLC hold the property for the HELOC?

No. The HELOC through Lendmire’s network requires title in an individual or a revocable living trust. A property already in an LLC needs a vesting change first, or a DSCR cash-out instead.

Is a DSCR cash-out a better route than a bank statement cash-out for an inherited rental?

It depends on the heir’s income picture. DSCR qualifies primarily on rental income covering the payment, subject to lender guidelines, so it suits heirs whose personal income is hard to document. A bank statement cash-out suits heirs with strong, well-documented deposits who want the file judged on the borrower.

Should an heir take an estate loan to bridge the gap?

Only with care. Estate loans are short-term private products and may need court authorization. They add a second set of costs and a refinance step later, so the plan should include a clear path to the permanent loan.
