How a Bank Statement HELOC Works for a Texas Homestead With a First Mortgage

How a Bank Statement HELOC Works for a Texas Homestead With a First Mortgage

The Quick Read: A bank statement HELOC on a Texas homestead is a home equity line qualified on your deposits rather than tax returns, and it sits behind your existing first mortgage, so the file must clear two separate tests: the lender’s income and credit review, and the state’s 80% cap on total borrowing against the home’s value.

  • Your first mortgage stays in place. The new line is a second lien that sits behind it.
  • Bank statements only change how income is proven. They never loosen the limit on what the house can hold.
  • On a Texas primary residence, combined borrowing tops out at 80% of value, whatever a credit tier might allow elsewhere.
  • Texas adds a 12-day waiting period, a one-equity-lien-at-a-time rule, and a minimum for each later draw.
  • A rental property is not a homestead, so a different set of rules and a tighter ceiling apply to it.

Many self-employed investors have a home with a healthy first mortgage and tax returns that understate what they actually earn. A deposit-based line can fit that profile. Here is how the machinery works, step by step, and where it breaks.

Editable Equity Scenario

How large a line the equity supports in Texas.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 80% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

What Is a Bank Statement HELOC, Really?

A bank statement HELOC is not a separate legal product. It is a home equity line of credit where the lender reads your deposits to establish income instead of leaning on tax returns. The line itself is the same revolving structure any HELOC uses: a limit, a draw period, then repayment.

Two layers sit on top of each other in Texas. The state’s homestead rules decide what kind of lien the lender can place on your home. The lender’s program decides how your income is proven and whether you qualify. Confuse the layers and you will misread what a “yes” from a lender actually means.

Lendmire is a mortgage broker, not a lender. It places these lines with select wholesale lenders, and every figure below is subject to lender guidelines and full file review. This particular home equity product is available in Lendmire’s 16 full-service states, Texas among them, which is narrower than its DSCR investor footprint of 41 markets, including Washington, D.C.

How Does Underwriting Treat Bank Statement Income?

Underwriting converts a stack of deposits into one monthly income number, then tests that number against your debts. The steps are consistent across most lenders, though each program sets its own details. Income is reviewed on documented deposits under the applicable program, subject to lender guidelines.

1. Pick the statement window. The program sets how many consecutive months of personal or business statements it wants. The length varies by lender.

2. Screen the deposits. Transfers between your own accounts, loan proceeds, and refunds are not income. They come out before anything is averaged.

3. Apply an expense factor to business accounts. A trade overview from Scotsman Guide notes that non-QM lenders can apply a standard expense factor to business deposits. The exact percentage is set by the lender, so treat any single figure you read online as illustrative. Personal statements are generally read closer to face value.

4. Average the result. The cleaned total is divided by the number of months. If you own only part of the business, the figure is prorated to your share.

5. Test debt-to-income. Debt-to-income (DTI) compares your monthly debts to your qualifying income. Across the network, the ceiling is 50%, and 45% applies to credit profiles from 600 to 679. A ratio above 45% needs at least a 680 score.

6. Count the first mortgage. Your existing first mortgage payment goes into DTI. A modest first lien helps here. The line itself is qualified on its interest-only payment, calculated on the maximum draw.

7. Check credit and collateral. The program floor is 600, using a single-bureau score model keyed to the primary wage earner. The credit report can be no more than 90 days old at closing.

Notice what is missing: any shortcut. Deposits are scrubbed, credit is pulled, the property is reviewed, and title must be clean. Bank statement documentation changes the income evidence, not the rest of the file.

How Does the Line Sit Behind Your First Mortgage?

The line becomes a second lien. Your first mortgage keeps its terms, its balance, and its lien position. A standalone line in first or second lien position is available, and on a homestead with a first mortgage you are in second position by definition.

That matters for one reason: the first mortgage eats into your borrowing room. Total borrowing against a Texas primary residence cannot pass 80% of the home’s value. The first mortgage balance, the new line, and any other debt secured by the home all count toward that 80%.

Run the numbers on a home valued at 100% of its appraised worth, with a first mortgage balance equal to 55% of that value. The state’s cap leaves 25% of value for the line. But the credit tier can tighten it further. On a Texas primary residence, the network’s tiers work out like this:

Credit profile Max CLTV (primary) Room with 55% first lien
640+ 80% (up to $500,000) 25% of value
700+ (720 on the longer-runway program) 75% (up to $750,000) 20% of value
620+ 70% (up to $400,000) 15% of value
600+ 60% (up to $400,000) 5% of value

CLTV, or combined loan-to-value, is every loan on the home added together and divided by its value. The higher-leverage tiers you may see advertised nationally, such as 85% or 90%, never apply to a Texas primary residence. The state cap overrides them. A 720-plus score also reaches only the same 75% tier on larger lines, since the 90% tier tops out at $500,000 and Texas holds that to 80%.

