Super Jumbo Bank Statement Loan Guest House Rent Rules

Super Jumbo Bank Statement Loan Guest House Rent Rules

The Quick Read: Guest-house rent helps a bank statement file only when it shows up as documented deposits in the account the underwriter analyzes. On an owner-occupied bank statement loan, the property’s projected rent is not the qualifying figure, because the file runs on deposits after an expense ratio. Rent becomes the qualifying income only on a DSCR file for a non-owner-occupied property.

  • Occupancy is declared first: primary, second home, or investment. That choice sets the whole path.
  • Guest-house rent counts on a bank statement file only if it reaches the statements.
  • A guest house that is unpermitted or not legally rentable can be excluded from income.
  • Above $4,000,000, every file is reviewed case by case before submission.
  • Through select wholesale programs, subject to full underwriting, a rent-based path exists on investment property.

A bank statement loan changes how income is documented. It does not change how the property is classified. That one fact explains most of the confusion about guest houses on large estates. Lendmire is a broker that shops these files across multiple wholesale programs, and the guest-house question comes up on a steady share of high-balance files. This article walks through how underwriting treats the rent, step by step.

Key Terms Defined

Super jumbo: A lender-defined size tier above ordinary jumbo. It has no regulatory definition, and each program draws its own line.

Bank statement loan: A mortgage qualified on 12 or 24 months of personal or business deposits instead of traditional personal-income documentation.

Expense ratio: The share of business deposits removed before the remainder is treated as income.

DSCR: Monthly rental income divided by the full monthly housing obligation. It qualifies a non-owner-occupied property on its own rent.

Guest house (ADU): A secondary dwelling on the same parcel, typically with its own sleeping, cooking and bathroom facilities.

Occupancy class: The declared use of the property: primary residence, second home, or investment.

What “Super Jumbo” Actually Means

Jumbo starts where the conforming limit ends. Anything above those lines is jumbo. “Super jumbo” is a label each lender applies at its own threshold.

Across the wholesale network, the practical lines look like this. A portfolio non-QM bank-statement program carries files from $300,000 to $6,000,000. A bank portfolio jumbo program carries twelve-month-statement files up to $30,000,000 on its own size ladder. That ladder begins above $4,000,000 on a primary residence, above $5,000,000 on a second home, and above $3,000,000 on investment property. It overlaps the portfolio program to $6,000,000, and above $6,000,000 it stands alone. Super-jumbo overlays on the portfolio program apply above $3,500,000 on a primary residence and $3,000,000 on a second home or investment property. Those overlays include a 700 credit floor, 0x30x24 housing history, and no rural property.

Size does not change the documentation type. It changes leverage, credit, and reserves.

Does Guest-House Rent Count on a Bank Statement File?

Sometimes, and only through the deposits. The underwriter takes 12 or 24 consecutive months of statements. Transfers and one-time deposits come out. On a business account, an expense ratio comes off. The remainder is divided by the number of months.

If the guest-house tenant pays into the account being analyzed, those deposits sit in the pool like any other. If the tenant pays cash, pays an account that is not in the file, or pays below a market lease with no paper trail, the rent is a documentation gap. It does not count.

Fixed expense ratios on the network programs run 20% for a service business with no employees, 40% for 1-5 employees, and 50% for 6+ employees or any product business. An accountant-provided ratio or a profit-and-loss method capped at 80% are alternatives. Transfers from the borrower’s own business into a personal account count in full. Through select wholesale programs, subject to full underwriting, those are the typical mechanics.

Guest-house rent that lands in a business account gets hit by the expense ratio. Rent that lands in a personal account is analyzed as a personal deposit. Commingled deposits raise questions. Keep the rent in one clearly labeled account.

How Underwriting Handles It, Step by Step

1. Occupancy and purpose are declared. Primary, second home or investment. This decides whether the file is income-qualified or property-qualified.

2. Deposits are analyzed. Twelve or 24 months of statements, with transfers and non-recurring items stripped out.

3. Guest-house rent is tested as a deposit stream. It counts only if the statements show it, and a signed lease supports the pattern.

4. The appraisal describes the property. A Form 1004 gives value only. Form 1007 documents long-term market rent on a one-unit property, and Form 1025 covers 2-4 units and reports both rent and value. Neither captures nightly short-term rent.

5. Legality is checked. The unit should be legal and permitted. An unpermitted guest house can be excluded from income and can complicate the appraisal.

6. Reserves and DTI are calculated. Debt-to-income runs up to 50%. Reserves are 3 months to $500,000, 6 months to $1,500,000, and 9 months above, through select wholesale programs, subject to full underwriting.

The rent amount matters less than three things: documentation, legality, and the occupancy declaration.

Occupancy Decides the Path

On a primary residence, renting a guest house while you live in the main house is consistent with owner-occupancy. The rent still has to come through deposits to help qualify. You cannot buy as a primary and run the whole estate as a full-time rental while living elsewhere. That is occupancy misrepresentation. Moving out after real occupancy and renting the home later is a different situation, generally acceptable after the occupancy period is real.

On a second home, the property must be a single unit. A second home is 1-unit only on these programs. A guest house that functions as a separate dwelling can push the property toward a different classification, so disclose it early.

On an investment property, the rent is the qualifying income. That is the DSCR path.

Occupancy Guest-house rent role What the file leans on
Primary residence Counts only via deposits Bank statements, DTI
Second home Counts only via deposits; 1 unit only Bank statements, DTI
Investment Property rent qualifies DSCR coverage

Bank Statement or DSCR for the Same Estate?

