The Quick Read: Yes, a bank statement HELOC takes first-lien position whenever no other mortgage is recorded ahead of it, either because the property is free and clear or because the old mortgage is paid off at closing with the new line. It cannot jump ahead of a mortgage that stays in place unless that lender agrees to subordinate, which is rare.
- Lien rank comes from recording order on title, not from the product name or the income method.
- Bank statements change how income is documented. They do not change rank.
- Taking first position on a financed home means the existing mortgage is paid off at closing.
- Keeping the old mortgage means the line records second.
- Title vesting, occupancy, and credit tier all still decide whether the file works, subject to lender guidelines.
What Decides Lien Position?
Recording order decides it. The lien recorded first in the land records generally outranks later ones, which is the old rule of first in time, first in right. A “second” mortgage is simply whatever records behind a first.
How large a line the equity supports.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
So the label HELOC says nothing about rank. Bankrate describes a first-lien HELOC as the primary loan on the property, also called an open-end mortgage, and notes these products are less common than second-position lines. An investor can also see the free-and-clear case in practice: a line can exist with no first mortgage at all, as BiggerPockets members discuss.
On the files Lendmire’s wholesale network sees, position is a structuring choice made before the application goes in. You tell the lender which position you want, and the payoff of the old mortgage follows from that choice.
Does the Bank Statement Method Change It?
No. Bank statements are an income documentation method sitting on top of a standard line. The borrower shows business or personal deposits, typically over 12 to 24 months, and the lender reviews them alongside credit, debts, equity, title, and valuation.
Two files can use the same bank statement method and land in different positions. One is a paid-off home where the line records first. The other is a home with a mortgage that stays, so the line records second. The income method is identical. The title is not.
Non-QM does not mean skipped verification. The file is reviewed on documented income under the applicable program, subject to lender guidelines.
First Lien or Second Lien: Which Fits Which Situation?
The right position depends on what is on title today and what the existing mortgage is worth keeping.
| Situation | Likely position | What happens to the current mortgage |
|---|---|---|
| Free and clear home | First | None to pay off |
| Mortgage stays in place | Second | Stays, balance counts in combined leverage |
| Pay off mortgage with the line | First | Paid off at closing |
| Existing HELOC already recorded | Depends | Must be paid off or subordinate |
| Thin equity | Often neither works | Leverage caps limit the line |
Keeping a first mortgage affects the file in two ways. Its balance counts toward combined loan-to-value, and its payment counts in the debt-to-income ratio. A line recorded first has no senior balance to subtract, so the lender sizes it against the full value, still inside the program caps.
How a First-Lien Bank Statement HELOC Works
The sequence is mechanical, and each step has a document attached.
1. Pull title. A title search shows every recorded lien. This tells you whether the line would record first or second.
2. Pick the structure. On a financed home, the first-lien route pays off the old mortgage at closing, much like a cash-out refinance delivered as a revolving line. The second-lien route leaves it alone.
3. Document income. The borrower supplies 12 to 24 months of deposits from business or personal accounts.
4. Clear title. A clean title and a recorded release of any old mortgage confirm first position.
5. Record the instrument. The new deed of trust or open-end mortgage is recorded. That recording is what makes it first.
6. Review the file. Credit, DTI, equity, and valuation all get reviewed, subject to lender guidelines and full file review.
The Edge Cases That Break “First”
Most failed first-position files trip on a title issue, not on income.
- Unreleased old mortgages. A paid-off mortgage whose release was never recorded can still show on title. So can a forgotten zero-balance HELOC.
- Statutory liens. Property tax liens, mechanic’s liens, and HOA super liens can outrank earlier-recorded claims under state law. A HELOC is first among mortgages, not always first among all claims.
- Liens that block title insurance. A lien that cannot be cleared stops the file even when the line would otherwise be first.
- Covenants on a mortgage that stays. If the first remains, its note may restrict additional liens.
- Going first ahead of a mortgage that stays. The only route is subordination, and the first-mortgage lender has no obligation to agree. In practice, the investor pays off the old loan.
The reverse case matters too. If you already hold a line and later refinance the first, the CFPB says you may need the HELOC lender’s approval, the lender can refuse, and you may then have to pay the line off. A second-lien line can complicate a later refinance of the first. A first-lien line is the only loan, so that friction does not exist.
What the Network Allows on Investment Property
Occupancy changes the numbers, so state the one you mean. On an investment property, the network ceiling is 70% combined loan-to-value, with a 700 minimum credit profile and a maximum line of $500,000. There is no tier above that on investment lines.
