The Quick Read: Qualifying on deposits instead of tax returns is possible here, but two separate tests decide the outcome: your deposits must prove you can carry the debt, and Texas homestead law plus the program’s acreage limit must allow the land and equity to secure it. The income side is reviewed on documented deposits under the applicable program, subject to lender guidelines.
- Texas caps all debt secured by a homestead at 80% of its fair market value, and the cap counts the full line, not just what you draw.
- Only one Texas equity-type lien can sit on a homestead at a time, so an existing cash-out loan or equity loan can block a new line.
- Texas law lets a rural homestead run to 100 or 200 acres, but the lines Lendmire arranges limit the property to 10 acres.
- Bank statements change how your income is proven. They do not change how much the home can carry.
- A homestead line is an owner-occupied product, not a DSCR loan, so it fits an investor who lives on the land and wants to fund rentals elsewhere.
Key Terms Defined
Bank statement HELOC: A home equity line of credit where the lender estimates your income from months of bank deposits instead of tax returns.
Homestead: The home you live in as your primary residence, which Texas protects with special rules. Only a person can hold it, never an LLC.
Combined loan-to-value (CLTV): Every loan secured by the home, added together, divided by the home’s value.
Seasoning: A required waiting period between two events. Here it means the gap after a prior Texas equity loan.
Deposit analysis: The lender’s screening of your statements to count real earnings and drop transfers, loan proceeds, and one-off deposits.
Urban and rural homestead: The two legal size categories. Urban is capped at 10 acres, and rural runs to 100 or 200 acres depending on who owns it.
How large a line the equity supports in Texas.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 80% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
What Does a Bank Statement HELOC Look Like on a Texas Homestead?
It is a standalone line of credit secured by the home you live in, sitting in first or second lien position. A Texas A&M research center explains that Texas puts many of its equity rules in the state constitution and sorts covered loans into three types: cash-out refinance, home equity loan, and HELOC. Only the homestead can secure the loan. No other property can be pledged alongside it.
Across the wholesale lenders Lendmire works with, two draw structures exist on primary residences. One runs a 3-year interest-only draw followed by a 17-year repayment period. The second is a 5-year interest-only draw followed by a 25-year fully amortizing repayment. Both require at least 75% of the line to be drawn at closing. Pricing floats through both the draw and repayment periods and does not convert to a fixed structure.
Lines run from $25,000 to $750,000. After closing, Texas sets the minimum later draw at $4,000.
Here is the framing point for investors. This is an owner-occupied equity product. It does not qualify on rent, and it never touches a rental property as collateral. You use the line’s proceeds for investing, and the home you live in is the collateral.
Test One: How Deposits Become Qualifying Income
The lender turns your bank deposits into a monthly income figure, then checks that figure against your debts. The usual pattern is simple. Scotsman Guide describes a self-employed borrower who provides 12 to 24 months of personal or business statements, with the lender applying an expense factor and still confirming ability to repay. Each program sets its own window and factor, so ask for the specifics on your file.
Step by step, the review usually works like this:
1. You supply consecutive, complete statements for the review window.
2. The underwriter screens out transfers between your own accounts, loan proceeds, and one-off deposits.
3. Business-account deposits are reduced by an expense factor. Personal accounts are generally treated more lightly.
4. The adjusted deposits are averaged into monthly income. If an entity owns the account, your ownership share sets the credited amount.
5. That income is measured against your debts, including the new line.
On the network, the maximum debt-to-income ratio is 50%. It drops to 45% for credit profiles from 600 to 679, and a ratio above 45% requires a 680 minimum. The line is qualified on the interest-only payment calculated on the maximum draw, so a big line you barely plan to use still counts in full. Minimum credit is 600, and the score model is a single-bureau score keyed to the primary wage earner.
Why do bank statement lines exist at all? A federal ability-to-repay rule exists for many mortgages, but an ICBA summary notes it does not cover home equity lines or other open-end loans. Income documentation on a HELOC is therefore a program decision. That is why lenders can build deposit-based options.
| Factor | What statements change | What they don’t |
|---|---|---|
| Income proof | Deposits replace tax returns | Underwriting still happens |
| Equity limit | Nothing | Texas 80% cap applies |
| Credit | Nothing | Score floor still applies |
| Acreage | Nothing | Program limit applies |
Test Two: What Texas Homestead Law Controls
Texas homestead rules size the line before income ever matters. The core rule comes from Article XVI, Section 50(a)(6) of the Texas Constitution, which governs home equity lending. Several pieces matter.
