Best Investment Property HELOC Program During and After a Divorce

Best Investment Property HELOC Program During and After a Divorce

The Quick Read: The best program depends on three gates: who is on title, who is on the existing first mortgage note, and whether a court order or your spouse’s consent allows a new lien. Clear those, and the investment-property line on Lendmire’s wholesale network is a standalone second lien that is reviewed on your credit, income, and debts, not on the rent. The files that break are the ones with an LLC on title, an ex-spouse still on the first note, or a case still pending.

  • Investment-property lines on the network cap at 70% CLTV, with a 700 minimum credit score.
  • Line sizes run from $25,000 to $500,000, with a five-year interest-only draw and a 25-year repayment period.
  • A line cannot be written on a property titled to an LLC, corporation, or partnership.
  • A HELOC does not remove an ex-spouse from the first mortgage. A cash-out refinance does.
  • During a pending case, a new lien usually needs a signed spousal agreement or a court order.

Lendmire is a mortgage broker. It places files with select wholesale lenders, and every figure here is subject to lender guidelines and full file review. This is not a commitment to lend. Home equity lines are available only in Lendmire’s 16 full-service states.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

What “Best” Means in a Divorce File

The best program for your situation is the one that keeps your existing first mortgage, qualifies you alone, fits the court’s timeline, and leaves a payment you can carry on one income. No single product wins on all four. A broker shopping several wholesale lenders matches the file to the program that clears the most of these tests.

Four criteria decide it:

1. Does it keep the first mortgage in place? A second lien does. A cash-out refinance replaces the first loan.

2. Does it release the ex-spouse? A HELOC does not. Only a refinance or a lender-approved assumption does.

3. Can you qualify alone? The line is underwritten on your credit, income, and debts after the split.

4. Can you carry the payment? The interest-only payment at full draw is what the lender tests, and it should be what you stress-test too.

How an Investment-Property HELOC Works

An investment-property HELOC is a revolving second lien. The CFPB’s HELOC brochure explains the two phases: a draw period when you borrow against your limit, then a repayment period when payments often rise significantly. Some plans allow interest-only payments during the draw, and variable-rate payments can change even if you borrow nothing more.

Rental lines are tighter than primary-home lines. NerdWallet reports that fewer lenders offer them, limits run lower, and requirements are strict because lenders see higher default risk on rentals. That matches what a broker sees across the network.

Here are the network’s investment-line terms:

  • Leverage: 70% CLTV on an investment property. Credit above 700 buys eligibility, not extra leverage.
  • Credit: 700 minimum, with a hard floor and no tier beneath it.
  • Line size: $25,000 to $500,000.
  • Structure: a five-year interest-only draw, then a 25-year fully amortizing repayment. At least 75% of the line is drawn at closing, so interest runs from the start. Pricing floats and never converts to fixed.
  • DTI: up to 50%, tested on the interest-only payment at the maximum draw.
  • Valuation: because the line caps at $500,000, it ordinarily runs on an automated valuation with no traditional appraisal.
  • Property types: single-family, 2-4 units, PUDs, townhomes, and condos, including non-warrantable. Manufactured homes, co-ops, condotels, and log homes are not offered.

CLTV means the first mortgage plus the new line, divided by value. That one subtraction drives most divorce files.

Key Terms Defined

Combined loan-to-value (CLTV): the first mortgage balance plus the new line, divided by the property’s value.

Second lien: a loan recorded behind the first mortgage that leaves the first loan untouched.

Quitclaim deed: a deed that moves title between spouses but does not change who owes the mortgage note.

Draw period: the stretch when you can borrow against the line, often interest-only.

Due-on-sale clause: a mortgage term letting the lender demand payoff when the property transfers.

Before Filing, During the Case, After the Decree

A new lien during a pending case usually needs a signed spousal agreement or a court order. Many jurisdictions impose an automatic restraining order on filing. These orders typically limit major financial moves, such as new liens on marital property, while allowing ordinary living expenses and attorney fees. The rules vary by jurisdiction, and no national statute sets them, so confirm with your family-law attorney.

Stage What usually happens Who signs Practical read
Before filing Both spouses are usually on title Both Cleanest window for a joint line, but a lien you take alone may land on both of you
During the case Restraining orders often apply Both, or the court Usually blocked without consent or an order
After the decree Decree names the keeper and any refinance deadline Keeper, after sole title Where most investment lines get placed

Bank statement income documentation does not change any of this. It fixes how income is documented. It does not change title, the note, or a court freeze.

Fix Title First

Only after sole title can one spouse sign a new lien alone. A quitclaim or other interspousal deed typically gets executed as part of the refinance package. Record it before the lender orders anything.

Title is a lender-level gate on this network. The property must be held by an individual or a revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title on an investment HELOC. That is the sharpest difference from a DSCR loan. A rental already deeded to an LLC needs a vesting change first, or a DSCR cash-out instead. Re-titling out of an LLC can raise its own due-on-sale and title-insurance questions, so get counsel before you move the deed.

