Best DSCR HELOC Program on an Inherited Rental Property Before Probate Closes

Best DSCR HELOC Program on an Inherited Rental Property Before Probate Closes

The Quick Read: No single DSCR HELOC program fits this situation while probate is open. The estate owns the rental, and a DSCR HELOC needs a borrower who holds title and can sign the lien. Rent strength does not fix that gap. The best path for your situation depends on title, the existing mortgage, and how many heirs are involved.

  • Open probate generally blocks a rent-qualified line because no heir holds title.
  • A will names who inherits. Court letters give authority to act. A recorded deed gives title.
  • An estate-level loan for the personal representative is a different product, not a DSCR HELOC.
  • Once title vests, the rent qualifies the line, subject to underwriting.
  • Trusts and survivorship deeds can skip probate, so title review decides your timing.

Why Open Probate Blocks the Line

A lender can only take a lien from someone with legal authority over the property. During probate, that is the estate, not you.

A will tells the court who should receive the rental. It does not make you the owner. Letters testamentary (or letters of administration when there is no will) let the personal representative act for the estate. They still do not make an heir the owner. Only a recorded deed or court order moving title does that.

Even with letters, the representative signs for the estate. That is estate-level borrowing, usually court-supervised, and it is not what a DSCR HELOC is built for. Some states allow refinancing during probate with letters, the right signers, and creditor-notice steps done first. In some states, closing before the creditor-notice step can create title problems, and claim deadlines can run at least 90 days from first publication or posting. Rules vary by state, so ask the probate attorney.

Strong rent is a great problem to have. It just cannot create title.

What a DSCR HELOC Is

A DSCR HELOC is a revolving line of credit on a rental you own, qualified on the property’s rent instead of your personal income. Across our wholesale network, the structure is simple. It is a standalone second lien behind the first mortgage you keep, or a standalone first lien on a paid-off rental. It qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. No traditional personal-income documentation, W-2s, or personal income calculation are involved. The LLC can stay on title, per program terms.

The label gets used loosely in the market. It can mean a closed-end second, a revolving line, or a cash-out refinance. Some investment-property HELOCs qualify on your income instead of rent. Ask which structure you are being offered. Lendmire’s complete DSCR loans guide covers the wider family of products.

Key Terms Defined

  • DSCR: debt service coverage ratio, meaning gross monthly rent divided by the qualifying payment.
  • HELOC: a home equity line of credit, a revolving line secured by property.
  • Second lien: a loan that sits behind the first mortgage in repayment priority.
  • CLTV: combined loan-to-value, meaning the first mortgage balance plus the new line, divided by value.
  • Letters testamentary: the court document giving an executor authority to act for the estate.
  • Seasoning: a waiting period tied to when you bought, refinanced, or took title.

Three Products People Confuse

Product Who borrows What it rests on
Consumer HELOC Owner-occupant Personal income and home equity
DSCR HELOC Titled owner of a rental The rental’s rent and equity
Estate-level loan Personal representative Estate authority, court oversight

A primary-residence HELOC is an owner-occupied product. A DSCR HELOC is never offered on your own home. If you are still the executor and not yet the owner, you are in the third row.

How Underwriting Treats It, Step by Step

1. Death. Nobody has signing authority yet.

2. Letters issued. The representative can act, but only for the estate. A servicer may ask for a death certificate and an affidavit of heirship, per the CFPB’s servicing documentation commentary.

3. Title moves. An executor’s deed or court order moves title to the heir, trust, or entity. The deed records.

4. File opens. Expect the recorded deed, a title commitment, payoff statements on existing liens, a lease, rent evidence, and your credit report.

5. Coverage test. The program requires a minimum DSCR of 1.10x. The payment tested is a fully amortizing payment on the entire credit limit at a stressed start rate. The lender’s own calculation governs, so confirm on the file how the lender treats the first-mortgage payment on a second lien. The exact numbers vary by lender and program and follow a full review of property, leverage, and credit.

6. Valuation. Lines up to $400,000 use an automated valuation with a property inspection report, or a full interior appraisal. Larger lines take a full interior appraisal. Appraisal waivers are not accepted. Final terms depend on lender guidelines, property type, leverage, and the borrower’s complete credit picture.

Rent is the lesser of the appraisal’s market rent (Form 1007) and the lease, unless three months of receipts support a lease above market. A lease in place is required, and a two-to-four-unit property can have at most one vacant unit.

The Numbers Once Title Vests

These are ceilings and floors, subject to underwriting, through select programs in our network.

Item Second lien First lien
Max leverage 70% CLTV 75% LTV at 740+
Credit floor 720 700
Line size $50,000 to $500,000 Up to $1,000,000

On a first lien, 70% LTV applies from 700 to 739 on lines to $500,000. Lines above $500,000 cap at 65% LTV. Nothing on a second lien goes above 70% CLTV. These specifics are subject to lender guidelines and a full review of property, leverage, and credit.

