How to Document Union Residuals on a Super Jumbo Bank Statement Loan

How to Document Union Residuals on a Super Jumbo Bank Statement Loan

The Quick Read: You document residuals by tracing each deposit from the payment advice to the bank statement line, then labeling it by payer. Underwriters count only deposits they can tie to a union or payroll source. Through select wholesale programs, subject to full underwriting, a clean trace turns lumpy residual checks into qualifying monthly income.

  • Residuals are earned income for past work, so lenders review them like variable wages or self-employment deposits.
  • Most union residuals arrive on a W-2 through a payroll company, but some arrive on a 1099 or through a loan-out company.
  • Statements must be consecutive, and 12 or 24 months of them is the usual lookback.
  • Loan size changes the leverage you can use and the reserves you need, but not how residuals are traced.
  • Rental purchases can often skip personal income entirely through a DSCR loan.

Key Terms Defined

Residual: a payment to a performer or writer when a past production is reused, such as in reruns or streaming.

Payment advice: the cover statement or check stub that shows the gross amount, withholding and payer for a residual.

Loan-out company: a business entity that employs the performer and receives the performer’s payments, then pays the performer by salary and distributions.

Expense ratio: the percentage of deposits a lender subtracts to estimate business costs before counting income.

Tracing: matching each deposit on a statement to a source document, so nothing is counted on a guess.

Super jumbo: a market term for loans far above the agency conforming limit. It has no official definition. Within this article’s programs, the super jumbo line sits at $3,500,000 on a primary residence and $3,000,000 on a second home or investment property.

Do Residuals Count as Income on a Bank Statement Loan?

Yes, they count when you can prove them and when they look likely to continue. A residual is not passive income. SAG-AFTRA’s tax FAQ says residuals are payment for services the performer previously performed. That classification matters because it puts them in the same family as other earned, variable income.

Underwriters therefore ask the questions they ask of any irregular earner. Can each deposit be traced? Is the stream steady or fading? Is the money landing in a personal or a business account?

Across our wholesale network, residuals are not treated as a separate product. They sit inside a standard bank-statement review. Each program decides for itself how much weight a tapering stream gets, so the documentation has to make the pattern easy to read.

How a Residual Deposit Becomes Qualifying Income

Eligible deposits are added up, divided by the number of statement months, and reduced by an expense ratio where the program applies one. Through select wholesale programs, subject to full underwriting, the lookback is 12 or 24 consecutive months of personal or business statements. The bank portfolio program uses 12 months.

The steps run in this order:

1. The underwriter screens out deposits that are not income, such as transfers between your own accounts and refunds.

2. Eligible deposits are totaled and divided by the statement months.

3. An expense ratio is applied where the account type calls for one. Business statements need at least 25% ownership. Fixed ratios are 20% for a service business with no employees, 40% for one to five employees, and 50% for six or more employees or any product business. An accountant-provided ratio is another option.

4. Transfers from your own business into your personal account count in full.

A profit-and-loss method also exists, capped at 80%. Transaction histories never replace consecutive statements.

What Each Payment Channel Looks Like

Residuals reach your account through several channels, and each one needs different backup. Reed Corp’s CPA guide says most SAG-AFTRA residual checks come on a W-2, with the signatory producer as employer of record. It also says residuals paid by a trust, a foreign distributor or a successor entity often come on a 1099 with no withholding. Use that as a working rule, then let your own forms tell you which applies.

Channel What the deposit looks like What to attach
W-2 via payroll company Net of withholding Payment advice, W-2
1099 from trust or distributor Gross, no withholding Payment advice, 1099
Paid to a loan-out Business account deposit Entity papers, business statements
Routed through an agent Net of agent commission Advice showing gross and commission

On a typical booking, the payroll company sends gross pay to the agency, which keeps its commission and forwards the rest, per Reed Corp’s commission guide. So your deposit can sit well below the figure on your tax form. The payment advice is what bridges that gap.

The Step-by-Step Documentation Procedure

Work through this list before you submit. It mirrors what an underwriter will otherwise ask for one email at a time.

1. Pull every statement page. Gather 12 or 24 consecutive months, every page, including blank-looking ones.

2. Mark the residual deposits. Highlight each deposit from a union, payroll company or distributor.

3. Attach the payment advice. Match each highlighted deposit to its cover statement or check stub.

4. Reconcile gross to net. Where withholding or commission shrinks the deposit, note the gross, the deductions and the net on one line.

5. Add the annual forms. Include W-2s and 1099s for the prior years to show payer type.

6. Separate the accounts. If residuals flow through a loan-out, include entity documents, ownership proof and the business statements, plus the salary and distribution transfers into your personal account.

7. Label odd deposits. Write a short explanation for any one-time buyout, settlement or foreign payment.

8. Consider an accountant letter. It can support a lower expense ratio or explain a loan-out structure.

9. Build the file in order. Statements first, then advice, then forms, then letters.

Keep personal transfers and residual deposits clearly apart. A residual that looks like a transfer from a friend gets stripped out, and that is the most common way a good file loses income. For a broader list of what a high-balance file needs, see Lendmire’s general super jumbo bank statement document checklist.

