Top DSCR HELOC Providers If Your Tax Returns Show a Business Loss

Top DSCR HELOC Providers If Your Tax Returns Show a Business Loss

The Quick Read: The lenders that fit an owner with a loss on the return are the ones that qualify the line on the rental’s rent instead of the owner’s income. The best program for your situation depends on whether that loss is a depreciation paper loss or a real operating loss, and on how the property is titled. On a rent-qualified file, the tax return is not an input to the coverage ratio, subject to lender guidelines.

  • A DSCR HELOC is a standalone second lien behind the first mortgage you keep, or a standalone first lien on a paid-off rental.
  • Minimum coverage is 1.10x, tested on a stress payment over the entire line. Taxes and insurance are not part of that payment.
  • Second liens reach 70% CLTV at a 720 score on lines of $50,000 to $500,000, through select programs.
  • Credit, lease, valuation, title and insurance are still reviewed. Nothing here is a no-paperwork product.
  • This page does not rank companies. It shows what separates a real rent-qualified line from a look-alike, and how a broker matches the file to a program.

Lendmire is a mortgage broker, not a lender, so it does not name or rank lenders, even though the title speaks of providers. It works with a network of wholesale DSCR HELOC lenders and matches the file to the program. The right provider depends on property type, credit, leverage need and how the rental is held.

What Does a Business Loss on Your Return Actually Mean?

A loss on a return can mean two very different things, and lenders read them differently.

The first is a paper loss. Depreciation is a non-cash deduction. IRS Publication 925 defines a passive loss as deductions, depreciation included, that exceed income. A rental can put cash in your account and still show a tax loss.

The second is a real loss from an operating business: a Schedule C, an S-corp or a partnership that lost money. That loss says nothing about how your rentals perform. It still hurts you on any product that starts from your reported income.

Keep the two apart. Rent-based underwriting helps with the first kind of loss and with the second kind only in one way: it stops looking at your personal income at all. A rental that doesn’t cover its own payment is a different problem, and no documentation path fixes it.

How Does a Rent-Qualified Line Treat the Return?

The return is not part of the coverage calculation. Across the wholesale network, a DSCR HELOC qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. There is no traditional personal-income documentation: no W-2s, pay stubs or debt-to-income ratio in the file. The LLC can stay on title.

DSCR loans are designed for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage.

Here is the step-by-step on how a file gets tested.

1. Set the rent. Rent is the lesser of the appraisal’s market rent and the lease, unless three months of receipts support a lease above market. A lease in place is required. A two-to-four-unit property may have at most one vacant unit.

2. Set the qualifying payment. The test uses a fully amortizing payment on the entire credit limit at the start rate plus 2 percentage points. It is a stress payment on the whole line, not on what you draw. Taxes and insurance are not part of it.

3. Run the ratio. Gross monthly rent divided by that qualifying payment must reach 1.10x at a minimum. The lender’s own calculation governs. On a second lien, confirm on the file how the lender treats the first-mortgage payment.

4. Pull the rest of the file. Credit report, valuation, title, hazard insurance and combined leverage over the first lien plus the new line all get reviewed.

5. Skip the return. Depreciation, Schedule C, Schedule E and K-1 results are not inputs to step 3.

That is the plumbing. A paper loss from depreciation never reaches the coverage number.

Why Do Rent-Qualified Lines Sit Outside Personal-Income Rules?

Investment-purpose loans are treated as business-purpose loans. The Federal Register notice on the CFPB’s ability-to-repay rule says business-purpose credit falls outside that rule. That is why the lender can look at the rent and not at your 1040.

Two cautions. Business purpose does not mean no rules. The purpose has to be documented correctly, and the line is never available on your own home or a second home. And a bank’s HELOC on a rental is often a different animal, covered next.

Top DSCR HELOC Providers: What Separates a Real One From a Look-Alike

“DSCR HELOC” is a market label, not a standardized product. Some lines sold under that name are cash-out refinances that replace your first mortgage. Some are closed-end seconds. Some are investment-property lines that test your personal income and debts. The word on the brochure tells you little.

