The Quick Read: Florida counts documentary stamp tax on the recorded mortgage, and the base is the full secured amount of the line, not only the first draw. Miami-Dade adds no separate tax to a HELOC, because its county surtax sits on deeds. The way income is documented changes who qualifies, but it does not change the tax.
- The tax follows the recorded mortgage and the stated line amount, so a large undrawn line still costs more at recording.
- The Miami-Dade deed surtax is a transfer tax and does not attach to a new HELOC.
- Bank statement underwriting changes qualification, not the tax math.
- A recorded mortgage has no cap on doc stamps, while the cap on a note by itself does not rescue a secured line.
- Florida’s rules are under revision, so confirm current text before you price a closing.
Key Terms Defined
Documentary stamp tax (doc stamps): a Florida state tax on documents such as notes and recorded mortgages, charged per $100 of the amount involved.
Intangible tax: a separate one-time Florida tax on a recorded mortgage, charged at 0.2% of the secured amount.
Credit limit (line amount): the maximum the borrower may draw, which is usually the number the mortgage secures.
Drawn balance: the money actually advanced so far, which can be far below the credit limit.
Maximum lien: a cap written into the mortgage that limits what the lien secures, which may change the tax base.
Deed surtax: the extra Miami-Dade tax on transfers of title, which does not apply when you borrow against a property you already own.
How large a line the equity supports.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
What Is the Tax Base on a HELOC?
The base is the full indebtedness the mortgage secures. The Florida Department of Revenue says mortgages and liens are taxed on the full amount of debt they secure, whether the debt is contingent or absolute, at 35 cents per $100 or portion thereof. The same page says there is no cap on tax due on a recorded mortgage.
On a revolving line, that matters more than any first draw. A borrower who opens a line and draws a fraction of it still pays on the line amount or the stated maximum lien. Pull-through draws later do not shrink that cost, and a larger limit adds to the cost at closing even if the money sits unused.
Here is the arithmetic in plain steps:
1. Take the secured amount, meaning the credit limit or the stated maximum lien.
2. Divide by 100 and round up to the next whole $100 increment.
3. Multiply by $0.35 to get the doc stamps on the mortgage.
4. Add the intangible tax by multiplying the secured amount by 0.002. This tax carries no $100 rounding.
One caution on step 4. The sources that apply intangible tax to the full line rather than the advanced amount are secondary commentary, so confirm that point with the closing attorney or title agent against the statute before you rely on it.
Does the Note Cap Help on a Recorded Line?
Usually it does not. The Department of Revenue states that the tax on a note or other written obligation to pay money is capped at $2,450. That cap works out to a $700,000 base at the 35-cent rate. The mortgage is a separate document with its own uncapped tax.
Rule 12B-4.053 adds that notes drawn in connection with a line of credit are taxable when they are executed in Florida, or approved and accepted in Florida. It also states a $2,450 maximum for a demand loan. So the note side can be capped while the mortgage side keeps running on the full secured amount.
This is where borrowers misread online calculators. Some blur the note cap and the mortgage tax into one figure. Treat them as two lines on the closing statement.
What Does Miami-Dade Change?
Miami-Dade changes the deed side only. The county surtax applies when title transfers, such as a purchase or a deed into a new owner. A HELOC does not transfer title, so a standalone line on a property you already own carries no county surtax. Doc stamps and intangible tax come from the state, and they are the same in Miami-Dade as in any other Florida county. Miami-Dade does not add a separate tax on a mortgage or a HELOC note.
| Tax or charge | Attaches to | Applies to a new HELOC? |
|---|---|---|
| State doc stamps on the mortgage | Recorded mortgage | Yes, on the secured amount |
| State doc stamps on the note | Note or credit agreement | Yes, subject to the note cap |
| Intangible tax | Recorded mortgage | Yes, at 0.2% |
| Miami-Dade deed surtax | Deed transferring title | No |
The one place a HELOC and a deed meet is a transfer of a property that already carries a line. The Department of Revenue’s own example computes deed stamps with a $3 million mortgage and a $700,000 line balance in the picture. That is a sale scenario, not a new line, so do not borrow its math for a refinance.
Does Bank Statement Documentation Change the Tax?
No. Doc stamps depend on the credit line amount, the recorded mortgage, and where the note is signed and delivered. They do not depend on how income was documented.
A bank statement HELOC is a qualification path. The borrower is reviewed on documented income under the applicable program, subject to lender guidelines, rather than on a standard tax-return profile. A file with a lower credit tier, a higher debt ratio, or a bigger line faces tighter limits, but none of that moves the tax rate. Two borrowers with the same line and the same recorded mortgage owe the same state tax, whichever way their income was documented.
That separation is useful for planning. Qualification asks whether the file clears credit, debt ratio, and equity tests. Tax asks only what the lien secures and where the paper is executed.
What Do the Program Limits Look Like for Florida Investors?
Lendmire arranges these lines through select wholesale partners in its 16 full-service states, and Florida is one of them. Figures below are typical guidance, subject to lender guidelines and a full file review. Occupancy changes the answer, so each limit is tied to its own property use.
| Property use | Typical max CLTV | Typical max line |
|---|---|---|
| Investment property | 70% | $500,000 |
| Second home | 90% at 720+ credit | $500,000 |
| Primary residence | 90% at 720+ credit | up to $750,000 |
On an investment property the ceiling is 70% combined loan-to-value, with a minimum credit score of 700. On a second home the 90% figure appears only at a 720 or better credit profile, and lower tiers step down from there. On a primary residence a line above $500,000 needs a 700 or better credit profile (720 on the longer-runway structure) and caps at 75% CLTV. Each figure is subject to lender guidelines and a complete review of property type, leverage, and credit.
