Investment Property HELOC Rules During and After a Divorce

Investment Property HELOC Rules During and After a Divorce

The Quick Read: Borrowing against a rental during a divorce is possible but tightly constrained: the line needs clean title in your name, consent or a court order where restraining orders apply, a 700 credit score, and total borrowing at or below 70% combined loan-to-value, all subject to lender guidelines and a full file review. A divorce decree settles who owes what between you and your ex. It does not rewrite the loan contract with the lender.

  • On an investment property, the network ceiling is 70% combined loan-to-value (CLTV), with a 700 minimum credit score and a maximum line of $500,000.
  • Many states freeze new liens the day a case is filed, so a mid-case line often needs written consent or a court order.
  • A joint line stays joint after the decree until it is paid off, refinanced, or released by the lender.
  • An LLC cannot hold title on an equity line, which is a sharp difference from a DSCR loan.
  • When the equity or the title does not fit, a DSCR cash-out refinance is often the practical alternative.

What Actually Changes When a Rental Is Part of a Divorce?

Less than most people expect. A decree divides property and debt between two spouses. A lender is not a party to that decree, so the lender’s contract stays exactly as written.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Picture a duplex bought during the marriage with a joint first mortgage and a joint credit line. The decree awards the duplex to you and says your ex pays the line. The lender still sees two borrowers on both loans. If your ex stops paying, the lender can come after either of you. University of Minnesota Extension says each spouse stays liable for debts they signed, and a lender is likely to require a refinance to remove a spouse from a mortgage or home equity loan.

Three things follow. A new line mid-case may be restricted. An old joint line has to be contained. And whatever you borrow after the decree depends on title being in the right name.

What Do the Three Stages Look Like?

Stage What usually applies Main risk
Before filing No order yet; borrowing may be scrutinized Looks like moving assets
During the case Lien often needs consent or court order Violating an order
After the decree Recorded deed and clean title Joint debt still on your file

The cleanest window is usually after the decree, once the deed is recorded and the settlement says who keeps the property.

How Does Underwriting Treat an Investment Property Line?

Across our wholesale network, an investment property line is the most restricted version of a home equity line. The rules below apply to investment properties only, and every figure is subject to lender guidelines and a full file review.

  • Leverage: the ceiling is 70% CLTV. That counts your existing first mortgage plus the new line against the property’s value.
  • Credit: 700 is a hard floor. A 720 score reaches the same 70% ceiling, so higher credit buys eligibility, not extra leverage.
  • Line size: up to $500,000 on an investment property. Lines above that are for primary residences only.
  • Structure: a standalone line in first or second lien position. Investment lines run a five-year interest-only draw, then a 25-year repayment. At least 75% of the line is drawn at closing.
  • Valuation: because investment lines stop at $500,000, they usually run on an automated valuation with no traditional appraisal. A borrower may still request a full appraisal.
  • Debt-to-income: 50% maximum, qualified on the interest-only payment at the maximum draw.
  • Credit report: a single-bureau score tied to the primary wage earner, no more than 90 days old at closing.
  • Exposure: a borrower is limited to three lines, and owning more than 15 financed properties makes a file ineligible.
  • History: a bankruptcy needs four years of seasoning. Foreclosure history on an investment file follows a seven-year path, and a deed-in-lieu, pre-foreclosure, or short sale follows four years.

The debt-to-income test matters most in a divorce. This is a personal-credit product. Your income, your debts, and any joint obligations still on your credit report all count. A joint first mortgage you expect your ex to pay still hits your ratio until it is refinanced or released.

Property types are narrower than a DSCR loan. Single-family homes, 2-4 units, PUDs, townhomes, and condominiums (including non-warrantable condos) are eligible. Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use, and agricultural-zoned property are not. Investment property lines are available only in Lendmire’s 16 full-service states, which is narrower than its 41-market DSCR footprint, Washington, D.C. included.

Who Owes What on Existing Joint Debt?

Both of you, until the lender says otherwise. The CFPB documents homeowners struggling to get servicers to complete assumptions that their divorce decrees called for. Getting an ex released is often harder than getting the decree.

Here is how the pieces work.

  • Joint HELOC: either borrower can generally ask to freeze or close it. A creditor cannot close a joint account just because your marital status changed. Freezing stops new draws. It does not pay the balance.
  • Joint first mortgage: a decree alone does not remove your ex. Release comes through a refinance, a lender-approved assumption with an explicit release of liability, or a sale.
  • Quitclaim or decree-ordered deed: this changes title only. It does not change who owes the loan.

Federal law also limits a lender’s ability to call a loan due when a property transfers to a spouse or former spouse under a decree. The statute is 12 U.S.C. § 1701j-3. It stops acceleration. It does not take anyone off the note. Its residential protections are written around owner-occupied homes of fewer than five units, so whether it covers your rental is a question for your attorney.

In practice, ask the lender for its release procedure in writing. Then put a deadline for the refinance in the decree itself.

What Does a Spouse Buyout Look Like in Percentages?

Run the numbers as shares of value, not dollars. Say you keep a rental and owe your ex half of the equity. Your existing first mortgage sits at 40% of the property’s value. That leaves 60% in equity, so your ex’s half is 30% of value.

