Banks That Offer a HELOC When the Line Must Sit in First Lien Position

Banks That Offer a HELOC When the Line Must Sit in First Lien Position

The Quick Read: A HELOC sits in first lien position when nothing else is recorded ahead of it, which means either the property is owned free and clear or the new line pays off the existing mortgage at closing, and only a limited group of lenders writes that structure on rentals, so the real question is which program fits your property and credit. Lien position is a recording-order fact, not a product type. The same line is a first lien on a paid-off rental and a second lien on a financed one.

  • On an investment property, the network’s ceiling is 70% CLTV, with a 700 minimum credit score and a maximum line of $500,000.
  • Primary residences and second homes reach higher leverage, but 90% CLTV exists only at 720 or better.
  • Approval rides on personal credit and debt-to-income, not on rent.
  • Title must be held by an individual or a revocable living trust, so LLC-owned rentals need a different path.
  • Lendmire is a broker and matches the file to a wholesale lender; it is not a lender itself.

What Does “First Lien Position” Actually Mean?

First lien position means the line is paid first from sale proceeds if the property is ever sold or foreclosed. Position is set by recording order on title. Bills.com makes the same point: lien position depends on what is already recorded against the property, not on the loan type.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

That gives a first-lien HELOC two routes.

1. Free and clear. The property has no mortgage, so the new line is the only lien and lands in first position automatically.

2. Payoff at closing. The line is large enough to retire the existing mortgage. A release is recorded and the line takes first position.

A first lien does not change the product. It is still a revolving line with a draw period and a repayment period. It does not turn into a term loan because it sits first.

Which Banks Offer a HELOC When the Line Must Sit in First Lien Position?

Few do, and the list changes often. NerdWallet says investment-property lines exist, but the lender pool is smaller, borrowing power is lower than on a primary home, and requirements are strict because lenders see higher default risk.

Any list of institutions goes stale, and this article does not rank or name lenders. The best program for your situation depends on occupancy, credit, how the title is held, and how much leverage you need. Lendmire is a mortgage broker that works with a network of wholesale HELOC lenders. It shops the file across them and matches it to the program whose guidelines fit. The brokerage describes what those programs look for below, so you can judge the fit before applying anywhere.

When you vet any institution yourself, the type of institution tells you what to ask.

Institution type What to verify
Community bank Does it write investment lines at all?
Credit union Any limit on unit count or occupancy?
Regional bank Is first position offered on rentals?
Large retail lender Does it exclude non-owner-occupied lines?
Broker with wholesale network Which program matches this scenario?

Availability matters here too. Lendmire’s HELOC placement is limited to 16 full-service states, which is narrower than its 41-market DSCR footprint (40 states plus Washington, D.C.).

How Underwriting Treats a First-Lien Line, Step by Step

Underwriting runs in five steps, and a file can stall at any one of them.

1. Title check. The lender orders a title search for recorded liens. A prior mortgage blocks first position unless it is paid and released at closing.

2. Value test. The lender sets a combined loan-to-value (CLTV) ceiling. The test counts every lien and the full credit limit, not only the drawn balance. On a paid-off property the existing-lien portion is zero, so the new line alone sets the ratio.

3. Borrower qualification. Personal credit and debt-to-income decide approval. These lines are underwritten on the borrower, which is the opposite of how a DSCR loan works. On the network’s programs, DTI tops out at 50%, and the test uses the interest-only payment calculated on the maximum draw. A score between 600 and 679 lowers the cap to 45%, and any ratio above 45% requires at least a 680 score.

4. Valuation. Lines at or below $500,000 ordinarily use an automated valuation with no traditional appraisal, though a higher CLTV can trigger a secondary valuation. Every line above $500,000 requires a full appraisal, and a borrower may request one in any case.

5. Payoff, release, and draw. If the line replaces a mortgage, proceeds retire the old loan and a release is recorded. At least 75% of the line is drawn at closing on the network’s programs, which matters for borrowers who wanted a mostly undrawn reserve.

