The Quick Read: An investment property HELOC works in a divorce when the line is reviewed on the retiree’s own net pension income, the title sits in the right hands, and the court orders allow new debt. The test is debt-to-income, not rent coverage. The line is a different product from a DSCR loan.
- Investment lines through Lendmire’s wholesale partners cap at 70% CLTV and need a 700 credit score.
- The largest investment line is $500,000, and DTI tops out at 50%.
- The lender counts the pension you keep after any court-ordered split.
- LLCs cannot hold title on this product. A DSCR cash-out is the usual alternative. These specifics are subject to lender guidelines and a full review of property, leverage, and credit.
What Is an Investment Property HELOC, and Why Does Divorce Complicate It?
An investment property HELOC is a revolving line of credit secured by a rental you own. Divorce complicates it because three things must line up: who is on title, who owes on the existing loan, and what income the lender can count.
How large a line the equity supports.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
Lendmire brokers these lines through select wholesale partners. It is never the lender. The line sits in first or second lien position. It runs a 5-year interest-only draw, then a 25-year fully amortizing repayment. Pricing floats the whole way and never converts to fixed.
The line is qualified on you. A DSCR loan is qualified mainly on the property. That one difference drives everything a retiree on pension income needs to plan for.
How Does Underwriting Treat Pension Income? (Step by Step)
Underwriting treats pension income as qualifying income, then tests it against debt. The steps below show what the file looks like from the lender’s side.
1. Income is documented. The lender confirms the pension amount and that it continues. Award letters and bank deposits are the usual evidence, subject to lender guidelines.
2. The split is netted out. If a court order assigns part of each pension payment to the former spouse, the lender should count only what you keep. A lender may ask for the decree or the plan’s order to confirm it.
3. Debt-to-income is run at the full line. The program caps DTI at 50%. The payment is figured as interest-only on the maximum draw, not on what you actually borrow. A modest pension can fail here even with a lot of equity.
4. Credit is pulled. Investment lines need at least 700, which is a hard floor with no tier beneath it. The program uses a single-bureau score, and the report can be no more than 90 days old at closing. Both 700 and 720 reach the same 70% CLTV, so a higher score adds eligibility cushion, not leverage.
5. Value is set. An investment line cannot exceed $500,000, and full appraisals are required only above that amount. An investment HELOC therefore sits in the automated-valuation lane and commonly closes with no traditional appraisal. A borrower can still request a full appraisal.
6. Combined leverage is checked. The existing mortgage plus the new line cannot exceed 70% of value. Divorce often leaves one spouse buying out the other, so the buyout and the old loan both sit inside that number.
Clearing these steps does not guarantee approval. Each file is reviewed individually.
Does Pension Income Count at All?
Yes. Pension income is eligible income, and a lender cannot treat it as weaker simply because it is a pension. Federal credit rules say a creditor may not discount or exclude income because it is an annuity, pension, or other retirement benefit. The lender may still weigh the amount and how long it is likely to continue.
That cuts both ways. Age or retirement alone is not a reason to decline. Debt-to-income, credit, and equity still are.
How Does a Pension Split Change the Number?
A pension split lowers the income the lender can use. A qualified domestic relations order is a court order that tells a retirement plan to pay part of the participant’s benefit to a former spouse. The Department of Labor’s guide to QDROs explains that the former spouse, called the alternate payee, receives a share of each payment the participant receives.
For underwriting, the practical effect is simple. The gross pension on your award letter may not be the figure that counts. Run your own DTI on the net amount before you apply. Also check whether the decree and order address survivor benefits, since that can affect what continues.
Title, Deeds, and the Existing Loan
A decree or quitclaim deed does not remove anyone from the original mortgage. A quitclaim changes who owns the property, not who owes the loan. As one law-firm explainer on quitclaim deeds and mortgages puts it, both spouses stay liable on the note until it is refinanced, assumed with a release, or paid off.
This matters for a HELOC in three ways:
- If both spouses are on title, both generally have to sign for a new line.
- If one spouse is deeded off title, the lender will want the recorded deed and the decree or settlement agreement.
- A new line does not release the ex-spouse from the first mortgage. That takes a refinance or a lender release.
Title also controls product fit. The line must be held by an individual or a revocable living trust. An LLC, corporation, partnership, or land trust cannot hold title. A rental already in an LLC needs a vesting change first, or a different loan.
Where the Timeline Breaks: Before, During, and After the Case
Timing is where divorcing borrowers get stuck. A pending case can carry court orders that limit new debt, and unsettled support or title leaves a lender with nothing firm to underwrite. Your family-law attorney, not the lender, decides what the orders allow.
| Stage | What usually holds the file up | What helps |
|---|---|---|
| Before filing | Joint title, joint signatures | Clear title picture |
| During the case | Court limits on new debt | Written consent or court permission |
| After the decree | Pension split not yet netted | Final decree, recorded deed |
After the decree is the cleanest point for most retirees. Title is settled, the pension number is final, and the buyout amount is known.
