Banks That Offer an Investment Property HELOC for Buying Out a Spouse

Banks That Offer an Investment Property HELOC for Buying Out a Spouse

The Quick Read: An investment property HELOC can pay out a spouse, but only when the keeping spouse holds title personally or in a revocable trust, qualifies alone on personal credit and income, and has equity under a 70% combined loan-to-value ceiling on an investment property; it does not by itself remove the ex-spouse from the first mortgage. No bank reviews the file by name alone, because the file decides the answer.

  • On Lendmire’s HELOC network, an investment-property line caps at 70% CLTV and $500,000, with a 700 minimum credit score, subject to lender guidelines.
  • The line is underwritten on your personal credit and income, not on the rent.
  • A HELOC adds a lien. It does not replace the old loan, so the ex stays on the first note unless it is paid off, refinanced, or assumed with a written release.
  • When the buyout is large or the ex must come off the note, a DSCR cash-out refinance is the usual alternative.

Why No Bank List Settles This

Lists of banks go stale, and a list cannot see your title, your signers, or your equity. Fewer lenders write lines on rentals than on primary homes. BiggerPockets members describe the same pattern, and some say credit unions or community banks were likelier sources. Others report months of effort ending in a denial. Those are individual accounts, not a ranking.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

So this article names no institutions. Large retail lenders, community banks, credit unions, and brokers each take a different approach to a rental-property line.

Lender type What it typically does
Large retail lenders Often exclude non-owner-occupied lines
Community banks, credit unions May hold the line in-house; programs differ
Broker with wholesale network Matches your file to a program

Lendmire is a broker. It does not lend. It arranges HELOC files through select wholesale lenders, and the right program depends on your equity, credit profile, title, and property type. HELOC availability runs through the 16 states where Lendmire offers full-service mortgage lending, which is narrower than its 41-market DSCR footprint that includes Washington, D.C.

How Underwriting Treats a Spouse Buyout, Step by Step

The lender sees one borrower, one property, and one question: is there enough equity and enough income? Here is the sequence.

1. The settlement defines the buyout. The decree or agreement says who keeps the rental and what the leaving spouse receives. The payout is the agreed value, minus the mortgage debt, times the leaving spouse’s ownership share.

2. Title is checked. On this network, the property must be held by an individual or a revocable living trust. LLCs, corporations, partnerships, and land trusts cannot hold title on the line.

3. Permission is confirmed. If a divorce case is still pending, a new lien may need written consent from the other spouse or approval from the court.

4. The keeping spouse is underwritten alone. Lenders look at personal credit and income against all remaining debts. The rent is not the qualifying measure on a HELOC. The ceiling on debt-to-income is 50%, and the line is qualified on the interest-only payment at the maximum draw.

5. CLTV sets the size. Add every lien, including the new line, and divide by the appraised value. The buyout draw can only be as large as the room under the cap.

6. The line closes and the deed is recorded. The buyout is paid, and the first mortgage stays in place.

A Worked Buyout in Percentages

Run the numbers this way, using modeled assumptions rather than market data. Say a rental is valued at 100% of its value and the first mortgage sits at 40% of that value. That leaves equity of 60% of value. If the settlement splits ownership evenly, the buyout is 30% of value.

The cap is 70% CLTV on an investment property. With the first mortgage at 40%, the room for a new line is 30% of value. The buyout fits exactly, with no cushion for closing costs or a lower valuation. Because investment lines ordinarily run on an automated valuation rather than a traditional appraisal, the value used in this math is whatever that valuation returns, and a borrower can request a full appraisal if wanted.

Change one assumption and the file breaks. If the first mortgage is 50% of value, the room is only 20% of value, and the same 30% buyout falls short. At that point the HELOC cannot fund it alone. The gap has to come from cash, a smaller payout, or a different structure.

Separately, the line itself cannot exceed $500,000 on an investment property, whatever the equity says.

What the Line Looks Like After Closing

Investment lines on this network run a 5-year interest-only draw followed by a 25-year fully amortizing repayment period. The pricing floats through both periods and never converts to fixed. At least 75% of the line is drawn at closing, so size the line to the buyout you actually need, which can be no larger than the room under the cap.

Variable and interest-only means the payment can move. Rent from the property needs to cover the line’s payment along with the first mortgage, taxes, and insurance. Plan for that before you sign.

Because an investment line caps at $500,000, it sits in the automated-valuation lane and commonly closes with no traditional appraisal. A borrower can still request a full appraisal.

These property types are not offered on the line: manufactured homes, co-ops, condotels, log homes, commercial, mixed-use, and agricultural zoning. Eligible types include single-family homes, 2-4 units, PUDs, townhomes, and condominiums, including non-warrantable ones. A borrower owning more than 15 financed properties is not eligible.