Here is the practical wrinkle. At least 75% of the line is drawn at closing. Because you will have borrowed most of the limit on day one, plan as if the full limit counts against the cap, not just the drawn amount. Many lenders size the entire limit against the ceiling, and your lender will confirm how it treats an undrawn balance.

For deeper reading on keeping the first lien, Lendmire’s piece on how to keep your first mortgage while opening a bank statement line covers the sequencing from the borrower’s side.

What Do the Texas Homestead Rules Actually Control?

They control the lien, the closing, and how the line can be used. The Texas Real Estate Research Center at Texas A&M explains that Section 50(a)(6) of the state constitution covers three loan types: cash-out refinances, home equity loans, and HELOCs. The same source confirms the 80% combined cap, with a required 20% equity cushion, and that these loans apply only to a homestead.

Several other rules shape the file.

  • A 12-day wait. The loan cannot close before the 12th day after you receive the separate written notice. The Texas Constitution’s Article XVI text sets this in Section 50(g). This waiting period binds primary residences only.
  • One equity lien at a time. A line and a closed-end home equity loan cannot both sit on the homestead. A prior cash-out refinance of this type creates the same conflict.
  • One-year spacing. The Texas Register’s adopted banking rules describe a general bar on closing one home equity loan within a year of another, with an exception for a declared state of emergency.
  • Where you close. The same notice says closing happens at the office of a lender, an attorney, or a title company. You do not sign at your kitchen table.
  • Card and draw limits. Texas lines cannot be tied to a credit or debit card. Each later draw must be at least $4,000, higher than the $1,000 minimum in most states.
  • Fee limits. Texas restricts what a lender can charge on these loans, including annual maintenance and non-usage fees.

The penalty for getting this wrong falls on the lender: an uncured violation can put the lender’s principal and interest at risk. That is why Texas files get careful attorney and title review, and why a seemingly small mismatch can stall a closing.

Which Existing Liens Block a New Line?

A purchase-money first mortgage rarely blocks anything. An earlier equity-type lien often does. This table shows how the common situations play out. Final eligibility always rests with the lender and title company.

What sits on your homestead Effect on a new line
Ordinary purchase-money first mortgage Allowed. Counts toward the 80% cap
Existing HELOC or home equity loan Generally blocks a second one
Earlier cash-out refinance Generally blocks it, and spacing rules apply
Home listed for sale, or listed in the past 60 days Ineligible in Texas
Property over 10 acres Outside the program’s limits

One more wrinkle: some practitioners say a loan once classified as a Texas cash-out stays classified that way through later refinances. Treat that as a question for your lender and attorney before you assume you are clear.

What Structures Exist?

Two draw structures exist on primary residences. Throughout this article, the 3-year-draw structure means three years of interest-only draws followed by a 17-year fully amortizing repayment. Pricing on both floats across the draw and repayment periods and never converts to fixed.

A few more facts shape the choice.

  • Line size. Lines run from $25,000 to $750,000. Anything above $500,000 is for primary residences only. It requires a score of 700 or better (720 on the 5-year-draw structure), caps at 75% CLTV, and requires a full appraisal.
  • Valuation. Lines at or below $500,000 ordinarily use automated valuation, though a higher CLTV may call for a second look. On a Texas homestead, expect the valuation step to be taken seriously, because the cap is measured against value. You can also request a full appraisal in any case.
  • Credit history. Bankruptcy needs four years from discharge or dismissal. Foreclosure-family events split by structure: one seasons a foreclosure at seven years and a short sale or deed-in-lieu at four, while the other declines that history entirely.
  • Property types. Single-family, 2-4 unit homes, PUDs, townhomes, and condos, including non-warrantable condos, are eligible. Manufactured homes, co-ops, condotels, log homes, and commercial or agricultural-zoned property are not.
  • Exposure. A borrower can hold up to three lines, and anyone with more than 15 financed properties is not eligible.

The structure choice is mostly about runway. A longer interest-only period lowers the early monthly obligation, but the repayment stretch that follows is also longer. The right pick depends on how you plan to use the money.

Where Does the General Rule Break?

Most of the surprises come from property type and title. The homestead rules do not follow you to every property you own.

Rule Texas homestead Rental or second home
Covered by Section 50(a)(6) Yes No
12-day wait, one-lien rule, 12-month seasoning Apply Do not apply
Max CLTV 80% Per program tables
Occupancy treatment Primary residence Non-homestead transaction

The Texas A&M research center states plainly that these home equity loans cannot be made on a secondary residence or a rental. A line on an investment property is a separate product with its own tables. On an investment property, the ceiling is 70% CLTV, the minimum credit score is 700, the maximum line is $500,000, and only the 5-year-draw structure is offered. A second home reaches 90% CLTV only at a 720 score, and the line tops out at $500,000.