On the transfer itself, federal law limits a lender’s ability to enforce a due-on-sale clause on certain divorce-related transfers. See 12 U.S.C. §1701j-3. Practitioner summaries tie that protection to residential property the borrower occupies. For a pure rental, treat it as uncertain and have an attorney confirm it. It is not automatic.

The Ex-Spouse Is Still on the First Mortgage

A decree binds the spouses, not the lender. A quitclaim changes title only.

A HELOC leaves the first note untouched. If your decree requires you to remove your ex from the loan, a second lien does not satisfy it. That calls for a cash-out refinance or a lender-approved assumption. A divorce buyout refinance is underwritten around the money going to the departing spouse, and extra cash to the keeper can push the loan into cash-out territory.

A HELOC fits better when the rental is free and clear, or when the ex-spouse is not on the first loan.

The Buyout Math

The buyout is a subtraction problem, not a fixed dollar amount. Value times 70% gives the combined ceiling. Subtract the first mortgage. What remains is the most the line can supply.

Run it on a rental whose first mortgage sits at 55% of value. That leaves 15% of value for the line. At a first mortgage near 65% of value, only 5% remains, and that may fall under the $25,000 minimum line. The buyout your decree demands must fit inside that room. If it does not, the line is the wrong tool, or only part of the answer.

Also watch the draw. Most of the line is drawn at closing, so a buyout funded this way starts accruing interest on that drawn balance immediately.

Qualifying Alone on One Income

The lender tests you alone on post-divorce income. Joint debts count against you until they are closed or refinanced out. Court-ordered pension splits shrink usable income. Support income needs a decree to document it, and a pending case has no support order to count yet. Payments assigned to your ex may be excludable in documented cases, but the treatment turns on the paperwork and payment history, not the decree alone.

Credit is judged on a single-bureau score model keyed to the primary wage earner. The report must be no more than 90 days old at closing, and rescores are not available. On an investment line, 700 is the floor.

If a personal-income test fails, a rent-qualified product is the other lane. A DSCR cash-out refinance qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. DSCR compares rent to PITIA only, so clearing it says nothing about repairs, vacancy, or management. Details are in Lendmire’s complete DSCR loans guide. Neither DSCR route works if the keeping spouse will live in the property. Owner-occupied programs apply then.

Which Program Fits Which Divorce

Situation Best-fit path Why
Ex off the first note, title individual, equity room Investment HELOC Keeps your first mortgage
Ex still on the first note Cash-out refinance in your name Only a refinance or assumption releases them
Rental held in an LLC DSCR cash-out, or re-title first LLC cannot hold title on the line
Thin personal income DSCR cash-out Is reviewed on rent
Buyout larger than the room Refinance, or a partial plan The 70% ceiling caps the line
Case still pending Wait for consent or order New lien likely frozen

If you are weighing payment structure during the draw, Lendmire’s piece Best Investment Property HELOC Program With Minimal Payments During the Draw Period covers that side.

Where the Rules Break

  • Listed property. A property listed for sale, or listed in the past 60 days, is ineligible in Indiana, North Carolina, Pennsylvania, Tennessee, Texas, and Washington.
  • Texas. The 12-day wait, one-lien rule, and 12-month seasoning bind primary residences only. Investment properties are eligible as non-homestead transactions.
  • Exposure. A borrower is limited to three lines and cannot own more than 15 financed properties.
  • Retirees. Qualification is a file question, not an age question. Pension splits are what reduce income.
  • Prior derogatory credit. Investment files follow a 7-year seasoning path for foreclosure and 4 years for a short sale or deed-in-lieu.

Mistakes That Derail These Files

1. Assuming the decree removes the ex from the loan.

2. Applying while the case is open without consent or an order.

3. Leaving the rental in an LLC and discovering it at the title review.

4. Sizing the buyout against the full value instead of the 70% CLTV room.

5. Skipping a stress test of the interest-only payment at full draw on one income.

Tax treatment varies; consult a qualified professional before relying on any deduction tied to how proceeds are used.

Frequently Asked Questions

Can I take a HELOC on a rental while my divorce is pending?

Usually not without a signed agreement from your spouse or a court order. Many jurisdictions freeze new liens on marital property once a case is filed. Confirm the rule with your family-law attorney before you apply.

Does a HELOC take my ex off the mortgage?

No. A second lien leaves the first note unchanged, and your ex stays liable on it. A cash-out refinance in your name or a lender-approved assumption is the usual release path.

Can a rental held in an LLC get an investment HELOC?

Not on this network. The property must be titled to an individual or a revocable living trust. A rental in an LLC needs a vesting change first, or a DSCR cash-out refinance, subject to program terms.

Can I use the line to buy another rental after the divorce?

Often yes, if the line itself is approved and the combined leverage stays within the 70% investment ceiling. Remember that most of the line is drawn at closing, and the payment floats.

Does alimony or child support count as income?

It can, but only with a decree to document it. A pending case has no support order, so there is nothing yet for the lender to count.
