The Quick Read: The bank statement cash-out refinance is the tool that replaces the joint mortgage and can release your ex from it, while the bank statement HELOC (home equity line of credit) only adds a second loan on top of the first and leaves your ex on the original note.
- A HELOC pays your ex out of equity but removes no one from the first mortgage.
- A cash-out refinance pays off the old first loan, pays the buyout, and puts one loan in your name alone.
- Both let you qualify on your own deposit history instead of tax returns, subject to lender guidelines.
- The size of the buyout matters, because equity lines on the network are capped by combined loan-to-value (CLTV).
- Property titled in an LLC cannot take the HELOC, so a vesting change is needed first.
The Honest Answer First
If your decree says you must refinance, or your ex is still on the first mortgage and wants off, choose the cash-out refinance. If your ex is already off the first loan, or the decree lets the first mortgage stay, the HELOC can be the simpler addition. It leaves your existing first loan alone and adds a second lien.
How large a line the equity supports.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
CLTV means combined loan-to-value: the first mortgage plus the new line, divided by the property’s value. A bank statement loan means the lender reads your income from a window of personal or business deposits rather than from tax returns. Qualification stays subject to lender guidelines either way.
Lendmire is a mortgage broker. It places these files through select wholesale lenders in its network and is never the lender itself. The decision turns on who is on the first note, how big the buyout is, and how the property is titled.
Side-by-Side
The HELOC column reflects Lendmire’s network parameters. The cash-out column shows published industry norms, which vary by lender and program.
| Factor | Bank Statement HELOC | Bank Statement Cash-Out |
|---|---|---|
| Lien position | New line behind the existing first | Replaces the first mortgage |
| Ex-spouse on first note | Stays liable | Can be released |
| Property types | 1-4 units, PUD, townhome, condo | Varies; often 1-4 units, condo |
| Entity vesting | Individual or revocable trust only | Often LLC-eligible; varies |
| Valuation | Automated at or under $500,000 line | Full appraisal typical |
| Structure | Interest-only draw, then amortizing | One fixed-structure loan |
| Fit | Ex already off the first note | Decree requires a refinance |
Two points deserve a closer look. On an investment property, the HELOC ceiling in the network is 70% CLTV, with a 700 minimum credit profile and a maximum line of $500,000. On a primary residence, the ceiling reaches 90% CLTV only at a 720-or-better profile, and only for lines up to $500,000. Primary-residence lines above $500,000, up to $750,000, cap at 75% CLTV.
Why a Deed or Decree Doesn’t Fix the Loan
A divorce decree changes who owns the property. It does not change who owes the lender. SmartAsset’s divorce buyout explainer makes the point that a quitclaim deed moves title, while a refinance is what removes a spouse from the loan.
Lenders were not parties to your divorce. Both names stay on the note until the loan is refinanced, assumed with a release, or paid off. If your ex stays on the first mortgage and you stop paying, your ex’s credit takes the hit.
A cash-out refinance and a HELOC treat the first mortgage in opposite ways: the refinance retires it, while the HELOC leaves it in place. That structural difference drives almost every decision below.
When the Bank Statement HELOC Is the Better Fit
The HELOC fits when the first mortgage should stay exactly where it is. The first loan may be small, or it may have been originated long ago. Your ex may already be off that note, or the decree may not demand a refinance. Putting a second lien on top avoids replacing the first.
It also suits a buyout that is modest compared with the equity. Picture a home whose first mortgage equals 30% of its value, which leaves 70% as equity. If the spouses split that equity 50/50, the buyout is 35% of value. On an investment property, 30% plus 35% lands at 65% CLTV, under the 70% network ceiling with some cushion for costs. A larger first mortgage with the same buyout would push combined leverage past that ceiling.
Other points favor the line:
- Your buyout is mostly lump-sum. Under the network’s HELOC programs, at least 75% of the line is drawn at closing, so the line suits a buyout paid largely up front. Later draws carry their own minimum amounts.
- You want a lower-touch valuation. Lines at or below $500,000 ordinarily run an automated valuation instead of a full appraisal. A higher CLTV can trigger a secondary valuation, and you can request a full appraisal in any case.
- The decree leaves room. Whether it mandates a refinance depends on how it was worded, which is a settlement-drafting question for your divorce attorney.
The HELOC has limits you should weigh. Pricing floats across the draw and repayment periods and never converts to a fixed structure. Investment lines run a 5-year interest-only draw followed by a 25-year amortizing repayment. Primary residences and second homes offer a choice of two structures: a 3-year interest-only draw with a 17-year fully amortizing repayment, or a 5-year interest-only draw with a 25-year fully amortizing repayment. Tennessee shortens them to 3 years/12 years and 5 years/10 years.
Eligibility is narrower than people expect. Manufactured homes, co-ops, condotels, log homes, and agricultural or mixed-use zoning are not eligible. A borrower is limited to three lines and cannot own more than 15 financed properties.
Availability matters too. Lendmire’s HELOC programs are offered in 16 full-service states: AL, CA, CO, FL, GA, IN, MI, MT, NM, NC, OH, PA, TN, TX, VA, and WA. Texas primary residences are homestead properties and cap at 80% combined loan-to-value.
When the Bank Statement Cash-Out Refinance Is the Better Fit
The cash-out refinance is the stronger tool when your ex needs to come off the loan. It pays off the joint first mortgage, funds the buyout, and covers costs in a single new loan in your name. That one step satisfies a decree with a refinance deadline. A HELOC does not.
It also fits when the existing first mortgage is the problem. Perhaps the first lender will not cooperate with a second lien. A later refinance of the first loan can require the second-lien lender’s cooperation, so investors planning another restructuring may prefer one clean loan instead.