Yahoo Finance notes that lenders weigh both the borrower’s creditworthiness and the property’s financials, and that investment lines often involve an in-person appraisal.

Structures and Variations That Exist

The network’s lines run in first or second lien position as standalone lines. Two wholesale programs sit behind them, and they differ in draw structure. One uses a 3-year interest-only draw followed by a 17-year fully amortizing repayment. The other, the longer-runway program, uses a 5-year interest-only draw followed by a 25-year fully amortizing repayment. Some states shorten both structures. Investment lines run the 5-year draw and 25-year repayment structure only. Pricing floats through both periods and never converts to fixed.

Leverage depends on occupancy, and the ceilings are not interchangeable.

Occupancy Max CLTV Credit and line size
Investment property 70% 700+, up to $500,000
Second home 90% 720+, up to $500,000
Primary residence 90% 720+, up to $500,000
Primary residence 75% 700+ (720 on the longer-runway program), up to $750,000

Treat the 90% figures as the top of the range. Lower credit tiers step down, and the 90% tier exists only at 720 or better. The second-home row shows that top tier, while the floor for a second-home file is a 640 credit score. An investment property has a floor of 700.

A line above $500,000 is available on a primary residence only. It caps at 75% CLTV, requires a full appraisal, and needs a credit profile of 700 or better, with 720 required on the longer-runway program. Line sizes start at $25,000, and a borrower can hold up to three lines at a time. A borrower who owns more than 15 financed properties is not eligible.

Eligible collateral includes single-family homes, 2-4 unit properties, PUDs, townhomes, and condominiums, including non-warrantable ones. Manufactured homes, co-ops, condotels, log homes, commercial and mixed-use properties, and agricultural zoning are not offered.

White Coat Investor reports that, market-wide, investment-property lines often come with up to 80% LTV and a 720 credit minimum. On the network’s investment lines, the ceiling is 70% CLTV at 700 or better. Surveys of the broader market describe what lenders do, and the network’s figure is the one that applies to a Lendmire file.

Where the Rule Breaks: Named Edge Cases

The property still has a mortgage. The line can be first only if it retires that mortgage. If the investor wants to keep the existing loan, any new line is a second lien, and many institutions decline second-position lines on rentals. A BiggerPockets discussion includes an investor describing a product that exists only in first position on 1-4 unit rentals, and another noting that a line with no first mortgage works on free-and-clear property. Those are individual experiences and not rules, but they match how the market tends to be structured.

The rental is held in an LLC. This is the sharpest edge case. On the network’s programs, title must be held by the individual borrower or a revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title. A paid-off rental already deeded to an LLC needs a vesting change first, or a different product. A DSCR cash-out refinance is the usual alternative for entity-held property, subject to program terms.

A paid-off home is not automatically free of every claim. A mortgage can be paid in full and still show on title if the lender never recorded the release. Picture a rental whose old loan was paid years ago, but the release was never filed. The title search shows an open lien, and the new line cannot take first position until the release is recorded. Tax, HOA, or judgment liens can also surface in a title search and may rank ahead of or alongside a new lien. A title search settles these questions before the line is committed.

A later refinance of the first mortgage. This matters most for second-lien structures, but it has a mirror image for first-lien lines. The CFPB explains that refinancing a first mortgage may need the HELOC lender’s approval, that the lender can refuse, and that the line may then have to be paid off. A first-lien line that is later joined by a new first mortgage faces the same problem. The new mortgage lender cannot take first position unless the line is paid off or subordinated, and a subordination request is reviewed like a new application.

Unit count and property type. Some institutions cap investment lines at 1-2 units. The network accepts 2-4 unit properties, but only on the longer-runway program (the one with the 5-year draw and 25-year repayment), which sets a 640 minimum score for that property type. An investment line still needs a 700 credit profile, so that 640 applies to primary residences and second homes. Modular factory-built homes are eligible on that program only.

Listed or recently listed properties. A property listed for sale, or listed within the past 60 days, is ineligible in several states.

