The Quick Read: A paid-off property gives a new line first position automatically because nothing else is recorded against the title, and bank statements change only how your income is documented; the best program for your situation depends on occupancy, how you hold title, your credit profile, and how much leverage you need.
- Lien position follows recording order. A free-and-clear property has no mortgage ahead of the new line.
- Bank statement documentation affects income calculation only. Credit, debt-to-income, equity, and property type are still reviewed.
- On an investment property, the network ceiling is 70% combined loan-to-value (CLTV), with a 700 minimum credit profile and a line of up to $500,000. Investment lines run only the 5-year interest-only draw with a 25-year repayment.
- Primary residences and second homes can reach higher CLTV tiers, but only at stronger credit profiles.
- Title must sit with you personally or in a revocable living trust. An LLC-held rental needs a different route.
Key Terms Defined
Lien: a recorded legal claim against a property that secures a debt.
Lien position: the order in which recorded claims get paid if the property is sold or foreclosed. First lien is paid first.
Free and clear: a property with no mortgage or other loan recorded against it.
HELOC: a home equity line of credit, a revolving line you can draw from, repay, and draw from again during a set draw period.
CLTV: combined loan-to-value, meaning all loans against the property added together and divided by its value.
Bank statement income: a way of documenting income from 12 or 24 months of deposits instead of tax returns.
Draw period: the stretch when you can borrow, usually paying interest only, before full repayment begins.
How large a line the equity supports.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
Why a Paid-Off Property Lands in First Position
Lien position is a matter of recording order, not product name. When you own a property free and clear, a new line is the first and only mortgage recorded. Nothing has to be subordinated and no old loan has to be preserved.
A first-lien line on a property that still carries a mortgage works differently. It pays that mortgage off, so it is not a way to keep a low-balance first loan in place. Keeping the old first loan means a second-position line, and that is a separate conversation.
For the borrower, first position has a practical benefit. With no balance ahead of it, the whole permitted CLTV band is available to size the line. On a second-position line, the existing mortgage balance eats into that band first.
Does Bank Statement Documentation Change Lien Position?
No. “Bank statement” describes how income is documented, nothing more. A borrower who documents income with tax returns and one who documents it with deposits both get first position on a free-and-clear property.
Self-employed landlords often choose this path. Depreciation and write-offs can push the income on a tax return well below what actually moves through the accounts. Bank statements show the deposits instead.
This is not a no-doc loan. The file still gets credit review, a debt-to-income test, a valuation, a title search, and reserve review where the program calls for it. The borrower is reviewed on documented income under the applicable program, subject to lender guidelines.
How Deposits Become Qualifying Income
Most bank statement programs across our wholesale network follow the same basic steps. Exact factors differ by lender and program.
1. Pick the review period. The underwriter takes 12 or 24 months of statements.
2. Choose the account type. Personal-account files generally skip the expense factor. Business-account files do not.
3. Strip out non-income deposits. Transfers between your own accounts, loan proceeds, and refunds come out.
4. Apply the expense factor. Business deposits are revenue, not profit, so the lender reduces them by a percentage. The lender or program sets that percentage. A CPA-prepared profit-and-loss statement or expense letter can sometimes support a different one.
5. Average the result. The adjusted total is divided by the months reviewed, and by your ownership share where it applies.
Deposit hygiene matters more than most borrowers expect. Mixed personal and business accounts, large one-off deposits, and seasonal swings all draw questions. A clean paper trail of where each large deposit came from saves real effort.
When “Paid Off” Isn’t Clean
A paid-off mortgage is first among mortgages. It is not automatically first among every claim. The lender runs a title search and verifies free-and-clear status instead of taking your word for it.
| Title problem | Why it matters | Usual fix |
|---|---|---|
| Unreleased satisfaction | Old mortgage still shows as open | Get the release recorded |
| Open zero-balance line | Old HELOC can still hold a position | Close and release it |
| Tax lien or judgment | Can outrank or complicate the new line | Pay off or resolve first |
| HOA or contractor lien | Recorded claim ahead of the line | Pay and record the release |
Run this check before you apply. A surprise at the title stage can reshape the whole file.
What the Program Looks Like by Occupancy
The ceiling depends on occupancy, and the title does not say which one applies to you. Lendmire brokers these lines through select wholesale lenders and is never the lender. Every figure below is a typical guideline range, subject to lender guidelines and full file review.
| Occupancy | Max CLTV | Min credit | Max line |
|---|---|---|---|
| Investment property | 70% | 700 | $500,000 |
| Second home | 90% at 720+ | 640 | $500,000 |
| Primary residence | 90% at 720+ | 600 | $500,000 at 90% CLTV; $750,000 at 75% CLTV, 700+ (720 on the longer-runway program) |
The higher tiers have limits attached. On a primary residence, 90% CLTV is available only at 720+ and up to $500,000. A primary-residence line above $500,000 needs a 700 or better credit profile (720 on the longer-runway structure described below). It caps at 75% CLTV and requires a full appraisal.
- Draw structure. Investment lines run a 5-year interest-only draw followed by a 25-year fully amortizing repayment. Primary residences and second homes can also take a 3-year draw with a 17-year repayment.
- Drawn at closing. At least 75% of the line is drawn at closing.
- Pricing. Pricing floats through both the draw and repayment periods and never converts to fixed.
- Debt-to-income. The cap is 50%, and 45% for credit profiles from 600 to 679. It is calculated on the interest-only payment at the maximum draw.
- Valuation. Lines at or below $500,000 ordinarily use an automated valuation. Anything above $500,000 needs a full appraisal, and you can request one in any case.
