How Much Can You Borrow on a HELOC in a Divorce With Both Spouses on the Mortgage?

How Much Can You Borrow on a HELOC in a Divorce With Both Spouses on the Mortgage?

The Quick Read: The limit is the program’s maximum combined loan-to-value applied to the appraised value, minus every lien already on the home, and divorce does not change that formula. With both spouses on the mortgage, the joint first lien eats into the available equity, and both spouses usually have to sign. Key points:

  • On an investment property, the network ceiling is 70% CLTV with a 700 minimum credit score and a $500,000 maximum line.
  • On a primary residence, the ceiling reaches 90% CLTV only at a 720 score, and only up to $500,000.
  • A line above $500,000 is primary-residence only, needs at least 700 credit (720 on the longer-runway structure), caps at 75% CLTV, and requires a full appraisal.
  • A line does not release either spouse from the first mortgage or from the line itself.
  • Lendmire’s HELOC availability covers 16 states, which is narrower than its DSCR footprint.

How the Borrowing Limit Is Calculated

The formula has three steps. Take the appraised value. Multiply it by the maximum CLTV your credit tier allows. Subtract the first mortgage and every other lien. What remains is the ceiling for the new line.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Run the numbers on a home with a joint first mortgage and no other debt. If the program caps CLTV at 70%, the first mortgage already uses part of that 70%. The new line only gets the gap. A home with a large joint first mortgage may leave very little room, even when the headline equity looks healthy.

Credit, income, and debt ratios can lower the result further. Across the wholesale network, debt-to-income tops out at 50%, and drops to 45% for credit profiles from 600 to 679. Anything above 45% needs a 680 minimum. Lines are qualified on the interest-only payment calculated on the maximum draw, so a large line tests your ratios harder than you might expect.

Experian describes the same formula and cites 85% as a common ceiling. That is a market-wide figure for consumer lines. It does not describe the investment-property ceiling in Lendmire’s network, which is 70% CLTV. Final terms depend on lender guidelines, property type, leverage, and the borrower’s complete credit picture.

What Are the Network Limits by Occupancy?

The ceiling depends on how the home is used, so the answer changes by occupancy. The ranges below come from select wholesale programs Lendmire brokers, subject to lender guidelines and full file review.

Occupancy Top CLTV Credit needed Max line
Investment property 70% 700+ $500,000
Second home 90% 720+ $500,000
Primary residence 90% 720+ $500,000
Primary residence, larger line 75% 700+ (720 on longer-runway) $750,000

Lower credit tiers step the ceiling down. On a primary residence, a 640 score reaches 80% CLTV, and 600 reaches 60%. A second home needs at least 640. An investment property needs at least 700, so a borrower under that score has no investment-property route on this product. A line above $500,000, up to the $750,000 maximum, is available only on a primary residence.

Lines at or below $500,000 ordinarily run an automated valuation instead of a traditional appraisal, though a higher CLTV may call for a secondary valuation. Every line above $500,000 needs a full appraisal, and a borrower can request one in any case.

Why Both Spouses on the Mortgage Changes the Math

Joint ownership affects the amount, the signatures, and the liability. It does not add borrowing power.

The amount. The joint first mortgage counts in full against the CLTV ceiling. If there is also an existing joint HELOC, that balance counts too. Each lien shrinks what a new line can add.

The signatures. Regulation B generally bars a lender from requiring a non-applicant spouse to sign a credit instrument when the applicant qualifies alone. It carves out an exception for secured credit. A creditor may require a spouse’s signature on any instrument that state law makes necessary to create a valid lien, pass clear title, or waive inchoate rights, as laid out in 12 CFR 1002.7. When both spouses are on title, expect both to sign the lien documents.

The liability. This is where borrowers get hurt. Nolo explains that a divorce decree can allocate payment duties between spouses, but it does not bind the lender or remove a name from the loan documents. Only a refinance, an assumption with release, a modification, or an express lender release does that. University of Minnesota Extension says each spouse stays liable on joint debts after divorce, and that a lender is likely to require a refinance to remove a spouse.

Does the Timing of the Divorce Change What You Can Do?

Yes. The stage of the case decides who signs, what paper the lender wants, and whether a lien is allowed at all.

Stage Who signs What to expect
Before filing Both spouses Standard joint file
Case pending Both, plus consent where required Some states restrict new liens on marital property
Decree entered, deed not recorded Both, usually Title still shows both names
Decree and deed recorded Keeping spouse alone Easiest file to underwrite

Many states restrict new liens on marital property once a case is filed. Written consent or a court order may permit one. Where no restraint applies, the lender can still insist that both owners sign. Counsel should confirm the local rule before anyone applies.

After a decree and a recorded deed, the keeping spouse is the most straightforward borrower. Even then, the existing first mortgage may still carry both names, and the lender will look at it that way.

Does a Quitclaim Deed or the Decree Remove Your Ex From the Loan?

No. A quitclaim moves title only. It leaves the mortgage liability exactly where it was. The decree allocates responsibility between you and your ex, but the lender is not a party to it.

The CFPB’s Issue Spotlight documents servicers that refuse to release the original borrower even when a decree requires it. It also notes that removing a borrower typically means the remaining owner must assume the loan, which can mean going through the investor’s underwriting.

