How Much a Full-Value VA Cash-Out Releases for a Surviving Spouse

How Much a Full-Value VA Cash-Out Releases for a Surviving Spouse

The Quick Read: A full-value VA cash-out lets an eligible surviving spouse borrow up to 100% of the home’s appraised value, then keep what is left after the old loan, other liens and allowed costs are paid off. For an exempt spouse, the VA funding fee is zero, so none of the ceiling goes to that fee. Your lender may set a lower cap, and the file still has to pass residual income, credit and appraisal review.

Illustrative estimate only — not a Loan Estimate, approval, quote, or commitment to lend. The rate field carries the weekly Freddie Mac thirty-year conventional benchmark, a market reference and not a VA cash-out refinance quote; a VA loan is priced by the lender at lock. The total loan, funding fee included, is capped at the program leverage on the reasonable value; the fee follows the tier chosen. The cash available is what the cap allows less the balances paid off and the fee, before closing costs, which are not included. The HELOC line is the line program’s combined loan-to-value ceiling applied to the same value and balance. Taxes and insurance are editable estimates. The debt-to-income figure is a guideline; residual income decides a VA file. Licensed in sixteen states for consumer mortgages.

Three Things People Mean by “Released”

“Released” gets used loosely, and the three meanings are not the same thing. Sort them out first.

Term What it means Does it change your cash?
Cash released Money paid to you at closing Yes, this is the number you want
Entitlement released VA guaranty tied to a prior loan is freed or restored Can limit how much you can borrow
Liability released A lender or estate is let off an old loan Not a cash-out feature

This article is about the first one. The second matters because remaining entitlement can cap the loan. The third belongs to assumptions, which are a different path.

Who Counts as an Eligible Surviving Spouse?

Eligibility comes from VA, not from the lender. VA’s surviving spouse page explains how to get a Certificate of Eligibility (COE), the VA document that confirms you can use the benefit. If you receive Dependency and Indemnity Compensation (DIC), a monthly VA benefit paid to some survivors, you file VA Form 26-1817. You also send the Veteran’s discharge papers if you have them.

The spouse of a Veteran who died on active duty or from a service-connected disability is generally the person this path is built for. Coverage can also reach some cases where a totally disabled Veteran died of another cause. Remarriage can matter. VA’s rules allow a surviving spouse who remarries on or after age 57, and on or after December 16, 2003, to stay eligible. Earlier remarriages follow a different rule with a long-passed deadline.

Eligibility is not the whole test. VA’s cash-out page sets three conditions: a valid COE, credit and income that meet VA and lender standards, and living in the home you are refinancing. This is an owner-occupied loan. Occupancy decides the leverage, and this program is not for a property you do not live in.

How the Cash Figure Gets Built

The arithmetic is simple. The inputs are where files differ.

VA’s cash-out page says you may refinance up to 100% of the appraised value. The legal basis is explained in the Federal Register rule, which kept the 100% ceiling in place.

Across the wholesale programs Lendmire places VA files with, the VA cash-out reaches 100% of the appraised value including the financed funding fee. It refinances any loan type into VA. Here is the sequence:

Step What happens
1. Appraisal VA appraisal sets the value ceiling
2. Ceiling 100% of value, or the lender’s lower cap
3. Subtract payoff Existing first mortgage comes out
4. Subtract other liens Any other liens on the home
5. Subtract allowed costs Costs paid from proceeds
6. Remainder Cash to you

This is a plain-arithmetic illustration, not a published VA formula. Every loan is different.

Here is where the exemption shows up. The funding fee on a cash-out is 2.15% for a first use and 3.3% after that. Eligible survivors receiving DIC are generally exempt, as are the other exempt groups. When the fee is waived, nothing is financed for it. So the same ceiling leaves more room for cash. A non-exempt borrower with the same home and the same payoff would see a smaller release, because the financed fee takes a slice of the 100%.

Make sure the COE reflects the exemption before closing. Fixing it afterward can mean asking for a refund, which is a hassle you can avoid.

Why 100% Is a Ceiling, Not a Promise

Many people think VA caps cash-out at 90%. That limit is older, and 90% survives only as one way to pass a separate test. The rule now allows 100%. Still, some lenders choose a lower cap as a matter of policy. Advertised leverage varies for that reason, and a lower cap shrinks the cash directly. Every figure here varies by lender and program, and guidelines, property type, leverage and credit profile all apply.

Ask early what cap your lender applies. A 100% program with a lender cap below it will not release 100%.

