Can You Get an Investment Property HELOC Alone When Divorcing or Sole Title Holder?

Can You Get an Investment Property HELOC Alone When Divorcing or Sole Title Holder?

The Quick Read: Yes, a sole titleholder who is reviewed on their own credit and income can usually open an investment property line without a spouse, but a spouse who is on title, or who holds a state-law interest in the property, may still have to sign the lien, and a divorce adds court and title checks. The lender cares about two things: who owns the rental on paper, and who is promising to repay. Both must line up with your file. On Lendmire’s network the investment line is a narrow product, so read the limits below before you plan around it.

  • A non-owner spouse generally does not have to co-sign the loan if you qualify alone.
  • A spouse on title usually signs the lien document, even if not borrowing.
  • A divorce decree does not change the deed, and it does not bind the lender.
  • Investment lines on this network cap at 70% combined loan-to-value (CLTV) and $500,000, subject to lender guidelines.
  • LLC-titled rentals are not eligible for the line. A DSCR cash-out may fit instead.

Who Has to Sign What?

Two documents matter. The note is the promise to repay. The security instrument (a mortgage or deed of trust) is the lien on the property. Lenders treat them separately, and that split is the heart of borrowing alone.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

The CFPB’s Regulation B says a lender may not require a spouse or other non-joint person to sign credit paperwork when the applicant qualifies alone. The exception is when the applicant relies on that person’s income. In community-property states, a spouse’s separate income can also trigger a signature if you lean on it.

Secured loans add a wrinkle. A lender may ask for a signature on whatever instrument state law requires to create a valid lien. The official commentary to the rule says that signature is generally needed only on the security agreement, and the spouse can sign a legend saying it creates no personal liability.

Your situation Signs the note Signs the lien
Sole title, spouse never on deed You only Usually you only
Spouse on title, not borrowing You only Spouse usually signs
Spouse off deed, community-property state You only State law may require it
Ex still on deed after decree You, once title is fixed Ex usually signs

Treat this table as the usual pattern, not a promise. A title company or attorney in your state confirms the final answer.

What Does a Divorce Add?

A divorce adds a gate that has nothing to do with the lender. Some states place automatic limits on new debt and property transfers once a case is filed. The rules vary by state, and the order in your case controls. Before you apply, check the order or get written consent from your spouse or the court.

Timing changes the picture.

Stage What to expect
Before filing Easiest to qualify. A large draw right before filing can look bad in the property division.
While the case is pending Hardest. Court limits and unresolved title can stall a lien.
After the decree and recorded deed Cleanest. Title matches the paperwork.

If your spouse is on title and refuses to sign, expect the application to stall. The fixes are a buyout, a recorded deed after the settlement, or waiting for the decree.

A pre-filing draw deserves honest thought. Equity you pull out becomes marital debt and cash that both sides will account for. It does not hide anything. Talk to your attorney before you borrow.

Does the Decree Change Title or the Loan?

No on both counts. A decree is a court order between you and your spouse. The deed is a recorded document, so when the decree awards you the rental, the departing spouse signs a deed, commonly a quitclaim, and it gets recorded. Until then, the lender sees the old owners.

A quitclaim moves ownership only. It leaves the debt alone, so an ex-spouse stays liable on the existing first mortgage until it is paid off or refinanced. The same is true of any joint home equity line: a decree that assigns the debt to you does not release your ex in the lender’s eyes. A freeze stops new draws, but it does not remove anyone from the debt.

One piece of good news. Federal due-on-sale rules generally stop a lender from calling a loan due because a spouse becomes an owner, or because of a transfer under a divorce decree or settlement. That protects a retained first mortgage from being called. Whether a rental, rather than a marital home, gets the same comfort is a question to confirm with your attorney before you count on it.

What Does an Investment Line Require on This Network?

The investment line is a narrow product. Across the network’s wholesale partners, it follows a tight set of terms.

  • Leverage: 70% CLTV maximum. CLTV counts your first mortgage plus the new line against the property’s value.
  • Credit: 700 minimum. A 720 score does not raise leverage on an investment line.
  • Line size: up to $500,000 on an investment property. Lines above that are for primary residences only.
  • Structure: a standalone line in first or second lien position, with a 5-year interest-only draw period and then 25 years of repayment. At least 75% of the line is drawn at closing.
  • Valuation: investment lines commonly run on an automated valuation with no traditional appraisal, though a full appraisal can be requested.
  • Income test: debt-to-income (DTI), which compares your monthly debts to your income, tops out at 50%. The lender reviews your file on the interest-only payment calculated on the maximum draw.
  • Title: you hold it individually or in a revocable living trust. LLCs, corporations, partnerships, and irrevocable or land trusts cannot hold title.
  • Property types: single-family, 2-4 units, PUDs, townhomes, and condos, including non-warrantable ones. Manufactured homes, co-ops, condotels, log homes, and commercial or mixed-use properties are not offered.
  • Limits per borrower: up to three lines, and borrowers with more than 15 financed properties are not eligible.
  • Footprint: this line is available only in Lendmire’s 16 full-service states, a narrower footprint than its DSCR lending.