The line has a 5-year interest-only draw period, then a 25-year repayment period, with a 30-year maturity and a variable rate. At least 80% of the line is drawn at closing, and later draws are at least $5,000. No reserves are required. Exposure is capped at 5 loans or $2,500,000 per borrower with the program.

Seasoning is the quirk heirs trip on. A rental bought or refinanced inside the last 6 months is not eligible (that clock runs from the last note date to the new note date), and the owner must have held title for 6 months (settlement date to note date). Fannie Mae and Freddie Mac waive their cash-out ownership waits for inherited property. That waiver does not carry over to DSCR programs, so ask early how a lender treats an inherited deed.

Keep the First Mortgage or Replace It?

This is the core decision after title vests. If the decedent left a first mortgage you want to keep, a second-lien line leaves it untouched. If the house is free and clear, a first-lien line works. If you need a lump sum, such as a sibling buyout with a fixed payoff, a cash-out refinance often fits better than a revolving line. Lendmire’s piece Best Investment Property HELOC Program on an Inherited Rental Property After Probate picks up from there.

The existing loan has some federal protection. Under Garn-St Germain due-on-sale enforcement is barred on a transfer to a relative at the borrower’s death. That keeps the old loan in place. It does not create a right to new financing. It also covers only residential property with fewer than five units, and it does not clearly reach non-relative heirs or irrevocable trusts.

Where the General Rule Breaks

Trust, survivorship, or transfer-on-death deed. These can skip probate, so title may already be clean. A title review decides, and the wait may not apply.

LLC-owned rental. The LLC owned it at death, so title does not change. This program allows LLC vesting on investment property, with members signing as guarantors. Deeding a mortgaged rental into an LLC mid-probate can raise due-on-sale questions, so have a title professional or attorney check first.

Multiple heirs. Everyone on title generally signs before underwriting starts. A title holder who is not a borrower signs a non-borrowing owner acknowledgment and the security instrument. One holdout stalls the file.

Loan servicer confirmation. A servicer that confirms you as a confirmed successor in interest has only confirmed your identity and ownership interest. That is not a deed and not a new loan.

Vacant or no-lease rental. A lease in place is required, so a vacant house is the wrong tool here.

Ineligible property. Rural-designated property, row homes, condotels, leaseholds, and land trusts sit outside the program. Foreign national and ITIN borrowers are also not eligible.

What to Do While Probate Is Open

The wait does not have to be dead time.

  • Executor or attorney: get certified letters and confirm the path to a deed or court order.
  • Heirs: sign a co-heir agreement on who keeps the property or buys out whom.
  • Title company: order the title commitment and payoff statements.
  • Authorized representative: keep collecting rent, keep the lease clean, and keep a rent history.
  • Everyone: keep hazard insurance active and get a date-of-death appraisal if your tax professional wants one.

Tax treatment varies; consult a qualified professional.

A Worked Scenario

Say three siblings inherit a duplex with a small first mortgage, both units leased. Probate is open, and the executor holds letters. Nobody can pledge the property yet, so the right move is prep, not applications.

Once the executor’s deed records in the siblings’ names, the file is reviewable. The rent evidence shows coverage comfortably above the 1.10x minimum on the stressed payment. Combined leverage lands under the 70% CLTV ceiling. The siblings keep the first mortgage and add a second-lien line. If one sibling wants a fixed buyout instead, coverage may tighten on a bigger cash-out. Then a different structure would be reviewed, with sizing adjusted to rent. Every file is underwritten individually.

Finding the Best Program for Your Situation

The best program depends on your title status, the existing mortgage, credit profile, leverage need, and tenant situation. Lendmire is a mortgage broker, not a lender. It shops a network of wholesale lenders and matches the scenario to the program. This line is offered in 15 of Lendmire’s 16 licensed states, every licensed state except Tennessee, subject to underwriting and not a commitment to lend.

If you are considering a home equity line on a rental property and want to see how the numbers work, Lendmire can help you compare DSCR HELOC options based on the property, the rent, the equity available, credit profile, combined leverage, and your goals. Call 828-256-2183 or request a quote.

Frequently Asked Questions

Can I apply for a DSCR HELOC while probate is open?

Generally no. The estate holds title, and an heir cannot pledge it. You can prepare documents and plan the structure so the file is ready when the deed records.

Can an executor get one for the estate?

Not as a DSCR HELOC. An executor with letters can pursue estate-level financing, which is a different, usually court-supervised product.

Does the seasoning clock start at death or at the deed?

It varies by program, so ask early. Two six-month clocks apply here: the line is not available on a rental bought or refinanced in the last 6 months (last note date to new note date), and title must have been held for 6 months (settlement date to note date).

Do all heirs have to sign?

Generally yes. Everyone on title signs the security instrument, and a title holder who is not a borrower signs a non-borrowing owner acknowledgment.

What if the house is vacant?

This program requires a lease in place. A vacant or unrentable house needs a different path first, such as leasing it up.
