HELOC Title Rules After a Quitclaim Between Spouses

HELOC Title Rules After a Quitclaim Between Spouses

The Quick Read: A quitclaim between spouses changes who owns the property. It does not change who owes the first mortgage, and a new equity line is underwritten on the title as it stands after the deed is recorded. Lenders read the recorded deed, the vesting form, and the ownership timeline before they decide whether a line can sit behind the existing loan.

  • A quitclaim moves title only. The departing spouse stays liable on the old note until it is refinanced or released.
  • The borrower on the line must hold title in an acceptable form: an individual, or a revocable living trust.
  • Every owner on title is typically asked to sign the lien, even a spouse who is not borrowing.
  • Seasoning after a deed is lender policy, not statute, and it differs by program.
  • On an investment property, the network ceiling is 70% CLTV, subject to lender guidelines and full file review.

Lendmire arranges financing through select lenders in its wholesale network. It is a broker, not a lender, and home equity lines are available only in its 16 full-service states. Investors who need a DSCR structure can use the complete DSCR loans guide as the starting point.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Key Terms Defined

Quitclaim deed: A document that passes whatever interest the grantor holds, with no promise that the title is clear.

Vesting: The legal form in which owners hold title, such as an individual, joint owners, or a trust.

Seasoning: The time a lender wants to see on title or on a loan before it treats a new transaction as settled.

Note versus lien: The note is the promise to repay. The lien, recorded as a mortgage or deed of trust, is the claim on the property.

CLTV: Combined loan-to-value, which adds the first mortgage and the new line together against the property value.

What Does a Quitclaim Actually Change?

It changes title and nothing else. Chase’s consumer education page describes a quitclaim as passing whatever interest the grantor has, with no warranty, and lists adding a spouse and divorce settlements among the common uses. LegalZoom adds that the deed does not change who is responsible for the mortgage.

Item Effect of the quitclaim
Title Moves to the new owner list once recorded
First mortgage debt Unchanged; both signers stay liable
New lien signers Every owner on title, typically
Owner’s title insurance May not follow the deed
Income and credit Come from borrowers only

A divorce decree does not move recorded title either. The deed has to be recorded in the county records before a lender treats the change as real.

Does the Existing First Mortgage Get Called?

Usually not. The federal due-on-sale statute, 12 U.S.C. § 1701j-3, bars a lender from calling the loan on certain transfers. Two of them are a transfer where the borrower’s spouse becomes an owner, and a transfer under a divorce decree or separation agreement. The protection applies to residential property with fewer than five dwelling units, as Adam Leitman Bailey, P.C. explains.

The protection does not reach every transfer. A revocable trust where the borrower remains a beneficiary is covered, but a deed into an LLC is not.

The departing spouse is still on the old note. Only the lender can release a borrower, through a refinance into one name or an approved assumption. A new equity line sits behind that first loan and does not touch it.

Who Signs, and Who Borrows?

Borrowers sign the note. Owners on title typically sign the lien. These are different roles.

Federal credit rules protect a spouse who is not borrowing. If the applicant qualifies alone, the lender generally cannot require another person to sign the credit instrument, per the CFPB’s Regulation B text. There is a secured-credit exception. A lender may require a signature on any instrument that state law makes necessary to create a valid lien, pass clear title, or waive inchoate rights, per the eCFR text.

In practice, a spouse on title can be asked to sign the mortgage or deed of trust without becoming a borrower. Their income does not count, and their credit is not pulled. On the network’s equity line, qualifying income and credit come from the borrower, with the score keyed to the primary wage earner.

How Do Lenders Treat the Deed Step by Step?

1. The deed is recorded. The change counts once it sits in the county records. An unrecorded deed does not change what the title report shows.

2. A title search reads the chain. The lender reviews the deeds and liens, confirms current vesting, and checks that the vesting form fits the program.

3. Title insurance is checked. A quitclaim usually comes with no new title policy for the person receiving the interest. Whether the original owner’s policy still protects anyone depends on the insurer, so ask before recording.

4. Roles are sorted. The lender decides who is a borrower and who is only a signer.

5. Seasoning is applied. Some lenders count time from the original purchase. Others restart the clock at the new deed’s recording date. No statute sets this figure. Get each lender’s treatment in writing.

6. The first lien is reviewed. The line is a new lien behind the existing mortgage. Combined leverage is measured against value.

Two recorded deeds in a short span, a spousal quitclaim followed by a transfer to a trust, can raise two seasoning questions instead of one.

What Title Forms Work for a Line?

On the network’s equity line, title must be held fee simple or leasehold by the individual borrower or an inter vivos revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title. That is the sharpest structural difference from a DSCR loan.

A rental already deeded to an LLC needs a vesting change before a line can be considered. A DSCR cash-out refinance is the other route. Investors weighing that tradeoff can read the DSCR cash-out refinance guide.

