How Much a Bank Statement HELOC Releases on a Texas Homestead

How Much a Bank Statement HELOC Releases on a Texas Homestead

The Quick Read: Two separate limits set the amount, and the lower one controls. Bank statements change only the income limit. They never lift the state’s 80% combined-leverage ceiling on a primary residence.

  • Legal ceiling: a Texas homestead caps at 80% combined loan-to-value, counting the first mortgage and every other lien.
  • Income ceiling: deposits become qualifying income after an expense factor, and debt-to-income (DTI) is tested on the full line, not your planned draw.
  • Credit tier: your score can set a tighter cap than 80%, and lines above $500,000 on a primary residence carry extra conditions.
  • Texas draws: each draw after closing must be at least $4,000, with no card access.
  • Rentals: an investment property is not a homestead, so these rules do not apply to it.

Key Terms Defined

Homestead is the home you live in as your primary residence. Texas gives it special equity protections.

CLTV (combined loan-to-value) is your first mortgage plus the new line, divided by the home’s value.

Release means the credit line a lender makes available to you. Here it is the dollar capacity of the line, not what you choose to draw.

Expense factor is the percentage a lender subtracts from your deposits to estimate what you actually keep.

DTI (debt-to-income) compares your monthly debts to your qualifying monthly income.

Interest-only payment is a payment covering the cost of borrowing but none of the balance.

Editable Equity Scenario

How large a line the equity supports in Texas.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 80% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Why Does Texas Cap a Homestead at 80%?

The cap lives in the state constitution, not in any lender’s policy. A home equity line on your homestead falls under Article XVI, Section 50 of the Texas Constitution. That text also sets a $4,000 minimum for each advance and bars credit cards or similar devices for drawing. The Texas Real Estate Research Center at Texas A&M confirms that the constitution itself writes the home equity rules.

The practical result is simple. The new line plus every other lien on the home cannot exceed 80% of fair market value on the date the line is made. A lender can be stricter than that. A lender cannot be looser.

Agency lending shows the same ceiling. The Fannie Mae Selling Guide lists an 80% limit for Texas home equity loans of this type. That is a contrast point only, because investor and bank statement programs are not agency products. It does show the cap is a state rule that every lender faces.

How Much Room Does the Legal Ceiling Leave?

Take 80% of the home’s value, subtract what you owe on liens, and you have the legal room. Value is set at closing, and the lender and borrower acknowledge it in writing. Lines at or below $500,000 on the network we place files with ordinarily use automated valuation. A full appraisal is required on every line above $500,000, and you can request one on any line.

The table uses an index. Treat the home’s value as 100, so no dollars are involved.

First-mortgage balance Legal room at 80% Room if your tier caps at 70%
0 (paid off) 80 70
30 50 40
50 30 20
70 10 0
80 or more 0 0

An existing HELOC balance counts toward the same 80% test. If the balance ever climbs above 80% of the value set when the line was established, advances stop until it falls back below.

Texas also allows only one home equity lien on a homestead at a time. A property cannot carry both a home equity loan and a HELOC. An existing Texas cash-out refinance or home equity loan blocks a new line until it is paid off. Lendmire’s piece Can a Texas Homestead Hold a Bank Statement HELOC and a Cash-Out Lien? covers that sequencing problem in detail.

What Does Your Credit Score Do to the Cap?

On most files, your credit tier can pull the ceiling below 80%. Across the wholesale network where Lendmire places these lines, the maximum CLTV on a primary residence steps down with the score. Texas then applies its 80% limit on top, so the lower number wins.

Credit profile Network tier on a primary residence Effective cap on a Texas homestead
660 and up Up to 80% CLTV, lines to $500,000 80%
640 and up 80% CLTV, lines to $500,000 80%
620 and up 70% CLTV, lines to $400,000 70%
600 and up 60% CLTV, lines to $400,000 60%

The top 720-or-better tier tops out at 80% CLTV on a primary residence, and a Texas homestead never gets past that. Higher-leverage marketing numbers you see online do not apply here. On a Texas homestead through this network, 80% is the most any tier can reach. Every figure is subject to lender guidelines and full file review.