The 80% combined cap. All debts secured by the home, including the full line limit, may not exceed 80% of fair market value on the day the line is established. The Texas A&M center frames this as keeping at least 20% equity. The math is plain: 80% of value, minus every existing lien, equals your maximum line. Value is fixed at that closing date, and the cap measures the whole line, drawn or not.
The one-lien rule. Only one equity-type loan of this kind can be secured by the home at a time. A prior home equity loan or cash-out refinance can block a new line.
The first-lien check. If your current first mortgage is itself a Texas cash-out loan, it occupies the single slot. Pull your closing documents early and find out how that loan was classified. Fixing a mistake here after the fact is hard.
Waiting and seasoning. A 12-day waiting period must pass after the lender’s written notice before closing. Texas also applies a 12-month seasoning gap after a prior equity loan. Both rules bind primary residences only.
Title. The borrower holds title as an individual or in a revocable living trust. LLCs, corporations, partnerships, and irrevocable or land trusts cannot hold title on these lines. A property already deeded to an LLC needs a vesting change first.
The rules did not appear overnight. The Legislature’s analysis of the 2003 amendment shows where the HELOC provisions began and how tight earlier limits were.
Credit tier then sets the program ceiling, and the Texas cap sits on top as a hard stop. Subject to lender guidelines, a primary residence looks like this:
| Credit profile | Program ceiling on Texas homestead |
|---|---|
| 640 and above, line to $500,000 | Up to 80% CLTV (Texas cap) |
| 620 to 639, line to $400,000 | 70% CLTV |
| 600 to 619, line to $400,000 | 60% CLTV |
| 700 or better, line above $500,000 | 75% CLTV |
Any matrix tier higher than 80% never applies to a Texas primary residence. The lower tiers bind before Texas does.
How Does Acreage Change the Picture?
Acreage adds a third question: how much of your land counts as the homestead, and how much of it the lender will accept. Two limits answer it, and they can disagree on the same parcel.
The Legal Limit
Under the Texas Property Code, an urban homestead is not more than 10 acres in one or more contiguous lots. A rural homestead runs up to 200 acres for a family or 100 acres for a single adult, in one or more parcels. Rural parcels do not have to touch.
Urban status is a test, not a label. The property must sit in a municipality, its extraterritorial jurisdiction, or a platted subdivision, and be served by police and fire protection plus at least three listed utilities. Property that fails the test is rural. If you own more than the legal homestead size, the same chapter allows a recorded voluntary designation of which land counts.
The Program Limit
The lines Lendmire arranges through its wholesale network limit Texas properties to 10 acres. A 60-acre rural homestead can be fully protected under state law and still fall outside the program. Agricultural zoning is also not eligible, and neither are manufactured homes, log homes, co-ops, condotels, commercial properties, or mixed-use properties. Barndominiums fall outside these programs too.
Agricultural-use valuation on the county rolls is a different thing from agricultural zoning. The program looks at zoning, but expect questions about both, and bring the paperwork.
A few other acreage situations come up often:
| Situation | Which test it hits | What to bring |
|---|---|---|
| Home on 6 acres | Neither limit | Survey or plat |
| Home on 25 rural acres | Program limit | Survey showing parcels |
| Rental house on your land | Legal limit | Deed and survey |
| Neighboring tract you also own | Program and legal | Survey, title review |
A rental house or other income tract on your acreage cannot be pledged. The homestead rules and the 80% cap reach only the homestead. Whether acres beyond the legal limit count toward the value base is a question for a Texas title attorney and the appraisal. Do not assume.
Property listed for sale, or listed within the past 60 days, is also ineligible in Texas.
How Does Rural Land Get Valued?
Lines at or below $500,000 ordinarily run an automated valuation with no traditional appraisal. A higher CLTV may require a secondary valuation, and you can request a full appraisal in any case. Every line above $500,000 requires a full appraisal.
Acreage is where automated values stumble. Comparable sales are scarce on rural parcels, and the value must be split sensibly between house and land. Well and septic, road access, outbuildings, and current land use all affect the number. Because the 80% cap is measured against that value, a conservative figure can shrink the line more than any income issue.