Other edge cases deserve a flag.

  • Title. The line must be vested in you individually or in an inter vivos revocable living trust. LLCs, corporations, partnerships, and irrevocable or land trusts cannot hold title. This is the sharpest difference from a DSCR loan, where lending to an LLC is possible subject to lender program eligibility. A property already deeded to an LLC needs a vesting change, or a DSCR cash-out refinance instead.
  • Co-signers. Texas readings of the no-additional-collateral rule generally keep guarantors and co-signers out of a homestead line.
  • Thin or messy deposits. A deposit-based review needs recent, consistent deposits to average. Mixed personal and business accounts, big unexplained transfers, or a recent business transition can shrink qualifying income.
  • Sub-640 profiles. These are limited to single-family residences with a clean 12-month housing history under the 5-year-draw structure.

Line, Cash-Out, or DSCR Loan: How Do They Compare?

The right tool depends on whether you want to keep the first mortgage and whether the capital is for the home or a rental. Here is the side-by-side.

Factor Bank statement HELOC Texas cash-out refi DSCR loan
Collateral Your homestead Your homestead The rental property
First mortgage Stays in place Replaced Not involved
Income basis Deposits Varies by program Property rent
Coexist with a Texas equity loan No No Yes, different collateral

A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines. DSCR compares rent to the full monthly obligation, which covers principal, interest, taxes, insurance, and any association dues. Clearing 1.00 does not mean the property cash flows, since repairs, vacancy, and management sit outside the calculation. Rental-based loans are designed for investment properties. Because they are business-purpose loans, they are reviewed differently from an owner-occupied mortgage. Lendmire’s complete DSCR loans guide covers the full picture.

Who Should Use This, and Who Should Skip It?

Use it if you are self-employed with a home that has meaningful equity, a first mortgage you want to keep, and a need for flexible capital such as down payments or rehab money. Deposit-based qualification can show cash flow that tax returns understate.

Skip it if any of these apply.

  • You already have a home equity loan or recent cash-out refinance on the homestead.
  • Your first mortgage already eats most of the 80%.
  • Your deposits are too irregular to average.
  • The capital is meant to buy or refinance a rental. In that case a DSCR purchase or cash-out refinance on the rental itself may fit better. On most files, DSCR purchases run at 75% to 80% LTV, and a cash-out refinance on a standard rental tops out near 75% LTV with roughly six months of seasoning. Strong coverage opens better terms, and reserves vary by lender and loan size.

The trade-off in the line itself is hard to ignore: you are pledging your home to fund your investments. A rental-secured product protects the home but usually gives less capital. Which risk you prefer is a personal call.

Key Terms Defined

Homestead: the home you live in as your primary residence, which Texas law protects from most forced sales.

CLTV (combined loan-to-value): all loans secured by the home added together, divided by its value.

Lien position: the order in which lenders get repaid from the property. The first mortgage is first, and the line is second.

Expense factor: a percentage lenders subtract from business deposits to estimate what is left as income after costs.

DTI (debt-to-income): your monthly debts divided by your qualifying monthly income.

Interest-only draw period: the early stretch of the line when your payment covers interest only.

Frequently Asked Questions

Can I keep my first mortgage when I open the line?

Yes. The line sits behind it as a second lien, and your first mortgage keeps its terms. Its balance counts toward the 80% combined cap, and its monthly payment counts in your DTI.

Does a bank statement line avoid the 80% cap?

No. The cap covers the first mortgage, the new line, and any other debt secured by the homestead. Bank statements change how income is proven, not how much the house can carry.

Can I use this on a Texas rental property?

Not under the homestead rules, since a rental is not covered by that section of the constitution. A line on an investment property is a separate product with its own tables, including a 70% CLTV ceiling and a 700 minimum credit score.

What happens if I already have a home equity loan?

A new line generally cannot close while another equity-type loan sits on the homestead. A prior cash-out refinance can trigger the same block, along with one-year spacing. Your lender and title company confirm where you stand.

Why are Texas draws different?

Each draw must be at least $4,000, and the line cannot be tied to a card. You also wait 12 days after receiving the written notice before closing, and you close at a lender, attorney, or title company office.

Next Step

If you are considering a home equity line and want to see how the numbers work, Lendmire can help you compare HELOC options based on the property, the equity available, credit profile, combined leverage, and your goals. The best program for your situation depends on your property type, credit profile, and how you plan to use the funds.

Once your first mortgage is factored in, Texas’ 80% cap, not your deposits, usually decides how much capital the homestead can actually release.
