Can You Get an Investment Property HELOC Before the Divorce Is Final?

Can You Get an Investment Property HELOC Before the Divorce Is Final?

The Quick Read: Sometimes, but only when the court’s orders, the deed, and the lender’s file all line up. A pending divorce does not bar a line by itself. The usual blocker is a state restraint that stops either spouse from putting a new lien on marital property without written consent or a court order.

  • On Lendmire’s wholesale network, an investment-property line tops out at 70% CLTV, with a 700 minimum credit score and a maximum line of $500,000, subject to lender guidelines.
  • The line is underwritten on personal credit and debt-to-income, so a divorce hits it harder than a DSCR loan.
  • Timing matters, because the rules differ before filing, during the case, and after the decree.

What Timing Does to a Rental Property Line

The answer changes at three points: before filing, during the case, and after the decree. Each stage has a different requirement and a different risk. The table lays them side by side.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Stage What’s possible What you need Main risk
Before filing Apply with no order in place Clean title, your own credit and income A draw just before filing can be challenged
During the case Possible where allowed Written spousal consent or court order Lien set aside, or sanctions
After the decree You are underwritten alone Decree, recorded deed, title report Ex still on title or on a joint line

Before filing, no restraint exists. That does not make a large draw safe. Courts look at what each spouse did with marital assets shortly before the case began, and a big draw with no documented purpose can look like moving money.

During the case, the restraint is the issue. After the decree, the keeping spouse is reviewed alone, but only once title and any joint debt are cleaned up.

Why Courts Block a New Lien Mid-Case

South Dakota’s statute, Codified Law 25-4-33.1, bars both parties from transferring or encumbering marital assets without the other party’s written consent or a court order. A home equity line is an encumbrance. So is a line on a rental.

States differ. California’s automatic order, as explained by a California family law practitioner, reaches community, quasi-community, and separate property. Colorado’s automatic injunction, described by a Colorado law firm, bars encumbering marital property. Texas works differently: a court may grant a temporary restraining order on motion or on its own motion after filing, but it is not automatic.

Whichever rule applies, the lender will want the consent or the court order in the file before it funds. Ask your attorney which rules apply to your case before anything goes to a lender.

Does a Restraint Cover a Rental or Separate Property?

It can. Restraints are not limited to the family home. In California, the automatic order covers separate property, so a rental you owned before the marriage can still be restrained. Treat any rental as covered until your attorney says otherwise.

Can a Lender Freeze a Line Because You’re Divorcing?

Not on that ground alone. Under Regulation Z’s home equity rule, a creditor may suspend or reduce a line only in the circumstances the rule lists, and only while one of them exists. Two common triggers are a significant drop in home value and a change in finances that leaves the lender doubting you can repay.

Divorce can trigger the second one indirectly. Those protections are written for consumer-purpose plans. A business-purpose line on a rental is reviewed differently, so confirm freeze terms with the specific lender.

A freeze also does not remove debt. It only stops new draws.

The Title Problem

A decree does not change the recorded deed. If your former spouse is still on title, the line cannot move forward until the deed is corrected or that person signs.

A quitclaim deed changes ownership only. It does not release anyone from the mortgage. The lender was not a party to the divorce, so both borrowers stay liable on a joint loan until it is paid off or refinanced into one name. Many lenders want the decree plus a recorded quitclaim deed in the file.

Spousal signatures are a separate question. When you qualify alone, a lender generally cannot demand that a non-applicant spouse sign the note. It can still require signatures that make the collateral reachable, which in practice means the lien document. Expect to need the spouse’s signature on the deed of trust or mortgage if that spouse is still on title.

