Investment Property HELOC Requirements When You Pay Child Support Every Month

Investment Property HELOC Requirements When You Pay Child Support Every Month

The Quick Read: Court-ordered support you pay is a monthly debt, and on an investment property HELOC it takes up room in your debt-to-income ratio (DTI) before the new line is even counted. Paying support does not disqualify you, but it can push a borderline file over the limit, and unpaid support can put a lien on the property that blocks the loan entirely.

  • A HELOC is underwritten on you personally, so support you pay sits on the debt side of DTI.
  • Across Lendmire’s wholesale network, an investment line allows a 50% maximum DTI, tested on the interest-only payment at the maximum draw.
  • Investment lines in the network run up to 70% CLTV (combined loan-to-value, meaning all liens against the property) and $500,000, with a 700 minimum credit score.
  • Arrears and recorded support liens can block a file, so cure them before you apply.
  • A DSCR loan reviews the property’s rent against its payment, so personal DTI is not the main test there.

Does Child Support Count Against You on a Rental HELOC?

Yes, it counts as a debt. A HELOC on a rental is a personal-credit product, and the lender adds up your fixed monthly obligations. A court-ordered support payment goes on that list next to car loans, student loans and your first mortgage. It does not bar you from borrowing. It shrinks the room left for the new line.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Think of DTI as a simple fraction. Monthly debts go on top. Gross monthly income goes on the bottom. Every point of DTI that support uses is a point the new line cannot use.

Support also behaves differently from a credit card. A card balance shrinks as you pay it down. Support is a fixed payment that runs until the order ends, so the lender treats it as permanent for the length of the order.

How Underwriting Treats Support You Pay, Step by Step

1. The lender establishes the obligation. It wants the paper that creates it: a divorce decree, separation agreement or court order. That document shows the monthly amount and how long it runs. Brick Underground reports that lenders may ask for the agreement to see how long payments continue.

2. The payment goes on the monthly debt list. The lender uses the amount in the order, not what you feel you can afford. Payments withheld from your paycheck or sent through a state agency still count as a debt.

3. The lender models the new line’s payment. In Lendmire’s network, an investment line is tested on the interest-only payment at the maximum draw. A large undrawn limit therefore still uses DTI room.

4. The lender counts income. Only income documented in your name counts. Rental income from other properties may be credited in part, depending on the program and how long the leases have been in place.

5. Title and lien review. The title search shows whether a support lien has been recorded against the property.

6. The lender weighs the whole file. The main factors are support as a share of gross income, your other debts, the new line’s modeled payment, your credit tier, whether payments are current, and how many payments remain.

That last step is why two people with the same support amount can get different answers. The mix of income and other debts shapes the result, alongside the other factors in that list.

A Worked DTI Example

Here is how support changes the math. These percentages are illustrative, not sourced market data. Every figure is a share of gross monthly income.

Item Without support With support
Existing monthly debts 30% 30%
Child support 0% 9%
New line (interest-only, max draw) 10% 10%
Total DTI 40% 49%

Both columns sit under the 50% maximum our network applies to investment lines. The right column lands above 45%, which brings in a second rule: in the network, a ratio above 45% requires a 680 minimum credit score. An investment line already floors at 700, so that condition is met automatically on this collateral.

Now change one input. If support took 11% instead of 9%, the right column would total 51%. That file fails on DTI no matter how strong the equity looks. The fixes are a smaller line, a payoff of other debts, or a different product.

Bankrate’s investment-property guide puts the market-wide investment HELOC DTI limit at 50%, versus 43% for primary residences, and notes it can depend on anticipated rental income, per Bankrate. That is a market-wide figure. The network figure is the 50% maximum above.

What the Network Requires on an Investment Line

Support is only one input. The line still has to clear the standard investment-property tests. Lendmire brokers these through select wholesale partners and is never the lender. Every figure below is a typical guideline, subject to lender review of the full file.

  • Leverage: up to 70% CLTV on an investment property. There is no higher tier on this collateral.
  • Credit: a 700 minimum. Credit above 700 buys eligibility rather than extra leverage, since 720 and 700 both reach 70% CLTV.
  • Line size: up to $500,000 on an investment property. Larger lines are limited to primary residences.
  • Structure: a standalone line in first or second lien position, with a 5-year interest-only draw followed by a 25-year repayment period. At least 75% of the line is drawn at closing. Pricing floats and does not convert to a fixed payment.
  • Valuation: at this size, lines normally use an automated valuation rather than a full appraisal, though a borrower can request a full one.
  • Property types: single-family, 2-4 units, PUDs, townhomes and condominiums, including non-warrantable condos. Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use and agricultural zoning are not eligible.
  • Title: held by you individually or in a revocable living trust. LLCs and similar entities cannot hold title on a HELOC.
  • Limits: a borrower can have up to three lines and cannot own more than 15 financed properties.
  • Availability: HELOC placements are limited to Lendmire’s 16 full-service states. That is narrower than its DSCR footprint of 41 markets, including Washington, D.C.

Where the General Rule Breaks

Arrears and liens. This is the biggest edge case. The Administration for Children and Families explains that a lien on real property does not collect money right away. It does keep the owner from selling, transferring or borrowing against the property until the debt is paid. Arrears can also be reported to the credit bureaus. A HELOC cannot close over a recorded lien in most cases. Lien rules vary by state, so confirm yours with the title company. If you owe arrears, the usual path is to pay them off and get the lien released before you apply.

