How Much Can You Borrow on a Bank Statement HELOC While a Divorce Is Pending?

How Much Can You Borrow on a Bank Statement HELOC While a Divorce Is Pending?

The Quick Read: Usually the amount is set by your equity, your documented income, and the program’s combined-loan-to-value ceiling, but only when no restraining order or ownership problem blocks the draw, and if one does, the practical answer is zero until your spouse consents in writing or the court permits the loan. Combined loan-to-value (CLTV) adds every lien on the property, including the new line, and divides by the property’s value. On the wholesale network Lendmire works with, that ceiling is 70% CLTV on an investment property, and the maximum line there is $500,000.

  • The court case decides whether you can borrow at all. The bank statement paperwork only decides how your income is documented.
  • Existing mortgages and any joint lines count against the ceiling before a dollar of new line is available.
  • A written consent or a court order is the document a lender wants in the file.
  • Lendmire arranges these lines as a broker through select wholesale partners and is not the lender. Every figure is subject to lender guidelines and full file review.

Two Gates: The Court First, the Lender Second

Short answer: you must pass both tests, and the court’s test comes first. No regulator or trade body publishes a rule for this exact situation. The answer comes from two separate layers: family-court orders that restrict what spouses can do with marital property, and the lender’s own program guidelines.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Many states put an automatic restraining order in place when a divorce is filed. Not every state does, and the terms differ by jurisdiction. Montana’s automatic order, for example, bars putting a lien or mortgage on marital property without the other party’s written consent or court permission. Massachusetts goes further. Under its Rule 411, the order names borrowing against a credit line secured by real estate, lets the parties agree to waive the restriction or ask the court for permission, and ends when judgment enters. Treat both as examples, not a national rule.

The usual exceptions are written consent from the other spouse, a court order, or ordinary-course expenses such as living costs and attorney fees. A new equity line for a rental purchase or a rehab rarely fits the ordinary-course category.

The lender’s test is separate. Passing the lender’s math does not override a court restriction, and the reverse is also true.

What Sets the Dollar Amount?

Available line equals property value times the CLTV ceiling, minus every lien already recorded, capped by the program’s maximum line. After that, your income limits the line through the debt-to-income (DTI) ratio, which compares your monthly debts to your documented monthly income.

The ceiling depends on how the property is occupied. These are the network’s parameters, and each is subject to lender guidelines:

Occupancy Max CLTV Max line Minimum credit
Investment property 70% $500,000 700
Second home Up to 90% (720+) $500,000 640
Primary residence Up to 90% (720+) $500,000 at 90% CLTV; $750,000 at 75% CLTV, 700+ (720 on the longer-runway program) 600

On a primary residence, the 90% tier applies to lines up to $500,000. Lines above $500,000 are primary-residence only, top out at 75% CLTV, and require a full appraisal. Lower credit tiers carry lower ceilings, so the figures above are the top of each range, not a typical result.

Here is the math in percentages. Say a rental has a first mortgage equal to 50% of its value. At the 70% investment ceiling, the new line can take the combined total up to 70%, which leaves room equal to about 20% of the property’s value. If a joint line from the marriage is also recorded, that line counts too, and the room shrinks. The $500,000 cap applies after that calculation, not before.

Income then limits the result. The network’s maximum DTI is 50%, and it drops to 45% for credit profiles from 600 to 679. The lender reviews your file on the interest-only payment calculated on the maximum draw, not on the amount you plan to use. A big line can therefore fail on income even when the equity is there.

Joint debt still assigned to you counts against you until it is closed or refinanced. Support you pay can also count as debt, while support you receive is treated according to the program’s rules and the order in place.

Lines at or below $500,000 ordinarily run an automated valuation with no traditional appraisal. A higher CLTV may require a secondary valuation, and you can request a full appraisal in any case. At least 75% of the line is drawn at closing, so the draw lands at the exact moment a court order cares about.

How Bank Statement Income Gets Reviewed in a Divorce

A bank statement HELOC is reviewed around documented income under the applicable program, subject to lender guidelines. The lender reads your deposit history instead of relying only on tax returns. It is a documentation method, not a shortcut around approval.

Self-employed borrowers typically supply personal or business statements over an extended period. For business accounts, the lender applies an expense factor to the deposits, or accepts a profit-and-loss statement from a third-party tax professional. Each program sets its own factor, so a figure you read elsewhere is an illustration, not a rule. Trade press describing non-QM bank statement underwriting shows how widely the approach varies.

Divorce makes deposit review messier. Expect the lender to strip out these items:

  • Transfers between accounts.
  • Loan proceeds and refunds.
  • One-time deposits.
  • Deposits funded by your spouse.

If statements come from a joint account, the lender wants to see which deposits are yours. The spouse who keeps the property is reviewed on their own deposit history. Clean, separate accounts documented well before you apply make the file easier to read.

Do Both Spouses Have to Sign?