What the Network Allows on an Investment Line

Across the wholesale network, the investment-property line is a narrower product than a primary-residence line. These figures come from select lenders and are subject to lender guidelines and full file review:

  • Leverage: 70% CLTV, with no higher tier. A score of 720 and a score of 700 both reach 70%, so a higher score buys eligibility rather than more leverage.
  • Credit: 700 minimum.
  • Line size: $25,000 to $500,000 on an investment property (Michigan’s floor is $10,000). A line above $500,000 is for primary residences only.
  • Structure: a standalone line in first or second lien position, with a 5-year interest-only draw and a 25-year repayment period. At least 75% of the line is drawn at closing, and pricing floats rather than converting to fixed.
  • Valuation: full appraisals are required on lines above $500,000, and an investment line tops out at $500,000. It is therefore ordinarily valued by automated valuation with no traditional appraisal, though a borrower may request a full appraisal in any case.
  • DTI: 50% maximum, qualified on the interest-only payment calculated on the maximum draw.
  • Title: held by you individually or in an inter vivos revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title.
  • Property: single-family, 2-4 units, PUD, townhome, and condo. Manufactured homes, co-ops, condotels, log homes, and commercial or mixed-use properties are not offered.
  • Availability: Lendmire’s 16 full-service states only, which is narrower than its 41-market DSCR footprint.

More equity never overrides these caps. Combined leverage across all liens is what gets measured, so an existing first mortgage uses up room fast under a 70% ceiling.

Qualifying Alone

You are reviewed on your own income and credit. A line is underwritten on personal credit and debt-to-income, so support you pay counts as debt, and joint debts assigned to your ex can still count against you until they are closed or refinanced.

Support you receive may count if the settlement documents it. Treatment of support income depends on the lender and program, so ask before you rely on it.

Contain any existing joint line first. Freeze it, pay it off, close it, or refinance it into one name. Left unfrozen, a joint line lets your ex keep drawing on it after the split, and you remain liable for that debt.

Wrong Tool? Use This Table

Situation Better path
Rental is titled in an LLC DSCR cash-out refinance, or change vesting first
Personal income is thin after the split DSCR cash-out refinance after the decree
Ex is still on the deed Fix title before any new lien
Joint line already exists Pay off or refinance into one name after the decree
Funding a spousal buyout DSCR cash-out refinance

A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines. It still needs clean title and any required consent or court order. Coverage of 1.00 is where select programs start, and clearing it is not the same as positive cash flow, since repairs, vacancy, and management sit outside the calculation. The complete DSCR loans guide walks through the structure.

A Scenario With No Numbers

Say a spouse owns a rental in both names and a first mortgage is on it. The divorce is filed in a state with an automatic order. A line is off the table until the other spouse consents in writing or the court approves it. If the decree later awards the rental to one spouse, that spouse records the new deed, then applies alone on personal credit. If the property is in an LLC, or personal income is thin, the DSCR route is usually cleaner.

Questions to Ask Your Attorney First

1. Does an automatic restraint apply in my state, and does it reach this rental?

2. Do I need written consent or a court order, and what form should it take?

3. Who is on title today, and what must be recorded before I apply?

4. Is there a joint line or mortgage that must be frozen, paid off, or refinanced?

5. Could a draw now be challenged in the property division?

Key Terms Defined

HELOC: a revolving line of credit secured by the equity in a property.

CLTV: combined loan-to-value, which adds every lien on the property and compares the total to its value.

Automatic restraint: a court order that takes effect on filing or service and limits what either spouse can do with marital assets.

Quitclaim deed: a deed that transfers ownership interest without releasing anyone from the mortgage.

Decree: the court’s final order dividing assets and debts.

Frequently Asked Questions

Can I open the line before I file?

Yes, if no restraint exists yet and title is clean. The risk is later challenge. A large draw close to filing can be questioned in the property division, so document the purpose.

Will the lender need my spouse’s signature?

If your spouse is on title, expect to need it on the lien document. A lender generally cannot require a non-applicant spouse to sign the note when you qualify alone, but it can require signatures that make the collateral reachable.

Does the decree take my ex off the loan?

No. The lender was not a party to the divorce, so a decree does not change what either borrower owes on a joint loan. Both stay liable until the loan is paid off or refinanced into one name. A quitclaim deed changes title only and does not release the mortgage debt.

What if the rental is in an LLC?

The network’s investment line cannot be written to an LLC, subject to program terms. The property needs a vesting change, or a DSCR cash-out refinance is the alternative.

Is the interest deductible?

Tax treatment can depend on how the funds are used and how the property is held; borrowers should keep clear records and speak with a qualified tax professional before relying on any deduction.