Market surveys, such as one from Taxstra, report maximum leverage of 70-80% on investment property lines across the broader market. On this network the ceiling for an investment line is 70% CLTV, and nothing sits above it. All of it stays subject to lender guidelines and a full file review.

Because this line leans on personal DTI, your divorce changes the math. Support payments you owe count as debts. Income you used to share may now be yours alone. Fix the household budget first, then run the line.

What Does a Buyout Look Like on a Rental?

Keeping a rental in a divorce often means paying your ex their share of the equity. Here is the math with percentages, so you can scale it to your property.

Say the rental is worth 100% of its appraised value. The first mortgage is 40%, so equity is 60%. A fifty-fifty split sends 30% of value to your ex. A line at 70% CLTV on top of a 40% first mortgage gives you at most 30% of value. That covers the buyout exactly, with no cushion for closing costs or repairs, and only if the line stays under the $500,000 cap.

Two more cautions. At least 75% of the line is drawn at closing, so you pay interest on most of it immediately. And a second lien alone may not satisfy a decree that requires you to refinance by a set date. Read the decree before you choose the tool.

HELOC or DSCR Cash-Out for a Divorcing Landlord?

The right tool depends on how the rental is titled and what you can document. A DSCR loan is an investor loan that qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. The ratio compares rent to the full monthly obligation (principal, interest, taxes, insurance, and any association dues). It does not measure cash flow. Repairs, vacancy, management, and utilities sit outside the calculation.

Factor Investment HELOC DSCR cash-out refinance
Max leverage 70% CLTV About 75% LTV on standard rentals (70% on short-term rentals)
Reviewed on Your credit and DTI Rent coverage, 1.00 where select programs start
Credit floor 700 Around 660 on most programs, 620 in parts of the network
Loan size Up to $500,000 Up to $3,000,000 on standard programs
Title Individual or revocable trust LLC possible, subject to program terms
Seasoning Varies by lender About 6 months is the common expectation

A HELOC is the wrong tool in a few cases. Your income dropped after the split. You need more than the $500,000 cap or more than 70% of value. The rental sits in an LLC. In each, a DSCR cash-out is worth a look. It replaces your first mortgage, so it also resolves a joint first loan with your ex, which a HELOC cannot do.

The complete DSCR loans guide covers how those programs work in full. Lendmire’s piece How to Qualify for a DSCR HELOC Alone When Divorcing or Sole Title Holder covers the rent-based side.

Key Terms Defined

Note: the signed promise to repay the debt.

Security instrument: the mortgage or deed of trust that puts a lien on the property.

CLTV: combined loan-to-value, which adds every loan secured by the property and divides by its value.

Quitclaim deed: a deed that transfers whatever ownership interest the signer holds, with no promises about the title and no effect on any loan.

DTI: debt-to-income, your monthly debt payments as a share of your monthly income.

Sole titleholder: the only person named as owner on the recorded deed.

Common Mistakes

  • Assuming the decree fixed title. Only a recorded deed does.
  • Assuming a quitclaim removed your ex from the loan. It did not.
  • Borrowing during the case without checking court limits. A line that violates an order creates bigger problems than the equity is worth.
  • Planning around an LLC title. The investment line cannot hold title in an LLC, so a property already deeded to one needs a vesting change or a DSCR cash-out.
  • Treating 70% CLTV as spendable. Your first mortgage uses part of it. Run the combined number before you sign a buyout.

Frequently Asked Questions

Can I get an investment property HELOC while my divorce is still pending?

Sometimes, but it is the hardest stage. Some states restrict new debt once a case is filed, and an unresolved title can stall the lien. Get the court order or your spouse’s written consent in hand first, and ask your attorney whether a draw affects the property division.

What if my spouse is on title and refuses to sign?

The application will usually stall, because a co-owner generally has to sign the lien document. The realistic paths are a buyout, a recorded deed after settlement, or waiting for the decree. A DSCR cash-out would face the same title issue.

Does a rental I bought before the marriage need my spouse’s signature?

If your spouse is not on title, you qualify alone, and state law gives them no interest in the property, a signature usually is not required. Marital-property rules vary by state, so a title company or attorney should confirm. Do not assume the purchase date settles it.

Does a quitclaim deed take my ex off the mortgage?

No. It transfers ownership only. The ex stays liable on the existing loan until it is paid off or refinanced, and the lender is not bound by your decree. A refinance is how both names usually come off.

Can I use an LLC-owned rental for this line?

Not on this network. The investment line requires title in your name or in a revocable living trust. A property already deeded to an LLC needs a vesting change first, or a DSCR cash-out as the alternative, subject to program terms.