Remaining term. Some loan types ignore a support obligation when only a few payments remain. Do not assume a HELOC works that way. Ask the program for its rule, and bring the end date from the order in writing. Whether a short remaining term helps depends on that program’s own guidelines.

Voluntary or informal payments. Payments with no court order or written agreement are less likely to be counted as a debt. That treatment varies by lender. If your payments are informal, expect questions, and expect the lender to want a clear record.

Support you receive. This runs the other way. Under the federal credit-discrimination rule, a lender cannot discount income because of its source and must judge it on your actual circumstances, per CFPB Regulation B. A lender may still weigh how much the income is and how likely it is to continue. Support received counts only if you choose to rely on it, and a decree or agreement backs it up.

Pending divorce. A new lien on marital property may need your spouse’s written consent or a court order. That can stall a file before DTI even comes up.

Variable income. If your income moves from month to month, a fixed support payment weighs more heavily in a bad stretch. Lendmire’s piece Best Investment Property HELOC Program When Business Income Fluctuates From Month to Month goes deeper on that side.

Here is a quick view of common situations.

Situation Typical effect on the file
Support current, DTI comfortable Counted as debt; file proceeds on normal tests
Support current, DTI near the cap Smaller line or debt payoff may be needed
Arrears owed, no lien Expect to cure before applying
Recorded support lien Lien must be paid and released first
Support ends soon Depends on program rules; bring the order
New decree or pending divorce Added paperwork; spouse consent may be needed

When a DSCR Loan Fits Better

A DSCR loan can fit better when your personal income is thin but the property rents well. DSCR stands for debt service coverage ratio. It compares the property’s monthly rent to its monthly payment, which covers principal, interest, taxes, insurance and any HOA dues. A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines. Personal DTI is not the main test. If you want the full picture, Lendmire’s complete DSCR loans guide walks through it.

Here is how the two products compare.

Factor Investment HELOC DSCR loan
Main test Your personal DTI Rent vs. the property’s payment
Effect of support paid Counts as debt Not part of the main test
Structure Second lien (or first) New loan on the property
Title Individual or revocable trust LLC allowed, subject to lender program eligibility
Size Up to $500,000 on investment Up to $3,000,000 on standard programs

Across the network, a DSCR purchase typically lands at 75%-80% LTV, and a cash-out refinance tops out around 75% LTV with about six months of seasoning. Most programs want a score near 660, with a 620 floor in parts of the network and 700+ for the strongest leverage. Coverage of 1.00 is where many select programs start. A separate select-lender path takes coverage below 1.00, with leverage and terms adjusted. Reserves vary by lender and loan size, and are commonly around six months of PITIA (principal, interest, taxes, insurance and association dues).

Two cautions apply. First, a DSCR loan is a replacement loan, so it replaces your first mortgage rather than sitting behind it. Second, clearing 1.00 does not mean the property produces positive cash flow, since repairs, vacancy, management and capital costs sit outside the calculation. Support also does not vanish. Credit, reserves and title still apply, and a recorded support lien would still cloud title.

If Your DTI Is Too High: What to Do

1. Pull your full monthly debt list and total it against gross income.

2. Pay off the smallest recurring debts first, since each one removes its whole payment from DTI.

3. Ask for a smaller line, which shrinks the modeled payment at max draw.

4. Gather the decree or court order and note the end date.

5. Cure any arrears and get any lien released before you apply.

6. Compare a DSCR loan if the property’s rent is strong relative to its payment.

Documents to Gather

  • The divorce decree, separation agreement or support order
  • Proof that payments are current, such as a payment history
  • Income documents for the borrower
  • Statements for your existing mortgages and other debts
  • A title or vesting document showing who holds the property

Key Terms Defined

DTI (debt-to-income ratio): your total monthly debt payments divided by your gross monthly income.

HELOC: a revolving line of credit secured by a property, with a draw period followed by repayment.

Lien: a legal claim on a property that has to be cleared before you can sell or borrow against it.

Arrears: support that was owed but not paid on time.

DSCR: the property’s monthly rent divided by its monthly debt payment.

Next Steps

If you are considering a home equity line and want to see how the numbers work, Lendmire can help you compare HELOC options based on the property, the equity available, credit profile, combined leverage, and your goals. Lendmire is a broker that arranges these loans through select lenders in its wholesale network. Approval depends on lender guidelines, and nothing here is a commitment to lend.

Frequently Asked Questions

Does paying child support stop me from getting a HELOC on a rental?

No. It uses DTI room rather than disqualifying you. A lender adds the payment to your monthly debts, so a file with modest debts and solid income can still fit under the 50% maximum our network applies to investment lines.

Will an undrawn line still count against my DTI?

Yes, in this network. The line is tested on the interest-only payment at the maximum draw, and at least 75% of the line is drawn at closing. Choosing a smaller limit is the cleanest way to protect your ratio.

What if I owe back support?

Cure it first. A recorded lien blocks borrowing against the property until the debt is paid, and arrears can be reported to the credit bureaus. Pay the arrears, get the lien released, and bring proof to the lender.

Can I put the rental in an LLC and still use a HELOC?

Not on these programs. Title must be held by you or a revocable living trust. If the property already sits in an LLC, a DSCR cash-out refinance is the usual alternative.

Does a DSCR loan ignore my child support?

Not entirely. A DSCR loan tests the property’s rent against its payment, so personal DTI is not the main test. Credit, reserves and clean title still matter, and a support lien would still need to be cleared.
