The Quick Read: The best program depends on the loan size, the occupancy of the property, and how the keeping spouse documents income. A buyout is usually priced and capped as cash-out, so the cash-out leverage column controls, not the purchase column. Through select wholesale programs, subject to full underwriting, a self-employed borrower can qualify on 12 or 24 months of deposits instead of tax returns.
- A divorce decree does not remove an ex-spouse from the old note. Only a refinance, payoff, or released assumption does.
- The keeping spouse qualifies alone. The departing spouse’s income no longer counts.
- Cash-out leverage on a primary residence runs 80% to $1,500,000, then steps down as the loan grows.
- Above $4,000,000, every file is reviewed case by case before submission.
- Test the buyout figure against the cash-out ceiling before anyone signs a settlement number.
What a Divorce Buyout Refinance Actually Is
One spouse keeps the property and pays the other spouse’s equity share. A cash-out refinance does both jobs at once. The new loan pays off the joint mortgage and funds the payment to the departing spouse. The debt then sits in one name.
The math is simple. New loan equals the existing payoff plus the buyout plus costs. The decree or settlement agreement defines the buyout. The appraisal sets the value. Equity is value minus the payoff.
Lenders treat the extra amount as cash-out in this lane. Fannie Mae’s Selling Guide does allow a co-owner buyout to be treated as a limited cash-out refinance on conforming loans. That label belongs to the agency program. Jumbo and non-QM programs do not inherit it, and each program sets its own treatment. Plan on cash-out pricing and cash-out leverage.
What “Super Jumbo” and “Bank Statement” Mean Here
Super jumbo is a lender convention, not a regulatory category. The baseline one-unit conforming limit is $832,750, and the high-cost ceiling is $1,249,125, per Orrick’s summary of the FHFA announcement. Anything above the county limit is jumbo. The super-jumbo line, where overlays tighten, sits higher and varies by program.
Bank statement is a documentation method. Income comes from 12 or 24 months of consecutive personal or business statements. It is still documented income. The loan is reviewed on deposits under the applicable program, subject to lender guidelines.
How Underwriting Treats the Buyout, Step by Step
1. Fix the buyout figure. Pull it from the decree or settlement. Add the payoff and estimated costs to get the loan amount.
2. Classify the property. The marital home is a primary residence. A rental is investment property, which is business-purpose and takes its own ladder. A leased rental may fit a DSCR loan better than bank statements.
3. Document income. Gather 12 or 24 consecutive months of statements. Eligible deposits are totaled, an expense ratio comes off business deposits, and the result is divided by the statement months.
4. Underwrite the keeping spouse alone. The new debt is measured against one borrower’s qualifying income, with debt-to-income up to 50%.
5. Size to the cash-out column. The loan must fit under the cash-out ceiling for its band and occupancy.
6. Check reserves. Reserves scale with size: 3 months to $500,000, 6 months to $1,500,000, 9 months above. Cash-out proceeds cannot satisfy reserves on files above the super-jumbo overlay line.
7. Close in one sequence. Payoff, buyout payment, and the deed or quitclaim run through one settlement. The ex-spouse’s liability ends at payoff.
The decisions that move a file most are the expense ratio, the cash-out leverage cell, deposit quality, credit score, reserves, and clean documentation of the buyout amount.
How Bank Statement Income Works After a Divorce
Qualifying income is eligible deposits divided by the statement months, after an expense ratio. Through select wholesale programs, the fixed ratios are 20% for a service business with no employees, 40% for one to five employees, and 50% for six or more employees or any product business. An accountant-provided ratio is an alternative, as is a profit-and-loss method capped at 80%.
Business statements need at least 25% ownership. That matches how the Federal Register’s rule text defines a self-employed consumer.
Transfers from the borrower’s own business into a personal account count at 100%. Statements must be consecutive. Transaction histories do not substitute.
Co-owned business is the hard edge case. If the ex-spouse owned part of the business, deposits may drop once ownership changes. The file needs the new ownership split documented and a clear picture of what the business deposits look like going forward. Expect underwriters to ask.
The Leverage Ladder: Where Buyouts Get Stuck
The bands below are loan amounts, not purchase prices. Figures are ceilings through select wholesale programs, subject to underwriting, and every loan above $4,000,000 is reviewed case by case.
| Loan band | Primary residence cash-out | Program |
|---|---|---|
| $300K–$1M | 80% | Portfolio program |
| $1M–$1.5M | 80% | Portfolio program |
| $1.5M–$2M | 75% | Portfolio program |
| $2M–$3M | 70% | Portfolio program |
| $3M–$4M | 65% | Portfolio program |
| $4M–$6M | 60% to 55% on review | Bank portfolio program |
| $6M–$10M | 55% on review | Bank portfolio program |
| $10M–$30M | 50% on review | Bank portfolio program |
The portfolio non-QM program carries files to $6,000,000. The bank portfolio program carries twelve-month-statement files to $30,000,000, and its ladder begins above $4,000,000. Within each band, the top cell needs a stronger score: 680 or higher to $1,000,000, 700 to $1,500,000, 720 from there to $3,500,000, and 760 at the $3.5M–$4M band. A lower score takes a lower leverage cell in the same band. These are not floors. The portfolio program floor is 660 up to the super-jumbo line and 700 above it, and the bank program keeps its own 680.
Second homes and investment property use their own ladders. Never subtract from the primary figure to guess them. Read each occupancy’s own table.
Cash-out has one more limit. Proceeds are unlimited at or below 60% LTV. Above 60%, the portfolio program caps cash-in-hand at $1,500,000. The bank program publishes no cap. Every figure here varies by lender and program — guidelines, property type, leverage, and credit profile all apply.
