How Much Can You Borrow on an Investment Property HELOC While a Divorce Is Pending?

How Much Can You Borrow on an Investment Property HELOC While a Divorce Is Pending?

The Quick Read: It depends on two gates: wherever a restraining order applies, you can borrow only with your spouse’s written consent or a court order, and then the amount is capped on Lendmire’s network at 70% combined loan-to-value on an investment property, up to a $500,000 line, minus every lien already on the property. Without that permission, the practical limit is zero.

  • Gate one is legal. Many states restrain new liens on marital property once a case is filed. A written consent or a court order is the usual way through.
  • Gate two is math. On an investment property, the network ceiling is 70% combined loan-to-value (CLTV), with a 700 minimum credit score and a $500,000 maximum line.
  • Rent does not size the line. A HELOC reads you, not the property’s rent.
  • A rent-based cash-out refinance is the common alternative, and it faces the same court and co-owner permissions.

Key Terms Defined

HELOC: A home equity line of credit, a revolving credit line secured by a lien on your property. You draw what you need up to a limit.

CLTV: Combined loan-to-value. It adds the first mortgage and every other lien, then divides the total by the property’s value.

Lien: A lender’s legal claim on a property until the debt is paid.

Automatic restraining order: A court order that takes effect when a divorce is filed. It freezes certain financial moves by both spouses until a judge or both spouses say otherwise.

DTI: Debt-to-income ratio. It compares your monthly debts to your monthly income.

DSCR: Debt service coverage ratio. It compares a property’s rent to its monthly mortgage obligation (principal, interest, taxes, insurance and any association dues).

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Gate One: Are You Allowed to Borrow at All?

No national rule bars a HELOC during a divorce. The restraint comes from your state’s law and from the specific orders in your case.

California is the best-documented example. Its Family Code section 2040 puts a restraining order into the divorce summons. As the California Legislature’s bill text for AB-1297 shows, it bars both spouses from encumbering property, “whether community, quasi-community, or separate”, without written consent or a court order. A new HELOC is an encumbrance. Two details matter for a rental owner.

  • Separate property is covered. A rental you owned before the marriage is not automatically outside that order.
  • Violations carry consequences. Courts can respond with contempt findings or credit the other spouse for the value they would have received in the final division.

Other states differ. Some attach automatic orders at filing, and others require a specific order from a judge. Ask your family-law attorney which applies to you, because the answer sets whether the borrowing limit is zero or something larger.

Timing matters too. Orders generally attach only after a case is filed and served. A line opened before filing carries a different risk: a court can still examine it in the property division. Treat a pre-filing line as part of the settlement picture, not as a loophole.

The lender cannot waive a court order. Only the other spouse’s written consent or a judge’s order can. If you cannot agree, a judge can permit the transaction, and California’s framework points to court orders as that path.

Gate Two: How the Lender Sizes the Line

The size of the line is the lender’s CLTV ceiling times the property’s value, minus the first mortgage and every other lien. The CFPB’s HELOC booklet describes the same method: a percentage of appraised value, less what you owe.

Across Lendmire’s wholesale network, the investment-property ceiling is 70% CLTV. There is no higher tier on an investment property. The maximum line is $500,000, and the minimum credit score is 700. A score of 720 earns the same 70% ceiling as a 700, so a higher score buys eligibility, not extra leverage.

Market-wide figures run differently. NerdWallet reports that at least 20% equity is a typical requirement for an investment-property HELOC. On Lendmire’s network, a 70% CLTV ceiling means you keep at least 30% equity.

A Worked Example in Percentages

Picture a rental with a first mortgage at 45% of its value and no other liens. At a 70% ceiling, the room is 25% of the value. Add a second lien at 5% of value, and the room drops to 20%.

On a very high-value property, the $500,000 maximum line binds before the CLTV does. The lender’s valuation sets the value, and the calculator on this page gives an illustrative estimate for your own numbers.

Why a Rental Line Is Smaller Than a Home Line

On Lendmire’s network, a primary residence can reach a higher CLTV, but only at strong credit profiles. That figure never applies to a rental.

What the Lender Reviews Besides Equity

A HELOC is reviewed on you personally: credit, DTI and equity. Rent plays no role in the size of the line, so a strongly performing rental does not borrow more than a weak one with the same equity.

  • Credit: 700 minimum on an investment line, with the report no more than 90 days old at closing.
  • DTI: 50% maximum, qualified on the interest-only payment at the maximum draw. Pending support obligations are unsettled, so expect the lender to ask how they will be treated.
  • Valuation: Lines at or below $500,000 ordinarily use an automated valuation with no traditional appraisal. A higher CLTV may require a second valuation, and you can request a full appraisal. NerdWallet notes that market lenders may require multiple appraisals on investment properties.
  • Structure: A standalone first- or second-lien line with a 5-year interest-only draw and a 25-year repayment period. At least 75% of the line is drawn at closing, and the pricing floats without converting to fixed.
  • Property type: Single-family, 2-4 units, PUDs, townhomes and condos. Manufactured homes, co-ops, condotels, log homes, commercial and mixed-use properties are not offered.
  • Exposure: A borrower is limited to three lines and cannot own more than 15 financed properties.
  • Availability: HELOCs are available only in Lendmire’s 16 full-service states, which is narrower than its DSCR reach.

