Can You Get a Bank Statement HELOC on a Texas Homestead?

Can You Get a Bank Statement HELOC on a Texas Homestead?

The Quick Read: Yes, a Texas homestead can carry a bank statement HELOC when the file clears two separate tests: deposit income that fits the lender’s program, and the Texas homestead rules that cap combined debt at 80% of the home’s value no matter how income is documented. Bank statements change how income is proven. They never change the state’s limits on the lien.

  • The income test and the homestead test are independent, and passing one never excuses the other.
  • A Texas primary residence caps at 80% combined loan-to-value on this network, even for strong credit tiers.
  • Texas homestead lines carry a 12-day waiting period, a one-lien-at-a-time rule, and 12-month seasoning.
  • A rental or second home is not a homestead, so those homestead-only rules do not apply to it.
  • Entity-owned property cannot hold this kind of line, which is where DSCR often takes over.

The Two Tests: Income and Homestead

A bank statement HELOC is a home equity line qualified on deposits instead of traditional personal-income documentation. Texas law does not regulate how a lender verifies income. It regulates the lien, the loan amount, the process, and the property. That means the product can exist on a homestead, but only if the lender is willing to originate Texas home equity products at all.

Editable Equity Scenario

How large a line the equity supports in Texas.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 80% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

That last point matters. Texas compliance is demanding, and many lenders skip the state entirely. Lendmire is a broker, not a lender, and it places these lines through select wholesale partners in the 16 states where it offers full-service home equity financing, Texas among them. Whether a particular partner accepts bank statement documentation on a Texas file is confirmed file by file, subject to lender guidelines.

The Texas homestead protection sits in the state constitution itself. Texas A&M’s Real Estate Research Center explains that home equity loans secured by a Texas homestead fall into three categories: cash-out refinances, home equity loans, and home equity lines of credit. A HELOC is one of the three. The Texas Legislative Council tracks the history of home equity lending in the state. Texas does not ban HELOCs. It regulates them tightly.

How Does a Bank Statement HELOC Work?

The lender replaces traditional personal-income documentation with a record of deposits, then turns that record into a monthly income figure. Most files follow the same path:

1. Submit statements. Borrowers typically provide 12 to 24 months of personal or business statements, depending on the program.

2. Screen the deposits. Transfers between your own accounts, loan proceeds, and refunds come out. They are not income.

3. Apply an expense factor. For business accounts, the lender counts only part of the deposits. Scotsman Guide gives 50% as an example, though each program sets its own factor, or accepts a profit-and-loss statement from a third-party tax professional instead.

4. Test the result. The remaining monthly figure feeds the debt-to-income ratio. Across the network, 50% is the common maximum, with 45% for profiles scoring 600 to 679.

5. Value the home. Lines at or below $500,000 ordinarily use an automated valuation, though a borrower can request a full appraisal in any case.

Bank statement documentation is not the absence of documentation. It is a different set of documents, and the loan is reviewed on documented income under the applicable program, subject to lender guidelines.

Why do self-employed owners use it? Depreciation, payroll, and contractor costs can shrink taxable income well below what actually moves through the account. HousingWire reports that bank statement loans make up roughly a third of non-QM volume, slightly ahead of DSCR loans.

Key Terms Defined

Bank statement HELOC: a revolving home equity line qualified on deposit history instead of traditional personal-income documentation or pay stubs.

Non-QM: a loan category built for borrowers whose income does not fit standard agency documentation.

Expense factor: the share of business deposits a lender subtracts to estimate usable income.

CLTV: combined loan-to-value, which adds every loan secured by the home and divides by its value.

Homestead: a Texas primary residence the owner occupies and intends as the home, protected by the state constitution.

Seasoning: the minimum time a prior loan or lien must have existed before a new one can be placed.

Why Does Texas Change the Answer?

Texas turns a documentation question into a lien question. The constitution protects a homestead from forced sale for most debts and lists a short set of permitted liens. The home equity lien is one of them. Each permitted lien comes with conditions, and a loan that misses one can be unenforceable, which is why compliance-heavy lenders tread carefully here.