Choosing Between a First-Lien Line and a DSCR Cash-Out

The decision turns on what you are underwriting and how the property is held. A first-lien HELOC is underwritten on you, so it can work when rent would not support a new cash-out payment. It also counts against your personal debt-to-income ratio.

A DSCR cash-out refinance is a term loan underwritten primarily on the property’s rental income covering its payment, subject to lender guidelines. Cash-out leverage tops out around 75% LTV across most of the network, and about six months of seasoning is the common expectation. A score near 660 is typical, and 700 or better unlocks the strongest tiers. 1.00 coverage is where select programs start. Coverage below 1.00 is available through select lenders in the network, with leverage and terms adjusted. Clearing 1.00 does not mean positive cash flow, because repairs, vacancy, management, and utilities sit outside the calculation.

Factor First-lien HELOC DSCR cash-out
Underwritten on Borrower credit and DTI Property rent vs. payment
Structure Revolving line Term loan
Entity ownership Individual or revocable trust LLC possible, per lender program requirements
Investment leverage 70% CLTV Around 75% LTV

If the existing mortgage is itself a DSCR loan, confirm its terms before choosing, since the answer depends on that loan’s own program rules.

A Short Decision Flow

1. No mortgage on the property, and you hold title personally or in a revocable trust. A first-lien line is available as a candidate structure. Check title for unreleased liens, then compare against a DSCR cash-out.

2. Mortgage on the property, and you want to keep it. Any line becomes a second lien, and fewer lenders write that on a rental. A DSCR cash-out may fit better.

3. Mortgage on the property, and the line is large enough to retire it. The line can replace the mortgage. Weigh the loss of a fixed structure against your plan for the equity.

4. Property held in an LLC. Change the vesting first or use a DSCR cash-out instead.

5. Credit below 700 on an investment property. The investment tier is not available, so the structure needs rethinking.

Questions to Ask Any Institution

These questions work with any bank or credit union and expose the answer in one conversation.

  • Do you write lines on non-owner-occupied 1-4 unit properties?
  • Will the line be in first position, and how do you confirm it?
  • Do you allow LLC or trust vesting?
  • Does the line count against my debt-to-income ratio on the maximum draw?
  • What happens if I want to refinance a mortgage later?
  • Is there a minimum draw at closing?

Key Terms Defined

First lien position: The line is recorded ahead of every other mortgage-type lien on the property.

Junior (second) lien: A loan recorded behind another mortgage, paid second if the property is sold.

CLTV: Combined loan-to-value, which counts every lien plus the full credit limit against the property’s value.

Subordination: A lender’s agreement to move its lien behind a new mortgage, which it is not required to give.

Lien release: The recorded document showing a paid-off loan no longer encumbers the property.

Draw period: The stretch when the borrower can use the line and pay interest only, before repayment amortizes.

Frequently Asked Questions

Is a HELOC on a paid-off rental automatically a first lien?

Yes, on recording order, provided nothing else is recorded against the title. The caveat is that a paid mortgage whose release was never filed can still appear as an open lien. A title search catches that before the line is committed.

Can a first-lien HELOC replace my existing mortgage on a rental?

Yes, if the line is large enough to pay off the loan at closing. On the network’s investment lines, the maximum is $500,000 at 70% CLTV with a 700 minimum score. If the payoff would exceed either limit, the structure does not work.

Can an LLC borrow on a first-lien HELOC?

Not on the network’s programs. Title must be held by the individual or an inter vivos revocable living trust. An LLC-held rental needs a vesting change or a DSCR cash-out refinance, subject to program terms.

Does the rent on the property help me qualify?

No. These lines are underwritten on personal credit and debt-to-income, with a 50% DTI ceiling. Rent matters on a DSCR loan, which qualifies primarily on property-level rental income covering the payment, subject to lender guidelines.

What if I want to refinance the first mortgage later?

A first-lien line has to be paid off or subordinated before a new first mortgage can take its place. The CFPB notes the HELOC lender may refuse a subordination request, so plan the exit before opening the line.
