The Quick Read: A spousal quitclaim does not shrink the line, but it can delay it. Through select programs, a second-lien line typically tops out at 70% combined loan-to-value (CLTV), on lines from $50,000 to $500,000, subject to underwriting. The amount comes from value, credit tier, and the first mortgage balance, not from the deed.
- Max line equals value times the CLTV cap, minus the first mortgage balance.
- A second lien needs a 720 credit score or better.
- The rent must cover a stress payment on the whole line at 1.10x or better.
- The recording date can restart the 6-month title clock.
- The departing spouse stays on the old mortgage unless the first lender releases them. Exact terms depend on the lender’s guidelines, property type, leverage, and a full review of the borrower’s file.
A quitclaim deed moves ownership. It does not move debt. Think of the deed as a title event and the line as a leverage event. They touch each other in one place: the waiting period.
What the Deed Changes and What It Doesn’t
The deed changes who is on title. It leaves the loan, the first-mortgage balance, and the rent exactly where they were. A quitclaim transfers whatever interest the grantor holds, with no warranties. It also does not rewrite the mortgage. Legal Aid of Arkansas notes that only the lender can remove a name from a mortgage, usually through a refinance.
| Item | After the quitclaim |
|---|---|
| Title | Changes to the new owner(s) |
| First mortgage | Unchanged; same balance, same borrowers |
| Line size formula | Unchanged |
| Who signs the lien | Everyone on title, typically |
| Seasoning | The recording date may restart a clock |
A spouse added to title does not automatically owe the debt. That spouse may still have to sign the security instrument. In community-property and homestead states, a spouse can be required to sign even when not on title.
How Much Can You Actually Borrow?
You borrow the gap between the CLTV cap and what you already owe. That is the whole formula, and the deed is not in it. Take the property’s valuation, multiply by the CLTV cap, then subtract the first mortgage balance. The dollar cap on the line comes next.
Here is the structure across our wholesale network. A standalone second lien sits behind a first mortgage you keep. It reaches 70% CLTV at a 720 credit score or better, on lines up to $500,000. Below 720 there is no second-lien tier. A standalone first lien works only on a rental with no mortgage at all. Every figure here varies by lender and program — guidelines, property type, leverage, and credit profile all apply.
The first-lien tiers run higher, subject to underwriting:
| First-lien tier | Max LTV |
|---|---|
| 740 or better, lines to $500,000 | 75% |
| 700 to 739, lines to $500,000 | 70% |
| 720 or better, lines above $500,000 (to $1,000,000) | 65% |
Run the numbers on a rental valued at $400,000 with a first mortgage already in place. At 70% CLTV, the combined debt can reach 70% of that value. If the first mortgage already uses most of that, the line has little room. If you already hold only 30% equity, a second lien has no room at all, because the first mortgage alone sits at 70% of value.
A paid-off rental has the most room.
The figures above are the network ceilings, and they are ceilings, not offers.
Does Strong Rent Raise the Line?
No. The rent test is separate from the leverage test. A DSCR HELOC qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. The minimum is 1.10x, measured as gross monthly rent divided by a stress payment. That payment is principal and interest on the entire credit limit, not just the amount you draw, and taxes and insurance are not part of it.
Rent is the lesser of the appraisal’s market rent and the lease, unless three months of receipts support a lease above market. A lease in place is required. A two-to-four-unit property can have at most one vacant unit.
A great coverage ratio does not lift the CLTV ceiling. A property can clear 1.5x and still have no room because the first mortgage is large. The reverse also happens: lots of equity, but rent too thin to carry a stress payment on the full line. On a second lien, confirm on the file how the lender treats the first-mortgage payment in its coverage calculation.
Your own income never enters the picture, because the loan is not underwritten with traditional personal-income documentation, W-2s, or a personal income calculation.
Does the Recording Date Restart the Clock?
Two six-month clocks apply: the line is not available on a rental bought or refinanced in the last 6 months (last note date to new note date), and title must have been held for 6 months (settlement date to note date).
That is where the deed bites. Seasoning is lender policy, not law. No statute sets it for business-purpose investor loans. It is contract language, and lenders read a spousal deed in one of two ways.
| Approach | How the clock runs |
|---|---|
| Restart | Counts from the recorded deed date |
| Look-through | Reads the chain, counts from the original purchase |
Plan around the recording date. If you recorded last month, expect to wait unless the lender looks through the transfer. If the rental has been in the family name for years and the deed is the only recent event, ask the lender up front which way it reads the chain.
The line is also never closed together with a purchase. It cannot be your acquisition financing.
Who Signs and Who Stays Liable
Everyone on title typically signs the lien. If an LLC holds title, the LLC can vest the property, subject to program terms. The members sign as guarantors, and a title holder who is not a borrower signs a non-borrowing owner acknowledgment and the security instrument.