Here are the rules that matter most to a borrower:

  • The 80% ceiling. The new principal plus all other debt secured by the home cannot exceed 80% of fair market value. The borrower keeps at least 20% equity.
  • The 12-day wait. Closing cannot occur until the 12th day after the later of the application date or the date the lender provides the required notice.
  • The $4,000 minimum draw. The Texas Office of Consumer Credit Commissioner lists $4,000 as the minimum for each HELOC advance. Lendmire’s network applies the same Texas minimum after closing.
  • No pre-signed blanks. The owner cannot sign any document with blanks left to fill in later.
  • Draw limits. Borrowers cannot draw with a credit card, debit card, or unsolicited pre-printed check, and payments during the draw period must at least cover accrued interest.

On this network, those Texas constraints show up in the numbers. A Texas primary residence caps at 80% CLTV. The higher tiers that exist in other states never apply to a Texas homestead. For a borrower scoring 640 or better, 80% is the practical ceiling, and lower credit tiers step down from there, to 70% at 620 and 60% at 600.

One more point on older material. Some summaries still describe a 50%-of-value limit on further advances. Later rule changes appear to have removed it, so treat that figure as stale and ask the lender what applies today.

Homestead, Second Home, or Rental: Which Rules Apply?

The property that secures the line decides the rules. A line on your own home is a homestead transaction with every constitutional constraint. A line on a rental or second home is not, which is why the same investor can face two very different processes.

Factor Texas Primary Second Home Investment Property
Max CLTV 80% in Texas Up to 90% at 720+ 70%
Minimum credit 600 640 700
Max line $750,000 $500,000 $500,000
12-day wait / one lien Applies Does not apply Does not apply
Seasoning of 12 months Applies Does not apply Does not apply

Two cautions apply to the table. First, the 90% second-home tier exists only at a 720-or-better profile and lower scores step down. Second, an investment line never goes above 70% CLTV or $500,000 on this network, and it runs a five-year interest-only draw followed by a 25-year repayment.

Title is the other hard line. The property must be held by an individual or a revocable living trust. LLCs, corporations, partnerships, and irrevocable or land trusts cannot hold title on these lines, subject to program eligibility. A rental already deeded to an LLC needs a vesting change, or it belongs in DSCR cash-out territory instead.

What a Texas Homestead Line Looks Like on This Network

Most Texas homestead files land in a fairly narrow band. The line is a standalone line in first or second lien position, with line sizes from $25,000 to $750,000. Anything above $500,000 is primary-residence only, needs a credit profile of 700 or better (720 on the longer-runway structure), caps at 75% CLTV, and requires a full appraisal.

Pricing floats and never converts to a fixed term. At least 75% of the line is drawn at closing. That requirement surprises borrowers who expected an unused cushion. Qualification runs on the interest-only payment calculated on the maximum draw, so a large line can strain debt-to-income even if you plan to borrow little.

Property rules also bite in Texas. Properties are limited to 10 acres, and a property listed for sale within the past 60 days is ineligible. Single-family homes, 2-4 units, PUDs, townhomes, and condominiums are eligible. Manufactured homes, co-ops, condotels, log homes, and agricultural or mixed-use zoning are not offered.

Borrowers with bankruptcy history need four years of seasoning from discharge or dismissal. Foreclosure history is more restrictive on primary residences, and one wholesale program declines it outright regardless of age.

The One-Lien Rule and What It Does to Your Options

A Texas homestead can hold only one home equity lien at a time. If you already have a cash-out refinance or a home equity loan on the home, adding a HELOC is not an option until that lien is gone. On the network, the 12-month seasoning requirement means a recent equity lien also delays a new one.

The first mortgage is a different matter. An ordinary purchase-money mortgage is not a home equity lien, so a line can sit in second position behind it. The 80% ceiling still counts that first mortgage in the combined debt.

There is also an old Texas principle that once a loan is a home equity loan it stays one. Texas allows a path out, which is refinancing it into an ordinary mortgage when specific conditions are met, such as no additional cash advanced and a minimum 12-month wait. That route is a lender and attorney question, not a borrower shortcut. For how this rule interacts with a cash-out lien, see Lendmire’s deeper piece Can a Texas Homestead Hold a Bank Statement HELOC and a Cash-Out Lien?.

