The Quick Read: While probate is open, a DSCR HELOC is usually not available to an heir, because a lender needs a borrower who holds recorded title and can sign a lien. Title, not rent, is the question these files turn on. The line becomes reviewable once a deed to the heir is recorded, which is different from the court closing its file. A funded trust, survivorship or transfer-on-death route may skip probate, though title review still decides.
- Three gates apply: recorded title, signing authority and insurable title.
- A will names who should inherit. It does not put the house in anyone’s name.
- Executor authority belongs to the estate and is not the same as ownership.
- Every title holder signs, so co-heirs must settle their position first.
- Use the open-probate period to prepare the lease, insurance and title file.
A DSCR HELOC is a home equity line on a rental, qualified primarily on property-level rental income covering the payment, subject to lender guidelines. It is a standalone second lien behind a first mortgage the owner keeps, or a standalone first lien on a rental with no mortgage. Lendmire’s complete DSCR loans guide covers the broader product family. This article covers one narrow question: what has to happen to title first.
Key Terms Defined
Probate is the court-supervised process of transferring a deceased person’s assets to the people entitled to them.
Letters testamentary are court documents that prove an executor’s authority to collect assets, pay debts and distribute property. When there is no will, the court issues letters of administration instead.
Vesting is the name in which title is held, and it should match across the note, title policy, insurance, lease and appraisal.
Seasoning is the waiting period a lender wants between a purchase or refinance and a new loan.
CLTV is combined loan-to-value: the first mortgage balance plus the new line, divided by property value.
DSCR is the debt-service coverage ratio: gross monthly rent divided by the qualifying payment.
What Do “Title Rules” Actually Mean Here?
Three separate tests decide the file, and a strong rent roll passes none of them. The first is recorded title: the borrower’s name must be on the deed. The second is signing authority: the person signing must be able to pledge the property. The third is insurable title: a title company must be willing to insure the lien position.
Being named in a will does not clear any of the three. A will only says who should receive the house. Probate validates the will, the court’s letters give authority, and the recorded deed gives title.
The rule is not a federal regulation. It comes from lien law, title insurance practice and lender guidelines. That is why the answer is steady across states even when the timelines are not.
Why Does Open Probate Block the Lien?
During probate the estate holds title, and the heir does not yet own the house. Iowa State’s Center for Agricultural Law and Taxation describes probate as a court-supervised transfer process, and notes that one benefit is that beneficiaries receive assets free of clouds on the title. Until that transfer happens, there is no borrower who can grant a lien.
Authority is the second piece. Cornell’s Legal Information Institute defines letters testamentary as the documents proving an executor’s authority. Even with letters, the executor acts for the estate.
Timing is set by each state and each estate. Iowa State Extension says probate is the court procedure that transfers clear title (except for jointly held property) and that complex estates can take two years or more. That is an Iowa source, so treat the duration as illustrative.
Who Owns the House, and Who Can Sign, at Each Stage?
The table below shows the stages in the order they happen.
| Stage | Who holds title | Who can sign | DSCR HELOC outlook |
|---|---|---|---|
| No court case opened | Decedent’s estate | Nobody | Open probate first |
| Probate open, no letters | Estate | Nobody | Wait |
| Letters issued, probate open | Estate | Executor, for the estate | Estate-level loan only |
| Deed to heir recorded | Heir or heirs | Everyone on title | Line can be reviewed |
| Funded trust, survivorship, TOD deed | Trustee or survivor | Trustee or survivor | May skip probate; title review decides |
“After probate” means the deed to the heir has been recorded. It does not mean the court has closed its file. Keeping that distinction in mind clears up most questions about timing.
Which Routes May Skip Probate?
Some assets pass outside the court. The Uniform Law Commission explains that a recorded transfer-on-death deed moves real property to the beneficiary without probate, and that the beneficiary holds no interest during the owner’s life. The title-insurance trade body ALTA adds that the deed must be recorded while the owner is alive. That piece is older, and state adoption has changed since.
Property properly titled into a trust is administered outside probate, per Iowa State’s probate overview linked above. Jointly held property passes to the survivor automatically.
A will does not avoid probate. And even a clean skip still goes through the title company, which decides whether title passed cleanly. An unrecorded TOD deed or an unfunded trust can look like a shortcut and turn out to be a dead end.
What About the Existing Mortgage?
The decedent’s mortgage stays on the property during probate and keeps accruing interest. That matters for two reasons.
First, an heir who keeps the first mortgage can only take a second lien, and the program’s combined leverage is measured on the first mortgage balance plus the new line. The lender’s own calculation governs.
Federal protections exist for heirs and the mortgage, but they are narrow. A federal exception, explained by Nolo, bars a lender from calling the loan due on certain transfers to relatives after death. That protects the existing loan. It does not make the heir a titled owner, and it does not authorize a new lien.
What Changes With Several Heirs or an LLC?
Co-heirs usually hold as tenants in common. One heir cannot pledge the whole property, and every title holder signs. A title holder who is not a borrower signs a non-borrowing owner acknowledgment and the security instrument.
An LLC can stay on title for an investment property, subject to program terms, and the members sign as guarantors. It does not help while the estate holds title, because the LLC cannot own what the estate still owns. Trust acceptance varies by program. A blanket loan across several rentals has a related weakness: one unresolved inherited rental can hold up the whole pool.
