The Quick Read: It can, but only in narrow cases: the borrower keeps a first mortgage worth protecting, holds the home personally rather than in an LLC, and is reviewed on personal credit and debt-to-income, with a line size that fits the equity needed. A bank statement HELOC is a separate second-lien product with its own limits, not a way around the FHA rule.
- The FHA cash-out cap is 80% of the property’s adjusted value, and it applies to a new FHA cash-out refinance on a primary residence.
- A standalone line behind your existing first mortgage is sized by its own combined loan-to-value (CLTV), credit, and dollar limits.
- Rent does not qualify a HELOC. Personal income and debts do, which is the main contrast with a DSCR cash-out refinance.
- Qualification is subject to lender guidelines, credit approval, and property review.
What the FHA Cash-Out Cap Actually Limits
The FHA cash-out cap limits how much total debt can sit on a home after a new FHA cash-out refinance. Since the rule changed, the ceiling on loan-to-value and combined loan-to-value is 80%, down from 85%. Orrick’s summary of the change notes the agency acted after cash-out volume rose 250.47% between fiscal 2013 and fiscal 2018, and wanted more borrower equity left in each loan.
How large a line the equity supports.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
Two details matter for the “above the cap” question. First, the 80% is measured against adjusted value as FHA defines it, and any second lien counts in the combined figure at the time of the refinance, as Consumer Finance Monitor describes. A second lien stacked into an FHA cash-out does not raise the cap.
Second, the cap is not 80% of your equity. It is 80% of value, so at least 20% of the home’s value stays as equity. A summary of the FHA handbook at FedLaws also lists a 12-month ownership and occupancy expectation for cash-out. That makes FHA cash-out a primary-residence tool, not a rental tool.
So What Does “Above the Cap” Really Mean?
“Above the cap” means keeping your current first mortgage and adding a separate line behind it. The FHA cap binds a new FHA cash-out loan. It does not follow you into a different product.
The line has its own rulebook. Whether a given lender will place a line behind an existing FHA first mortgage depends on that lender’s guidelines. No FHA document sets that rule, so ask before assuming.
Picture a primary residence with a first mortgage at 65% of value. An FHA cash-out refinance can take total debt to 80%, which frees up 15 points of value. A line at the network’s highest primary-residence tier, which requires a 720 or better credit profile, can reach 90% CLTV. That is 25 points of value, subject to the $500,000 dollar limit on that tier. The gap between the two is real, but it only opens for borrowers with strong credit and enough income to carry the extra debt.
How a Bank Statement HELOC Works
A bank statement HELOC is an ordinary line of credit that documents self-employed income from deposits instead of tax returns. It is reviewed on documented income under the applicable program, subject to lender guidelines. It is not a no-documentation product.
The usual steps look like this:
1. The lender reviews 12 or 24 months of personal or business statements, depending on the program. 2. Transfers, loan proceeds, and unexplained large deposits come out of the deposit total. 3. Business-account deposits receive an expense factor set by the lender, so there is no universal figure. 4. The adjusted total, scaled to your ownership share, is divided by the number of months to produce monthly income. 5. The new payment joins your first mortgage and other debts in a personal debt-to-income test. 6. Valuation, title, and occupancy rules decide the CLTV tier.
On this network, maximum debt-to-income runs 50%, or 45% for credit profiles from 600 to 679. A ratio above 45% requires a 680 minimum. The test is run on the interest-only payment calculated at the maximum draw, so a line you plan to draw lightly is still qualified as if it were fully drawn.
The Network’s Limits, by Occupancy
The ceiling depends on how the property is occupied, and the occupancy tiers differ sharply. These figures come from the select wholesale lenders Lendmire works with, and every one is subject to lender guidelines and full file review.
| Occupancy | Top CLTV | Credit pairing | Max line |
|---|---|---|---|
| Primary residence | 90% | 720+ | $500,000 |
| Primary residence (larger line) | 75% | 700+ (720 on the longer-runway program) | $750,000 |
| Second home | 90% | 720+ | $500,000 |
| Investment property | 70% | 700+ | $500,000 |
Lower credit tiers step the ceiling down. On a primary residence, a 640 score pairs with 80% CLTV, and the program floor is 600. Second homes floor at 640. Investment lines floor at 700. A primary-residence line can run up to $750,000, but any line above $500,000 caps at 75% CLTV and requires a full appraisal.
Structure matters too. Pricing on these lines floats through both the draw period and the repayment period, and it never converts to fixed. At least 75% of the line is drawn at closing. Primary and second-home lines come in two draw structures: a 3-year interest-only draw followed by 17 years of repayment, or a 5-year draw followed by 25 years. Investment lines use the 5-year draw and 25-year repayment structure only.
Lines at or below $500,000 usually run on an automated valuation, though a higher CLTV may call for a second valuation. Every line above $500,000 requires a full appraisal. A bankruptcy needs 4 years of seasoning from discharge or dismissal.
Why Rentals Change the Answer
For a rental, the FHA question mostly disappears, because FHA cash-out is for a principal residence. The real choice becomes a HELOC against a DSCR cash-out refinance. They solve different problems.
On an investment property, the network ceiling is 70% CLTV, with a 700 minimum score and a $500,000 maximum line. Market sources describe the broader picture: investors on BiggerPockets say many banks write lines only on a primary residence. Multifamily lines are especially hard to find.