On a primary residence, the ceiling reaches 90% CLTV, but only at a 720-or-better credit profile and up to a $500,000 line. Second homes follow their own table, also reaching 90% only at 720 or better. These figures come from select wholesale lenders and are subject to full file review.
Some market surveys report different leverage figures for equity lines, but those describe the broader market, not this network.
Investment lines run a 5-year interest-only draw followed by a 25-year fully amortizing repayment, and the pricing floats across both periods. At least 75% of the line is drawn at closing. Lines at or below $500,000 ordinarily run automated valuation, though a full appraisal can be requested.
Vesting: The Sharpest Difference From a DSCR Loan
Title must be held by the individual borrower or an inter vivos revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title on this product. A rental already deeded to an LLC needs a vesting change first, or a different loan.
That is where a DSCR cash-out refinance often takes over. A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines, and the borrower can generally stay in the entity. The complete DSCR loans guide covers how that coverage test works.
The two products answer different questions, and the comparison depends on the file.
| Factor | Bank statement HELOC | DSCR cash-out refinance |
|---|---|---|
| Reviewed on | Borrower deposits, credit, DTI | Property rent against payment |
| Title | Individual or revocable trust | Entity generally allowed |
| Existing first mortgage | Paid off (first) or kept (second) | Replaced |
| Structure | Revolving line, interest-only draw | Term loan |
A DSCR ratio compares rent to the full monthly obligation. Clearing 1.00 does not mean positive cash flow, because repairs, vacancy, and management sit outside the calculation.
The Cost of Giving Up a Low-Rate First
This is the decision point for most investors. Picture an owner with a cheap legacy mortgage and a rental with plenty of equity. A first-lien line pays that mortgage off, and the cheap loan is gone. A second-lien line preserves it.
Run it as a trade. The first-lien route gives you one loan, no subordination issue later, and sizing against full value. The second-lien route keeps the old terms but adds a combined-leverage test and a payment that counts in DTI. Neither is better in general. It depends on how cheap the old mortgage is relative to what the line would cost, and what you plan to do with the funds.
Honestly, if the legacy loan is the best financing you will ever hold, keeping it and taking a second is usually the stronger play. If you are already planning to refinance, first position is cleaner.
Tradeoffs and Who Should Skip It
First position has real costs.
- Variable pricing on the whole balance. When the line replaces the mortgage, the entire housing balance floats.
- Payment shock. The interest-only draw ends and the amortizing repayment begins.
- Tighter qualification. Because the lender funds the whole primary position, first-lien files tend to be stricter than second-lien ones.
- Limited availability. Many lenders in the broader market avoid rental lines or lend only in first position, and the network is limited to Lendmire’s 16 full-service states.
- Eligibility limits. Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use, and agricultural-zoned properties are not eligible.
Skip it if the rental sits in an LLC you do not want to unwind, if your credit profile is under the 700 investment floor, or if you want fixed pricing. Fixed structures belong in a term loan, not this line.
Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

Key Terms Defined
Lien position: The rank of a claim against a property, set by the order liens are recorded.
First lien: The senior mortgage, paid first if the property is sold or foreclosed.
Second lien: A mortgage recorded behind a first, paid only after the first is satisfied.
CLTV: Combined loan-to-value, which adds every mortgage balance and compares it to value.
Subordination: A lender’s voluntary agreement to let a later lien rank ahead of its own.
Frequently Asked Questions
Can I choose first position if I already have a mortgage?
Yes, but the choice carries a trade. First position means the existing mortgage is paid off at closing with the line. Second position means it stays, and its balance and payment count in the file. Request the position you want at the start so the structure is built around it.
Does bank statement documentation make a HELOC riskier for the lender’s position?
No. Position comes from recording order, and income documentation is a separate variable. The lender still reviews credit, debts, equity, title, and valuation, subject to program guidelines.
Can a HELOC sit alone with no mortgage?
Yes. On a free-and-clear property the line records first automatically. Title still needs to show no unreleased old mortgage or forgotten zero-balance line, and statutory liens can still intervene.
What if my rental is in an LLC?
The HELOC product cannot close with an LLC holding title. The property would need to be vested in the individual or a revocable living trust first, subject to your own legal and tax advice, or the investor can look at a DSCR cash-out refinance instead.
Can a first lien be taken ahead of my current mortgage without paying it off?
Only if the current lender voluntarily subordinates, and it has no obligation to. In practice, investors pay the old loan off to get first position.
