The Quick Read: Yes, a frozen or reduced line does not bar a new application, because a new lender underwrites the file on its own and simply sees the old line on the credit report and title, so eligibility turns on equity, credit, occupancy, and vesting rather than on the freeze itself, subject to lender guidelines. A bank statement review solves an income-documentation problem. It does not solve an equity, credit, or title problem.
- A freeze stops new draws, and a reduction lowers the limit. Neither one cancels the loan.
- A new line is a separate underwriting event, and the old line counts in combined leverage.
- Investment properties carry the tightest limits, and LLC title is a hard stop for this product.
- A cash-out refinance on a rental removes the draw right that can be frozen.
How Does a Bank Statement HELOC Work as a Replacement?
It qualifies the borrower on deposits instead of tax-return income. The lender reviews twelve or twenty-four months of personal or business bank statements, or a CPA-prepared profit-and-loss statement or 1099s, and then screens the deposits. Transfers between your own accounts, loan proceeds, and one-time deposits come out. Business deposits usually get an expense factor applied. Finder notes that these products sit mostly with non-bank, non-QM lenders and brokers, and that the lender still verifies the deposits. Income is reviewed on documented income under the applicable program, subject to lender guidelines.
How large a line the equity supports.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
This matters for rental owners. Depreciation and deductions can leave taxable income thin even when cash flow is strong, so deposits can tell a truer story than the return.
Occupancy sets the limits, and the wholesale network Lendmire works with ties them to occupancy:
- Investment property: the ceiling is 70% combined loan-to-value, with a 700 minimum credit score and lines up to $500,000.
- Primary residence: the ceiling reaches 90% combined loan-to-value only at a 720 score or better, with lines up to $500,000 at that tier. Lower score tiers carry lower ceilings, and the program floor is 600.
- Second home: the same 90% ceiling applies only at 720 or better, and the minimum score is 640.
- Line size: lines run from $25,000 to $750,000, and anything above $500,000 is primary residence only and needs a full appraisal.
Debt-to-income tops out at 50%, and it drops to 45% for scores from 600 to 679. At least 75% of the line is drawn at closing. Investment lines use a five-year interest-only draw followed by a 25-year repayment period. Condos, including non-warrantable ones, are eligible. Manufactured homes, co-ops, condotels, log homes, and commercial or mixed-use properties are not offered.
Availability is narrower than Lendmire’s DSCR footprint. The HELOC product is available through the network only in AL, CA, CO, FL, GA, IN, MI, MT, NM, NC, OH, PA, TN, TX, VA, and WA. Every figure here is subject to lender guidelines and full file review.
What Happens to the Old Frozen Line in a New File?
The new lender sees it, counts it, and decides how to treat it. The old line shows up on the credit report and on title. If it sits in first or second lien position, the new line has to fit around it. Combined leverage includes the first mortgage, the frozen line’s limit or balance, and the new line, measured against value. How a lender handles the old line (paid off, closed, or counted as is) varies by program and file, so ask before you apply.
A frozen line does not hurt the application by itself. The reason behind the freeze matters more. If a value drop caused it, the new lender’s own valuation drives the new file. Lines of $500,000 or less ordinarily run on an automated valuation, and a borrower can request a full appraisal in any case. If a finances-based action triggered the freeze, expect questions about the deposits and about any late payments.
Title is the sharpest edge. These lines require the individual borrower or a revocable living trust to hold title. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot. A rental already deeded to an LLC needs a vesting change first, or it belongs in a DSCR cash-out refinance, which can lend to LLC-titled properties subject to program terms.
Exposure limits apply too. A borrower is limited to three lines, and a borrower with more than 15 financed properties is not eligible.
Reinstate, Replace, or Restructure?
Run the decision in this order, because each step is cheaper than the next.
1. Find the reason in the notice. The lender must send written notice with specific reasons, and it can follow the action by up to three business days, per the Philadelphia Fed’s Consumer Compliance Outlook. That notice requirement belongs to consumer HELOC plans; a business-purpose DSCR loan is exempt from TRID under Regulation Z section 1026.3, so those consumer disclosure timelines do not apply to it.
2. Ask for reinstatement if the cause was temporary. Credit privileges must be restored once the justifying circumstance ends and no other ground exists, according to that same publication. The lender may need a written request, and it can charge only reasonable appraisal and credit-report costs to check whether the condition persists, under Regulation Z section 1026.40. A reinstatement fee is not allowed once the condition is gone.
3. Dispute a value-based freeze with evidence. Send recent comparable sales or an appraisal. Lenders may not know about improvements that raised value.
4. Replace the line if reinstatement stalls. A new bank statement line, where it is offered and the property qualifies, restores access on a fresh file.
5. Restructure if the line is the wrong tool. A rental held in an LLC, or an investor who wants funds certain at closing, usually ends up in a cash-out refinance.
