How to Qualify for a Bank Statement HELOC After a Divorce Decree Before the Title Changes

How to Qualify for a Bank Statement HELOC After a Divorce Decree Before the Title Changes

The Quick Read: A divorce decree settles who keeps the house between the spouses, but it does not change recorded title or release anyone from the existing mortgage. A home equity line lender can only take a lien from someone on title. So the working order is decree first, recorded deed second, then the application, with bank statements proving income alongside the title work.

  • The decree is not the deed. Until a deed is signed and recorded, title stays in the old names.
  • A quitclaim deed moves title only. It does not take anyone off the mortgage.
  • Bank statement qualification changes how income is documented, not whether the file is underwritten.
  • On Lendmire’s network, an investment-property line tops out at 70% CLTV; primary-residence lines reach higher ceilings only with strong credit.
  • Divorce disrupts deposit history, so sourcing every transfer, support payment, and moved account matters.

You may be asking this question because the ink on the decree is dry and the deed is not. That gap is where most of the confusion lives. This guide walks through what a lender actually sees in that window, what has to happen first, and where the usual rules bend.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

What Is a Bank Statement HELOC, and Who Uses One?

A bank statement HELOC is a home equity line that reads your deposits instead of your tax returns. It suits self-employed owners and investors whose taxable income looks small after deductions. It is reviewed on documented income under the applicable program, subject to lender guidelines.

The line is a revolving credit line secured by your home. A HELOC is a separate product from a DSCR loan, which looks at a rental’s income instead of yours. This article is about the line, because that is what the title asks about.

Across the wholesale network Lendmire works with, the line sits in first or second lien position. Lendmire is a mortgage broker, not the lender. It shops the scenario to select wholesale lenders and matches it to a program. Each lender sets its own statement window and expense treatment. Many programs look at roughly a year or two of statements, but the exact lookback depends on the lender.

Key Terms Defined

Decree: the court order that ends the marriage and divides property and debt between the spouses.

Title: the recorded legal ownership of the property, shown in county records.

Quitclaim deed: a deed where one person gives up their ownership interest, with no promise about the property and no effect on the loan.

Note: the signed promise to repay the mortgage. It is separate from title.

CLTV: combined loan-to-value, meaning all loans on the home added together and divided by the home’s value.

Seasoning: the waiting period a lender may want after a deed or other event before it will lend. It is lender policy, not law.

Vesting: the exact form in which title is held, such as an individual or a trust.

Why the Decree Alone Does Not Get You a Line

A decree binds the two spouses to each other. It does not bind the lender, and it does not rewrite the county’s records. If the decree says you keep the house but only orders a deed to be signed later, title still sits in both names.

A new lender wants a clean lien. It orders a title report that shows the chain of deeds and any existing liens. If your ex is still on title, expect the lender to require a recorded transfer first, or to require your ex to sign the security instrument.

There is one piece of good news. Federal rules protect the transfer itself. The regulation on due-on-sale limits, 12 CFR Part 191, lists a transfer resulting from a divorce decree or property settlement as protected. So moving the house into your name under the decree should not let the first-mortgage lender call the loan.

That protection has limits. A bankruptcy-court opinion from the Eastern District of Wisconsin shows the exemption is read narrowly: the transfer has to actually result from the decree or settlement. And the exemption does not force any lender to release anyone from the note.

What Stays Joint After the Deed

A deed changes who owns the house. It does not change who owes the debt. A joint mortgage stays joint until it is refinanced, assumed, or paid off. A joint credit line stays joint until it is closed or paid off.

That matters for two reasons. First, the existing mortgage still counts on your credit and debt ratio when you apply. Second, a late payment on a joint account hurts both names, whatever the decree says.

A new home equity line does not fix this. It adds a lien. If the goal is to take your ex off the first mortgage, only a refinance or an assumption does that. Keep that in mind when you compare routes later.

The Sequence, Step by Step

Here is the order that works on most files.

1. Read the decree and settlement. Find who gets the property, whether there is a buyout or a refinance-by-date clause, and whether a deed is ordered to be signed later.