Intestate estates follow the same logic. The court issues letters of administration instead of letters testamentary, per Policygenius, and the authority is equivalent.
Heirs’ Property: When No Probate Was Ever Opened
Some families never open a case. Iowa State’s heirs’ property article explains that heirs may possess the property yet lack clear title to prove ownership, and unknown heirs keep clouding it. For a lender this is a collateral problem. The fix is cleaning up title, not strengthening the rent file.
How Does the DSCR Test Work Once Title Is Clean?
Once a deed is recorded, the rent file takes over. The line qualifies primarily on property-level rental income covering the payment, subject to lender guidelines, with no traditional personal-income documentation, W-2s or personal income calculation. Across Lendmire’s wholesale network, the program on this lane works like this, subject to underwriting:
- Coverage: a minimum DSCR of 1.10x, tested on a fully amortizing stress payment over the entire credit limit.
- Rent: the lesser of the appraisal’s market rent and the lease, unless three months of receipts support a lease above market.
- Lease: a lease in place is required, and a two-to-four-unit property may have at most one vacant unit.
- Second lien: up to 70% CLTV at a 720 score or better, on lines of $50,000 to $500,000.
- First lien (rental with no mortgage): up to 75% LTV at 740 or better, 70% from 700 to 739, on lines to $500,000. Lines above $500,000, up to $1,000,000, carry a 65% LTV ceiling.
- Draws: at least 80% of the line is drawn at closing, later draws are at least $5,000, and the draw period is five years interest-only followed by a 25-year repayment period, with a variable rate and a 30-year maturity.
- Valuation: lines to $400,000 use an automated valuation with a property inspection report or a full appraisal. Larger lines need a full interior appraisal.
- Reserves: none required. The exact numbers vary by lender and program and follow a full review of property, leverage, and credit.
Seasoning matters for inherited property too. A rental bought or refinanced inside the last 6 months is not eligible (that clock runs from the last note date to the new note date), and the owner must have held title for 6 months (settlement date to note date). How a lender counts recorded inherited title can differ, so ask before counting on a date.
The program is offered in 15 of Lendmire’s 16 licensed states, every licensed state except Tennessee. Rural property, condotels, row homes and leaseholds sit outside it. Lendmire is a broker arranging this through a wholesale lender, and every file is underwritten individually.
Which Product Fits While Title Is Still Open?
| Option | Needs recorded heir title? | Fit |
|---|---|---|
| DSCR HELOC | Yes | Keep the first mortgage, add a line |
| DSCR cash-out refinance | Yes | Replaces the first mortgage, can set LLC vesting |
| Estate-level loan | No, uses executor authority | Different product, often needs court approval |
| Sale | Depends on authority | Ends the hold |
A refinance can set LLC vesting in the same transaction, which a HELOC cannot do for a first mortgage you keep. Lendmire’s piece on investment property HELOC rules before probate ends compares the personal-income version of this line. Co-heirs who want one investor to borrow alone need a buyout or partition first.
What Should You Do While Probate Is Open?
Use the wait to build the file so the deed is the only missing piece.
1. Keep the existing mortgage current and the hazard insurance active.
2. Assemble the lease file, rent receipts and tenant contact details.
3. Order a title commitment and ask what the title company needs for the heir to be insurable.
4. Decide who will be on title, and settle any buyout among co-heirs.
5. Ask the probate attorney which steps your state requires before a deed can record.
A hypothetical timeline shows where each gate clears. Say an owner dies leaving a duplex with a mortgage and a lease in place. The estate opens probate and gets letters, so the executor can manage the property but not pledge it. Rent keeps flowing and the mortgage stays current. Later the deed to the sole heir records, so recorded title and signing authority both clear. The title company confirms the lien is insurable, which clears the third gate. Only then does the DSCR review begin, with coverage tested against the 1.10x floor.
Frequently Asked Questions
Can I get a DSCR HELOC on an inherited rental before probate ends?
Usually not. The estate holds title until a deed to the heir records, and the executor can act only for the estate. The line can be reviewed once title is recorded in the borrower’s name, subject to lender guidelines and underwriting.
Does being named executor let me borrow against the property?
No. Authority exists only after the court issues letters, and it belongs to the estate rather than to you personally. Even then, an estate-level loan is a different product from a DSCR HELOC.
Can a trust or transfer-on-death deed get me a line sooner?
It may, because those routes can pass title without probate. The title company still has to confirm title passed cleanly, and an unfunded trust or an unrecorded deed will not count.
What if several siblings inherited the house?
Everyone on title signs, and one heir cannot pledge the whole property. A title holder who is not a borrower signs an acknowledgment and the security instrument. A buyout or partition often comes first.
How does seasoning apply to an inherited rental?
Two six-month clocks apply: the line is not available on a rental bought or refinanced in the last 6 months (last note date to new note date), and title must have been held for 6 months (settlement date to note date). Ask how recorded inherited title is counted on your file.
If you are considering a home equity line on a rental property and want to see how the numbers work, Lendmire can help you compare DSCR HELOC options based on the property, the rent, the equity available, credit profile, combined leverage, and your goals. Lendmire’s piece HELOC Signature Rules Before Probate Ends goes deeper on who must sign.
Probate courts set the calendar, but an heir who arrives with a lease file, current insurance and a title plan loses nothing when the deed finally records.