Two points in the rule trip up borrowers. A freeze is not a closure, and the lender can call the balance only under a separate, narrower power. Also, a lender cannot freeze a line merely because the economy feels uncertain. It needs a listed ground.
Why Do Lenders Freeze or Reduce a Line?
Only for specific listed grounds. The text of 12 CFR 1026.40 at Cornell LII lays them out, and sources count them differently, so the table lists them without a number.
| Trigger | What it means | Fixable? |
|---|---|---|
| Significant value decline | Home worth far less than at origination | Often, by dispute or recovery |
| Finances worsen | Lender reasonably expects repayment trouble | Sometimes, with new documents |
| Material default | Borrower breaks a key term of the agreement | Only by curing the default |
| Government action on the rate cap | Lender cannot charge the agreed pricing | When the action ends |
| Government action on lien priority | Security falls below 120% of the line | When the action ends |
The regulation does not define a significant decline. The commentary treats a decline as significant if it cuts the gap between the credit limit and the available equity by 50%. A contract cannot justify a freeze over an insignificant decline.
One caution on investor lines. These limits apply to consumer-purpose plans secured by a home. Many investment-property lines are business-purpose, so the freeze limits above may not apply and the note and state law govern. Read your loan agreement before assuming the protections cover you.
How Do the Options Compare?
| Factor | Reinstatement | New bank statement HELOC | DSCR cash-out refinance |
|---|---|---|---|
| What it fixes | Restores the old line | Replaces lost access | Funds at closing |
| Income basis | None needed | Deposits | Property rent vs. PITIA |
| LLC title | Per old note | Not allowed | Allowed, per program terms |
| Freeze risk | Can recur | Can recur on undrawn part | None after funding |
| What it won’t fix | Low equity | Equity, credit, title | Thin rent coverage |
DSCR compares rent to principal, interest, taxes, insurance, and any HOA dues. Clearing 1.00 is not the same as positive cash flow, because repairs, vacancy, management, utilities, and capex sit outside the calculation. Many select programs start at 1.00. A separate select-lender path takes coverage below 1.00 with leverage and terms adjusted. Cash-out tops out around 75% LTV on standard rentals across most of the network, and about six months of seasoning is the common expectation. Reserves vary by lender, leverage, and loan size, and about six months of PITIA is common. The trade-off is that a cash-out refinance replaces the first mortgage, so coverage thins as the balance grows. The complete DSCR loans guide covers those mechanics.
Will the Replacement Line Get Frozen Too?
It can. Any open-end line carries the same exposure, and it peaks when values or finances weaken, which is when you most want the cash. Lines have been cut at scale in past downturns. A new line draws at least 75% at closing, so the freezable portion is the undrawn remainder. Treat that remainder as optional liquidity, not as a reserve you can count on. A cash-out refinance has no draw right left to freeze, which is a structural difference rather than a pricing one.
What Should the File Contain?
Gather these before you apply:
- Twelve or twenty-four months of statements, or a CPA profit-and-loss statement or 1099s.
- The freeze or reduction notice, plus your reinstatement request if you sent one.
- A current mortgage statement, the old line’s statement, and a title or vesting check.
- A plain-language explanation of the cut: the cause, what changed, and the date.
- Recent comparable sales if a valuation drove the action.
Check your credit report before you apply. The report cannot be older than 90 days at closing, and the score model keys to the primary wage earner. A bankruptcy needs four years of seasoning from discharge or dismissal. Lendmire’s guide Best Bank Statement HELOC Program When the Lender Reduces or Freezes the Line covers fit.

DSCR: Rent divided by the full monthly property obligation, used to qualify rental loans.
Frequently Asked Questions
Can I apply for a new line while my old one is frozen?
Yes. A freeze is not a credit event that blocks an application. The new lender will see the old line and count it in combined leverage. Eligibility still depends on equity, credit score, occupancy, and title.
Will a bank statement HELOC fix a denial caused by low equity?
No. It changes how income is documented, not how much equity you have. On an investment property the ceiling is 70% combined loan-to-value, and the line is available only at a 700 score or better.
Can a frozen line be restored without a new loan?
Yes, when the cause was temporary. Credit privileges must be reinstated once the justifying circumstance ends and no other ground exists. You may need to ask in writing, and the lender cannot charge a reinstatement fee once the condition is gone.
Does my rental in an LLC qualify for a bank statement HELOC?
No. Title must sit with the individual borrower or a revocable living trust. Move title first, or use a DSCR cash-out refinance, which can lend to LLC-titled properties subject to program terms.
Is a cash-out refinance safer than a HELOC against freezes?
Structurally, yes. The funds arrive at closing, so no draw right remains to freeze. The trade-off is that it replaces your first mortgage, and coverage thins as the balance grows.
Investors who plan their liquidity around a closed-end structure rather than an open line are the ones a freeze cannot surprise.
