Can You Get a Bank Statement HELOC Right After a Spousal Quitclaim?

Can You Get a Bank Statement HELOC Right After a Spousal Quitclaim?

The Quick Read: Usually yes, as long as the deed is recorded, the person applying matches the person on title, and the title is held in an eligible way. No federal rule blocks a new line after a spousal deed, so any waiting period is lender policy.

  • A quitclaim moves title. It does not move the mortgage debt.
  • On an investment property, the line must sit in an individual’s name or a revocable living trust.
  • Investment lines run up to 70% CLTV, with a 700 minimum credit profile and a $500,000 maximum line.
  • Debt-to-income tops out at 50%, and deposits are screened line by line.
  • Some lenders count seasoning from the original purchase. Others restart the clock at the new recording date.

What Does a Spousal Quitclaim Change?

A quitclaim changes who owns the property. It does not change who owes the loan. A spouse who signs the deed away stays on the existing mortgage until it is refinanced, assumed, released by the lender, or paid off. Florida Realtors makes the same point: the lender can look to both borrowers until the loan is gone.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Two practical consequences follow for a new equity line.

First, only someone on title can borrow against the property. A spouse who quitclaimed out cannot be the applicant on that rental.

Second, the departing spouse’s name on the first mortgage still shows up in the retaining spouse’s credit and debt-to-income picture. Settlement agreements often require a refinance within a set period. Until that happens, the underwriter sees the obligation.

A decree alone does nothing to title. Title moves only when the deed is recorded with the county. Any seasoning clock runs from that recording date, not the signing date.

Does the Deed Start a Waiting Period?

No law sets one for a new line. The lender decides. Across the wholesale network, the treatment splits two ways, and the file lands in one bucket or the other.

Approach Where the clock starts Effect on a fresh deed
Look-through Original purchase date Deed rarely delays the file
Restart New recording date Wait until seasoning is met

Divorce-related transfers are a common place for lenders to shorten or waive the wait. Some programs say nothing at all, so the borrower has to ask. Get the policy in writing before the deed is recorded, not after. A deed recorded last month on a restart lender’s file is a preventable delay.

Picture an investor who adds a spouse to a rental title in the same week she wants to pull equity. On a look-through lender, the file reads off the original purchase. On a restart lender, the same file waits. Same property, same borrower, different answer. That is why comparing several lenders matters more than any single guideline.

Which Direction Did the Deed Go?

Direction decides who applies, who signs, and what the underwriter checks. This is where most borrowers get tangled.

Scenario Who is on title What to check
Spouse added Both spouses Both sign; application matches title
Spouse removed Retaining spouse Departing spouse’s liability on first mortgage
Divorce-awarded Awarded spouse Recorded deed, not just the decree
Moved to an LLC The entity Ineligible for this line

Adding a spouse is the simplest. Both owners usually sign, and the application has to match title. Removing a spouse is mostly a debt question: is the ex still on the first mortgage, and does that obligation count against the retaining spouse’s ratios?

Divorce transfers add one more layer. A decree assigns responsibility, but it does not release anyone from the lender. A decree that assigns the payment to an ex-spouse still leaves the original borrower liable to the lender.

How Does Bank Statement Qualification Work When Title Just Changed?

Bank statement qualification reads income from deposits instead of traditional personal-income documentation. A self-employed borrower provides 12 to 24 months of personal or business statements. The lender applies an expense factor, or uses a profit-and-loss statement prepared by a third-party tax professional. Scotsman Guide’s non-QM overview describes this mechanism and notes that non-QM lenders must still confirm ability to repay, with more flexibility in how. The expense factor is set by the lender. Treat any single figure you read as an example, not a rule.

This path matters most for self-employed landlords. Heavy write-offs and depreciation can understate income on traditional personal-income documentation, so deposits tell the truer story.

“Bank statement” does not mean light underwriting. The file is reviewed on documented income under the applicable program, subject to lender guidelines, and still runs credit, combined LTV, debt-to-income, deposit screening, and title review.

A spousal deed adds specific wrinkles:

  • Transfers between accounts and loan proceeds get stripped from deposits.
  • If deposits land in a joint account, expect questions about ownership percentage and whose business produced them.
  • If a spouse was removed from title but still shares the account, the lender will want to see which deposits belong to the applicant.
  • Large one-off deposits need a written explanation.

Clean separation of accounts, before the application, removes most of these questions.

What Are the Network Numbers on an Investment Line?

These are the parameters for an investment property line, typically and subject to lender guidelines. Lendmire brokers these lines through select wholesale partners and is never the lender.

  • Combined leverage: up to 70% CLTV on investment property.
  • Credit: a 700 minimum profile.
  • Line size: up to $500,000. There is no tier above that for investment property.
  • Debt-to-income: 50% maximum, qualified on the interest-only payment calculated on the maximum draw.
  • Structure: a standalone line in first or second lien position, with a 5-year interest-only draw and a 25-year fully amortizing repayment. At least 75% of the line is drawn at closing.
  • Valuation: lines at or below $500,000 ordinarily run automated valuation, though a borrower may request a full appraisal.