Vesting is the sharpest structural limit. Title must sit with the individual borrower or an inter vivos revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title. A rental already deeded to an LLC needs a vesting change before a line is possible, or a DSCR cash-out instead. A borrower who owns more than 15 financed properties is not eligible, and each borrower is limited to three lines.
Property type matters as well. Single-family, 2-4 unit, PUD, townhome, and condominium properties are eligible, including non-warrantable condominiums. Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use, and agricultural zoning are not offered.
HELOC or DSCR Cash-Out? A Decision Frame
The right path depends on three things: who holds title, what you want to preserve, and how much you need. A HELOC makes sense when the first mortgage is cheap and worth keeping, title is personal, and the amount fits inside the line limits. A DSCR cash-out usually fits when the property is entity-owned, the amount is larger, or personal debt-to-income is already stretched.
| Factor | Bank statement HELOC | DSCR cash-out refinance |
|---|---|---|
| Reviewed on | Personal income and debts | Property rent versus its payment |
| First mortgage | Stays in place | Replaced |
| Title | Individual or revocable trust | LLC allowed, subject to program terms |
| Occupancy | Primary, second home, investment | Non-owner-occupied investment property |
| Leverage reach | Up to 70% CLTV on investments | Around 75% LTV on most files |
A DSCR cash-out generally tops out near 75% LTV across most of the network, with about 6 months of seasoning as the common expectation. Coverage of 1.00 is where select programs start, and stronger ratios open better pricing and leverage. A separate select-lender path takes coverage below 1.00, with leverage and terms adjusted. Most programs want a score near 660, with 620 available in parts of the network and 700 and up unlocking the strongest tiers. Loan sizes run up to $3,000,000 on standard programs (smaller balances available through select lenders), and reserves commonly sit around 6 months of PITIA, varying by lender, leverage, and loan size.
Clearing 1.00 does not mean positive cash flow. DSCR compares rent to the monthly payment, taxes, insurance, and any HOA dues. Repairs, vacancy, management, and utilities sit outside the calculation. The strongest files clear both tests, enough equity and enough rental coverage.
Lendmire’s complete DSCR loans guide walks through how that rent-based path works.
When This Is a Bad Idea
A bank statement HELOC is the wrong tool in several common situations.
- You need a fixed budget. Lines carry floating pricing, and an interest-only draw period eventually shifts into full amortization. A line is a poor foundation for a rehab or down payment you cannot afford to lose.
- Your debt-to-income is already tight. Each draw adds to personal debt, and the qualifying test assumes the maximum draw.
- The property sits in an LLC. Title rules block the line unless you change vesting, which may cut against your asset-protection plan.
- You need more than the line size allows. Investment lines top out at $500,000 and 70% CLTV, and larger needs usually point to a DSCR cash-out.
- You want cash for another rental purchase. Lines draw against personal credit capacity, which competes with your next mortgage application.

What Federal Rules Say About HELOCs
HELOCs are not covered by the federal ability-to-repay rule that governs closed-end mortgages.
That means no federal rule dictates how a lender documents self-employed income on a line. Each program sets its own method. Exempt from one rule does not mean unregulated, though, and the lender still reviews statements, credit, debt-to-income, and the property.
Key Terms Defined
Combined loan-to-value (CLTV): the total of all liens on a property divided by its value.
Cash-out refinance: a new mortgage that replaces the old one and pays out part of the equity as cash.
Junior lien: a loan that sits behind the first mortgage and is paid second if the property is sold.
Bank statement income: monthly income calculated from deposits over 12 or 24 months, adjusted by the lender for business expenses.
DSCR: the property’s monthly rent divided by its monthly payment, taxes, insurance, and any HOA dues.
Frequently Asked Questions
Can a bank statement HELOC exceed the FHA cash-out cap?
Yes, in the sense that it is a different product with its own CLTV limits. On a primary residence, the network reaches 90% CLTV only at a 720 or better credit profile, up to a $500,000 line. An FHA cash-out refinance still caps total debt at 80% of adjusted value.
Can I qualify without traditional personal-income documentation?
Self-employed borrowers can qualify on documented bank statement income under the applicable program, subject to lender guidelines. The lender still reviews 12 or 24 months of statements, credit, debt-to-income, and the property. It is a different documentation method, not an absence of documentation.
Will the rent from my rental property qualify me for the line?
No. A HELOC is reviewed on your personal income and debts, so rent does not carry the file. A DSCR loan is the rent-based path, and it qualifies primarily on property-level rental income covering the payment, subject to lender guidelines.
Can an LLC borrow on a bank statement HELOC?
No. Corporations, partnerships, LLCs, and irrevocable, blind, or land trusts cannot hold title. A rental in an LLC needs a vesting change or a DSCR cash-out refinance instead.
Does keeping my first mortgage always beat refinancing?
No. A second lien protects a low-cost first mortgage, but it adds personal debt, floats in price, and is limited to $500,000 at 70% CLTV on investments. Investors on BiggerPockets describe a DSCR cash-out as the practical route for larger multifamily needs. That is one investor view, not a rule.
Next Steps
Before talking to any lender, gather 12 to 24 months of statements, a current first-mortgage balance, a rough value, and your credit profile. Know whether the property is held personally, in a trust, or in an LLC. Those facts decide which structure is even available.
If you are weighing a home equity line against a cash-out refinance and want to see how the numbers work, Lendmire can help you compare HELOC options based on the property, the equity available, credit profile, combined leverage, and your goals.