Lines above $500,000 on a primary residence are a separate case. They require a credit profile of 700 or better (720 on the longer-draw structure), cap at 75% CLTV, and need a full appraisal. The maximum line is $750,000. Texas properties are also limited to 10 acres.

How Do Bank Statements Become Qualifying Income?

Bank statements replace traditional personal-income documentation as proof of income, and the lender converts deposits to income in steps. This is the part that changes with a bank statement HELOC. The legal ceiling stays put. Only the income test moves.

1. You submit consecutive statements. Lenders commonly review 12 to 24 months of deposits.

2. The lender screens the deposits. Transfers between your own accounts, loan proceeds, and refunds come out. Only recurring earned revenue counts.

3. The lender applies an expense factor. Business statements are discounted more heavily than personal statements, because the business has costs. The lender sets the factor, not you. Some programs accept a CPA letter in its place.

4. Ownership share is applied. If you own part of the business, only your share counts.

5. The result is averaged. Seasonal swings are smoothed over the lookback period. A sharp recent drop usually draws a letter of explanation.

The exact factors vary by lender, so treat any single percentage you read online with caution.

This approach helps a self-employed investor whose traditional personal-income documentation shows large write-offs. Deposits can show more qualifying income than the returns do. The expense factor deliberately takes some of that advantage back.

Why Can DTI Shrink the Line Below the Legal Ceiling?

DTI is tested against the full line, not what you plan to draw. The network’s guidelines cap DTI at 50%. The limit is 45% for credit profiles from 600 to 679, and a ratio above 45% requires a 680 minimum. The lender reviews your file on the interest-only payment at the maximum draw.

That detail catches people. A bigger line means a bigger tested payment, even if you intend to borrow a small piece of it. Income that supports a modest line does not support the full legal room.

Texas adds a second wrinkle. On the lines we place, at least 75% of the approved line is drawn at closing. After closing, each draw must be at least $4,000, and you cannot use a card or check-style access. So the released amount is mostly cash on day one, then lumpy access afterward. The line is also variable and revolving, and it never converts to a fixed payment.

Which Ceiling Binds? Three Modeled Examples

The lower of the two ceilings controls. These are modeled index examples, not market data. Each assumes a home value of 100 and a first mortgage of 50.

Strong deposits, good credit. Legal room is 30 (80 minus 50). Income supports a line of 40. The release is 30, and the Texas ceiling binds. Better documentation would change nothing here.

Thin qualifying income. Legal room is still 30. After the expense factor and the DTI test on the full line, income supports only 18. The release is 18, and the income test binds. This is the situation where a bank statement file can disappoint a borrower who assumed the equity alone sets the number.

Lower credit tier. Say the profile sits in the 620 to 639 band, where the network tier is 70% CLTV. Room is 20 (70 minus 50), even if income would support more. The credit tier binds, and the legal ceiling never comes into play.

Always run all three limits: the Texas 80%, your credit tier, and your income. The smallest result is your release.

What Else Changes What You Receive on a Homestead?

Several Texas-specific rules affect the amount and the process. They bind primary residences only.

  • A 12-day waiting period applies before closing. This is a legal rule, and it runs from the later of your application or delivery of the required notice.
  • Both spouses must consent. The homeowner or spouse can cancel after closing during a rescission window, per the State Bar of Texas.
  • 12-month seasoning is required on the homestead.
  • Listed properties are ineligible. A property listed for sale, or listed within the past 60 days, cannot qualify in Texas.
  • Title must sit with you personally or in a revocable living trust. An LLC, corporation, or partnership cannot hold title on these lines. A home already deeded to an LLC needs a vesting change first.
  • Property types are limited. Manufactured homes, co-ops, condotels, log homes, and agricultural or mixed-use zoning are not eligible.

Availability also matters. Lendmire arranges these lines in 16 full-service states, Texas among them, and some lenders elsewhere exclude Texas homesteads entirely. Ask any lender up front whether it writes owner-occupied Texas home equity lines.