Ask any provider five questions before you spend money on an appraisal:

  • Is the file underwritten on the property’s rent or on my personal income?
  • Is it a revolving line, or a lump-sum second or cash-out?
  • Do I keep my existing first mortgage?
  • Can the LLC hold title?
  • What is the stress payment tested against, the full limit or the drawn balance?

If the lender asks for returns, you are in the second kind of product. A loss then hurts, because personal-income underwriting starts from the loss-reduced figures.

The table below compares lender types by what they test. It describes categories, not companies.

Lender type What it tests Effect of a loss Title flexibility
Bank or credit union investment HELOC Personal income, DTI Often a problem Usually personal name
Bank statement HELOC Deposits, expense factor Depends on deposits Varies
DSCR cash-out refinance Rent vs payment Not an input Often LLC
DSCR HELOC (rent-qualified line) Rent vs stress payment Not an input LLC allowed

HousingWire’s non-QM guide describes the same product map, from DSCR loans to bank statement loans of 12 to 24 months of statements and bank statement HELOCs for the self-employed. Those are market products. The program figures below come from the network.

What the Network’s Program Looks Like

The figures below are ceilings and floors on select wholesale programs. They are not offers, and each is subject to underwriting. The program is offered in 15 of Lendmire’s 16 licensed states, every licensed state except Tennessee. Lendmire arranges it as a broker through a wholesale lender. Borrowers must be US citizens, permanent residents or non-permanent residents with a Social Security number. Foreign nationals and ITIN borrowers are not eligible.

Leverage. On a second lien, combined loan-to-value (first mortgage balance plus the new line, divided by value) goes up to 70% CLTV at a 720 score or better, on lines up to $500,000. Below 720 there is no second-lien option. On a first lien for a rental with no mortgage, loan-to-value reaches 75% LTV at 740 or better and 70% LTV from 700 to 739 on lines to $500,000. Lines above $500,000, up to $1,000,000, carry a 65% LTV ceiling at 720 or better. A borrower who keeps a first mortgage can only take a second lien. A declining-market flag lowers the ceiling by 5 points, and Philadelphia lines run 10 points lower. Exact terms depend on the lender’s guidelines, property type, leverage, and a full review of the borrower’s file.

Structure. Lines start at $50,000. At least 80% of the line is drawn at closing, and the closing draw is never less than $50,000, so the smallest lines are drawn in full. Later draws are at least $5,000. The draw period is 5 years interest-only on the drawn balance, followed by a 25-year fully amortizing repayment period, with a 30-year maturity. The rate is variable. The rate and the pricing terms come with the lender’s disclosures.

Credit and file. No 30-day late on the mortgage in the last 12 months. Forty-eight months since a bankruptcy, foreclosure, short sale or deed-in-lieu. No reserves and no cash to close are required. Exposure is capped at 5 loans or $2,500,000 per borrower with the program.

Valuation. Lines to $400,000 take an automated valuation with a property inspection report, or a full interior appraisal. Larger lines take a full interior appraisal. Appraisal waivers are not accepted.

Seasoning. A rental bought or refinanced inside the last 6 months is not eligible (that clock runs from the last note date to the new note date), and the owner must have held title for 6 months (settlement date to note date).

Property. Single-family, PUD, townhome, two-to-four units, and warrantable and non-warrantable condominiums are eligible, along with lots to 10 acres. Rural-designated property, condotels, row homes, leaseholds, land trusts, age-restricted communities, mixed-use, and anything listed for sale in the prior 2 months are outside this lane. So is a property with a solar lien.

Lendmire’s complete DSCR loans guide covers the wider investor-loan family if this line is not the right fit.

Where the Rule Breaks: Edge Cases That Derail Files

Income-based files. On a bank-statement or full-documentation file, a business loss lowers qualifying income, so that kind of file struggles with it. A rent-qualified line avoids that problem, but it brings the edge cases below.

Rent under the floor. If the stress payment on the full limit pushes coverage under 1.10x, the file does not clear on this program. Smaller lines or lower leverage change the math. Some other programs offer no-ratio alternatives where credit, equity and the investor’s plan carry the file. Those are separate programs with their own pricing and leverage.