Several situations push you here:
- The buyout is larger than the line can carry. The investment line caps at $500,000 and 70% CLTV, and a cash-out can be sized differently.
- The property sits in an LLC. The HELOC cannot be written on entity-titled property. Network HELOC parameters allow only the individual borrower or a revocable living trust to hold title. You would need to change vesting or use a cash-out, subject to lender program eligibility.
- You want one loan, one lien. That simplifies your books if you hold several rentals.
- The joint HELOC is still open. An existing joint line does not vanish at divorce. It should be paid off, closed, or refinanced into one name first.
The tradeoff is real. A refinance replaces a first mortgage that may have favorable terms. A cash-out may also carry its own leverage cap and seasoning review, so ask the lender how both apply to your file. Compare total terms from the lender rather than assuming the first number is the whole story.
Qualifying Alone on Deposits
Divorce often ends shared income, so you qualify on your own. A bank statement loan reads qualifying income from your deposits. Business accounts may take an expense-factor reduction, and personal accounts may be averaged, depending on the program. Programs also differ on how many months they review.
Lenders must still verify what they rely on. The CFPB’s ability-to-repay assessment report treats bank statement loans as non-qualified mortgages, which remain subject to the verification requirements. A deposit the lender cannot identify as income will not count.
That is why deposit cleanup matters before you apply:
- Separate business and personal funds before the statement window opens.
- Document transfers between you and your ex, since a settlement payment is not income.
- Keep a record of large one-time deposits and where they came from.
- Leave support payments out unless you can document them.
On the HELOC side, the network’s debt-to-income limit is 50% at most, and 45% for profiles from 600 to 679. A ratio above 45% requires a 680 minimum. The lender reviews your file on the interest-only payment calculated on the maximum draw. Credit review keys to a single-bureau score, and the report must be no more than 90 days old at closing.
The Timing Problem
Sequence matters more than speed here. The decree or settlement agreement should spell out who keeps the property, the equity split, and any refinance requirement. Your divorce attorney should review that wording before you choose a product.
A deed signed before the refinance closes leaves your ex still liable on the mortgage. Coordinate the deed with the loan closing. During a pending divorce, restrictions on new debt and liens may apply, and your ex may need to consent. Ask your attorney before you apply.
Two details of the network’s HELOC programs also affect your plan. Foreclosure history on a primary-residence line splits between the two programs: one seasons a foreclosure in 7 years, while the other declines the history entirely. A bankruptcy needs 4 years of seasoning from discharge or dismissal.
What If the Property Is a Rental?
If the home is a rental you do not live in, a third path exists. Many DSCR loans qualify primarily on property-level rental income covering the payment, subject to lender guidelines. That path skips the deposit review entirely. DSCR compares rent to the full monthly obligation: principal, interest, taxes, insurance, and any HOA dues.
On a DSCR cash-out, most of Lendmire’s network tops out near 75% LTV on standard rentals. About 6 months of seasoning is a common expectation. Where rent coverage clears 1.00, which is where select programs start, the file can proceed without your personal deposits. Sub-1.00 coverage is available through select lenders in the network, with leverage and terms adjusted. Every figure here varies by lender and program: guidelines, property type, leverage, and credit profile all apply.
Clearing 1.00 does not mean the property produces positive cash flow. Repairs, vacancy, management, utilities, and capital expenses sit outside that calculation. The complete DSCR loans guide explains the loan type from the start.
DSCR loans are designed for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage. If you live in the home, owner-occupied rules apply instead.
What Happens When the Buyout Is Bigger Than the Line
Suppose the buyout and the existing first mortgage together push combined leverage past the 70% network ceiling on an investment property. The usual fallbacks are a phased buyout, a partner note, a smaller first payout, or a move to a cash-out structure.
Tax treatment varies; consult a qualified professional. A cash-out refinance may also trigger a different leverage cap and seasoning review than a line. Ask for both options to be sized on your actual file. The site calculator only gives an illustrative HELOC estimate from combined loan-to-value, not a quote and not a cash-out refinance model.
Frequently Asked Questions
Does a bank statement HELOC take my ex off the first mortgage?
No. A HELOC adds a second lien and leaves the first mortgage untouched, so anyone on the first note stays liable. Only a refinance, an assumption with a release, or a payoff removes a borrower from that loan.
Can I get either product while the divorce is still pending?
It depends on your state’s restrictions and any court orders. Pending divorces can limit new debt or liens, and your ex may need to consent. Ask your attorney before applying, and confirm with the lender how it treats a case that is not yet final.
Can a bank statement HELOC be written on a rental held in an LLC?
Not in Lendmire’s network. The HELOC programs require the individual borrower or a revocable living trust to hold title. A property already in an LLC needs a vesting change, or a cash-out or DSCR refinance that accepts entity vesting, subject to program terms.
Will a lender count my ex’s income or support payments?
Your own income is what the file is built on. Support payments count only with documentation, and lenders must verify the income they rely on. Deposits they cannot identify as income do not qualify.
What if my credit profile is below the HELOC minimum?
The minimum depends on occupancy. Investment lines require at least a 700 profile, second homes at least 640, and primary residences at least 600, with tighter leverage and loan limits at the lower scores. A refinance with a different credit floor may fit better.
Verdict
Pick the cash-out refinance when anyone needs to come off the first note, when the property sits in an LLC, or when the buyout outgrows the line. Pick the HELOC when the first mortgage should stay put, the buyout is modest against the equity, and the decree allows it. If the home is a rental, price out the DSCR path as well, since it skips the deposit review.
If you are weighing a home equity line against a cash-out refinance and want to see how the numbers work, Lendmire can help you compare HELOC options based on the property, the equity available, credit profile, combined leverage, and your goals.