The Net Tangible Benefit Test

Hitting 100% does not satisfy the rules. The loan also has to show a net tangible benefit, which means the new loan is in your financial interest. VA’s rule lists several ways to pass. One example is a new loan at or below 90% of value, because you keep at least 10% equity.

That is one path of several, not a cap. Choosing a high-leverage loan means the file needs to pass by another route. The refinance also carries seasoning, which is the waiting period after your last loan began. On the programs Lendmire works with, that means the later of 210 days from the first payment and the sixth payment, along with the net tangible benefit.

How the Loan Is Underwritten

Think of it as a full file, not a formality. A cash-out is not an IRRRL, the VA rate-reduction refinance, which does not return cash and runs VA-to-VA only.

Here is what the lender looks at:

  • Credit. VA sets no minimum score. The wholesale programs Lendmire places VA loans with start at a 580 decision score.
  • Residual income. This is the controlling test. It measures what is left each month after your major obligations and living costs. VA publishes minimum residual income amounts by region, household size and loan size, and the lender checks your file against them.
  • Debt-to-income. The 41% figure is a guideline, not a cap. A ratio above 41% needs residual income well above VA’s minimum for your household.
  • Appraisal. VA’s value sets the ceiling.
  • Survivor income. DIC and other survivor income can be part of the picture, and a lender will want the award documentation. Treatment varies by lender, so ask up front.

Entitlement: When It Limits the Loan

With full entitlement, there is no VA loan limit. The wholesale programs Lendmire works with serve amounts to $4,000,000 with full entitlement. That is a program ceiling, not a typical loan size.

Entitlement can be partly in use. VA explains that remaining entitlement for prior users is 25% of the county loan limit, less entitlement used and not restored. With remaining entitlement, a down payment may be required. Speak with a loan officer about your own number. Check the COE for entitlement already in use before you plan around a figure.

Title, Inheritance and Occupancy

Cash-out refinancing replaces an existing first mortgage on a home you own and occupy. So the lender will want to see that you own the home. If you inherited it or the Veteran’s name is still on title, expect questions. A lender will want the title situation clear before the deal works. Occupancy is simpler: you live there now, and you keep living there.

A cash-out can also move a non-VA loan into a VA-backed one. You do not need an existing VA loan to use the program.

What a Cash-Out Does to Your Budget

VA News is blunt about this. Cash-out adds to your loan balance, which raises total interest over the life of the loan. It rarely lowers the monthly payment, and a lender who says otherwise deserves caution. Refinancing is not free, and costs can add up. You should compare the full terms on the Loan Estimate.

When a cash-out is the wrong tool:

Your goal Better fit
Lower payment, existing VA loan IRRRL
Keep a loan you like Keep paying it
Cash for a real need, with equity to spare VA cash-out

Most people want to know how much equity to leave behind.

Key Terms Defined

  • COE (Certificate of Eligibility): The VA document that confirms you can use the home loan benefit.
  • DIC: Dependency and Indemnity Compensation, a monthly VA benefit paid to some survivors.
  • Entitlement: The amount of loan VA guarantees for you.
  • Funding fee: A VA fee that can be financed and is waived for exempt borrowers.
  • Net tangible benefit: A test showing the new loan is in your financial interest.
  • Residual income: What is left monthly after major obligations and living costs.

Common Mistakes

  • Assuming the exemption is automatic. It follows DIC and COE documentation.
  • Planning around 100% before asking about the lender’s cap.
  • Ignoring entitlement still tied up from an earlier loan.
  • Treating an IRRRL as a source of cash. It is not.
  • Starting before the title is in order.

Tax treatment can depend on your situation; borrowers should speak with a qualified tax professional before relying on any deduction or credit.

Frequently Asked Questions

Does a surviving spouse pay the VA funding fee on a cash-out?

Usually not, if you are an eligible spouse receiving DIC. The fee is waived for exempt groups, which is why more of the ceiling stays available as cash. Confirm the exemption shows on your COE before closing.

Can I take out 100% of the home’s value?

VA allows it, but your lender may not. Some lenders cap below 100% as a matter of policy. Ask what cap applies before you assume a number.

Do I need an existing VA loan?

No. A cash-out can refinance a non-VA loan into a VA-backed loan. You do need a valid COE and a home you live in.

Does remarriage end my eligibility?

Not always. A surviving spouse who remarries on or after age 57, and on or after December 16, 2003, may remain eligible. Other remarriage dates follow different rules.

Will a cash-out lower my monthly payment?

Rarely. A cash-out adds to the balance, so VA itself cautions that a lower payment is unusual. If your goal is a lower payment on an existing VA loan, an IRRRL is the tool.