Federal law offers only narrow help. A lender generally cannot call the first mortgage due only because the home transferred to a spouse in a divorce. That protection does not release anyone from the debt, and it does not force a lender to approve a new loan.

Late payments hurt both borrowers. If your ex is ordered to pay a joint debt and does not, the creditor can still come to you.

Worked Example: What a Joint First Lien Leaves for a New Line

Consider a jointly owned rental valued at $400,000 by an appraisal or automated valuation. These are modeled assumptions, not market data. Say the borrower has a 720 score and the program caps investment-property lines at 70% CLTV.

Seventy percent of $400,000 is the total debt the program will allow against the property. The joint first mortgage uses part of that allowance. If the first mortgage already sits near the cap, the new line has almost nothing to work with. If it sits well below, the gap is the ceiling.

Now add the spouse’s share. A buyout line pays the ex their equity portion. It does not take them off the first mortgage. The keeping spouse then carries a joint first lien, a new line, and the ex’s continuing liability on both. Two moves can ease this: a refinance into one name, which releases the ex, or a sale. A second lien alone is the weakest option for releasing liability.

Existing Joint Lines: Freeze, Pay Down, or Close

An existing joint HELOC adds risk beyond the balance. Both borrowers stay liable, and an ex who draws on the line can bind the other. The University of Minnesota Extension page notes that when both spouses applied for a line, each remains liable, even for debts contracted after the divorce.

Freezing or paying off the line limits that exposure. It also restores the CLTV room the balance was using. A new line is sized on whatever equity is left, so clearing the old one can raise what you can borrow.

On the Lendmire network, new lines draw interest-only for a period and then amortize, and they are qualified on the interest-only payment calculated on the maximum draw. Investment lines run a 5-year draw with a 25-year repayment, and at least 75% of the line is drawn at closing. That is a meaningful balance from day one, and it counts against your ratios.

Who Qualifies, and What Disqualifies a File

Credit sets the tier. The program floor is 600. Housing history is applied across all financed properties, which matters in a divorce when a joint mortgage shows up on your file whether or not you pay it.

Other limits that catch divorcing borrowers:

  • A bankruptcy needs 4 years of seasoning from discharge or dismissal.
  • Foreclosure-family history splits by program on primary residences and second homes. Investment files follow a 7-year seasoning path for a foreclosure and 4 years for a deed-in-lieu, pre-foreclosure, or short sale.
  • A borrower is limited to three lines and cannot own more than 15 financed properties.
  • Title must be held by the individual or a revocable living trust. An LLC cannot hold title on this product, so a rental deeded to an LLC needs a vesting change or a DSCR cash-out instead.
  • Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use, and agricultural-zoned properties are not offered.

The product is also limited to 16 states: AL, CA, CO, FL, GA, IN, MI, MT, NM, NC, OH, PA, TN, TX, VA, and WA. Some states add their own rules, such as shorter repayment periods in Tennessee and a 12-day waiting period on Texas primary residences.

The Investor Decision: A Line, or a DSCR Cash-Out?

An equity line keeps the first mortgage in place and adds a second lien. A DSCR cash-out refinance replaces the joint loan, which can release your ex and fund the buyout in one step. For a rental you plan to keep, the second path often fits better when the joint loan is the problem.

DSCR cash-out on a standard rental tops out around 75% LTV across most of the network, with about 6 months of seasoning as the common expectation. DSCR compares rent to the full monthly obligation. It qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. Clearing a 1.00 coverage ratio is where many select programs start, but it is not the same as positive cash flow, since repairs, vacancy, and management sit outside the calculation. Coverage below 1.00 is available through select lenders in the network, with leverage and terms adjusted.

Key Terms Defined

Combined loan-to-value (CLTV): All liens on the property added together and divided by its appraised value.

Joint liability: Each borrower on a loan can be pursued for the full balance, whatever a decree says.

Quitclaim deed: A deed that moves title and leaves the mortgage debt unchanged.

Assumption: A process where the remaining owner takes over the loan, often with underwriting review.

Frequently Asked Questions

Can I get a HELOC while my divorce is pending?

Sometimes. Many states restrict new liens on marital property once a case is filed, so written consent or a court order may be required. Even where no restraint exists, the lender will likely want both owners to sign. Ask your attorney before applying.

Does the divorce decree take my ex off the HELOC or mortgage?

No. The decree binds you and your ex, not the lender. Only a refinance, an assumption with release, a modification, or an express release from the lender removes a name.

Can I borrow alone if both of us are on title?

Rarely. Regulation B limits spousal signature demands, but its secured-credit exception lets a lender require a co-owner to sign the instruments that create the lien. With both names on title, plan on both signing.

What is the maximum CLTV on an investment property line?

On the Lendmire network, an investment property line caps at 70% CLTV with a 700 minimum credit score and a $500,000 maximum line. Primary residences and second homes can reach 90% only at a 720 or better profile, subject to lender guidelines.

Will a buyout line lower my payment burden on the first mortgage?

No. A line leaves the first mortgage in place and adds a second payment. A refinance into one name can release your ex, but it replaces the first loan.
