How an Investment Property HELOC Works With a Tenant Mid-Lease

How an Investment Property HELOC Works With a Tenant Mid-Lease

The Quick Read: A tenant under lease does not block an investment property line of credit, and it does not change the tenancy, because the lender underwrites you and your equity rather than the rent, and the lien attaches to your title while the existing lease continues on the same terms. The tenant is background evidence that the property is a working rental. Your credit, debt load, title, and combined leverage decide the outcome.

  • Investment lines on Lendmire’s wholesale network top out at 70% combined loan-to-value (CLTV) and need a 700 credit score, subject to lender guidelines.
  • Line sizes run from $25,000 to $500,000 on an investment property.
  • Title must sit in your own name or a revocable living trust, not an LLC.
  • The lease stays in place, but the payment obligation starts at closing and does not depend on the tenant renewing.
  • Availability is limited to 16 full-service states, narrower than Lendmire’s 41-market DSCR footprint.

What Does a Tenant Mid-Lease Actually Change?

Almost nothing about the loan, and nothing about the lease. A home equity line of credit (HELOC) is a revolving loan secured by a lien on the property. The lien attaches to your ownership. The tenant is not a party to it.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

That means the rent, the lease term, the deposit, and the tenant’s right to stay all continue as written. The tenant does not co-sign, and the tenant does not need your lender’s permission to keep living there.

What the tenant does change is the category. The property is now a non-owner-occupied investment, and lenders treat that as a different risk. NerdWallet explains that rental lines are harder to get than primary-home lines because lenders see higher default risk. A borrower under stress tends to protect the home they live in first.

Say it plainly on the application. Hiding a rental to get better terms is misrepresentation, and the occupancy you declare drives which table the lender uses.

Key Terms Defined

HELOC: a revolving credit line secured by a lien on real estate, with a period when you can draw funds and a later period when you repay.

CLTV (combined loan-to-value): your first mortgage balance plus the new line, divided by the property’s value.

Lien: a recorded legal claim on the property that secures a loan.

Holdover tenant: a tenant who stays after the lease term ends without a new lease.

Rent roll: a list of units, tenants, lease dates, and rents for a rental property.

DSCR loan: an investor loan that qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. Lendmire’s complete DSCR loans guide covers it in full.

How Underwriting Treats the Property, Step by Step

Across the wholesale network, the equity-line path is built around the borrower. Here is the sequence.

1. You declare occupancy. The file is labeled an investment property. That sets the leverage ceiling, the credit floor, and the line cap.

2. The lender checks title. The property must be held by you individually or by a revocable living trust. An LLC cannot hold title on this product.

3. The lender reviews credit. An investment line needs a 700 minimum. The score comes from a single-bureau model keyed to the primary wage earner. The report can be no more than 90 days old at closing, and there are no rescores.

4. The lender reviews debt-to-income (DTI). The maximum is 50%. The lender reviews your file on the interest-only payment calculated on the maximum draw, not on what you plan to borrow. Your existing mortgages, your other loans, and the new line all count against you personally.

5. The lender sets combined leverage. Credit of 700 and credit of 720 both reach 70% CLTV on an investment property. A higher score does not buy more leverage here. It only has to clear the 700 floor.

6. Value is established. Because an investment line caps at $500,000 and full appraisals start only above $500,000, these lines normally run on an automated valuation. A higher CLTV may call for a secondary valuation. You can also ask for a full appraisal.

7. The line closes. The lien records, and the lease keeps running.

Where does the tenant show up? Mostly nowhere. Some lenders ask for a lease or a rent roll as supporting evidence, and requirements vary by program. The rent is not the qualifying income on this product. That is the main difference from a DSCR loan.

The valuation step is the one place the tenant can touch the process. An automated valuation rarely needs anyone to enter the unit. If a full appraisal or secondary valuation is ordered, give the tenant the entry notice your lease requires and coordinate the visit.

How the Line Itself Is Structured

On an investment property, the line runs a 5-year interest-only draw period followed by a 25-year fully amortizing repayment period. There is no shorter-runway option on investment files.

Two features matter when a tenant is in place:

  • At least 75% of the line is drawn at closing. You cannot open a large line and leave it idle. The payment begins on most of the amount from day one.
  • Pricing floats and never converts to fixed. That applies through the draw and the repayment period.

After closing, the minimum subsequent draw is generally $1,000, with a higher minimum in Texas. Lines are limited to three per borrower. A borrower with more than 15 financed properties is not eligible.

The property must be a single-family home, a 2-4 unit building, a PUD, a townhome, or a condominium, including a non-warrantable condo. Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use, and agricultural-zoned properties are not offered.

Availability is limited to 16 states: AL, CA, CO, FL, GA, IN, MI, MT, NM, NC, OH, PA, TN, TX, VA, and WA. Every figure here is subject to lender guidelines and full file review. None of it is a commitment to lend.

Lease Status Table: What Each Situation Means

Tenant situation Effect on the file Practical note
Mid-lease, rent current Neutral to helpful Confirms a working rental
Lease ending soon Little direct effect Payment continues if tenant leaves
Month-to-month Little direct effect Lender cares less about type than paid rent
New lease just signed Neutral Keep a copy ready if asked
Vacant between tenants Same underwriting Rent is not the qualifier

The pattern is consistent. The lease type matters less than your personal numbers. A vacant rental is underwritten the same way as a leased one on this product, because rent is not what the lender is reading.

Where the General Rule Breaks

Several edge cases change the answer.

