The Quick Read: Yes, paying child support does not by itself bar a bank statement HELOC, because the lender counts a court-ordered payment as a monthly debt and then tests whether your deposit-based income still supports the line. Two things decide the outcome: how much the support payment pushes up your debt-to-income ratio, and whether you are current with no recorded lien on title.
- Court-ordered support goes on the debt side of your debt-to-income (DTI) ratio. It does not reduce your income.
- Being current matters more than the payment amount. Arrears, and especially a recorded support lien, can stall a file.
- The network’s HELOC programs cap DTI at 50% and test the line at the full line size, not the amount drawn.
- A DSCR cash-out refinance is a different product that qualifies primarily on property-level rental income covering the payment, subject to lender guidelines.
What a Bank Statement HELOC Is, and Who Uses It
A bank statement HELOC is a home equity line where income is documented from deposits instead of W-2s and tax returns. Self-employed borrowers and investors with heavy write-offs use it, because their tax returns often show less income than they actually earn.
How large a line the equity supports.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
The lender reviews a window of statements (commonly 12 to 24 months across the market) and converts the deposits into a qualifying income figure. That figure then goes into a personal DTI test. The product is personal, not property-based. Your obligations still count, and child support is one of them. Qualification runs on documented income under the applicable program, subject to lender guidelines.
Lendmire is a mortgage broker. It places these lines through select wholesale partners and is never the lender. The HELOC offering is available only in Lendmire’s 16 full-service states, which is narrower than its 41-market DSCR footprint.
Does Child Support Disqualify You?
No. Child support is a recurring liability, and a recurring liability is something a lender counts. It is not a standalone reason to decline.
Brick Underground describes support as a debt added to DTI instead of a deduction from income. That matches how files are built across the wholesale network. The payment goes into the monthly-debt column next to the car loan, the credit cards, and the first mortgage.
Three things shape the effect:
1. The size of the payment against qualifying income. A modest order barely moves the ratio. A large one, stacked on a first mortgage, can move it a lot.
2. Whether you are current. A clean payment history is a neutral fact. Missed payments are a file problem.
3. Whether anything is recorded against the property. This is the lien question, covered below.
How Support Fits Into the DTI Math
The network’s HELOC programs allow a maximum DTI of 50%, with a tighter limit for lower credit tiers: profiles from 600 to 679 are held to 45%, and any ratio above 45% requires a 680 minimum score. The line is qualified on the interest-only payment calculated on the maximum draw, so a larger line puts a larger payment in the ratio even if you plan to draw little.
That last point surprises borrowers. A support order sits on top of a payment sized to the whole line. Asking for more line than you need can crowd you out of the ratio.
An illustrative example
Take a self-employed owner whose DTI sits at 38% before support. The percentages here are illustrative only. Add a support obligation that carries roughly 8 points of DTI, and the file lands near 46%.
- At a 700 score, that file is over 45% but still under the 50% maximum, so it remains in range.
- At a 660 score, the same file is past the limit for that credit band and does not fit as submitted.
The fixes are mechanical. Request a smaller line, pay down a revolving balance, or document higher qualifying income. The same borrower without the support obligation would not have faced that choice.
How the Deposits Become Qualifying Income
1. The lender collects the statement window and strips out transfers between your own accounts, one-time deposits, and anything it cannot trace to business or personal income.
2. For business accounts, it may apply an expense factor to the remaining deposits.
3. The adjusted total is averaged into a monthly income figure.
4. That figure is divided into your monthly debts, including support, to produce the DTI.
Support can create a double-counting trap. The obligation should be counted once, as a debt based on the order. If a payment also flows out of a business account and gets treated as an expense that lowers deposits, the same payment can hit you twice. Pay support from a personal account, and say so up front, so the underwriter does not have to guess.
Documentation usually includes the court order or divorce decree and may include proof of payment history. Lenders vary on exactly what they ask for, so assemble the order, a payment record, and a clean explanation before you submit.
Arrears, Liens, and Title
Arrears are where a manageable file turns into a hard one. Child support agencies can record a lien against a delinquent parent’s real property, usually sized to the amount owed. A recorded lien typically has to be paid from sale or refinance proceeds, and a title search will find it. Lien rules vary by state, so do not assume your state works the same way as any other.
Think of it this way:
- Current on payments, nothing recorded: the obligation is a DTI line item.
- Behind, no lien yet: expect questions, and expect the lender to want a payoff or a repayment history.
- Lien recorded: the lien must be cleared or paid at closing. Equity from the loan can sometimes pay off arrears, but the payoff has to go through title.
- Arrears paid but lien not released: a paid lien that was never released can still cloud title, so get the release recorded.