Picture an owner who lives in the main house and rents the guest house. Rent is a small slice of the file. The bank statement route fits, because the borrower’s business deposits carry the income and the guest house is a side stream.

Now picture a buyer acquiring a vacation estate with a main house and a guest house, with no plan to live there. That is an investment file. Rent from both structures is the story, and qualification runs primarily on property-level rental income covering the payment, subject to lender guidelines. Select lenders in the network will review coverage below 1.00, though leverage and terms adjust when they do.

Factor Bank statement DSCR
Income basis Deposits after expense ratio Property rent vs. obligation
Fits Owner-occupied, second home Investment property
Guest-house rent Only if deposited Counts via rent evidence
Key document 12 or 24 months of statements Lease or Form 1007/1025

Leverage Ladder: What the Loan Size Does

The bands are loan amounts, not purchase prices. Compute price times leverage first, then read the band for that loan. These are ceilings through select wholesale programs, subject to full underwriting. Above $4,000,000 each figure is case by case, on review.

On a primary residence, purchase leverage steps down: 90% to $1,000,000, 85% to $2,000,000, 80% to $3,000,000, then 75% to $4,000,000 at the top credit tier. The bank portfolio program takes over above $4,000,000 at 65% on a purchase to $5,000,000, then 60% to $10,000,000 and 55% to $30,000,000, on review.

Second homes and investment property run their own ladders. On an investment-property purchase, the ceiling is 85% to $1,000,000, 80% from $1,000,000 to $2,500,000, and 75% from $2,500,000 to $3,000,000. From $3,000,000 to $4,000,000 the investment-property ceiling is 60% on a purchase, set by the bank portfolio program’s band for that range. From $4,000,000 to $5,000,000 it is 65% on a purchase, case by case on review. The top-tier cells need higher credit. Read each band on its own; never subtract from the primary figure to guess another occupancy’s ceiling.

Edge Cases Where the General Rule Breaks

Detached guest house with no kitchen. Agency definitions of an accessory unit require living, sleeping, cooking and bathroom facilities, as Fannie Mae’s ADU job aid lays out. That definition belongs to the agency channel, but it is a useful test. A guest house without a kitchen is hard to present as rentable income anywhere.

Illegal or unpermitted unit. Agency guidance, such as Freddie Mac’s ADU fact sheet, excludes rent from an illegal ADU. Agency rules do not govern these non-QM files, but wholesale underwriters take the same practical view. No permit, no rent.

Short-term guest-house rent. Form 1007 assumes a lease. A luxury short-term guest house is poorly served by that form, and the appraisal can understate it. Short-term rental rules can vary by city, county, HOA, and property type, so investors should confirm local rules before relying on projected rental income.

Entity borrowers. A loan to an entity for an investment property is business-purpose, subject to program terms and lender eligibility.

Cash-out on the estate. Cash-out on the portfolio program is unlimited at or below 60% LTV, with a $1,500,000 cash-in-hand cap above that. The bank program publishes no cap. On a primary residence, the cash-out column tops out at 80% in the lowest band. Leverage, reserves, and pricing vary by lender and program; the final terms follow the full file review.

What the Investor Decision Looks Like

Start with the question: does the file need the rent? If the borrower’s deposits clear the DTI without it, the guest house is a documentation footnote. Keep the lease, keep the deposits in one account, and make sure the appraisal describes the unit correctly.

If the file does need the rent, there are two honest routes. Move the rent into documented deposits for a full statement window before applying. Or recognize that the property is really an investment and run it on coverage. Rent that is not seasoned or not supported tends to be excluded.

A third option exists for liquid borrowers. Asset allowance divides liquid assets by 36, 60 or 84 months to build qualifying income, on primary and second homes only. Assets-only qualification needs U.S. liquid assets equal to the loan plus closing costs. Retirement accounts count at 70% (80% at 59.5 or older). Business funds, gifts, and cryptocurrency never count.

Operator note: the files that stall on guest houses are rarely rejected over the rent. They stall because the occupancy declaration, the appraisal form, and the deposit pattern tell three different stories. Align those three before submission.

Tax treatment can depend on how the funds are used and how the property is held; borrowers should keep clear records and speak with a qualified tax professional before relying on any deduction.

Frequently Asked Questions

Can guest-house rent help me qualify on a super jumbo bank statement loan?

Only if it appears as deposits in the statements being analyzed. The underwriter does not use the appraiser’s rent figure as income on an owner-occupied file. A lease plus a clean deposit trail is what supports it, subject to lender guidelines.

Does a guest house change my occupancy class?

It can, depending on how the guest house is used. A second home must be a single unit on these programs, so a guest house that works as a separate dwelling needs early disclosure. On a primary residence, renting it while you live in the main house is consistent with owner-occupancy.

What if the guest house is unpermitted?

Expect the rent to be excluded and the appraisal to raise questions. Legal, permitted use is the baseline for counting any rent.

Is the DSCR route better for an estate with a guest house?

When the estate is an investment property, yes, because rent is the qualifying income. Qualification runs primarily on property-level rental income covering the payment. Select lenders review coverage below 1.00, with leverage and terms adjusted.

Does super jumbo size change how rent is treated?

Not the treatment, but the overlays. Above $3,500,000 on a primary and $3,000,000 on a second home or investment property, tighter credit and housing-history rules apply, and above $4,000,000 every file is case by case.