Worked Buyout Example
Picture a founder keeping a $3,000,000 primary residence. The existing payoff plus the buyout and costs produces a loan near 60% of value. That sits under the 75% cash-out ceiling for the $1.5M–$2M band, with room to spare. Reserves would be 9 months. The file qualifies or fails on deposits and the expense ratio, not on leverage. Final terms depend on lender guidelines, property type, leverage, and the borrower’s complete credit picture.
Now flip it. Same house, but the buyout is large and the payoff is small, so the loan lands near 75% of value. That is over the cash-out ceiling for the loan’s band. The gap has to be closed another way, as described below.
When the Buyout Is Too Large for the Ceiling
Test the ceiling before a settlement number is signed. If the loan lands above it, the options are:
- Trade other assets to the departing spouse in place of cash.
- Stage the payment over time through the settlement terms.
- Bring cash to the table, which lowers the loan.
- Choose a different property, occupancy, or program lane if the file allows it.
A second lien can help only when the ex-spouse is not on the first note. If the ex is on the first mortgage, they still have to be released, which means a refinance in the keeping spouse’s name.
Alternative Income Paths
Bank statements are not the only route. Through select wholesale programs, an asset allowance is reviewed on liquid assets divided by 36, 60, or 84 months, on primary and second homes, to 80% maximum. Assets-only needs no debt-to-income calculation. It requires U.S. liquid assets equal to the loan plus closing costs plus sixty months of any net loss on other residential property.
Retirement accounts count at 70%, or 80% at age 59.5 and up. Business funds, gifts, trusts other than a revocable living trust, unvested stock, and cryptocurrency never count. Assets awarded in the divorce can matter here, so the decree’s asset schedule belongs in the file.
Buyout Refinance Versus Other Routes
| Route | What it does | Main catch |
|---|---|---|
| Buyout refinance | Replaces the note, pays the ex | Must fit cash-out ceiling |
| Assumption | Keeps the old note | Needs written release |
| Sale | Splits proceeds | Property is gone |
| Asset trade | Offsets the equity | Needs assets of equal value |
Keeping a low legacy rate is the usual argument for an assumption. A refinance replaces the whole first lien, so it gives that rate up.
Rental Property in the Buyout
A rental keeper faces a different test. Credit extended primarily for a business purpose is exempt from Regulation Z under § 1026.3, so a rental buyout is reviewed differently from a marital-home buyout. For a leased rental, a DSCR loan may suit better than bank statements, because it qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. Lendmire’s complete DSCR loans guide covers that path. Sub-1.00 coverage programs exist through select lenders in the network, with adjusted leverage and terms.
Super-Jumbo Overlays to Plan For
Above $3,500,000 on a primary residence, and above $3,000,000 on a second home or investment property, the portfolio program adds overlays. These are a 700 credit floor, a 0x30x24 housing history, and 48-month seasoning on any credit event. They also require U.S. citizens or permanent residents, no non-occupant co-borrowers, no rural property, and a ten-acre maximum.
A recent credit event is common after a divorce. Check the dates early. Late payments during the separation can trip the housing-history overlay.
Common Mistakes
- Signing a buyout figure before testing it against the cash-out ceiling.
- Using the purchase column instead of the cash-out column.
- Assuming the decree releases the old mortgage.
- Counting the ex-spouse’s income after the divorce.
- Submitting statements with gaps or transaction histories.
- Skipping the expense ratio math and assuming a lower factor than the file supports.
Documents that cut friction include the decree or settlement, the payoff statement, consecutive statements, and proof of title status. Lendmire’s piece on documents for a super jumbo bank statement cash-out lists them. Tax treatment varies; consult a qualified professional.
Finding the Right Program for the File
No single program is the best across files. The right one depends on the loan band, occupancy, credit, reserves, and how deposits look after the business changes. A broker that shops multiple wholesale programs can match the file to the ladder that fits it. Lendmire’s article on bank statement cash-out for business owners covers the owner-income side.
If you are financing a high-balance property on business or personal bank statements and want to see how the numbers work, Lendmire can help you compare super jumbo bank statement loan options based on your deposits, the property, credit profile, leverage, and your goals. Key Terms Defined
Super jumbo: a lender-defined loan size above the conforming limit where tighter overlays apply.
Bank statement loan: a loan that is reviewed on deposits from 12 or 24 months of statements rather than tax returns.
Expense ratio: the share of business deposits treated as costs before income is calculated.
Equalization payment: the sum one spouse pays the other to even out the split of property.
Release of liability: a written release removing a borrower from an existing note.
Frequently Asked Questions
Does a divorce decree take my ex off the mortgage?
No. The decree sets who pays, but the lender still holds both names on the note. Only a refinance, a payoff, or an assumption with a written release ends the ex-spouse’s liability.
Is a divorce buyout treated as cash-out?
On these programs, yes, expect cash-out treatment. Fannie Mae’s limited cash-out rule is an agency concept. Jumbo and non-QM programs set their own treatment, so the cash-out leverage column governs.
Can I qualify alone on bank statements?
Often, if deposits support it. The keeping spouse is measured alone, with debt-to-income up to 50%. Income is eligible deposits divided by the statement months after the expense ratio, subject to lender guidelines.
What if my ex co-owned the business?
Deposits may fall once ownership changes. The file needs the new ownership split and a clear view of post-divorce deposits. Business statements require at least 25% ownership.
What if the buyout exceeds the cash-out ceiling?
Restructure before signing. Trade assets, stage the payment, add cash, or look at a different program lane. Above $4,000,000, the file is reviewed case by case before submission.