A recorded lien can complicate other lien-based financing too, including a DSCR cash-out, because title finds it either way.
What the Lender Still Reviews
Support is one input among several. The network’s HELOC programs also look at:
- Credit. The program floor is 600, with a single-bureau score model and a report no more than 90 days old at closing.
- Combined leverage. CLTV caps depend on the credit tier and the occupancy of the home. On an investment property, the ceiling is 70% CLTV, with a 700 credit minimum and a maximum line of $500,000. The 90% CLTV ceiling exists only on primary residences and second homes, and only at a 720-or-better credit profile.
- Vesting. Title must be held by the individual borrower or a revocable living trust. An LLC cannot hold title on a HELOC.
- Property and valuation. Lines at or below $500,000 ordinarily run automated valuation, and a full appraisal is required above that size.
Every figure above applies subject to lender guidelines and full file review.
If You Also Receive Support
The rule runs the other way for support you receive. Under the CFPB’s Regulation B rule on rules for applications, a lender may ask about your obligation to pay support, but support income only has to be disclosed if you want it considered. If you rely on it, the lender cannot simply discard it. The federal text at eCFR also allows lenders to weigh whether the payments are likely to continue. That is why continuance and documentation requirements differ by program.
When Support Is Nearly Finished or Informal
Some conventional-style DTI rules ignore payments with fewer than 10 months remaining. That is a convention from those programs, not a rule you can assume for non-QM files. Ask the broker how a given lender treats a payment that is about to end, and bring the final payment date from the order.
Informal or voluntary support is harder. Without an order, the payments are difficult to verify, and treatment depends on the lender.
Common Mistakes
- Assuming bank statement means no debt review. Only the income documentation changes. Obligations still count.
- Requesting a larger line than needed. The payment is tested at the full line.
- Leaving arrears for the lender to find. A title search will find a lien. Disclosing early gives you room to plan the payoff.
- Paying support through business accounts without telling anyone. This invites double counting.
- Skipping the release. A paid lien that is not released can still cloud title.
The Investor Angle: When a DSCR Cash-Out Fits Better
If your DTI is stretched by support, a different product may fit. A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines, so a support payment is not part of the coverage calculation. DSCR compares rent to the full monthly property payment (principal, interest, taxes, insurance, and any HOA dues). Clearing it is not the same as positive cash flow, because repairs, vacancy, and management sit outside the calculation.
Typical cash-out ranges across the network:
- Up to about 75% LTV on standard rentals, with about 6 months of seasoning as the common expectation.
- 1.00 is where many select programs start, and coverage below 1.00 is available through select lenders in the network, with leverage and terms adjusted.
- Most programs want around a 660 score, with a 620 floor in parts of the network.
- Reserves commonly run around 6 months of PITIA and vary by lender, leverage, and loan size.
Loans to LLC-titled borrowers are available subject to lender program eligibility. That is a real structural difference from the HELOC, which cannot be held in an LLC. A recorded support lien still has to be cleared on either path. The complete DSCR loans guide covers the full mechanics.
Support is also one of several family obligations that can shape an equity request. Lendmire’s piece Best Bank Statement HELOC Program To Pay for a Child’s College Costs walks through a related use of equity.
Key Terms Defined
Debt-to-income (DTI): Your total monthly debt payments divided by your gross monthly income.
Bank statement income: Qualifying income computed from the deposits in your statements instead of tax returns.
Arrears: Court-ordered support that is past due.
Support lien: A claim recorded against real property to secure unpaid support, which title must clear before a loan closes.
CLTV: Combined loan-to-value, meaning all liens on the property divided by its value.
DSCR: Debt service coverage ratio, meaning rent divided by the full monthly property payment.
Frequently Asked Questions
Does child support count against me on a bank statement HELOC?
It counts as a monthly debt in your DTI, not as a reduction of income. It lowers the line you can qualify for in proportion to its size. It does not disqualify you on its own.
What if I am behind on support?
Arrears are the larger problem. A lender will want to see current status, and a recorded lien must be paid or cleared through title. Bring the payoff amount and a payment history before you apply.
Can I leave support off my application?
No. A lender may ask about obligations you pay, and a court order or payment history can surface in the file. The disclosure exception applies only to support income you receive and do not want counted.
Should I use a DSCR cash-out instead?
It depends on the property and the goal. A DSCR cash-out ties qualification to the rental’s coverage, so support does not enter the ratio. It requires a rental property and the leverage, seasoning, and credit tiers above, and a support lien still has to be cleared.
Does Lendmire place bank statement HELOCs in every state?
No. Lendmire’s HELOC offering is limited to its 16 full-service states: AL, CA, CO, FL, GA, IN, MI, MT, NM, NC, OH, PA, TN, TX, VA, and WA.
