The Quick Read: No single provider is the right answer for every borrower, because the best program for a spouse buyout depends on credit profile, occupancy, combined leverage, and whether title can carry a new lien. A bank statement HELOC lets a self-employed borrower document income through deposits instead of tax returns, then draw equity to pay out the departing spouse. Lendmire is a mortgage broker that shops a wholesale network of HELOC lenders and matches the file to the program.
- A bank statement HELOC changes how income is documented. It does not change how the file is underwritten.
- Combined leverage across every lien decides how large the buyout can be.
- A new line does not remove the ex-spouse from the existing first mortgage.
- Lines on a primary residence reach higher leverage than lines on an investment property.
- If the decree requires a refinance, a HELOC may not satisfy it.
What Does “Top Provider” Actually Mean Here?
It means the lender whose guidelines fit your file. It does not mean a ranked brand. Bank statement HELOCs are non-QM and portfolio-style products, so each lender sets its own income method, leverage ceiling, and property rules.
How large a line the equity supports.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
That is why a ranked list would mislead you. A lender that suits a primary residence with a strong credit score may decline an investment property. Another may accept the property but cap the line well below what the buyout requires. A broker sees many sets of guidelines side by side and matches the scenario to the program that fits. That is the practical meaning of “best” in this niche.
How Does a Bank Statement HELOC Buyout Work?
The keeping spouse keeps the existing first mortgage, adds a second lien or a standalone line, and uses the draw to pay the departing spouse. Here is the sequence.
1. Size the buyout. Take the home’s value, subtract the mortgage debt, and apply the departing spouse’s share. The settlement or decree sets that share. Community property states generally divide marital property evenly, while equitable-distribution states divide it fairly, which may not be equal.
2. Check combined leverage. Add the first mortgage and the new line, then divide by value. That combined figure, not the line alone, is what lenders cap.
3. Document income with deposits. The borrower supplies a run of bank statements, commonly 12 to 24 months across market programs. The lender averages qualifying deposits and removes transfers and other non-income items. On business accounts, lenders typically apply an expense factor, so only part of the deposits counts as income. Factors vary by lender.
4. Underwrite the whole file. Credit, debt-to-income, title, and the property are all reviewed. This is a documentation choice, not a no-doc loan.
5. Value the property. On the network’s HELOC programs, lines at or below $500,000 ordinarily run an automated valuation, and a full appraisal is required above that size. A borrower may also request one.
6. Draw and pay out. At least 75% of the line is drawn at closing on the network’s programs. The proceeds go to the departing spouse.
Self-employed borrowers often look weaker on tax returns than they are in the bank, because deductions shrink reported income. Deposit-based documentation exists for that gap.
What Do Network Programs Typically Allow?
Leverage depends heavily on occupancy and credit, so no single ceiling applies. These are typical ranges from select wholesale partners, subject to lender guidelines and full file review.
| Factor | Primary residence | Second home | Investment property |
|---|---|---|---|
| Credit floor | 600 | 640 | 700 |
| Top CLTV | 90% at 720+ | 90% at 720+ | 70% |
| Max line | $750,000 | $500,000 | $500,000 |
| Draw structure | Two options | Two options | 5-year draw only |
A few details matter for a buyout.
- On a primary residence, 90% CLTV applies only at a 720 profile, and only up to a $500,000 line. A line above $500,000 is primary-residence only, needs a 700 profile or better (720 on the longer-runway structure), and caps at 75% CLTV with a full appraisal.
- On an investment property, the ceiling is 70% CLTV and the maximum line is $500,000. Many buyouts on a rental simply will not fit under that cap.
- The two draw structures on primary and second homes are a 3-year interest-only draw with a 17-year repayment, and a 5-year interest-only draw with a 25-year repayment. Investment lines use the 5-year draw and 25-year repayment only.
- Debt-to-income tops out at 50%, with 45% for scores from 600 to 679, and the file is qualified on the interest-only payment at the maximum draw.
- Eligible properties include single-family, 2-4 units, PUDs, townhomes, and condominiums. Manufactured homes, co-ops, condotels, log homes, and commercial or agricultural properties are not offered.
- Title must sit with the individual borrower or a revocable living trust. An LLC cannot hold title on these lines.
Availability is narrower than the DSCR footprint. These HELOC programs run in Lendmire’s 16 full-service states, so confirm the state before building a plan around one.
Which Structure Fits Which Borrower?