If your acreage is large or unusual, ask for the full appraisal up front. A line above $500,000 is for primary residences only and caps at 75% CLTV. It also requires a credit profile of 700 or better (720 on the longer-runway program).
A Worked Example With Percentages Only
Treat these as modeled assumptions, not market data. Say you own a homestead on about 6 rural acres, with a credit profile above 640 and a first mortgage balance equal to roughly 45% of value. The Texas cap leaves room for a line of up to 35% of value, and the 80% CLTV ceiling for your credit tier matches that.
You request a line equal to 30% of value, so combined debt lands at 75%, under the cap. The valuation runs automated because the line is under $500,000. For income, the lender converts your deposits and compares them against your debts, using the interest-only payment on the full line. Because at least 75% of the line is drawn at closing, size it to the amount you will actually use.
Now change one assumption. The land is 30 acres, and the home is the same. Texas law may still protect it as a rural homestead, but it is outside the network’s 10-acre limit. The path is a smaller defined tract, a different structure, or a different product. Bring the survey before you apply.
Why Do These Files Fail?
Most failures come from a short list:
- An existing equity-type lien already holds the one slot.
- Acreage exceeds the program’s 10-acre limit.
- The property type is not offered, such as a manufactured home, log home, or agricultural-zoned parcel.
- The home was listed for sale within the past 60 days.
- Title sits in an LLC or land trust.
- Thin deposit history, or business and personal money mixed in one account.
- Debt-to-income lands above the 45% or 50% thresholds for the credit tier.
- A bankruptcy inside the 4-year seasoning window from discharge or dismissal.
Foreclosure history splits by program on primary residences. One seasons a foreclosure at 7 years and a deed-in-lieu, pre-foreclosure, or short sale at 4. The other declines that history regardless of age.
Spouses matter too. Homestead protection reaches the family, so expect a spouse to sign closing documents even when only one person’s income qualifies. A Texas title attorney confirms who must sign.
What Should You Bring?
- Consecutive personal or business statements for the review window your program sets.
- A profit-and-loss statement if the program accepts one.
- A survey or plat showing total acreage and any separate parcels.
- Proof of homestead status, such as a homestead exemption record.
- Your first-lien closing documents, to check classification.
- Evidence of any prior Texas equity loan and its date.
When Is a Homestead Line the Wrong Tool for an Investor?
If the goal is buying or refinancing a rental, a different loan often fits better. A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines. DSCR means debt service coverage ratio, which compares monthly rent to the full monthly payment of principal, interest, taxes, insurance, and any association dues, called PITIA.
On a standard rental, a DSCR cash-out refinance tops out around 75% LTV across most of the network, and about 6 months of seasoning is the common expectation. A 1.00 coverage ratio is where many select programs start, and a separate select-lender path takes coverage below 1.00 with leverage and terms adjusted. Most programs want credit around 660, and 700 or better unlocks the strongest leverage tiers.
Clearing 1.00 is not the same as positive cash flow. Repairs, vacancy, management, and utilities sit outside the calculation. The Texas homestead rules do not apply to a non-homestead rental, and LLC-titled rentals can be eligible, subject to program terms. Read Lendmire’s complete DSCR loans guide for the full picture.
A separate investment-property line also exists, with a 70% CLTV ceiling and a 700 credit minimum, running the 5-year draw structure only.
Frequently Asked Questions
Can I use this line if my homestead sits on more than 10 acres?
Not through the network’s programs, which limit Texas properties to 10 acres. State law may still protect a larger rural homestead. A survey that defines a smaller homestead tract, reviewed by a title attorney, is the usual first step.
Can I hold a HELOC and a cash-out refinance on the same Texas homestead?
No. Both are the same equity loan category, and only one can be secured by the home at a time. A seasoned prior loan may follow a different route, so ask how your first lien was classified.
How much can I borrow against an acreage homestead?
Take 80% of the home’s value at closing, subtract every lien, and the remainder is the ceiling. Your credit tier may set a lower ceiling, and the line can be up to $750,000. Extra acres do not raise the percentage.
Can the rental house or barn on my land count toward the line?
No. Only the homestead can secure the loan, and rental or investment property is outside these rules. Whether outlying acres add to the value base is a title and appraisal question.
Can my LLC be the borrower?
No. These lines require title in your name or a revocable living trust. If the home is deeded to an LLC, the vesting must change before you apply.