Programs change, and every file is reviewed individually.
How Much Can You Borrow on a Paid-Off Property?
On a free-and-clear property, the CLTV equals the new line’s loan-to-value. Nothing is subtracted for an existing balance.
Picture an investment rental that appraises at a round number you choose. The line can reach up to 70% of that value, then the $500,000 cap applies. Multiply it out with your own appraised value.
Now picture the same property carrying a mortgage at 40% of value. The new line would pay that balance off, or sit in second position with only the remaining room under the ceiling. Paid-off properties use the full band. That is the real advantage of this setup.
Equity is only one test. The strongest files clear both: enough equity and enough documented income. A larger cushion of equity never erases credit floors, debt-to-income limits, or property eligibility.
First-Lien HELOC or a DSCR Cash-Out Refinance?
If your income documentation is thin or your title sits in an LLC, a debt service coverage ratio (DSCR) cash-out may fit better. A DSCR loan compares the property’s rent to its full monthly obligation: principal, interest, taxes, insurance, and any association dues. It qualifies primarily on property-level rental income covering the payment, subject to lender guidelines.
| Factor | First-lien bank statement HELOC | DSCR cash-out refinance |
|---|---|---|
| What is tested | Borrower’s deposits, credit, DTI | Property rent against its payment |
| Structure | Revolving line, draw then repay | Closed-end lump sum |
| Title holder | Individual or revocable trust | Individual or entity, per program |
| Leverage | 70% CLTV on investment lines | Around 75% LTV on a standard rental |
| Best fit | Self-employed owner wanting flexible access | Rent-driven file, LLC-held property |
Many DSCR programs want around 6 months of ownership seasoning before a cash-out. Credit requirements typically start near 660, and 700+ unlocks the strongest tiers. For a closer look at that path, see Lendmire’s explanation of how a DSCR cash-out refinance works on a rental.
One caution applies to DSCR. Clearing 1.00 coverage is not the same as positive cash flow. Repairs, vacancy, management, utilities, and capex all sit outside the calculation. The complete DSCR loans guide covers how the ratio is built and when it opens better leverage.
Where the General Rule Breaks
Several situations change the answer.
LLC-held rentals. These lines lend to individuals and revocable living trusts. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title. A property already deeded to an LLC needs a vesting change or a DSCR cash-out instead. This is a program-fit issue, not a legal bar.
Property type. Single-family, 2-4 unit, PUD, townhome, and condominium (including non-warrantable) are eligible. Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use, and agricultural zoning are not offered.
Exposure limits. A borrower is limited to three lines. An owner of more than 15 financed properties is not eligible.
Credit history. A bankruptcy needs 4 years of seasoning from discharge or dismissal. Investment files follow a 7-year path for foreclosure and 4 years for a deed-in-lieu or short sale.
Property listed for sale. A property listed, or listed within the past 60 days, is ineligible in certain states.
Availability. These lines are available in 16 states (AL, CA, CO, FL, GA, IN, MI, MT, NM, NC, OH, PA, TN, TX, VA, WA). That is narrower than Lendmire’s DSCR footprint of 41 markets, including Washington, D.C.
Recently bought with cash. Seasoning expectations vary by program, so confirm them before you plan around a quick draw.
A short business-purpose note belongs here. Credit secured by a non-owner-occupied rental and used for business or investment is treated as business-purpose, and the purpose of the loan drives that classification, not just the collateral. See 12 CFR 1024.5 for how the federal mortgage servicing and settlement rules define their coverage and exemptions. Because these are investor loans, they are reviewed differently from a standard owner-occupied mortgage.
The Draw-Period Trade-Offs
A HELOC is an open-end line you can borrow against repeatedly. The CFPB’s HELOC explainer notes that payments are often significantly higher once repayment starts, and in some cases the whole balance can come due. Interest-only during the draw is not cheap forever.
Interest accrues only on what you draw, but at least 75% of the line is drawn at closing. If you want a small standby line for cash offers, that structure may not match your plan. A DSCR cash-out gives a fixed lump sum from the start, with every dollar costing interest right away.
The honest toss-up is this: flexibility favors the line, while predictability favors the closed-end loan. Which wins depends on how soon you will actually deploy the money.
Who This Fits
The best program for your situation usually comes down to four questions.
- Is the property in your name or a revocable trust?
- Can your deposits document the income after the expense factor?
- Does your credit profile reach the tier you need?
- Do you need leverage that the 70% investment ceiling allows?
Self-employed owners of free-and-clear rentals with strong deposits and clean title fit best. Borrowers with LLC titling, thin deposits, or a need for higher leverage on an investment property should look at other structures. A broker that shops multiple wholesale lenders can match the scenario to the program, which beats guessing at a single lender’s overlays.
Frequently Asked Questions
Is a bank statement HELOC on a paid-off property a first or second lien?
It is the first lien. With no mortgage recorded ahead of it, the new line takes first position automatically. It would be a second lien only if a mortgage already exists.
Does using bank statements change lien position?
No. Bank statements only affect how income is calculated. Position follows what is recorded on title.
Can an LLC-owned rental qualify?
Not directly. Title must be held by an individual or a revocable living trust. An LLC-held property needs a vesting change or a DSCR cash-out refinance, subject to program terms.
How do I prove the property is free and clear?
The lender orders a title search and verifies it. Gather your payoff and release documents ahead of time, and check for open zero-balance lines, tax liens, and judgments.
How many months of statements do I need?
Programs typically use 12 or 24 months of personal or business statements. The lender sets the expense factor on business accounts.