Clean Up Your Deposits Before You Apply

Perfect statements still get declined for messy deposits. A short pre-application review prevents most surprises:

  • Separate personal spending from business deposits, since a single account mixing both is harder to analyze.
  • Document any large transfer or one-time deposit, because lenders remove what they cannot source.
  • Avoid moving money between your own accounts in large lumps, which inflates deposits that never count.
  • Keep statements consecutive, with every page included.
  • Pay down revolving balances first. Credit is pulled with a single-bureau score, the report cannot be older than 90 days at closing, and there are no rescores.

Who Should Use It, and Who Should Not

A bank statement HELOC fits a self-employed owner whose deposits tell the real income story and whose home has real equity. It suits an owner who wants a flexible line to fund a down payment or rehab on the next rental. It fits less well when income is strong on paper, because a standard documentation path usually costs less.

Here are four myths worth clearing up:

  • “Bank statement means no documentation.” That’s wrong: it means a different documentation set, tested against the same debt-to-income limits.
  • “The 80% cap applies to rentals.” That’s wrong: it applies to the homestead.
  • “The business can borrow.” That’s wrong: title must sit with an individual or revocable trust.
  • “Any lender can do a Texas equity loan.” That’s wrong: the lender must be set up for the (a)(6) conditions, and many are not.

An investor who owns several rentals should compare the home equity route with DSCR financing against the rentals themselves. A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines, so the owner’s deposits matter far less. Lendmire’s complete DSCR loans guide covers the mechanics.

Factor Homestead HELOC DSCR Cash-Out on a Rental
What is tested Deposits and DTI Rent against PITIA
Typical max leverage 80% in Texas About 75% on standard rentals
Title Individual or revocable trust Entity title possible, per program terms
Texas homestead rules Apply Do not apply

On the DSCR side, many select programs start at a 1.00 coverage ratio, and a separate select-lender path goes below 1.00 with leverage and terms adjusted. Cash-out refinances top out around 75% LTV, with roughly six months of seasoning common. Most programs want about a 660 score, and a 620 floor exists in parts of the network. Short-term rental cash-out is limited to 70%.

Clearing 1.00 does not equal positive cash flow, because repairs, vacancy, management, and capex sit outside the calculation. The same discipline applies to the homestead line.

The Tradeoffs Worth Weighing

Pricing on a HELOC floats through the draw and the repayment period, so the monthly obligation can change. The jump from interest-only to full amortization can be significant. Because 75% of the line is drawn at closing, borrowers start with a balance rather than an open cushion.

Texas adds friction. The 12-day wait, one-lien rule, and 12-month seasoning make the line a planned move, not an impulsive one. Lenders also keep their own freeze rights. Tax treatment can depend on how the funds are used and how the property is held, so investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

If you are considering a home equity line and want to see how the numbers work, Lendmire can help you compare HELOC options based on the property, the equity available, credit profile, combined leverage, and your goals. An illustrative calculator on this page can help frame the equity math before you talk to anyone.

Frequently Asked Questions

Can an LLC get a bank statement HELOC on a Texas rental?

Not directly. Title must sit with an individual or a revocable living trust, so entity-held property is outside these lines. An investor who wants to pull equity from an LLC-owned rental usually looks at DSCR cash-out instead, subject to program terms.

Does the 80% Texas cap apply to my rental properties?

No. The cap comes from the homestead protections and applies to a primary residence. A rental is treated as a non-homestead transaction, so the 12-day wait, one-lien rule, and 12-month seasoning do not bind it. An investment line on this network has its own 70% CLTV ceiling.

How much equity do I need on a Texas homestead?

You need at least 20% after the new line, because combined debt cannot exceed 80% of the home’s value. Credit also matters. A 640 score reaches the 80% ceiling on this network, while lower scores sit at 70% or below, subject to lender guidelines.

Can I have a HELOC and a cash-out refinance on the same Texas homestead?

Not at the same time. Texas allows one home equity lien on a homestead at a time, and the 12-month seasoning requirement can delay a second one. An ordinary first mortgage is not a home equity lien, so a line can sit behind it.

Do bank statements replace the credit and equity requirements?

No. Deposits only replace traditional income documentation as proof of income. Credit floors, combined leverage caps, debt-to-income limits, property eligibility, and the Texas homestead rules apply in full, with every figure subject to lender guidelines and full file review.