Title in an LLC. Many investors hold rentals in an LLC for liability reasons. On this product, an LLC cannot hold title. BiggerPockets investors describe LLC title as the main hurdle in getting a rental line. A property already deeded to an LLC needs a vesting change first. The other route is a DSCR cash-out refinance, which can work with LLC-titled properties, subject to lender program eligibility.

Banks that simply do not offer it. Some lenders do not offer rental lines at all. A BiggerPockets Rookie Reply episode describes investors hitting this wall and working around it, sometimes by opening the line while the home was still a primary residence.

Foreclosure. This is the risk scenario, and it is where the lease matters most. A federal law, the Protecting Tenants at Foreclosure Act, protects tenants if a property is sold after foreclosure. The UNC School of Government notes that a buyer must give a bona fide tenant at least 90 days’ notice to vacate. A bona fide tenancy can last to the end of the lease term. Nolo adds that a buyer who intends to live in the home may end the lease on 90 days’ notice. The National Low Income Housing Coalition says the law applies in every state but does not override more protective state rules. For you as the landlord, the takeaway is that a bona fide lease generally carries real protection against a successor, though a buyer who plans to live in the home may end it.

Credit between 600 and 699. The overall program floor is 600, but an investment property floors at 700. Below that, an equity line on a rental is not available through this network.

Past credit events. A bankruptcy needs 4 years of seasoning from discharge or dismissal. Foreclosure history follows a 7-year path, and a deed-in-lieu, pre-foreclosure, or short sale follows a 4-year path.

Exposure limits. A large portfolio can hit the three-line limit or the financed-property cap before the equity runs out.

HELOC or DSCR Cash-Out: Which Fits a Leased Property?

The real decision is whether your existing first mortgage is worth keeping. A line sits behind it. A cash-out refinance replaces it.

Factor Investment HELOC DSCR cash-out refinance
Reviewed on You: credit, DTI, CLTV Rent covering the payment
Title Individual or trust LLC possible, per program
Leverage cap 70% CLTV 75% on a standard rental
Size $25,000 to $500,000 Up to $3,000,000 on standard programs
Credit 700 minimum Often around 660; 620 in parts
First mortgage Stays in place Replaced

On a cash-out, 75% is the ceiling for a standard rental, and 70% applies to short-term-rental collateral. Seasoning of about 6 months is the common expectation. Reserves commonly run around 6 months of PITIA, though they vary by lender, leverage, loan size, and transaction type.

On coverage, 1.00 is where many select programs start. A separate select-lender path takes coverage below 1.00 with leverage and terms adjusted. A ratio above 1.00 does not mean positive cash flow, because repairs, vacancy, management, and capital expenses sit outside the calculation.

What the Decision Looks Like in Practice

Picture an investor who owns a duplex in their own name. One unit has about eight months left on its lease, and the other is month-to-month. The first mortgage is worth keeping. Credit sits above 700, and combined leverage after the new line would land comfortably under 70%.

This investor is a fit for the line. The tenants do not need to be told to do anything. Valuation runs automated, and the lien records.

Now change one fact. The duplex is deeded to an LLC. The line is off the table until the title moves. A DSCR cash-out becomes the better tool, and the investor would also have to decide whether replacing the first mortgage makes sense.

Change a different fact. Credit sits at 680. Same property, same tenants, and the line is unavailable. A cash-out refinance may still work, since many programs want around 660.

Rental-heavy investors face one more squeeze. The line counts against your personal DTI, and the payment is qualified on the maximum draw. An investor with thin income relative to their total debt can run into that wall even with plenty of equity. A DSCR path avoids that test because it focuses on the property’s rent.

What Happens If the Tenant Leaves or Stops Paying

The line does not care. The payment obligation belongs to you, and at least 75% of the line was drawn at closing, so interest is accruing on most of it from the start.

That is the real risk of leaning on a lease. A tenant gives you income, but the line is a floating-price, interest-only obligation during the draw period. Vacancy does not pause it.

Before you open a line, run a stress test on one question: can you carry the payment through a vacancy without the rent? If the answer is only barely, size the draw smaller or keep cash on hand.

Keep your lease paperwork clean regardless. Do not change lease terms, deposits, or rent after closing because of the line. Treat it as a separate matter from the tenancy.

If you use the proceeds for the rental itself, keep records of where the money went.

Frequently Asked Questions

Do I have to tell my tenant I am taking out a HELOC?

The loan does not make the tenant a party, so there is generally no lender requirement to notify them. The lease continues unchanged. If a full appraisal is ordered, you will need to give the tenant the entry notice your lease requires. Check your lease and local landlord rules.

Does a mid-lease tenant help me qualify?

Not much. On this product, qualification rests on your credit, DTI, and combined leverage. A lease may be requested as supporting evidence, but rent is not the qualifying income. A DSCR loan is the product where rent drives the file.

What if the lease ends while the line is open?

Nothing happens to the line. The draw period runs for 5 years on an investment property, and your payment continues whether or not the unit is leased. Renewing, re-tenanting, or going month-to-month is your landlord decision, not a loan event.

Can my LLC take out the line on a leased rental?

No. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title on this product. Title must be in your name or a revocable living trust. A property already in an LLC needs a vesting change or a DSCR cash-out instead.

Does the tenant keep the right to stay if the lender forecloses?

Generally yes for a bona fide tenancy, with at least 90 days’ notice required of a buyer. Federal law sets that floor, and state law can be more protective. This is a general overview, not legal advice for your lease.