What Bank Statements Cannot Change

A cleaner income file cannot override the constitution. It cannot raise your credit tier, remove the one-lien rule, or waive the waiting period.

A bank statement HELOC is not a no-document loan, either. It is reviewed on documented income under the applicable program, subject to lender guidelines. The lender still reviews credit, DTI, equity, and the property.

Deposits are also not income. They are discounted by a factor you do not choose. And the $1,000-at-a-time draw does not exist in Texas, where the minimum advance is $4,000.

Do the Same Limits Apply to a Rental?

No. An investment property is not a homestead, so the 80% homestead cap and the homestead process rules do not govern it. Texas investment properties and second homes are eligible as non-homestead transactions.

Leverage still has limits. On the network, a HELOC on an investment property caps at 70% CLTV, requires a 700 credit profile, and tops out at a $500,000 line. There is no tier above that for investment lines. Investment lines also run a five-year interest-only draw followed by a 25-year repayment period.

Factor Texas homestead Texas rental
Combined-lien cap 80% by state law 70% under network tier
Minimum credit 600 700
Largest line $750,000 (to $500,000 under 700) $500,000
12-day wait, one-lien rule Apply Do not apply

Ownership differs too. Homestead protections attach to natural persons, so a homestead line cannot sit in an LLC.

How Does This Compare With a DSCR Cash-Out on the Rental?

A home equity line and a DSCR cash-out refinance draw on different equity, so they work as complements, not substitutes. The HELOC taps your homestead and leans on your personal income. A DSCR cash-out taps the rental and qualifies primarily on property-level rental income covering the payment, subject to lender guidelines.

DSCR loans are designed for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage.

On most files in the network, a DSCR cash-out refinance tops out around 75% LTV, with about six months of ownership expected first. A coverage ratio of 1.00 is where many select programs start. A separate select-lender path accepts coverage below 1.00, with leverage and terms adjusted. Stronger ratios open better leverage.

Clearing 1.00 does not mean positive cash flow, though. DSCR compares rent to the full monthly obligation only. Repairs, vacancy, management, and utilities sit outside it. Lendmire’s complete DSCR loans guide walks through how that calculation works.

The decision often comes down to sequence. If you plan a Texas cash-out refinance on the same homestead later, a HELOC now blocks it under the one-lien rule. Many investors weigh that before opening the line.

Tax treatment can depend on how the funds are used and how the property is held. Investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

What Should You Gather Before Applying?

  • Consecutive bank statements covering the lookback period, personal or business.
  • Proof of ownership share if you own part of the business.
  • A letter explaining any sharp recent deposit drop or seasonal swing.
  • The current first-mortgage statement and any existing HELOC balance.
  • Title documents showing you or your revocable trust holds the home.
  • Your spouse’s availability to sign and attend an in-person closing.

Frequently Asked Questions

Can I draw $1,000 at a time from a Texas HELOC?

No. Texas sets a $4,000 minimum for each advance, and credit cards or similar devices cannot be used for drawing. Most of the line is also drawn at closing on the programs Lendmire places, so access after closing is occasional and in larger pieces.

Does a larger deposit history raise my limit above 80%?

No. Deposits only affect the income test. The 80% combined cap on a Texas homestead comes from state law, and it applies no matter how strong your statements look. Strong income simply means income is less likely to be the binding limit.

What happens if I already have a Texas cash-out refinance or home equity loan on the home?

You generally cannot add a HELOC while that lien stands. Texas permits only one home equity lien on a homestead at a time. The existing lien would need to be paid off first.

Does my rental property follow the same 80% rule?

No. A rental is not a homestead, so the state’s homestead cap does not govern it. On the network, a HELOC on an investment property caps at 70% CLTV with a 700 credit minimum and a $500,000 maximum line.

Can my LLC hold the home when I apply?

No. On these lines, title must sit with you individually or in a revocable living trust. An LLC, corporation, or partnership cannot hold title. A property already in an LLC needs a vesting change or a different structure such as a DSCR cash-out, subject to program terms.