2. Sign and record the deed. The departing spouse’s deed removes them from title. Record it with the county.

3. Pull a current title report. Confirm the chain of deeds and every lien. Fix surprises now.

4. Deal with joint debt. Decide what happens to the first mortgage and any joint line. Freezing, paying off, refinancing, or assuming are the usual choices.

5. Set up your statement window. Choose the deposits that prove your income and make sure the accounts are in your name.

6. Apply as the sole borrower. The lender orders a valuation, reviews credit and debts, and applies its own leverage limits.

7. Close and record the new lien. The title now matches the decree.

Some title companies will accept a certified copy of the decree, with a full legal description, as a title document. That is not universal. The lender and the title insurer both have to agree, so treat it as a maybe, not a plan.

How Bank Statement Income Works When You’re Now Single

Bank statements are still underwritten. Income and assets are verified, a valuation is ordered, and leverage and credit rules still apply.

Business statements usually take an expense factor, which is a haircut for operating costs. Deposits have to be identifiable as business income. And the statements that prove income are a separate job from the statements that prove reserves.

Divorce scrambles all of this. Here is what tends to trip files up:

  • Joint accounts that were split. Deposits may drop sharply when the account changes hands. Explain the date and reason.
  • Transfers between you and your ex. Buyout payments, equalization transfers, and moved balances all need a plain explanation.
  • Commingled funds. If personal and business money shared one account, separating it now makes the deposit story cleaner.
  • Support. Support you receive and support you pay both change the picture. Each needs the decree language and a payment history.

Many lenders in the network will want a written explanation for large or unusual deposits. A clean paper trail helps more than a perfect month. Wholesale lenders differ on how many months they read, so a broker who sees several guideline sets can match the window you have to the program that fits it.

What the Network’s Programs Look For

Program figures differ by occupancy, so here they are separated. Every figure is subject to lender guidelines and full file review, and none is a commitment to lend.

Occupancy Credit floor Top CLTV Max line
Primary residence 600 90% (720+ only) $500,000 at 90% CLTV; $750,000 at 75% CLTV, 700+ (720 on the longer-runway program)
Second home 640 90% (720+ only) $500,000
Investment property 700 70% $500,000

A few details change outcomes more than the table suggests. On a primary residence, the 90% ceiling applies only at a 720 or better credit profile and only up to $500,000. A line above $500,000 is primary-residence only, calls for 700 or better (720 on the longer-runway structure), caps at 75% CLTV, and requires a full appraisal.

If the property is a rental you kept in the divorce, the investment ceiling of 70% CLTV is the one that applies. Debt-to-income tops out at 50%, and drops to 45% for credit profiles from 600 to 679. A ratio above 45% needs at least a 680.

Vesting matters here too. Title must be held by you as an individual or in a revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title. A rental that was deeded into an LLC needs a vesting change first, or a different product.

Valuation is usually automated on lines at or below $500,000, though a higher CLTV may call for a second valuation. The basic idea behind a HELOC is that the credit limit generally comes from a percentage of the appraised value, less what you still owe.

Two draw structures exist on the network. One runs a 3-year interest-only draw with a 17-year repayment. The other runs a 5-year draw with a 25-year repayment. Investment lines use the 5-year structure only, and pricing floats rather than converting to fixed.

Where the Rules Bend: Edge Cases

The decree vests title but no deed is recorded. Some states and title companies accept a recorded certified decree. Others do not. Ask before assuming.

Your ex stays on title but not on the new line. Lenders commonly require a non-borrowing title holder to sign the security instrument. Some states require both spouses’ consent on a homestead no matter whose name is on the deed.

A joint line is still open. Either borrower can generally draw on it until it is frozen or closed. Federal rules limit when a lender may freeze or cut a line, so closing it takes coordination.

You are borrowing mid-case. A new lien during a pending divorce may breach court orders or automatic restraining orders. The lender might fund it while the court objects. Get consent as its own item.