The spouse who deeded out is a separate problem. If that spouse still needs to come off the old note, a line does not solve it. Only the first lender can release them, and a cash-out refinance is the usual route. That spouse also cannot open a new line on a property they no longer hold, because the applicant must hold title.
Adding a spouse to the borrower side can bring that spouse’s credit into the tier. Credit tiers are read from the lender’s own report, so decide who is on the line before you apply.
Scenarios at a Glance
| Situation | Who signs | Does the line work? |
|---|---|---|
| Spouse added to title | Both, typically | Yes, once title seasoning is met |
| Spouse removed from title | Remaining owner | Yes, but the deed date may restart the clock |
| Deed into an LLC | Members as guarantors | Subject to program terms and the clock |
| Deed signed, not recorded | Depends on the lender | Plan around the recording date |
| Community-property state | Spouse may sign even off title | Confirm signing rules first |
When a Cash-Out Refinance Fits Better
A line is a narrow niche when you already have a first mortgage. A first-lien cash-out refinance replaces the first mortgage and can release a departing spouse. Compare the two in Lendmire’s complete DSCR loans guide.
| Goal | Better fit |
|---|---|
| Keep the existing first mortgage in place | DSCR HELOC (second lien) |
| Rental has no mortgage | DSCR HELOC (first lien) or cash-out |
| Take the departing spouse off the old note | Cash-out refinance |
| Need the line while the deed is fresh | Depends on the title clock |
If you have owned the rental past the window and the deed is optional, ask whether the quitclaim is worth the added questions at all.
The Due-on-Sale Question
Your old lender’s rules are separate from the new lender’s seasoning. A due-on-sale clause lets a lender declare the loan due if the property is transferred without consent. Federal law limits that clause on certain family transfers, and the limit reaches only residential property of fewer than five units. A deed on a five-unit or larger building can trigger it. A deed to an LLC is not on the statutory spouse list.
Sequence It Before You Record
Ask the lender these things, in this order, before the deed is recorded:
1. Does the recording date restart your title clock, or do you read the chain? 2. Who must sign the lien, including any spouse off title? 3. Does the first mortgage stay, and what balance counts in CLTV? 4. Does the property fit: one-to-four units, non-rural, not a row home, condotel, or leasehold? 5. Which valuation path applies: an automated valuation with an inspection report on lines to $400,000, or a full interior appraisal above that?
Gather the recorded deed, title report, first-mortgage statement, lease, and entity documents if an LLC holds title.
Draw Rules and Terms
The line is a 5-year interest-only draw period on the drawn balance, then a 25-year repayment period, with a 30-year maturity and a variable rate. At least 80% of the line is drawn at closing, and later draws are at least $5,000. No reserves are required. A borrower can carry at most 5 loans or $2,500,000 with the program. The program runs in 15 of Lendmire’s 16 licensed states, every licensed state except Tennessee, through select programs and subject to underwriting.
Key Terms Defined
Quitclaim deed: a deed that transfers whatever interest the signer holds, with no promises about the title.
CLTV: combined loan-to-value, meaning the first mortgage plus the new line, divided by the property’s value.
Seasoning: the waiting period a lender requires after a purchase, refinance, or title change.
DSCR: debt service coverage ratio, meaning rent divided by the qualifying payment.
Due-on-sale clause: a mortgage term that lets the lender demand payoff after a transfer without consent.
Not Legal or Tax Advice
DSCR loans are designed for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage. This article is general information, not legal or tax advice. Talk to a qualified attorney or CPA about your own deed and situation. Tax treatment varies; consult a qualified professional.
If you are considering a home equity line on a rental property and want to see how the numbers work, Lendmire can help you compare DSCR HELOC options based on the property, the rent, the equity available, credit profile, combined leverage, and your goals. Frequently Asked Questions
Does a spousal quitclaim lower how much I can borrow?
Not by itself. The line is sized from value, the CLTV cap, your credit tier, and the first mortgage balance. The deed affects timing and signers, not the formula.
How soon can I apply after recording the deed?
A look-through lender may count from the original purchase rather than the recording date. A lender that restarts the clock at recording may instead require a 6-month wait before you apply. Confirm which approach your lender uses before you record.
Does my spouse have to sign if they are not on title?
It depends on the state. A spouse who signs only the lien does not owe the debt.
Can my LLC hold title and still get the line?
Yes, subject to program terms. The members sign as guarantors, and the property must be an investment rental.
Does the line take my ex-spouse off the first mortgage?
No. Only the first lender can release a borrower, usually through a refinance. A cash-out refinance is the route that solves it.
