How to Get a First-Position HELOC on a Texas Rental

How to Get a First-Position HELOC on a Texas Rental

The Quick Read: A first-position line on a Texas rental comes from one of two paths: the property is free and clear, or the new line pays off the existing mortgage at closing so nothing else is recorded ahead of it. The lender then underwrites the line on your credit, income, and combined loan-to-value, not on the rent. Texas homestead rules do not govern a rental, so lender policy sets the limits.

  • On Lendmire’s wholesale network, an investment-property line tops out at 70% CLTV (combined loan-to-value) and $500,000.
  • A 700 credit score is the hard floor on an investment line, and 720 does not buy more leverage.
  • Title must sit with you personally or in a revocable living trust. An LLC cannot hold title on this product.
  • A rental listed for sale, or listed in the past 60 days, is ineligible in Texas.
  • The line floats in price and requires at least 75% drawn at closing, so it is not a standby account. These specifics are subject to lender guidelines and a full review of property, leverage, and credit.

Why Texas Homestead Rules Don’t Govern a Rental

Most search results on Texas equity lines describe the homestead product, which only applies to the home you live in. A rental is not your homestead, so those limits never attach to it. Texas A&M’s Real Estate Research Center explains that the state’s home equity lending provisions sit inside the homestead protection and cover cash-out refinances, home equity loans, and lines of credit on that residence.

Editable Equity Scenario

How large a line the equity supports in Texas.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 80% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

That is where the “Texas bans HELOCs on rentals” claim comes from. It mixes up two products. A lien on a rental is ordinary non-homestead lending, and each lender’s investment-property policy decides whether it takes the collateral at all.

On a primary residence in Texas, the 12-day waiting period, the one-lien-at-a-time rule, and 12-month seasoning apply, and combined leverage caps at 80%. None of those bind a Texas investment property. A rental follows the network’s own investment table, which is tighter on leverage and stricter on credit.

What Does First Position Mean on a Rental?

First position means nothing else is recorded ahead of your line. It is a title result, not a special product. A lien that records first holds first position, whatever the lender calls the loan.

For a rental, that outcome happens one of three ways:

1. The property has no mortgage, so the line records first on its own.

2. The line pays off the existing mortgage at closing, and the payoff and release record before or with the line.

3. You paid the mortgage off separately and the release is already on record.

If a mortgage stays in place, the new line sits behind it in second position.

Two Routes Into First Position

The route depends on what is recorded against the property today. A title search settles it before anything else, because solar liens, HOA liens, and tax assessments compete for the same equity and can push a line out of first position.

Factor Free and clear Payoff at closing
Existing loan None Retired by the new line
Equity used All of it available Payoff comes out of the line first
What must be true Clean title, no other liens Payoff and release record cleanly
Main risk Hidden liens on title Payoff eats most of the line

The payoff route has a quirk. At least 75% of the line is drawn at closing, so the payoff and the required draw move together. A large mortgage balance can absorb most of what you hoped to keep as available credit.

How Big Can the Line Be?

Size comes from combined loan-to-value, not from rent. On an investment property, the network ceiling is 70% CLTV, and the maximum line is $500,000. Lines start at $25,000. Subject to lender guidelines, here is how the math works in percentages.

CLTV is every lien on the property plus the full credit limit, divided by value. On a free-and-clear rental, the existing-lien part is zero, so the whole 70% is available as the line, up to $500,000. On a higher-value rental, the $500,000 cap binds before the 70% does.

Now take a rental with an existing mortgage equal to 45% of value. The line is sized to 70% CLTV in total, and the existing mortgage already accounts for 45 points of that. That leaves about 25 points of value as the available line. If the existing mortgage is paid off at closing, the line would be drawn to cover the payoff, so the amount of fresh cash depends on how much of the line is drawn beyond that payoff. A mortgage at 60% of value leaves room for a line of only about 10 points of value, so a payoff would leave little or no fresh cash.

Credit adds eligibility, not leverage. A 720 score and a 700 score both reach 70% CLTV on an investment line. Below 700, the investment line is not available.

How Is a Rental HELOC Underwritten?

The line is underwritten on the borrower. It is the opposite of a DSCR loan, which compares rent to the monthly housing payment on the property. Here, the file runs on credit, income, debt-to-income, title, vesting, and value.

1. Confirm no one lives there as a home. The property must be non-owner-occupied and not your homestead. A rental held in a revocable trust is still a rental.

2. Check title. Pull the title report before applying. Any recorded lien outside the new line is a first-position problem.

3. Size the line on CLTV. Add every lien and the full proposed limit, divide by value, and test it against 70% and the $500,000 cap.

4. Qualify the borrower. Maximum DTI is 50%. It drops to 45% for credit profiles from 600 to 679, and a ratio above 45% needs a 680 score, but an investment line already floors at 700. The lender reviews your file on the interest-only payment calculated on the maximum draw, not on what you plan to draw.

5. Pull credit. The score is single-bureau, keyed to the primary wage earner, and the report must be no more than 90 days old at closing. Rescores are not available.

6. Value the property. Because an investment line is capped at $500,000, it falls in the automated-valuation lane. A traditional appraisal is not ordinarily required, though a higher CLTV may call for a secondary valuation, and you can request a full appraisal in any case.

7. Record and draw. If an existing mortgage is being retired, the payoff and release record before or with the line.

Income can be documented through the applicable program, subject to lender guidelines. Alternative documentation does not mean no review, and a business bank account needs a 680 minimum for deposit analysis, which an investment file already clears at 700.