Entity ownership is subject to lender program eligibility. Moving a property in and out of an entity adds recorded deeds, and each one is a title event a lender will read.

What Leverage Applies Once Title Is Clean?

It depends on occupancy, and the figures differ a lot.

Occupancy Max CLTV Minimum credit Max line
Investment property 70% 700 $500,000
Second home 90% at 720+ 640 $500,000
Primary residence 90% at 720+ (to $500,000) 600 $500,000 at 90% CLTV; $750,000 at 75% CLTV, 700+ (720 on the longer-runway program)

The 90% tier exists only at a 720-or-better credit profile on a primary residence or second home. A line above $500,000 is primary-residence only, requires 700 or better (720 on the longer-runway structure), caps at 75% CLTV, and requires a full appraisal.

Investment lines use a standalone structure in first or second lien position with a 5-year interest-only draw and a 25-year repayment period. At least 75% of the line is drawn at closing. Pricing floats and does not convert to fixed. Debt-to-income runs to 50% at most, and the ratio is tested on the interest-only payment at the maximum draw. Lines at or below $500,000 usually use an automated valuation, though a higher CLTV can require a secondary valuation.

Eligible property types include single-family, 2-4 units, PUD, townhome, and condominium, including non-warrantable. Manufactured homes, co-ops, condotels, log homes, and commercial or mixed-use zoning are not eligible. All figures are subject to lender guidelines and full file review, and none are a commitment to lend.

Where the General Rule Breaks

Spouse added at marriage. Both names go on title and both usually sign the new lien. The due-on-sale exemption covers the transfer.

Divorce with one spouse removed. The deed must be recorded. The decree may assign payment of the old loan to one spouse, but both stay liable to the lender if both signed.

Community-property or homestead states. State law can require a spouse’s signature or consent even when that spouse is off title. The title company decides what applies. Consent matters most on an owner-occupied home and is generally a smaller issue on a rental, but confirm with an attorney or title company.

Deed and reverse. Some owners deed to the spouse with stronger credit and plan to deed back. That creates a second title event and a second seasoning question. A lender may treat the reversal as a new transfer.

An existing line when title changes. The lender may freeze or reduce it. A former spouse may keep draw access unless the line is frozen or paid off.

Property listed for sale. A property listed, or listed within the past 60 days, is ineligible in NC, PA, TN, TX, and WA.

Texas primary residences. Primary homesteads face a waiting period, a one-lien-at-a-time rule, and 12-month seasoning, and cap at 80% combined loan-to-value. Texas second homes and investment properties are eligible as non-homestead transactions.

Deed First or Apply First?

Neither order is right for every file. Use the title facts to decide.

Apply first when the borrower already holds title in an acceptable form and the deed is optional. A recorded deed adds a title event the lender has to evaluate.

Deed first when the spouse who qualifies is not yet on title. The borrower must hold title to borrow against the property. Ask each lender in writing how a spouse-to-spouse deed counts for seasoning, who must sign, and whether the vesting form is acceptable. Do that before recording, because a recorded deed cannot be unrecorded.

Why Files Stall After a Deed

Cause Fix
Borrower not on title Record the deed before applying
Vesting in an LLC or irrevocable trust Vest in the individual or a revocable trust
Seasoning not met Wait, or choose a lender that looks through to purchase
Missing spouse signature on the lien Line up signers with the title company
Credit below the occupancy floor Compare tiers, since investment lines start at 700
Property listed within 60 days in a listed state Wait for the window to clear

A downward move on credit tier lowers allowed CLTV, so the same equity supports a smaller line.

Moving from a Line to a DSCR Loan

A DSCR cash-out refinance is a different product from an equity line. It tops out around 75% LTV on most of the network, with about 6 months of seasoning as the common expectation. Coverage of 1.00 is where select programs start, and a separate select-lender path goes below 1.00 with leverage and terms adjusted. DSCR compares rent to the full monthly obligation only. Clearing it does not mean positive cash flow.

Frequently Asked Questions

Does a quitclaim take my spouse off the mortgage?

No. The deed changes ownership only. The spouse who signed the note stays liable until the loan is refinanced into one name or the lender approves a release.

Can my spouse refuse to sign if they are not borrowing?

A spouse on title can typically be required to sign the lien instrument, not the note. Federal credit rules limit what a lender can demand from a non-borrowing spouse, and state law can add requirements.

Is there a legal waiting period after a spouse-to-spouse deed?

No statute sets one for the HELOC itself. Seasoning is lender policy, and some lenders look back to the original purchase while others restart at the recording date.

Can I deed a rental into an LLC and then take a line?

Not on the network’s equity line, since an LLC cannot hold title. A vesting change or a DSCR cash-out refinance is the usual path.

What is the CLTV limit on an investment property line?

It is the lowest of the occupancy tiers, and lender guidelines govern the final figure. Higher ceilings apply to primary residences and second homes only.