The 70% CLTV ceiling leaves room for 30% of value in a new line. The buyout fits exactly, with no cushion. Appraisal variance, closing costs, or a line capped at $500,000 on a high-value property could break it.

Now change one input. If the first mortgage sits at 50% of value, the equity is 50% and the buyout is 25%. Room under the ceiling is only 20%. You are short by 5% of value.

At that point you have choices: bring cash, negotiate a different split, sell, or refinance the whole property. Remember that a line is drawn at least 75% at closing, so you pay on most of it from day one, and the interest-only draw is reviewed around the maximum draw.

Where Does the General Rule Break?

Five edge cases come up often.

An ex who remains on title. The line must be held by an individual borrower or a revocable living trust. A co-owner still on the deed complicates the file, and the lender and title company decide which signatures are required. A non-borrowing co-owner may still have to sign the lien documents, so an ex on the deed is a problem even when they are not on the loan.

LLC-held rentals. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title on this line. A property already in an LLC needs a vesting change or a different product. The structure matters when an ex holds an interest through the entity.

Contested sole-titled rentals. Title in one name does not always shield a property from an automatic order, and a line closed before the decree can still be pulled into the property division.

Community-property and common-law states. Debts taken on during marriage are treated differently depending on the state. Your attorney reads the law for your state, and the lender reads the title.

Property listed for sale. In several states, a property listed for sale, or listed within the past 60 days, is ineligible. Divorce-driven sales often hit this wall.

When Is a HELOC the Wrong Tool?

Situation Better fit
Rental is held in an LLC DSCR cash-out refinance
Equity needed beyond 70% CLTV DSCR cash-out refinance
Personal income hard to document DSCR loan on rental income
Ex must come off the first mortgage Refinance of the first lien
Credit below 700 DSCR cash-out refinance

A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines. That can suit a keeping spouse whose personal income is changing after a split. Our complete DSCR loans guide covers the full mechanics.

A DSCR cash-out refinance on a standard rental tops out around 75% LTV across most of the network. About six months of seasoning is the common expectation, and ask the lender how a decree-ordered deed counts. A 1.00 coverage ratio is where many select programs start. A separate select-lender path takes coverage below 1.00 with leverage and terms adjusted. Most programs want credit around 660, and 700 or better unlocks the strongest leverage tiers. Reserves commonly run around six months of PITIA, though they vary by lender, leverage, and loan size.

Clearing 1.00 does not mean positive cash flow. DSCR compares rent to the monthly payment only. Repairs, vacancy, management, and utilities sit outside the calculation. LLC title is possible on DSCR loans, depending on program guidelines.

The after-decree checklist below sets out the sequence of steps for using an investment property line in a divorce.

What Should the After-Decree Checklist Include?

1. Pull the title report and list every lien and every signer.

2. Confirm the deed is recorded in the right name.

3. Freeze any joint line you do not need.

4. Get the lender’s written release process for the ex.

5. Pull your credit report and see which joint debts still count against you.

6. Compare a line with a refinance, a DSCR cash-out, or selling.

7. Ask your attorney whether any order or settlement term limits new liens.

Key Terms Defined

CLTV (combined loan-to-value): your first mortgage plus the new line, divided by the property’s value.

Decree: the court’s final order that divides property and debt between spouses.

Lien: a lender’s legal claim on a property, recorded against its title.

Quitclaim deed: a deed that moves ownership between people without moving the loan.

Assumption: a new borrower takes over an existing loan with the lender’s approval.

Release of liability: the lender’s written agreement that a borrower no longer owes the loan.

Automatic restraining order: a court order that takes effect at filing and limits spending, transfers, and new debt.

DSCR (debt service coverage ratio): annual or monthly rent divided by the property’s payment of principal, interest, taxes, insurance, and HOA dues.

Frequently Asked Questions

Can I open an investment property HELOC while my divorce is pending?

Only if no order blocks it, or you have written consent or a court order. Many states restrain new liens at filing, though details vary. Even without an order, a mid-case line can be treated as part of the division of property. Clear it with your family-law attorney first.

Who owes a joint HELOC after the decree?

Both of you, unless the lender releases one. The decree can assign payment to your ex, but the lender can still pursue either of you for the full balance. Either borrower can ask to freeze or close the line, which stops new draws but does not pay it off.

Does a quitclaim deed take my ex off the loan?

No. It moves title only. Removing a borrower requires a refinance, an assumption that includes a release of liability, or payoff by sale. Your ex can come off the deed and still owe the loan.

Can a line fund a spouse buyout?

Sometimes. On an investment property the ceiling is 70% CLTV, so the buyout plus your existing first mortgage must fit under that limit. When it does not fit, the usual alternatives are cash, a different split, a sale, or a DSCR cash-out refinance at up to 75% LTV on a standard rental. Terms vary by lender guidelines, property type, leverage, credit profile, and full file review.

What if the rental is in an LLC?

An equity line cannot be written on LLC-held title. The property would need a vesting change first, or you can look at a DSCR cash-out, which can accommodate LLC borrowers depending on program guidelines.