The home is a rental held in a trust or entity. Eligible vesting is narrow, as noted above. Do not assume a transfer into a trust is automatically protected the way a residence transfer is. Ask an attorney.

Texas, Tennessee, and a few other states. The network applies state-specific rules. A Texas primary residence is a homestead and caps at 80% CLTV, and carries a waiting period and seasoning rule. Tennessee shortens both draw structures. Availability is limited to Lendmire’s 16 full-service states.

One more point: the broker’s wholesale network spans several lenders, but a housing-history or derogatory-credit event can narrow it fast. A bankruptcy needs 4 years of seasoning from discharge or dismissal. Foreclosure-family events split by program.

HELOC, Refinance, or Something Else?

The right route depends on what the decree says and what you want from the property.

Situation Likely route Why
Keeping the home, ex off the mortgage required Refinance Only a refinance or assumption releases the note
Keeping the home, first mortgage can stay HELOC after deed Adds a lien without touching the first mortgage
Keeping a rental in an LLC Vesting change, or a DSCR cash-out The line cannot close in an LLC
Title cannot be cleared yet Wait, or negotiate with the ex No lender can lien what you do not own

If the property is a rental, a DSCR cash-out refinance is worth a look. It qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. It can replace the first mortgage, take the ex off the note, and pull equity in one transaction. Cash-out leverage tops out around 75% LTV on standard rentals, and about 6 months of seasoning is the common expectation. Coverage of 1.00 is where select programs start, and a separate select-lender path takes coverage below 1.00 with leverage and terms adjusted. See Lendmire’s complete DSCR loans guide for how that works.

Two Neutral Scenarios

Picture a self-employed contractor who keeps the family home under a decree that orders a deed within a set period. The deed gets recorded, the first mortgage stays joint, and she applies alone on a primary residence with a 720 credit profile. Her business deposits dipped when the joint account split, so she documents the date and the reason. The lender reviews the file at a leverage tier set by credit and line size. The deposits, the title, and the equity all had to line up.

Now consider an investor who keeps a duplex. The duplex is held in his name, so title is simple. But the lender’s investment ceiling is 70% CLTV with a 700 minimum credit, and his existing mortgage uses up most of that room. A HELOC leaves little to draw. A DSCR cash-out, sized to rent coverage, may do more. Clearing a coverage ratio is not the same as positive cash flow, since repairs, vacancy, and management sit outside the calculation.

Questions to Ask Before You Apply

  • Will the lender accept a recorded decree, or does it need a deed?
  • Does the lender require your ex’s signature on the security instrument?
  • Does the lender restart a seasoning clock at the new deed?
  • How many months of statements, and which accounts count?
  • How does the lender treat support received and support paid?
  • Does the court order restrict new liens right now?

Ask your divorce attorney about the last one. Federal rules also say a HELOC made alongside a new covered loan on the same home has to be counted in that loan’s repayment review. So if you are also refinancing the first mortgage, tell your lender about both.

Frequently Asked Questions

Can I apply for a bank statement HELOC before the deed is recorded?

You can talk to a broker, but the lender needs title in your name before the line funds. A lender can only take a lien from someone on recorded title. Some files accept a recorded decree in place of a deed, but that depends on the lender and title insurer.

Does a quitclaim deed take my ex off the mortgage?

No. A quitclaim moves title only. The note stays joint until the loan is refinanced, assumed, or paid off. A missed payment still hits both credit reports.

Is there a legal waiting period after the deed?

No law sets one for a new HELOC lender. Seasoning is lender policy and varies. Some lenders want a recorded deed before they will start, and some wait longer.

How do lenders treat divorce-related deposits in my statements?

They look for a clear source and date. Buyout transfers, support, and moved balances usually need an explanation. Support counts as income only with decree language and a payment history, subject to lender guidelines.

What if my rental is held in an LLC?

The line cannot close in an LLC on this network. You would need a vesting change into your own name or a revocable trust, or a DSCR cash-out refinance instead. An attorney should review any transfer.

A decree ends the argument between two people, but the county recorder is the one who decides what a lender can see, so record the deed first.