Often the non-borrowing spouse still signs the lien, even though they do not sign the note. The rule is in Regulation B, which says a creditor generally cannot require a non-applicant spouse’s signature on a credit instrument when the applicant qualifies alone. The exception covers secured credit. The lender may require signatures on any instrument that state law says is needed to make the collateral available on default. The FDIC’s compliance manual restates the same secured-credit rule.

In practice, if both spouses are on the deed, both sign the lien. You may be the only borrower, but the lender cannot take a valid lien without the co-owner. That is why the court-consent question and the signature question usually arrive together.

Title, LLCs and the Existing Joint Line

Title must be held by you as an individual or by a revocable living trust. Property held in an LLC cannot take this HELOC, and neither can corporations, partnerships, or land trusts. If your rental sits in an LLC, the options are changing the vesting first or using a DSCR cash-out refinance instead.

An existing joint HELOC needs attention first. A decree binds the spouses, not the lender, so a lender is not bound by a divorce decree and the line stays joint until it is paid off, closed, or refinanced. Freezing the joint line limits further draws, and it keeps the combined total from growing while you negotiate.

Separate-property rentals deserve a second look. A rental owned before the marriage may be separate property, but marital funds or appreciation during the marriage can blur that line. A rental bought during the marriage usually counts as marital. Your attorney should classify the property before a lender sees it.

Where Each Stage of the Case Leaves You

Stage What is usually possible Main risk
Before filing Open a line on sole-titled property Looks like a pre-divorce asset move
Pending, order in effect Only with written consent or court order Contempt, unequal award
Settled, decree entered Retaining spouse reviewed alone Joint debt still counts
After decree Buyout line within combined limits Support counted as debt

Timing before filing deserves care. Courts scrutinize what spouses did with marital assets shortly before filing, so talk to counsel before opening a line in your own name. A violation of an automatic order can carry contempt and an unequal asset award.

After the decree, a HELOC against a retained rental can fund the departing spouse’s equity share, as long as the combined total stays under the ceiling. That works only when the buyout number is settled, because lenders size the line against a fixed amount, not a negotiation.

What the Consent Document Should Say

The lender will want a document in the file. It typically needs to:

  • Name the property and the line.
  • State the maximum amount of the line.
  • Be signed by both spouses, or be a court order.
  • Be dated within the case.

Your attorney drafts it, and the lender reviews it.

The DSCR Alternative on a Rental

A rental can sometimes be funded through a DSCR cash-out refinance instead. A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines, so your personal income matters less. On standard rentals, cash-out tops out around 75% LTV across most of the network, and about six months of seasoning is the common expectation. A DSCR of 1.00 is where select programs start, and a separate select-lender path goes below 1.00 with leverage and terms adjusted. The complete DSCR loans guide walks through the mechanics.

Three cautions apply. The court case still blocks the loan if an order restricts it, because the new lien still needs clean title and any required consents. A cash-out replaces the existing first mortgage rather than sitting behind it. Clearing 1.00 is also not the same as positive cash flow, since repairs, vacancy, management, and utilities sit outside the calculation. A rental in an LLC may be eligible on a DSCR cash-out, subject to lender program eligibility.

Key Terms Defined

Automatic restraining order: a court order, in many states, that takes effect when a divorce is filed and limits how spouses can borrow against or transfer marital property.

CLTV (combined loan-to-value): all loans secured by the property, including the new line, divided by the property’s value.

Expense factor: the share of business deposits a lender treats as operating costs when it estimates the income you can actually use.

Lien: the lender’s recorded claim on the property, which is why co-owners usually sign it.

Vesting: how title is held, such as an individual, a revocable living trust, or an LLC.

Frequently Asked Questions

Can I get a bank statement HELOC while my divorce is pending?

Often it is blocked, but not always. Written consent from your spouse or a court order can permit it, and some jurisdictions have no automatic order at all. Even with no order, a lender may require both owners to sign the lien. Your attorney should read your jurisdiction’s rules before you apply.

Does my spouse have to sign if only I am the borrower?

Usually your spouse does not have to sign the note if you qualify alone. If your spouse is on the deed, though, the lender generally needs that signature on the lien. Both points rest on the same federal credit rule, which separates the promise to repay from the pledge of the property.

Does the divorce decree release my ex from a joint HELOC?

No, not as far as the lender is concerned. The decree binds the two of you, so the line stays joint until it is paid off, closed, or refinanced. A freeze limits new draws in the meantime, and your attorney can build the payoff into the settlement.

Can a HELOC fund a buyout of my spouse’s share?

Yes, in many cases, once the buyout figure is settled. The line must fit under the CLTV ceiling after existing liens, and your income must cover the qualifying payment on the maximum draw. If the property is a rental, the line is eligible only when title is held individually or in a revocable trust.

What if my rental is in an LLC?

The network’s HELOC cannot go on LLC-held property. You can change vesting first, which your attorney and the lender should both review, or look at a DSCR cash-out refinance, subject to program terms.