A Modeled Example: The Tapering Stream

Say your residuals on an older series run lower each year. These are modeled index points, not dollars. The earlier year averages 100 per month and the most recent year averages 70.

On a 24-month window, eligible deposits average 85 per month. On a 12-month window, they average 70. The 24-month view looks better here. Underwriters also look at trend, so a declining line may draw a closer review whichever window you use.

Which window is available depends on the program. The portfolio non-QM program, which carries files to $6,000,000, offers 12 or 24 months. The bank portfolio program, which carries twelve-month-statement files to $30,000,000, uses 12.

Now add a loan-out. If the 70 flows through a business account, a 20% ratio for a service business with no employees would leave about 56. Moving the same money to your personal account by transfer counts it in full. The account path changes the math, so document which one is real.

Common Red Flags and Their Fixes

Red flag Clean fix
Missing statement pages Re-download full statements
Unlabeled deposits Add payment advice per deposit
Net-versus-gross mismatch One-line reconciliation
Lump-sum buyout Explain it in writing; expect it to be removed
Loan-out ownership unclear Provide entity and ownership papers
Transfers counted as income Flag them and exclude them yourself

What Changes at Super Jumbo Size

Loan size changes everything except the tracing. Through select wholesale programs, subject to full underwriting, leverage on a primary residence purchase steps down with the loan amount. The ceiling is 90% to $1,000,000, 85% to $2,000,000, 80% to $3,000,000 and 75% to $4,000,000 at the top credit tier. The 90% cell needs a score of 680 or better. Above $4,000,000, everything is reviewed case by case before submission. On a primary residence purchase, the bank portfolio program steps to 65% from $4,000,000 to $5,000,000, on review.

Second homes and investment property use their own ladders. Read each figure from that occupancy’s own table, never by subtracting from the primary figure.

Other tests still apply. The credit floor is 660 on the portfolio program, 700 above the super jumbo line, and 680 on the bank program. Debt-to-income can run to 50%. Reserves are 3 months to $500,000, 6 months to $1,500,000 and 9 months above that. Above $3,500,000 on a primary residence, extra overlays apply, including a 700 credit floor and a 0x30x24 housing history. Residual income does not get a pass on any of these.

Lenders also have to confirm that a borrower can repay. That determination must be reasonable and made in good faith before consummation. Legal commentary on non-QM files notes that a lender need only verify the income it actually relies on. That is why only the residual deposits counted must be proven, and why an estimate will not do.

Where the General Rule Breaks

Loan-out structures. When residuals are paid to your company, you document through the business. Arc & Ledger’s entertainment tax guide says the loan-out pays the performer through salary and distributions. Your file then needs entity papers, ownership proof of at least 25%, and the transfers into your personal account.

Mixed payers. Most working performers run a hybrid file, with union residuals on a W-2 and other work on 1099s. Label each stream separately so the deposits do not blur together.

Retired performers. Residuals are payment for earlier work, so they can continue after active work stops. Whether a lender counts them depends on the program, and a long, steady history helps.

Other unions. SAG-AFTRA, the WGA and the DGA each run their own residual systems, per the same Arc & Ledger guide. The payment advice looks different from each, so attach the right one.

Lump sums. A one-time buyout or settlement is not recurring income. Expect it to be stripped from the average.

When Another Path Fits Better

If you are buying a rental, you may not need residuals at all. A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines. It asks for no personal income documentation, because qualification runs on the property’s income. Lendmire’s complete DSCR loans guide walks through how that works. Select lenders in the network also offer sub-1.00 programs, though loan-to-value and terms adjust.

Two asset paths exist for primary and second homes. An asset allowance divides liquid assets by 36, 60 or 84 months, and assets-only needs liquid U.S. assets equal to the loan plus closing costs. Retirement accounts count at 70%, or 80% at age 59.5 and up. Business funds, gifts and cryptocurrency never count.

Tax treatment varies; consult a qualified professional.

Frequently Asked Questions

Are residuals W-2 or 1099 income?

Most union residuals arrive on a W-2, because the signatory producer is the employer of record. Payments from a trust, a foreign distributor or a successor entity may come on a 1099. Your forms show which applies, and the file should label each stream.

Can I use personal statements, or do I need business statements?

Both are accepted through select wholesale programs. Business statements need at least 25% ownership and an expense ratio. Transfers from your own business into a personal account count at 100%.

Why is my deposit lower than my W-2 shows?

Withholding, agent commissions and payroll fees all shrink the net deposit. Add a one-line reconciliation next to the payment advice. This keeps the underwriter from guessing.

Do lump-sum buyouts count?

Usually not. They are one-time payments, and underwriters strip them from the average. Document them with a short letter so they do not look like unexplained deposits.

Does a super jumbo loan need more proof of residuals?

The documentation is the same, but the other tests tighten at size. Credit, reserves and leverage all shift as loan amounts rise. Above $4,000,000, every file is reviewed case by case before submission.