Lendmire brokers these lines through select wholesale partners, and every figure is subject to lender guidelines and full file review.

Title Is the Hidden Constraint

A HELOC lender wants the applicant on title. On Lendmire’s network, an investment line must be held by an individual or a revocable living trust. LLCs, corporations, partnerships and irrevocable, blind or land trusts cannot hold title.

If the property sits in an LLC, a vesting change or a DSCR cash-out refinance is the practical route. A DSCR loan to an LLC is available subject to lender program eligibility.

If your spouse is a co-owner, expect the lender to require their signature on the lien document. If your spouse is not on title, an order may not reach the property at all. Only your attorney can confirm that, and moving title mid-case is its own legal question.

What Changes Before Filing, While Pending and After the Decree

Stage What is possible Main risk
Before filing Lender sizes line on equity alone Court may revisit it later
Pending Needs written consent or court order Zero limit without permission
After decree You alone on title can apply Old joint debts stay joint

After a decree, borrowing is simpler only if your name alone is on title and the settlement is final. The lender will want the order or consent, the vesting deed, the mortgage statement, the insurance declarations page, income documents and a credit report.

Edge Cases That Trip Up Rental Owners

A joint line that is already open. A decree binds you and your ex, not the lender. As Sterling Lawyers explains, both borrowers stay liable until the loan is paid off, refinanced or released. A quitclaim deed moves title, not the debt. Many attorneys advise freezing draws on joint lines during the case, so ask yours.

Divorce-related transfers. Federal law limits a lender’s right to call a loan due when a divorce decree or property settlement makes your spouse an owner. Foust Law’s summary covers the exception. It applies to residential property with fewer than five units, and commentators dispute whether occupancy conditions apply to rentals. Do not assume a rental transfer is automatically safe.

Equity pulled mid-case. A court may count the cash in the property division. That matters if you are planning a buyout.

Alternative income paperwork. Documenting income differently changes how income is proven. It changes neither who owns the property nor what a court has frozen.

When a HELOC Is the Wrong Tool

A HELOC fits a smaller, flexible draw against equity you intend to keep. It fits poorly when you need a large payout or a clean exit from a joint mortgage.

Factor Investment HELOC DSCR cash-out refinance
What is reviewed Your credit, DTI, equity Property rent against payment
Sizing driver CLTV headroom LTV cap and coverage ratio
Ceiling on network 70% CLTV, $500,000 line About 75% LTV, standard rentals
Title Individual or revocable trust LLC possible, per program terms
Old joint first mortgage Stays in place Paid off in the refinance

A DSCR loan is a business-purpose investor loan, reviewed differently from a standard owner-occupied mortgage. It qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. Many select programs start at 1.00 coverage, and a separate select-lender path takes coverage below 1.00 with leverage and terms adjusted. Most files want a score around 660, and 700 or higher opens the strongest leverage tiers. Reserves commonly run around 6 months of mortgage obligation, depending on the lender and loan size. Cash-out refinances usually expect about 6 months of seasoning, meaning time since you bought or last refinanced.

Clearing 1.00 does not mean positive cash flow. Coverage compares rent to the mortgage obligation only, so repairs, vacancy, management and utilities sit outside it.

A cash-out refinance needs the same permissions. It places or replaces a lien, so a restraint requires the same consent or order, and a co-owner still signs. What a DSCR loan avoids is personal-income and DTI questions. For the program basics, the complete DSCR loans guide walks through leverage, credit and reserves. DSCR programs are available in 41 markets, including Washington, D.C.

HELOC interest on a rental is deductible only in specific cases. Tax treatment varies; consult a qualified professional.

Questions to Bring to Your Attorney and Lender

  • Do automatic orders attach in my state, and do they reach this rental?
  • Is the rental separate property, and have marital funds improved it?
  • Will you draft a written consent, or should we ask the court for an order?
  • Is my spouse on title, and must they sign the lien?
  • How will the equity I pull be treated in the final division?
  • Should I freeze draws on any joint line?

Ask the lender what CLTV ceiling applies to your occupancy, whether valuation is automated, how support obligations count in DTI, and how title must be held.

Frequently Asked Questions

Can I get an investment property HELOC if my spouse refuses to consent?

Not without a court order where a restraint applies. If you cannot agree, a judge can permit the transaction after reviewing the request. A lender cannot waive the restraint for you, so the lien waits until consent or an order is in hand.

Does a lower credit score still work on a rental line?

On Lendmire’s network, an investment line has a hard 700 minimum with no tier beneath it. A score of 720 earns the same 70% CLTV ceiling. If your score is below 700, a DSCR loan may fit better, since DSCR programs are underwritten differently from a HELOC.

Will the lender count my ex’s debts or support payments?

Joint debts still on your credit report count against you until they are released. Pending support obligations are unsettled, so the lender will ask how they will be treated. The qualifying DTI maximum is 50%.

Can I put an LLC-owned rental under a HELOC?

Not directly. On Lendmire’s network, only an individual or a revocable living trust can hold title on an investment line. A rental already in an LLC needs a vesting change, or you can use a DSCR cash-out refinance instead. Changing title mid-case is a question for your attorney first.

Does the decree take my ex off a joint HELOC or mortgage?

No. A decree binds the two of you, not the lender, so both borrowers stay liable until the debt is paid off, refinanced or released.