Which Properties and Owners Pass?

The property type and the vesting matter as much as the equity. These are the pass and stop points on the network’s investment lines.

Item Passes Stops the file
Property type Single-family, 2-4 units, PUD, townhome, condo Manufactured, co-op, condotel, log home
Use Residential rental Commercial, mixed-use, agricultural
Acreage Up to 10 acres in Texas Over 10 acres
Listing status Not listed Listed now or in the past 60 days
Title holder You, or a revocable living trust LLC, corporation, irrevocable or land trust
Exposure Up to three lines, 15 financed properties A fourth line, or more than 15 properties

Condominiums include non-warrantable projects, which is wider than many conventional programs allow. Barndominiums fall outside what these programs offer. A borrower with more than 15 financed properties is not eligible, and combined exposure across multiple lines has its own cap.

Where the General Rule Breaks

The rental still has a mortgage. Without a payoff, the new line is second. Most first-position structures on rentals are really a refinance of the old loan into the line.

The rental sits in an LLC. The LLC cannot hold title on this product, subject to program terms. A property already deeded to an LLC needs a vesting change before the line, or a DSCR cash-out refinance instead. Moving title can have its own consequences with the existing lender and insurer, so settle it before applying.

You want to use your own home’s equity. A line against your Texas primary residence is the homestead product, with the homestead limits described earlier. The 12-day wait and one-lien rule bind that line, not the rental. Combined leverage on a Texas primary caps at 80%, while the investment line caps at 70%.

The property was recently on the market. A rental listed for sale, or listed within the past 60 days, is ineligible in Texas. Pulling a listing and relisting later does not reset the clock.

Credit history has a derogatory event. A bankruptcy needs 4 years of seasoning from discharge or dismissal. Foreclosure-family history on investment files follows a 7-year path for foreclosure and a 4-year path for a deed in lieu, pre-foreclosure, or short sale.

First-Position HELOC or a DSCR Cash-Out?

The two products solve different problems. A HELOC on a rental is underwritten on you. A DSCR cash-out refinance is underwritten on the property’s rental income covering the payment, subject to lender guidelines, and it replaces the first mortgage instead of sitting beside it. If you want the full picture of how those loans work, the complete DSCR loans guide walks through it.

Factor First-position HELOC DSCR cash-out refinance
Underwritten on Borrower credit, income, DTI Property rent against its payment
Leverage ceiling 70% CLTV, investment About 75% LTV on most files
Structure Revolving line, floating pricing Closed-end loan
Title holder Individual or revocable trust LLC possible, subject to program
Line or loan size $25,000 to $500,000 Up to $3,000,000 on standard programs

An investor with many financed properties or thin traditional employment income often fits the DSCR path better. An investor with strong personal income and a clean title may prefer the line. A DSCR ratio above 1.00 only means rent covers the housing payment, since repairs, vacancy, and management sit outside it, so neither product proves a deal makes money. Cash-out DSCR files commonly want about 6 months of seasoning too.

Is First Position the Right Move?

First position is right when you own the property outright or are fine retiring a loan to get the line. It is wrong when the existing mortgage is cheap and you want to keep it, because the payoff trades away a good first for a floating line.

Pricing floats through both the draw period and repayment, and it never converts to fixed. The structure on an investment line is a 5-year interest-only draw followed by a 25-year fully amortizing repayment. The Consumer Financial Protection Bureau’s HELOC explainer warns that payments are often significantly higher once repayment starts, and that is the stage to plan for. Its HELOC brochure also notes that some plans require a minimum draw each time, which matches what to expect here: later draws carry a minimum, $4,000 in Texas under the program that states one.

The 75% draw at closing matters most. You start borrowing most of the line on day one and pay for it from then on. If you want a standby reserve, this is the wrong tool.

Key Terms Defined

First position: The lien recorded ahead of every other lien on the property, which gets repaid first if the property is sold.

CLTV: Combined loan-to-value, meaning every lien plus the full credit limit divided by the property’s value.

Draw period: The stretch when you can borrow against the line and pay interest only, five years on an investment line.

Homestead: The home you live in, which Texas protects with its own equity-lending limits that do not reach a rental.

Vesting: How title is held, here limited to an individual or a revocable living trust.

Automated valuation: A computer-based value estimate used in place of a traditional appraisal on lines at or below $500,000.

Frequently Asked Questions

Can I get a first-position line on a rental that has a mortgage?

Only if the line pays that mortgage off at closing. Otherwise the new line sits behind it in second position. The payoff counts against your CLTV, and the 75% draw at closing means you borrow most of the line immediately.

Does the Texas 80% cap apply to my rental?

No. The 80% cap applies to a Texas primary residence. A rental follows the investment table, which caps at 70% CLTV and $500,000 on this network.

Will rent income qualify me for the line?

No. The line is underwritten on your credit, income, and DTI, with the payment calculated on the interest-only amount at the maximum draw. If you want rent to carry the qualification, a DSCR cash-out refinance is the product built around it.

Does my LLC-owned rental work?

Not as titled. An LLC, corporation, or land trust cannot hold title on this product. You can move title into your name or a revocable living trust, or look at a DSCR cash-out instead.

How many rentals can I borrow against?

You are limited to three lines, and you cannot own more than 15 financed properties. Combined exposure across lines is also capped by the program.