Does a HELOC Release Your Ex From the Mortgage?

No. A divorce decree divides property between the two of you, but it does not bind the lender. The leaving spouse stays liable on the original note until the loan is paid off, refinanced, or formally assumed with a written release.

Due-on-sale clauses add a second wrinkle. A due-on-sale clause lets a lender demand payoff if the property is transferred without consent. 12 CFR § 34.5 confirms these clauses are enforceable, except for the transfers listed in 12 U.S.C. § 1701j-3(d). That list covers transfers on residential property with fewer than five units, including transfers tied to a divorce decree or property settlement. Confirm how this applies to your file with counsel and the servicer.

Quitclaim sequencing also trips people up. A quitclaim deed moves title only. If the deed goes first, the leaving spouse stays on the note without owning anything. If the refinance goes first, the keeper may lack title at closing. The cleanest approach is to vest title at the closing of the new financing.

Where the Rule Breaks

The general rule is a HELOC for buyouts. These cases push you elsewhere.

  • The ex is on the first note and must come off. A HELOC leaves the note untouched. A cash-out refinance replaces it.
  • The decree requires a refinance. A HELOC does not satisfy that order.
  • The rental sits in an LLC. The line cannot be written on LLC-held title. The property needs a vesting change, or a DSCR cash-out fits instead.
  • The buyout exceeds the equity room. The CLTV cap decides this. See the worked example above.
  • Someone lives in the property. It becomes an owner-occupied scenario, not an investment one. A different occupancy tier applies, and so does a different set of ceilings.
  • Credit below 700. On an investment line, 700 is a hard floor with no tier beneath it.
  • Ineligible property type. The types listed above are not offered.

Choosing the Route

Route Best fit Watch for
Investment HELOC Keep a low first mortgage Ex stays on first note
DSCR cash-out refinance Large buyout, ex must come off New loan replaces the old
Assumption with release Lender agrees in writing Rarely offered
Sell and split Neither can carry the property Gives up the asset

The DSCR Cash-Out Alternative

A DSCR cash-out refinance replaces the old mortgage and can pay the spouse at closing in one transaction. The loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines. DSCR means debt service coverage ratio: monthly rent divided by the monthly payment of principal, interest, taxes, insurance, and any HOA dues.

Across Lendmire’s wholesale network, cash-out tops out at about 75% LTV on a standard rental. For a short-term rental, the cash-out ceiling is 70%. About 6 months of seasoning is the common expectation. Most programs want a credit score near 660, and 700 or better opens the strongest leverage tiers. Coverage of 1.00 is where many select programs start. A separate select-lender path takes coverage below 1.00, with leverage and terms adjusted.

Clearing 1.00 does not mean positive cash flow. Repairs, vacancy, management, utilities, and capital expenses sit outside the calculation. The complete DSCR loans guide walks through how those files are built.

Questions to Ask Before You Apply

  • How is title held, and does it match what the line allows?
  • Does the decree or pending case require consent for a new lien?
  • What is the combined loan-to-value after the new line?
  • Is the ex on the first note, and does the settlement require a release?
  • Does the rental income need to cover the line’s payment?
  • Does the property type qualify?

Key Terms Defined

CLTV (combined loan-to-value): All liens on the property added together, divided by its appraised value.

Due-on-sale clause: A mortgage term letting the lender demand payoff if the property is transferred without consent.

Quitclaim deed: A deed that moves the giver’s ownership interest to someone else without changing who owes the mortgage.

Assumption: A new borrower takes over an existing mortgage, ideally with a written release of the old borrower.

Seasoning: The waiting period a lender wants between buying or acquiring a property and borrowing against it.

Frequently Asked Questions

Can I get an investment property HELOC to buy out my spouse if the rental is in an LLC?

Not on this network. The line requires title held by an individual or a revocable living trust. A property already deeded to an LLC needs a vesting change first, or a DSCR cash-out refinance fits better.

How much can I borrow against a rental to pay my ex?

On an investment property, the ceiling is 70% CLTV, with a maximum line of $500,000 and a 700 minimum credit score. The usable amount is the room left under 70% after your first mortgage, subject to lender guidelines.

Does my ex-spouse’s income count?

No. The keeping spouse is underwritten alone, on personal credit and income against all remaining debts. The ceiling on debt-to-income is 50%, so your own income has to carry the full set of debts.

Is a HELOC or a DSCR cash-out better for a buyout?

It depends on the first mortgage and the ex’s liability. A HELOC keeps the existing first mortgage in place, which helps if its terms are favorable. A DSCR cash-out replaces it and pays the spouse in one step, which suits larger buyouts and releases.

Can I use a HELOC if the divorce is not final?

Possibly, but a pending case can require written consent from your spouse or court approval before a new lien is recorded. Ask your attorney before applying.