What Is the Worked Math, in Ratios?
Think in ratios, not dollars. Say a retiree keeps the rental in the decree and wants to cash out part of the equity to fund a spouse’s share. Three ratios decide it.
- CLTV: the first mortgage plus the new line, divided by value, must stay at or below 70% on an investment property.
- DTI: the interest-only payment on the full line, plus the retiree’s other debts, divided by net pension and other documented income, must stay at or below 50%.
- Credit: 700 or better.
A retiree with a large pension and modest debts can clear DTI with room. A retiree with a modest pension after a QDRO split can have plenty of equity and still miss the 50% mark, because the lender tests the full line, not the draw.
Rent does not enter this test. A rental with thin rent and a strong pension can qualify on a HELOC. A rental with strong rent and a thin pension may not. That is the reverse of a DSCR file.
When Is a HELOC the Wrong Tool?
A HELOC is the wrong tool when the file fails one of its three gates: title, income, or property type.
| Situation | Why the HELOC stalls | Better direction |
|---|---|---|
| Rental held in an LLC | LLCs cannot hold title | Vesting change, or DSCR cash-out |
| Modest pension, high draw | DTI above 50% | Smaller line, or DSCR |
| Needs more than $500,000 | Investment line cap | Cash-out refinance |
| Retiree will live in the home | Not an investment file | Primary-residence HELOC |
| Manufactured or log home | Property not eligible | Different financing |
Several more limits apply to investment lines. Condotels and co-ops are ineligible property types. A borrower is limited to three lines. A borrower with more than 15 financed properties is not eligible. A bankruptcy needs 4 years of seasoning. Foreclosure history is eligible on investment files after 7 years, or 4 years for a deed-in-lieu or short sale.
How Does a DSCR Cash-Out Compare?
A DSCR cash-out refinance qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. Your pension is not the test. DSCR investor loans are available in 40 states plus Washington, D.C. (41 markets), while the HELOC is limited to Lendmire’s 16 full-service states.
Across the wholesale network, cash-out refinances top out around 75% LTV, with about 6 months of seasoning as the common expectation. Credit floors run from 620 in parts of the network to roughly 660 for most programs. Coverage of 1.00 is where select programs start. A separate select-lender path goes below 1.00, with leverage and terms adjusted.
Two cautions apply. Clearing 1.00 is not the same as positive cash flow, because repairs, vacancy, and management sit outside the ratio. And a cash-out is a full refinance, so it replaces the existing mortgage rather than adding a second line. Lendmire’s complete DSCR loans guide covers the structure, and its piece on whether an investment property HELOC makes sense in a divorce as a retiree takes up the decision itself. This article covers the mechanics.
What Does the Investor Decision Look Like in Practice?
For most divorcing retirees, the decision runs in this order.
1. Settle title. Know who is on the deed and the mortgage after the decree.
2. Net the pension. Calculate income after any QDRO split.
3. Test DTI at the full line. Use the maximum draw, not the amount you plan to use.
4. Pick the product. Strong pension and individual title point toward the HELOC. Strong rent or LLC title points toward DSCR.
5. Plan the repayment. The draw period is 5 years interest-only, then 25 years of amortizing payments. Pricing floats throughout. A fixed income has to carry the higher amortizing payment.
A borrowed draw is debt, not income. It does not fix a tight budget.
Key Terms Defined

DSCR: Debt service coverage ratio, meaning rent divided by the full monthly housing payment.
Alternate payee: The former spouse who receives a share of the pension under a QDRO.
Frequently Asked Questions
Can a retiree qualify for an investment property HELOC on pension income alone?
Yes, if the net pension, plus any other documented income, keeps DTI at or below 50% at the full line, and the credit score is 700 or better. Pension income cannot be discounted just because it is a pension. Approval remains subject to lender guidelines and full file review.
Does a divorce decree remove my ex-spouse from the existing mortgage?
No. A decree and a quitclaim deed change who owns the home, not who owes on the note. The original loan stays in both names until it is refinanced, assumed with a release, or paid off. A new HELOC does not change that.
Can I get a HELOC on a rental while the divorce is still pending?
It depends on the court orders in your case and on title. Orders may limit new debt, and a lender cannot count support that no order documents. Ask your family-law attorney what is permitted before you apply.
What if my rental is held in an LLC?
An LLC cannot hold title on this HELOC. The property would need to be re-vested in your name or a revocable living trust, or you could look at a DSCR cash-out instead. Moving title is a separate transfer, so confirm the effect on the existing loan first.
Is the maximum line the same for every property?
No. Investment lines run from $25,000 to $500,000 at 70% CLTV. Larger lines up to $750,000 exist only for primary residences, with a stricter credit requirement and a full appraisal.