Market surveys report non-QM leverage reaching as high as 90% on some products, per the same Scotsman Guide piece. That is a market-wide figure. On the network’s investment line, the ceiling is 70% CLTV, full stop. The 90% CLTV tier exists only on primary-residence and second-home lines, and only at a 720-or-better credit profile.

This product is available only in Lendmire’s 16 full-service states, narrower than the 41-market DSCR footprint. A borrower also cannot hold more than three lines through the network, and owning more than 15 financed properties makes a borrower ineligible.

Title and Vesting: The Gate That Stops Most Files

Title must be held by the individual borrower or an inter vivos revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title for this line.

This is the sharpest structural difference from a DSCR loan. A rental deeded into an LLC has to be deeded back out first, or the investor uses a DSCR cash-out refinance instead. A DSCR cash-out is a property-cash-flow test rather than a borrower-income test, and it can work for entity-titled files, subject to lender program eligibility. On most files the network’s cash-out tops out around 75% LTV with about 6 months of seasoning.

A transfer into a revocable trust where the borrower stays a beneficiary is a listed exemption under 12 CFR §191.5, and it also meets the network’s vesting test. Moving a rental from joint names into a revocable trust is usually clean. Moving it into an LLC is not, on either front.

For the broader product, Lendmire’s complete DSCR loans guide covers how property-income loans compare.

What About the Existing Mortgage and Due-on-Sale?

Keep this separate from seasoning. Federal law limits when a lender can call an existing mortgage due because of a transfer. Under 12 CFR Part 191 on eCFR, transfers where a spouse becomes an owner, and transfers from a divorce decree or incidental property settlement, are protected.

Two cautions for rental owners. The regulation’s occupancy language sits under the limitation for a home occupied or to be occupied by the borrower. A non-owner-occupied rental should not assume the safe harbor applies. And the rule restricts calling the existing loan. It does not force a new line lender to ignore the deed.

Ask the first-mortgage servicer and a real estate attorney about your specific note. Also ask the title company whether an existing owner’s policy survived the quitclaim, since that depends on the insurer.

Before You Record: A Pre-Application Checklist

Sequence matters more than speed. Run through this before the deed goes to the county.

1. Ask each candidate lender for its seasoning policy in writing: look-through or restart. 2. Confirm vesting. The final title must be an individual or a revocable living trust. 3. Finish the refinance or lender release first if a departing spouse is on the first mortgage. 4. Separate accounts so deposits clearly belong to the applicant. 5. Assemble 12 to 24 months of statements and explain every large or unusual deposit. 6. Check that the insurance policy names the right owner after the deed.

If You’re Told to Wait or Denied

Most denials after a spousal deed trace to one of four causes.

Reason Fixable? Next step
Restart seasoning not met Yes Wait, or use a look-through lender
Title in an LLC Yes Deed out, or DSCR cash-out
Departing spouse still on note Yes Refinance or lender release
Deposits unclear or joint Often Separate accounts, document ownership

If credit or combined leverage is the issue, the fix is different: lower the requested line, pay down debt, or wait. Not every denial is about the deed.

Key Terms Defined

  • Quitclaim deed: a deed that transfers whatever ownership interest the signer has, with no promise the title is clean.
  • Recording: filing the deed with the county, which is when title actually moves.
  • Vesting: the exact way title is held, such as an individual or a revocable living trust.
  • Seasoning: the minimum time a lender wants the borrower to have held title before lending.
  • CLTV: combined loan-to-value, counting every lien against the property.
  • Look-through: counting seasoning from the original purchase, not the latest deed.

Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

Frequently Asked Questions

Is there a legal waiting period after a spousal quitclaim before I can borrow?

No. Waiting periods come from lender policy. Some lenders count from your original purchase, and others restart at the recording date. Ask for the policy in writing before you record.

Does removing my spouse from title remove them from the mortgage?

No. The deed and the loan are separate. The departing spouse stays liable until a refinance, assumption, lender release, or payoff. That obligation also counts in your debt-to-income picture.

Can I take this line on a rental held in an LLC?

No. On the network’s investment line, an LLC cannot hold title. You would deed the property out of the entity first, or use a DSCR cash-out refinance, which can work for entity-titled files subject to program eligibility.

Does a divorce decree change who owns the property?

Not by itself. Title moves only when a deed is recorded. A decree assigns responsibility, but the lender still looks to the borrowers on the note.

What leverage and credit does an investment line require?

Typically up to 70% CLTV, a 700 minimum credit profile, a 50% debt-to-income ceiling, and a line up to $500,000, subject to lender guidelines. If you want to see how the numbers work, Lendmire can help you compare home equity line options based on the property, the equity available, your credit profile, combined leverage, and your goals. It is not a commitment to lend.