The choice turns on one question: which looks stronger, your personal profile or the property’s cash flow? A HELOC qualifies you personally. A DSCR cash-out refinance qualifies primarily on property-level rental income covering the payment, subject to lender guidelines.
| Path | Keeps first-mortgage rate | Releases ex from first loan | Income test |
|---|---|---|---|
| Bank statement HELOC | Yes | No | Deposits, credit, DTI |
| Cash-out refinance | No | Yes | Varies by program |
| DSCR cash-out refinance | No | Yes, if the loan is refinanced | Property rent vs. payment |
Preserving a low legacy first mortgage is the main reason to choose a HELOC. The cost is a floating payment that can step up when the draw period ends. The CFPB notes that HELOCs carry variable rates, that a draw period could last 10 years, for example, and that payments are often significantly higher in repayment. Pricing on the network’s lines floats across the draw and repayment period and never converts to fixed.
A refinance resets the first mortgage. That matters if your current loan carries favorable terms, but it is the cleaner route when the decree demands a refinance or when the ex-spouse must come off the note.
Where Does the General Rule Break?
Several edge cases decide outcomes more than the headline guidelines do.
The decree requires a refinance. A HELOC may not satisfy that order. Read the decree language before choosing a product, and confirm with your family-law attorney.
The ex stays on the first mortgage. A new line does not release them. Only a refinance, or an assumption with servicer release, does. Many borrowers accept that exposure for a time. Others cannot, and that settles the structure.
The property sits in an LLC. A vesting change or a DSCR cash-out refinance is the usual fallback. For rentals, that second path is often the practical one.
The lender freezes or reduces the line. HELOC agreements generally let a lender restrict a line if value falls or finances weaken. That is a real risk when a one-time buyout depends on the draw. Drawing at least 75% at closing reduces, but does not remove, the exposure.
Exposure limits apply. A borrower is limited to three lines, and an owner of more than 15 financed properties is not eligible.
Deposit files get messy in a divorce. Joint accounts, deposits that shift after separation, and commingled personal and business funds all complicate the income calculation. Separate the accounts early and keep clean records.
The property is listed for sale. A listing, or one within the past 60 days, makes a property ineligible in NC, PA, TN, TX, and WA.
A Worked Comparison
Run the numbers on two borrowers, using ratios and percentages only.
Say a self-employed borrower holds a primary residence, has a 720 profile, and needs a line under $500,000. Combined leverage lands below the 90% ceiling. Deposit income supports debt-to-income under 50%. This file fits the HELOC lane, and the low first mortgage stays in place.
Now picture an investor buying out a spouse on a rental. The investment ceiling is 70% CLTV with a $500,000 line cap. If the buyout needs combined leverage above 70%, the line cannot reach it. A DSCR cash-out refinance, which tops out around 75% LTV across most of the network, may fit better if rent clears the program’s coverage floor. Clearing 1.00x is where select programs begin, and it is not the same as positive cash flow, since repairs, vacancy, and management sit outside the calculation. Stronger ratios open better leverage. A separate select-lender path takes coverage below 1.00 with leverage and terms adjusted. For the full picture, see Lendmire’s complete DSCR loans guide. Leverage, reserves, and pricing vary by lender and program; the final terms follow the full file review.
What If You Cannot Qualify Alone?
Start by identifying which constraint binds: credit, debt-to-income, combined leverage, or title. Each has a different fix.
- Leverage is the problem. Negotiate a smaller or staged payout, or use a different structure.
- Debt-to-income is the problem. Pay down debt before applying, or look at a refinance with a different income test.
- Credit is the problem. A higher score unlocks higher leverage tiers, and some programs in the network start at 600 on primary residences only.
- Title is the problem. Fix vesting before applying.

Combined loan-to-value (CLTV): the total of all liens on the property divided by its value.
Expense factor: the percentage a lender removes from business-account deposits before counting the rest as income.
Draw period: the stretch when you can borrow from the line, usually paying interest only.
Quitclaim deed: a deed that transfers whatever ownership interest the signer holds, without guaranteeing clean title.
Vesting: how title to the property is held, such as individually or in a revocable living trust.

Frequently Asked Questions
Can I get a bank statement HELOC during a pending divorce?
Sometimes. It turns on whether a court order or your spouse’s written consent permits a new lien, whether title is clean, and whether you qualify alone. Check with your attorney before applying.
Is it a no-doc loan?
No. Bank statements replace tax returns as income evidence, and the file is reviewed on documented income under the applicable program, subject to lender guidelines. Credit, debt-to-income, title, and valuation are all still reviewed.
Does a HELOC remove my ex from the mortgage?
No. It adds a lien without releasing anyone from the existing first loan. Only a refinance, or an assumption with servicer release, does that.
Does my spouse’s income count?
Only if they are a borrower on the new line. If you must qualify alone, the file relies on your own deposits, credit, and debt-to-income. Deposits shifting after separation can lower the figure.
What if the property is a rental held in an LLC?
These lines require title in an individual’s name or a revocable living trust. A vesting change or a DSCR cash-out refinance is the usual alternative. Tax treatment varies; consult a qualified professional.