Several points shape how the tax lands on these lines:
- Structure. The line is a standalone first or second lien. Investment lines run a 5-year interest-only draw followed by a 25-year repayment period.
- Title. The individual borrower or a revocable living trust must hold title. An LLC cannot hold title on this product, which is a sharp difference from DSCR financing, so a property already deeded to an LLC needs a vesting change or a DSCR cash-out instead.
- Draw at closing. At least 75% of the line is drawn at closing, which narrows the gap between the tax base and the money actually used.
- Debt ratio. The maximum debt-to-income ratio is 50%, and a ratio above 45% requires a 680 minimum.
- Valuation. Lines at or below $500,000 ordinarily run an automated valuation, and a full appraisal applies above that size.
When the General Rule Breaks
The base rule is straightforward. These edge cases are where files get surprises.
Note signed outside Florida. A note executed and delivered outside the state but secured by Florida real property still triggers doc stamps and intangible tax once the Florida mortgage is recorded, per Starfield & Smith. An out-of-state signing does not avoid the tax.
Maximum-lien language. The same firm explains that when a mortgage limits what it secures to a stated maximum, the tax is computed on that maximum. For a loan of $700,000 or more where the mortgage is limited to a lesser amount, the note-side cap may come into play. This is a law-firm reading and a structuring question, not a general rule, so a closing attorney should confirm how it applies to a particular line.
Unfunded lines and contingent obligations. Rule 12B-4.054 addresses exempt transactions, including promises to pay that are not fixed and absolute when signed. That sits awkwardly beside the Department of Revenue’s statement that mortgage tax applies to contingent or absolute debt. Do not assume an undrawn line escapes the tax.
Later draws, increases, and modifications. Rule 12B-4.053 treats notes tied to a line of credit as taxable documents. A 1997 report from Florida TaxWatch notes that minor changes to note or mortgage documents can be treated as taxable renewals. That report is old, so current renewal treatment needs checking before you plan a mid-term increase.
A second lien behind an existing mortgage. The new tax is based on the new line. The first mortgage was taxed when it was recorded and is not taxed again.
Rules in motion. The Department of Revenue has a rulemaking notice that proposes removing provisions on determining the amount of a secured line of credit, as well as the maximum and minimum tax on written obligations. Confirm current rule text before you finalize cost estimates.
How Does This Compare With a DSCR Cash-Out Refinance?
A DSCR cash-out refinance also pays note and mortgage tax, but on the new loan amount. A HELOC is taxed on the line amount instead. The two products serve different goals.
A HELOC at the investment tier tops out at $500,000 on an individual or revocable-trust title. A DSCR cash-out refinance qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. It runs to about 75% LTV on standard rentals, and it can sit in an LLC subject to program eligibility. Clearing 1.00 coverage is not the same as positive cash flow, since repairs, vacancy, and management sit outside the calculation. Lendmire’s complete DSCR loans guide covers those mechanics in full.

Common Mistakes
- Treating the tax as a lender fee. It is a state tax collected at recording. By Florida custom the borrower pays the note tax and intangible tax, though the statute and the Department of Revenue govern legal liability.
- Sizing the line by the first draw. The tax follows the secured amount, so an oversized limit raises closing cost even if it stays unused.
- Applying deed math to a loan. The county surtax belongs to deeds.
- Assuming the $2,450 cap covers everything. It covers the note, not the recorded mortgage.
- Assuming non-traditional documentation means different taxes. The documentation type does not appear in the tax.
Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.
What the Decision Looks Like in Practice
A Miami-Dade investor weighing a line against a cash-out refinance should price three things side by side: the secured amount the tax will run on, the leverage tier the property supports, and whether the title can sit with an individual or revocable trust. The line is the cheaper tool when the investor wants flexible access, holds title personally, and sits within the investment-tier limits of 70% CLTV and a $500,000 line. The cash-out refinance fits better for an LLC-titled property, a larger draw, or a borrower who wants coverage-based qualification.
Ask the title agent for the tax line items before you commit to a line size. The two figures worth comparing are the mortgage doc stamps and the intangible tax at the full limit, because those two move with every dollar added to the line.
If you are considering a home equity line and want to see how the numbers work, Lendmire can help you compare HELOC options based on the property, the equity available, credit profile, combined leverage, and your goals. It is a mortgage broker arranging financing through select lenders in its wholesale network, and nothing here is a commitment to lend.
Frequently Asked Questions
Do I pay doc stamps on money I haven’t drawn?
Usually yes. The mortgage tax is based on the full secured amount, so the credit limit or stated maximum lien drives the cost, not the balance. A drawn amount of 75% at closing narrows the gap on these programs, but the tax still follows the limit.
Does Miami-Dade’s extra transfer tax apply to a HELOC?
No. The county surtax attaches to deeds that transfer title. A HELOC secures a lien on property you already own, so only the state doc stamps and intangible tax apply.
Do bank statement HELOCs cost more in taxes?
No. The documentation type does not enter the tax calculation. The tax depends on the line amount, the recorded mortgage, and where the note is executed, and the same line owes the same tax under any income documentation.
Does signing out of state avoid the tax?
Not when a Florida mortgage secures the debt. A note signed and delivered elsewhere but secured by Florida real property still triggers the tax once the mortgage is recorded.
Who pays doc stamps on a HELOC?
By Florida custom the borrower pays the note doc stamps and intangible tax, and it shows up as a closing cost. The statute and the Department of Revenue govern legal liability, so confirm the allocation with the closing agent.