Real operating loss, strong rentals. Rent-based underwriting ignores the loss. But the credit report still counts, so a loss that led to late payments will show up there. A mortgage late in the last 12 months is a hard stop.

Title. The LLC can hold title. The members sign as guarantors, and a title holder who is not a borrower signs a non-borrowing owner acknowledgment and the security instrument. Gather the entity documents early, because the file cannot move forward without them. The borrowers on the line need not be the borrowers on the first mortgage.

Mixed use. If you live in part of the property, the line is not available. It is for non-owner-occupied rentals only.

Passive-loss limits. Your tax position and your financing position are separate questions. Pub 925 describes a special allowance of up to $25,000 for active participants that phases out as income rises. A loan that is reviewed on rent does not change how your deductions are treated, and the reverse is also true.

How the Loss Pattern Changes the Lane

Your situation Likely lane What to gather
Depreciation paper loss, strong rent Rent-qualified line Lease, entity papers, first-mortgage statement
Operating-business loss, rentals cover payment Rent-qualified line Same as above
Two straight loss years, thin rent Fix coverage first Rent roll, receipts
Loss plus late payments Credit repair first Credit report
Rental is your home Different product Not this program

A worked example shows the logic with no dollar figures. Picture a duplex held in an LLC with a first mortgage the owner wants to keep. The owner’s return shows a loss from cost segregation. The rent, tested against the stress payment on the whole line, clears roughly 1.2x. At a 720 score and under 70% CLTV, that file is reviewable as a second lien. Raise the line size and the stress payment on the full limit rises with it, so coverage can slip below 1.10x even though the property did not change. That is why the size of the limit matters more than the draw.

What Operators See on These Files

The honest toss-up is DSCR cash-out versus a DSCR line. A cash-out replaces the first mortgage, which is a bad trade if that first loan is cheap. A line leaves it alone. But a line carries a variable rate and a stress test on the whole limit. A broker can run both. One tax sentence, since it comes up: tax treatment can depend on how the funds are used and how the property is held, so keep clear records and speak with a qualified tax professional before relying on any deduction.

If You Have Been Denied

Work the denial in order.

1. Read the stated reason. Income-based denial means the product was the wrong lane, not that the property failed.

2. Check coverage. Run rent against a stress payment on the full limit, not the draw.

3. Check eligibility. Seasoning, property type, listing history and the Tennessee exclusion are all places where a file can fail without the denial letter saying so.

4. Re-route the file by matching it to a rent-qualified program, a smaller limit, or a cash-out structure.

Key Terms Defined

  • DSCR: gross monthly rent divided by the qualifying payment, with 1.10x the minimum on this program.
  • CLTV: the first mortgage balance plus the new line, divided by property value.
  • Stress payment: a fully amortizing payment on the entire limit at the start rate plus 2 percentage points.
  • Paper loss: a tax loss created by non-cash deductions such as depreciation.
  • Standalone second lien: a line recorded behind a first mortgage you keep, not closed with a purchase.

Frequently Asked Questions

Can I get a HELOC if my return shows a business loss?

Yes, on a rent-qualified program, because the return is not an input to coverage. A line that tests personal income reads the loss against you. The lender type matters more than the loss.

Do I need tax returns for a DSCR HELOC?

No. Qualification runs on the rental’s income: no traditional personal-income documentation, W-2s or personal income calculation, subject to lender guidelines. You still supply a lease, entity papers where relevant, and the items behind credit, valuation, title and insurance.

Does an LLC-owned rental qualify?

Yes, it can. Vesting in the LLC is allowed on investment property, subject to program terms, with members signing as guarantors. A title holder who is not a borrower signs a non-borrowing owner acknowledgment.

How long must I own the rental first?

Two six-month clocks apply: the line is not available on a rental bought or refinanced in the last 6 months (last note date to new note date), and title must have been held for 6 months (settlement date to note date).

Can I use bank statements instead?

Another product class does that. Bank statement programs read 12 to 24 months of deposits and a different lender type writes them. The DSCR line reads rent.
